REPORT: Assistant County Attorney Geri Bonzon-Keenan read the foregoing proposed resolution and amendments to the resolution into the record. Commissioner Heyman questioned the rationale for reducing the timeframe from 60 to 30 days considering that “the purchase of goods and services” was added to the proposed resolution. Commissioner Edmonson noted the consultants could complete the disparity study within 30 days; although she preferred 60 days. Commissioner Heyman expressed concern over consultants obtaining the required data from County staff in the reduced timeframe. Commissioner Edmonson said that the data was already available for the consultants to analyze. Commissioner Heyman asked whether gender and ethnicity information was available for companies selling goods and services to the County. Deputy Mayor Edward Marquez indicated that staff would address Commissioner Heyman’s question regarding the available data. He noted the 60-day time frame related to staff negotiations with the consultant as to the specifics of the study and was not to be considered the time necessary to submit final results. Commissioner Edmonson clarified that the staff negotiations would be completed rather quickly. Commissioner Heyman noted she thought the amendments read into the record by Assistant County Attorney Bonzon-Keenan pertained to services rendered and expressed support for the foregoing proposed resolution. Hearing no further questions or comments, the Committee members proceeded to vote on the foregoing proposed resolution, as amended. The foregoing proposed resolution was forwarded to the Board of County Commissioners with the following Committee amendments: - on handwritten page 3, to insert the language “the purchase of goods and services and” between the words “include” and “design” in the fourth line of the resolution’s title; and in the third WHEREAS clause after the word “the”; and in the fourth line of the Now, Therefore clause; and - on handwritten page 4, to replace “sixty (60) days” with “thirty (30) days” in the third line; and to add the language “The Mayor shall report to this Board together with the amendment the fiscal impact of the amendment and shall identify the funding necessary to accomplish such amendment” at the end of the same line. Commissioner Moss asked to be listed as a co-sponsor to the foregoing proposed resolution.

TITLE
RESOLUTION DIRECTING THE EXPANSION OF THE DISPARITY STUDY OF BLACK, HISPANIC, AND WOMEN OWNED BUSINESS PARTICIPATION IN MIAMI-DADE CONTRACTS TO INCLUDE THE PURCHASE OF GOODS AND SERVICES AND DESIGN, ENGINEERING, AND CONSTRUCTION CONTRACTS ISSUED BY OTHER COUNTY DEPARTMENTS

WHEREAS, in May 2012, the Board of County Commissioners adopted Resolution R 397-12 directing the County Mayor to issue a solicitation for a disparity study of Black, Hispanic and Women-owned business enterprises in County contracting; and
WHEREAS, in September 2012, the Board of County Commissioners adopted Resolution R 751-12 authorizing the execution of an agreement with the firm of Mason Tillman Associates, Ltd. in the amount of $450,000.00 to perform that disparity study for contracts issued by the Public Works and Waste Management and Water and Sewer Departments (the “Contract”); and
WHEREAS, this Board wishes to perform a more complete study by expanding the scope of the Contract to include the >>purchase of goods and services and<<1 design, engineering, and construction contracts issued by other County departments,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board directs the County Mayor or County Mayor’s designee to negotiate an amendment to the Contract to include the >>purchase of goods and services and<< design, engineering, and construction contracts issued by the Internal Services Department, Miami-Dade Public Housing and Community Development Department, and the Parks, Recreation and Open Spaces Department. In addition, the County Mayor or County Mayor’s designee shall be and are hereby authorized to recommend any other additional scope of work to the Contract as is in the best interest of the County including the study of other County contracting departments. The County Mayor shall present such amendment for approval by this Board not later than [[sixty (60)]] >>thirty (30)<< days following the effective date of this resolution. >>The Mayor shall report to this Board together with the amendment the fiscal impact of the amendment and identify the funds necessary to accomplish the amendment.<<
