According to investigators, the subject, Dale Leary, was a sponsor for students that are part of an international educational exchange program. In 2012, Marta San Jose, the second subject, which was 16 years-old at the time, came to Miami from Spain to reside in Leary’s residence to attend school.  Upon completion of Marta’s 11^th grade, Dale and Marta then flew to Spain to convince her parents extend her stay for an additional year.  When Marta San Jose reached the age of 18, Dale Leary divorced his wife and married Marta San Jose.   The victim and her parents were not aware of Dale and Marta’s marriage.  The parents then sent the victim to Miami to accompany Marta San Jose back home.  After the victim arrived in Miami, she learned that her sister and Dale were married. 

Marta San Jose manipulated her sister into believing that she may have been molested as a child. Marta persuaded her sister to allow Dale to conduct a vaginal examination, claiming that Dale would be able to determine if she had been sexually assaulted.  The victim agreed to the examination and Dale digitally penetrated her vagina.  Marta and Dale engaged in sex in the presence of the victim several times.  They would have her remove her clothing and Dale would digitally penetrate her.  On more than seven different occasions, Dale performed oral sex on Marta, then on the victim, and in return he would make both sisters perform oral sex on him.

The victim stated that Dale was a photographer, and during one of the sessions, both Dale and Marta gave her alcoholic beverages. Once she was intoxicated, they had her remove her clothing and wear high heels.  Dale then began to photograph the victim in different poses, in the presence of her nude sister, who also participated.  In some of the poses, Dale had the sisters hug causing their breast to touch.

Both, Dale Leary and Marta San Jose were placed under arrest and charged accordingly. The victim was reunited with her parents in Spain.

Investigators believe that there may be other victims and are urging anyone that has been in contact with Dale Leary or Marta San Jose to contact Crimestoppers.
