Miscellaneous Construction Contracts Program

In order to participate in the Miscellaneous Construction Contracts Program, contractors must be an active registered vendor.

  • Vendors that have not registered under the vendor registration process that became effective in July 2008 will be required to submit a new Vendor Registration Package Adobe Reader prior to receiving a new contract award.

  • Compliance with the insurance requirements is mandatory for participation in the MCC 7040 and MCC 7360 Plans.

The New MCC Program

The Miscellaneous Construction Contracts Program became effective April 16, 2010. Awards after this date will be made under the Miscellaneous Construction Contracts Program 7360 Plan, which replaces the old CICC 7360-0/08 contract, and the Miscellaneous Construction Contracts Program 7040 Plan, which replaces the old CICC 7040-0/07 contract.

The key changes applicable to vendors included in the new MCC Program are:

  • Inclusion of the Community Workforce legislation - Except where federal or state laws or regulations mandate to the contrary, the Community Workforce Program (CWP), as established in relevant legislation, shall apply to all RPQs meeting the CWP eligibility criteria. The CWP, § 2-1701 of the Code of Miami-Dade County, shall apply to all RPQs in which the estimated value is equal or greater than $250,000, with a project duration greater than 30 days and if the project is located in a Designated Target Area (DTA). The CWP goal will be set every quarter by the Review Committee with a minimum of 10% goal for these RPQs.
  • Specifies thresholds for application of Liquidated Damages - For RPQs with estimated values less than $10,000, user departments are encouraged to specify a liquidated damages rate in the RPQ. If no liquidated damages rate is specified on the RPQ, the user department must inform the contractor that the County reserves the right to assess actual damages in lieu of liquidated damages. For RPQs with an estimated value of $10,000 or greater, a liquidated damages rate will be required. User departments must calculate the liquidated damages rate based on a good-faith estimate of potential damages that may be incurred by the department and the department must maintain records of supporting documents used to establish the liquidated damages rates for each RPQ prior to receiving bids.
  • The Notice-To-Proceed (NTP) shall constitute a contract for the work described in the RPQ and must be executed by the contractor and returned to the issuing department. No contractual relationship will exist until the contractor submits an executed NTP, once an RPQ is awarded.
  • Emergency RPQ procedure - When a vendor fails to respond two consecutive times within two hours of being contacted for an emergency, user departments shall notify OCI of the vendor's lack of compliance. Vendors who do not comply may be removed from the emergency vendors' response team list.

Miscellaneous Construction Contracts (MCC) 7040 Plan

The MCC 7040 Plan is set-aside solely for Community Small Business Enterprise (CSBE) firms certified by the Miami-Dade County Department of Small Business Development (SBD).All contractors with a local Miami-Dade County office that meet the CSBE eligibility requirements may participate.

This plan utilizes a blind rotation process Adobe Reader that factors the required building trade, value of the solicitation, number of times vendors have been invited to bid and prior work assigned. All firms must be Community Small Business Enterprise certified and registered under the MCC 7040 Plan before bidding on a solicitation.

Registered firms are contacted when it is time to bid. For more details about the CSBE certification process and related requirements, please contact SBD at 305-375-3111 or visit SBD website. The 7040 Plan replaces the CICC-7040-0/07 contract.

All insurance certificates must be kept current and submitted to Internal Services Department, Risk Management Division at 111. N.W. 1st Street, Suite 2340, Miami, Fl 33128 or faxed to 305-375-1477.

Completing and submitting MCC 7040/7360 Plan Registration Form does not guarantee construction work or execute a contract to perform work with Miami-Dade County. The MCC 7040 Plan participant firms are responsible to comply with the program guidelines. See files of the MCC Ordinance 09-101 Adobe Reader and the MCC Implementing Order 3-53 Adobe Reader approved by the Board of County Commissioners.

The executed Notice To Proceed (NTP) will constitute a contract between the Contractor and the County for the work described in the Request for Price Quotation (RPQ) under the MCC 7040 or MCC 7360 Plan. The County reserves the right to amend the MCC 7040/7360 Plan Registration Form, the program guidelines and the contract terms and conditions at any time. The contract terms and conditions Adobe Reader applicable to the work shall be those in effect at the time of issuance of the RPQ.

Miscellaneous Construction Contracts (MCC) 7360 Plan

Starting on April 16, 2010, all the Miscellaneous Construction Contracts (MCC) awards will be issued under the new MCC Program 7360 Plan that will be replacing the old CICC 7360-0/08 contract.

The MCC 7360 Plan is open-competitive and accessible to all contractors. This plan is utilized when federal funding is involved or when a 100 percent Community Small Business Enterprise goal is not attainable due to unavailability of certified firms in the required trades. Firms can respond to a Request for Price Quotation without being registered under the MCC 7360 Plan. However, firms must be registered prior to a Request for Price Quotation award.

Requirements for Participation

  • Copy of state and/or local Contractor License (General Building, General Contractor, General Engineering or Specialty Trade Contractor).
  • Copy of the certificate(s) of insurance meeting the following minimum requirements: General Liability, Auto Liability, and Workers' Compensation. For more information see Insurance Process.
  • Completed MCC 7040/7360 Plan Registration Form Adobe Reader.
  • Copy of Community Small Business Enterprise certification letter is required for the MCC 7040 Plan
