TITLE RESOLUTION RATIFYING THE MAYOR�S EXECUTION OF A FLORIDA INLAND NAVIGATION DISTRICT GRANT AGREEMENT TO PROVIDE $20,000.00 TO MIAMI-DADE COUNTY FOR THE PURPOSE OF REMOVING AND DISPOSING OF ABANDONED AND DERELICT VESSELS LOCATED IN BISCAYNE BAY PURSUANT TO RESOLUTION NO. R-1170-06; AUTHORIZING THE MAYOR OR MAYOR�S DESIGNEE TO EXPEND THESE FUNDS; AND AUTHORIZING THE MAYOR OR MAYOR�S DESIGNEE TO EXECUTE ANY NECESSARY AMENDMENTS TO THE AGREEMENT BODY WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference; and WHEREAS, abandoned and derelict vessels pose significant hazards to the public and to the environment, and negatively impact the aesthetics of coastlines and waterways; and WHEREAS, the Florida Inland Navigation District Grant Agreement No. ICW-DA-13-03 provides $20,000.00 to Miami-Dade County for the removal and disposal of eleven (11) abandoned and derelict vessels located within the Biscayne Bay Aquatic Preserve in the vicinity of Dinner Key Marina in the City of Miami, thereby eliminating these navigational and environmental hazards and improving the physical appearance of the surrounding area; and WHEREAS, Resolution No. R-1170-06 authorizes the Mayor to apply for, accept and execute grants on the County�s behalf without prior County Commission approval when certain terms are met, subject to periodically submitting such grant agreements to this Board for ratification; and WHEREAS, the Florida Inland Navigation District Grant Agreement No. ICW-DA-13-03 met the terms set forth in Resolution No. R-1170-06, was signed by the Mayor and fully executed on January 27, 2014, and is hereby submitted to the Board for ratification, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board ratifies the Mayor�s execution of Florida Inland Navigation District Grant Agreement No. ICW-DA-13-03 to provide $20,000.00 to Miami-Dade County for the purpose of removing and disposing of eleven (11) abandoned and derelict vessels located within the Biscayne Bay Aquatic Preserve in the vicinity of Dinner Key Marina; authorizes the Mayor or Mayor�s designee to expend these funds; and authorizes the Mayor or Mayor�s designee to execute any necessary amendments to the agreement. Gimenez Mayor Subject: Resolution Ratifying the Mayor�s Execution of the Florida Inland Navigation District Grant Agreement No. ICW-DA-13-03 STAFF RECOMMENDATION Recommendation It is recommended that the Board of County Commissioners (Board) approve the attached resolution ratifying the Mayor�s execution of Florida Inland Navigation District Grant Agreement No. ICW-DA-13-03 with the Florida Inland Navigation District to provide Miami-Dade County with $20,000.00 for the removal of eleven (11) derelict vessels from Biscayne Bay in the vicinity of Dinner Key Marina. Scope Under this agreement, derelict vessel removal occurred in Commission District 7(Commissioner Suarez). Fiscal Impact/Funding Source This Florida Inland Navigation District Grant Agreement (Attachment A) will provide $20,000.00 toward the total cost of $41,000.00 to remove eleven (11) derelict vessels from Biscayne Bay in the vicinity of Dinner Key Marina. The remaining $21,000.00 will be paid from the Biscayne Bay Environmental Enhancement Trust Fund, as approved by Resolution No. R-517-11 (Attachment B) for removal of derelict vessels from Biscayne Bay. No additional impacts due to receipt of these funds are anticipated. Track Record/Monitor The Coastal & Wetlands Resources Section Manager, Lisa Spadafina, within the Department of Regulatory and Economic Resources, Division of Environmental Resources Management (DERM), is responsible for implementing these activities. MANAGER'S BACKGROUND Background The Miami-Dade County Derelict Vessel Removal Program, administered through DERM, conducts the removal of abandoned boats and related marine debris from within Biscayne Bay and its tidal tributaries. Removal of these vessels and debris eliminates hazards to public safety, navigation and the environment and enhances the aesthetic quality of the County�s coastlines and waterways. DERM works cooperatively with State and local law enforcement and the US Coast Guard to identify derelict vessels and, when possible, to have them removed by their owners. When a vessel owner cannot be located or fails to remove a vessel in a timely manner, DERM arranges for the vessel�s removal and disposal using contractors selected via a competitive bidding process. This program has been funded through a variety of sources, including federal and state grants and the Biscayne Bay Environmental Enhancement Trust Fund. The Florida Inland Navigation District has previously provided grant funds to Miami-Dade County for the removal and disposal of derelict vessels from navigable waterways. In late 2013, eleven (11) derelict vessels were identified by the City of Miami Police Department Marine Patrol Unit and DERM in the vicinity of Dinner Key Marina. Bids for the removal and disposal of these vessels were requested from five pre-approved vendors and bids ranged from $41,000.00 to $105,400.00. The attached Florida Inland Navigation District Grant Agreement No. ICW-DA-13-03 will provide $20,000.00 toward Miami-Dade County�s contracted costs of $41,000.00 to remove the eleven (11) derelict vessels. Miami-Dade County submitted a grant application for partial funding of the removal of these derelict vessels to the Florida Inland Navigation District on November 13, 2013. All eleven (11) of the derelict vessels were removed and disposed in November and December of 2013. The Florida Inland Navigation District determined that the removal of these derelict vessels was eligible for grant funding and the attached grant agreement was executed on January 27, 2014. Miami-Dade County has invoiced the State for reimbursement of the $20,000.00 from the Florida Inland Navigation District. If the grant had not been awarded, all funding would have come from the Biscayne Bay Environmental Enhancement Trust Fund. Resolution No. R-1170-06 (Attachment C) authorizes the execution of grants and agreements without prior Board approval when certain criteria are met.
