TITLE RESOLUTION DECLARING APPROXIMATELY 2,300 EXPIRED BULLETPROOF VESTS SURPLUS AND AUTHORIZING THEIR DONATION TO THE ASSOCIATION OF CARIBBEAN COMMISSIONERS OF POLICE BODY WHEREAS, approximately 2,300 expired bulletproof vests are owned by Miami-Dade County; and WHEREAS, these bulletproof vests are not in use by Miami-Dade County; and WHEREAS, pursuant to Section 2-11.2.1(d) of the Code of Miami-Dade County, Florida, the Board of County Commissioners may waive the procedure set forth in Section 2-11.2.1(b) of the Code of Miami-Dade County by a two-thirds vote of members present and may donate surplus property to a foreign governmental entity upon a finding that the property is obsolete and cannot legally be used by another County department, a municipality in Miami-Dade County, or an eligible community organization; and WHEREAS, the expired bulletproof vests are obsolete and cannot legally be used by another County department, a municipality in Miami-Dade County, or an eligible community organization; and WHEREAS, the expired bulletproof vests are eligible for donation under Section 274.05 of the Florida Statutes, and Section 2-11.2.1 of the Code of Miami-Dade County; and WHEREAS, the Association of Caribbean Commissioners of Police (the �Donee�) desires to use the expired bulletproof vests for its members� law enforcement officers; and WHEREAS, the Donee is a foreign governmental entity pursuant to Section 2-11.2.1(d) of the Code of Miami-Dade County, and is eligible to receive the expired bulletproof vests pursuant to sections 274.05 and 273.01, Florida Statutes, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that: Section 1. This Board declares approximately 2,300 expired bulletproof vests to be surplus pursuant to Section 274.05 of the Florida statutes, and Section 2-11.2.1 of the Code of Miami-Dade County. Section 2. This Board waives the procedure set forth in Section 2-11.2.1(b) of the Code of Miami-Dade County by a two-thirds vote of members present and hereby donates approximately 2,300 expired bulletproof vests to the Donee. The Donee shall take possession of the equipment within 60 days of the effective date of this resolution and shall be responsible for any and all costs of transferring the equipment. The County Mayor or County Mayor�s designee shall and is hereby directed to take any and all actions necessary to effectuate the intent of this resolution. Section 3. If, for any reason, the Donee fails to take possession of the equipment within 60 days of the effective date of this resolution, then this resolution shall be null and void, and the ownership rights to the expired bulletproof vests shall revert back to the County. Gimenez Mayor SUBJECT: Resolution Declaring Surplus Property Bullet Proof Vests and Authorizing Donation to STAFF RECOMMENDATION Recommendation It is recommended that the Board of County Commissioners (Board) approve the attached resolution authorizing the County Mayor or County Mayor�s Designee to declare as surplus and donate approximately 2,300 bullet proof vests to the Association of Caribbean Commissioners of Police (Association) from the Miami-Dade Police Department (MDPD). Scope The equipment will be used by law enforcement officers from the police agencies of foreign government entities, i.e. various countries in the Caribbean region. Fiscal Impact/Funding Source There is no fiscal impact. Track Record/Monitor The transfer of this surplus equipment will be monitored by Gustavo Knoepffler, MDPD�s Chief Financial Officer. Delegation of Authority The County Mayor or County Mayor�s designee is seeking authority to donate surplus equipment to the Association of Caribbean Commissioners of Police. Background In accordance with best practices for officer safety and the policies of the MDPD, the MDPD encourages sworn police personnel and other departmental employees to wear approved body armor on-duty. Body armor, as with many kinds of specialized equipment, expires after a period of time and officers must replace the vests. Presently, the MDPD has approximately 2,300 expired vests in storage. In disposing of these vests, the Department, in partnership with the Department of State, identified the Association of Caribbean Commissioners of Police, as an organization which would be appropriate for the donation of this equipment. The Association represents 25 countries across the Caribbean region and also partners with many law enforcement agencies regionally and internationally. This equipment will be used by law enforcement officers of the member nations in line with their duties.
