Wage Violations

Pursuant to the Responsible Wages and Benefits Ordinance 90-143

The provisions of Miami-Dade County’s Responsible Wages and Benefits Ordinances (Section 2-11.16 of the code of Miami-Dade County) stipulate that for construction contracts valued greater than $100,000, all laborers and mechanics employed or working upon a project will be paid the full amount of wages and fringe benefits (or Cash Equivalent thereof) computed at rates not less than those contained in the wage determination in effect at the time the work is performed, regardless of any contractual relationship which may be alleged to exist between the contractor and such laborers and mechanics.  Laborers and mechanics shall be paid the appropriate wage rate and fringe benefits on the wage determination for the classification of work actually performed without regard to skill.  In the event of an underpayment of the required wage rates, the contractor shall be liable to the underpaid employee for the amount of such underpayment.  Underpayment by a contractor or subcontractor of the stipulated wages constitutes a wage violation pursuant to Section 2-11.16 of the Code.
