REPORT: | It was moved by Commissioner Sosa to adopt the foregoing proposed resolution. This motion was seconded by Commissioner Diaz. Commissioner Levine Cava expressed concern over the use of diesel busses, noting efforts to make the County’s bus fleet more energy efficient. Seeing no staff member present to address Commissioner Levine Cava’s concern, she invoked the 4 Day Rule. Later in the meeting, Mr. Alex Heckler, 801 41st Street, Miami Beach, representing New Flyer, reported that the 15 busses in this item were clean diesel busses. He pointed out that 1 old bus being replaced had more emissions than the 15 new busses. Mr. Heckler advised that the busses were ready to be delivered. Commissioner Jordan asked Deputy Mayor Jack Osterholt to provide her with information on this request, noting she previously sponsored legislation requiring future purchases of diesel vehicles used natural gas as an alternative. | ||||||

TITLE RESOLUTION AUTHORIZING ACCESS OF BROWARD COUNTY CONTRACT NO. L1168501B1 FOR PURCHASE OF 15 DIESEL BUSES FOR THE DEPARTMENT OF TRANSPORTATION AND PUBLIC WORKS IN THE AMOUNT OF $8,139,630.00; AND AUTHORIZING THE COUNTY MAYOR OR COUNTY MAYOR�S DESIGNEE TO EXECUTE DOCUMENTS NECESSARY TO ACCESS SAME AND EXERCISE ALL PROVISIONS OF THE CONTRACT INCLUDING EXTENSIONS AND RENEWALS PURSUANT TO SECTION 2-8.1 OF THE CODE OF MIAMI-DADE COUNTY, FLORIDA AND IMPLEMENTING ORDER 3-38 BODY WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board approves the access of a competitively awarded Broward County Contract No. L1168501B1 in the amount of $8,139,630.00 for purchase of 15 diesel buses for the Department of Transportation and Public Works and authorizes the County Mayor or County Mayor�s designee to execute documents necessary to access the same for and on behalf of Miami-Dade County and exercise all provisions of the contract pursuant to Section 2-8.1 of the Code of Miami-Dade County, Florida and Implementing Order 3-38. A copy of the contract documents are on file with and available upon request from the Internal Services Department, Procurement Management Services Division. Gimenez Mayor Subject: Recommendation for Approval to Access the Broward County Contract, for 40 and 60 Foot Diesel Transit Buses STAFF RECOMMENDATION Recommendation It is recommended that the Board of County Commissioners (Board) approve accessing a competitively established Broward County, Contract No. L1168501B1, for 40 and 60 Foot Transit Buses for the purchase of 15 diesel buses for the Department of Transportation and Public Works. The contract was originally awarded to NABI Bus, LLC, in May 2014 for a one-year period, and subsequently extended to November 12, 2016. On August 31, 2015 NABI Bus, LLC was merged into New Flyer of America, Inc. (New Flyer). On October 26, 2015, Broward County and New Flyer signed a Memorandum of Understanding memorializing this change. The Department of Transportation and Public Works will use these buses for the I-95 Express Bus Service to expand bus routes between Miami-Dade and Broward Counties. Florida Department of Transportation funding will be used to pay for the buses. Although the County issued a solicitation for the conversion of its diesel bus fleet and facilities to compressed natural gas, that project is in the negotiation phase and under the Cone of Silence. While the County remains committed to pursuing energy efficiency options for its vehicle fleet, the Department of Transportation and Public Works is in urgent need of replacing its aging bus fleet and the New Flyer diesel buses to be purchased on this contract are built and ready to be delivered within 90 days. There are no contracts available for hybrid buses that could meet this timeline. Negotiations with the vendor resulted in a per bus price reduction of $4,794, for a total savings of $71,910, with the required specifications and options. This contract will provide the best value for the County. Additionally, by expediting the approval of this item, the County will realize a savings of approximately $250,000 in the form of a credit towards parts. Scope The impact of this item is countywide in nature. Fiscal Impact/Funding Source The fiscal impact for the 15 diesel buses on this contract is $8,139,630. Due Diligence Pursuant to Resolution No. R-187-12, due diligence was conducted in accordance with the Internal Services Department�s Procurement Guidelines to determine contractor responsibility, including verifying corporate status and review of performance or compliance issues. The lists referenced include convicted vendors, debarred vendors, delinquent contractors, suspended vendors, and federal excluded parties. There were no adverse findings relating to contractor responsibility.
