TITLE
RESOLUTION DIRECTING THE MAYOR OR DESIGNEE TO PREPARE A REPORT FOR THE CREATION OF AN OPEN DATA POLICY IN MIAMI-DADE COUNTY THAT INCORPORATES THE SUNLIGHT FOUNDATION�S OPEN DATA GUIDELINES

BODY

WHEREAS, Miami-Dade County government, like all democratic governments, is strengthened by enhanced transparency, accessibility, and civic participation; and
WHEREAS, Miami-Dade County is committed to using technology to foster a more open, transparent, and accessible government; and
WHEREAS, information and data about our County is one of our government�s greatest public assets; and
WHEREAS, open data refers to data (such as documents, databases, records, or transcripts, including those managed by outside vendors) released by a government or organization that is:
(1) freely available to be used, shared, and reused by anyone for any purpose, commercial or otherwise;
(2) available in digital, machine-readable formats so that it can be used in combination with other data and applications; and
(3) available in its entirety and able to be downloaded �in bulk� and not just manually retrieved record-by-record; and
WHEREAS, open data serves a variety of public purposes, including fostering greater civic participation in government, increasing government transparency, accessibility, and accountability, spurring economic development and innovative solutions to civic challenges, and enhancing coordination and efficiency among governmental departments and public, nonprofit, and private organizations; and
WHEREAS, open data can help residents better understand important civic issues in their communities, including spending, economic development, services, energy, transit, infrastructure and crime; and
WHEREAS, open data also allows different governmental departments as well as residents to monitor trends and needs more quickly and effectively, thereby decreasing costs and improving core services; and
WHEREAS, additionally, open data ensures that every aspect of our community has reliable digital descriptions available to citizens and entrepreneurs for deep engagement mediated by smart devices; and
WHEREAS, on January 24, 2012, this Board adopted Resolution No. R-56-12, which directed the Mayor or designee to prepare a plan to increase the transparency of County government by expanding County public records available on the County�s website for review and copying by the public; and
WHEREAS, while Miami-Dade County has made a significant amount of data available through the release of an open data portal (�Open Data Portal�), it lags behind many other large metropolitan counties in terms of the overall availability of data and the frequency at which that data is updated; and
WHEREAS, the County also lacks a centralized data repository for easy access to its data; and
WHEREAS, adopting a formal policy with respect to the rules governing the County�s Open Data Portal (an �Open Data Policy�) would provide needed guidelines on data accessibility and data security; and
WHEREAS, an Open Data Policy would foster innovation by preserving data integrity and ensuring that the County�s Open Data Portal is up-to-date and accurate; and
WHEREAS, an Open Data Policy would also provide assurances about the quality of the County�s data to entrepreneurs wishing to start local tech businesses and to developers seeking to utilize public data to create high-tech applications that improve civic life; and
WHEREAS, an Open Data Policy may also help decrease the number of public records requests submitted to various County departments as more public information becomes readily accessible through the Internet; and
WHEREAS, an Open Data Policy should maintain as paramount priorities the protection of privacy, confidentiality and security, but also advance the County government�s transparency and accountability through open data; and
WHEREAS, the Sunlight Foundation, a national, nonpartisan, nonprofit organization that advocates for open government globally and uses technology to make government more accountable to all, has created a living set of open data guidelines on its website to address what data should be public, how to make data public, and how to implement an Open Data Policy; and
WHEREAS, a copy of the Sunlight Foundation�s open data guidelines is attached hereto and incorporated by reference; and
WHEREAS, this Board supports the creation of an Open Data Policy in Miami-Dade County that incorporates the Sunlight Foundation�s open data guidelines,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board directs the Mayor or designee to prepare a report for the creation of an Open Data Policy in Miami-Dade County that incorporates the Sunlight Foundation�s open data guidelines. The report shall, at a minimum, identify additional datasets that could be published on the County�s Open Data Portal, identify a means for continually updating the data on the County�s Open Data Portal and verifying the accuracy of said data, present a plan for making the identified datasets available to the public, identify robust security measures to protect the data published on the County�s Open Data Portal from cyber-attacks, and identify means to incorporate the Sunlight Foundation�s open data guidelines into the proposed Open Data Policy. The Mayor or designee shall provide the report to this Board within 90 days of the effective date of this resolution and shall place the completed report on an agenda of the Board pursuant to Ordinance No. 14-65.
