TITLE RESOLUTION URGING THE FLORIDA LEGISLATURE TO ENACT LEGISLATION THAT PROVIDES THAT A SIGNIFICANT PERCENTAGE OF THE REVENUES IN EXCESS OF THE OPERATING COSTS AND DEBT OBLIGATIONS OF THE MIAMI-DADE EXPRESSWAY AUTHORITY SHALL BE TRANSFERRED TO MIAMI-DADE COUNTY FOR TRANSPORTATION INFRASTRUCTURE PROJECTS BODY WHEREAS, in 1990, the Florida Legislature passed the Florida Expressway Authority Act, codified in Chapter 348 of the Florida Statutes, providing that any county may form an expressway authority, which shall be an agency of the State; and WHEREAS, the Miami-Dade Expressway Authority (�MDX�) was created by this Board in 1994 pursuant to state law to serve as an innovative transportation agency dedicated to the enhancement of mobility in Miami-Dade County, and to establish local control and retain within the County the toll revenues generated for infrastructure improvements and maintenance of five expressways within the MDX system; and WHEREAS, MDX has been tasked with re-investing the funds generated from tolls and user fees in order to maintain, operate, and enhance its expressway system; and WHEREAS, additionally, section 348.0004(7), Florida Statutes, authorizes expressway authorities to finance or refinance the planning, design, acquisition, and construction of public transportation facilities, intermodal facilities, or multimodal corridors owned or operated by a county as defined in section 125.011(1), Florida Statutes; and WHEREAS, transportation and mobility issues are of upmost concern for the residents of Miami-Dade County; and WHEREAS, funding the development of transportation infrastructure is critical to improving the chronic traffic congestion in Miami-Dade County; and WHEREAS, this Board wishes to explore all avenues of potential funding mechanisms for transportation infrastructure projects, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board: Section 1. Urges the Florida Legislature to enact legislation that provides that a significant percentage of the revenues in excess of the operating costs and debt obligations of the Miami-Dade Expressway Authority shall be transferred to Miami-Dade County for transportation infrastructure projects. Section 2. Directs the Clerk of the Board to transmit a certified copy of this resolution to the Governor, Senate President, House Speaker, the Chair and Members of the Miami-Dade State Legislative Delegation, and the Chair, Members, and Executive Director of the Miami-Dade Expressway Authority. Section 3. Directs the County�s state lobbyists to advocate for the legislation described in Section 1 above, and authorizes and directs the Office of Intergovernmental Affairs to amend the 2017 State Legislative Package to include this item. |
