    What kind of complaints does the IRP review?
    Serious complaints made by citizens against Miami-Dade County government employees and departments.

    What is a serious complaint?
    Information that pertains to substantial and specific damage to public health, safety or welfare, or information alleging gross mismanagement, misconduct or wrongdoing, gross neglect of duty. 
    Examples of serious complaints are:
    • Excessive Use of Force
    • Improper Detainment
    • Racial Profiling
    • Abuse of Authority
    • Department Policy Violation
    • Mismanagement
    • Harassment (multiple occurrences)

    What is expected of me when I file a complaint?
    You are expected to provide as much information as possible regarding the incident or situation that led to your complaint:
    • What happened? A detailed, factual description of the incident (or incidents).
    • Where did it happen? Address or location.
    • When did it happen? Date and time.
    • Who was there? As much identifying information as possible regarding the accused County employees and witnesses.
    • Evidence to support the allegations of wrongdoing, such as witness statements, documents, pictures, records, etc.

    Do I have to give my name when I file a complaint?
    No, the IRP accepts anonymous complaints.

    Does the IRP take complaints against municipal, state or federal employees?
    The IRP may provide civilian oversight to a municipality on a case-by-case basis, when requested to do so by that municipality. The IRP has no jurisdiction over state or federal employees.

    Can the IRP take complaints from County employees against their departments or supervisors?
    The IRP will not duplicate County, departmental or union grievance procedures. The IRP only considers personnel complaints in rare cases of substantial inequity or unfairness.

    Can I complain to the IRP if I'm charged with something I didn't do, such as a traffic ticket or an arrest?
    The IRP does not review legal matters, such as traffic or arrest charges. The IRP will consider complaints of wrongdoing associated with citations or arrests.

    What can the Panel do?
    The Panel provides safe mediated dispute resolution by:
    • Requesting an investigation from the involved department
    • Reviewing complaints and the departmental response
    • Conducting face-to-face mediations employing constructive conflict strategies
    • Holding public hearings to address citizen complaints

    The Panel may also do fact-finding by:

    • Independent Community inquiry
    • Independent studies of grievances

    The Panel can recommend that:

    • Corrective action be taken
    • An employee be disciplined or commended
    • Departmental or County policies and procedures be revised

    Can the Panel impose disciplinary action?
    The ordinance that created the IRP does not provide for the power to impose disciplinary action.

    How long does the IRP process take?
    The time it takes to resolve a serious complaint can take from 2-12 months, depending on the complexity of the complaint and the time it takes for the IRP to receive the investigative report from the involved department.

    Complaints filed against the Miami-Dade Police Department and the Corrections and Rehabilitation Department are formally investigated through the Internal Affairs Section of each department. Historically the time for these investigations has been from two months to two years. Other County departments usually respond to requests for investigations within 45 days.
