  CITIZEN'S PRESENTATION BY KARINA RON, DIRECTOR FOR FINANCIAL STABILITY AT THE UNITED WAY OF MIAMI-DADE REGARDING FREE TAX PREP SERVICES FOR COUNTY RESIDENTS AND THE EARNED INCOME TAX CREDIT Presented
  REPORT: Ms. Karina Ron, Director for Financial Stability at the United Way of Miami-Dade, gave a PowerPoint presentation about her organization�s tax-free services for Miami-Dade County residents. According to her, these direct services provided skills and resources to residents for filing taxes.

The presentation featured a federal program her organization supported, the Earned Income Tax Credit (EITC). In the presentation, it claimed the program lifted more people out of poverty than other programs. In 2018, Florida residents received an average of $2,533 per household, which Ms. Ron stated amounted to more than 10 percent of County residents� annual income. Meanwhile, the local economic impact was estimated to be at least twice the EITC amount.

Further details in the presentation illustrated how the EITC allowed residents to save money, pay bills, encouraged work and improved children�s health and education. However, Ms. Ron noted that one out of five eligible residents did not claim the EITC in their tax returns, which amounted to about $200 million in unclaimed revenue.

Ms. Ron stated the United Way of Miami-Dade researched why residents had not taken advantage of the EITC. They discovered many residents did not understand the tax process or were intimidated by it and needed more reliable information. The organization partnered with the County and with a coalition of organizations, which offered free tax preparations under the Volunteer Income Tax Assistance (VITA) program.

Ms. Ron also stated new outreach, communication and access tools were developed and used by the United Way of Miami-Dade. She added her organization�s partners had seen significant growth in EITC claims, tax return filings and refunds. As an example, she mentioned how refunds increased from over $11 million in 2018 to over $13 million in 2019.

Ms. Ron asked the Board for support through discretionary funding, volunteer recruitment, and increased outreach materials in order to reach the people who still were not filing tax returns.

Commissioner Higgins announced there would be increased outreach efforts in District 5. She also stated she would make a community-based organization (CBO) allocation to the organization for additional outreach activities.

  REPORT: County Attorney Abigail Price-Williams advised the changes to the preliminary agenda were as follows:

Commissioner Martinez had an amendment read into the record for Agenda Item 8A1 (See Agenda Item 8A1, Legislative File No. 200265).

Commissioner Martinez released his portion of Agenda Item 8J1. Vice Chairwoman Sosa moved the item which was seconded by Chairwoman Edmonson, and upon being put to a vote, the item passed 12-0 (Commissioner Heyman was excused).

County Attorney Abigail Price-Williams advised the items to be considered at today�s (2/19) meeting would be those listed on the printed final agenda with the additions, deferrals, withdrawals and scrivener�s errors noted in the Chairwoman�s memorandum entitled �Changes Sheet� dated February 19, 2020, including the aforementioned requests. The Board will approve all of those items by a single vote setting the agenda except Ordinances for First Reading, Public Hearings, Discussion Item 6B1, Ordinances for Second Reading and the following �Pull List� items:

  REPORT: First Assistant County Attorney Geri Bonzon-Keenan read the title of the foregoing proposed ordinance into the record and advised the Board the proposed ordinance was a public hearing item.

Assistant County Attorney Abbie Schwaderer Raurell then read a proposed amendment by Commissioner Martinez to the proposed ordinance:

�On handwritten page 10, new paragraph (3) (a) would be revised to add the phrase: �it is provided, however, that for any Metrorail segments constructed after February 14, 2020, such additional uses may only be permitted by ordinance of the Board of County Commissioners.� This amendment would require an ordinance by this Board, rather administrative site plan review, to approve additional uses in any Metrorail segments constructed after the effective date of this ordinance.�

Chairwoman Edmonson opened public hearing for the item.

The following persons came before the Board and voiced their support for the ordinance, which related to The Underline, an urban trail beneath the Metrorail guideway from the Brickell Metrorail Station to the Dadeland South Metrorail Station:

Two persons appeared before the Board and declared their opposition to the item because of alcohol sales during events at The Underline:

Vice Chairwoman Sosa clarified a portion of the revenue generated from the businesses at The Underline selling food, alcohol, and other goods would be used for maintenance and protection. She stressed if the item did not pass, it would be difficult to fund maintenance and security.

Commissioner Diaz cited similar developments in other cities like New York and Orlando have been successful. He opined The Underline would enhance the County for local families and tourism, and reaffirmed his support for the ordinance.

Commissioner Moss agreed with Vice Chairwoman Sosa and Commissioners Diaz and Bovo�s assertion that alcohol would not be sold on a daily basis at The Underline but only during special events.

While Commissioner Bovo strongly supported The Underline, he asked for clarification on whether alcohol sales would be sold on a permanent basis at The Underline. Ms. Raurell informed him the ordinance does not limit alcohol sales to special events and she deferred to the zoning director.

Mr. Nathan Kogon, Assistant Director for Development Services at Miami-Dade County Development Services Division, came before the Board and confirmed Ms. Raurell�s statement. The ordinance did allow for permanent locations such as kiosks to sell alcohol even though The Underline�s management agreement only allowed temporary facilities.

Commissioner Bovo expressed his concerns that permanent structures at other County parks could sell alcohol as a result of exemptions found in the item, and about competition between permanent and temporary businesses at The Underline.

Ms. Daly noted there would only be temporary kiosks during events at The Underline which could be used to sell alcohol. She added there were not any plans to sell alcohol on a permanent basis because over 90 percent of programs were family based.

Commissioner Higgins pointed out The Underline�s management agreement banned alcohol sales near single family homes close to area. She mentioned train stations such as New York City�s Grand Central Station which contained permanent businesses, sold food and alcohol and became tourist destinations.

Ms. Raurell declared the ordinance was only specific to The Underline, which was under the Rapid Transit Zone (RTZ), and could not be used by other park and recreational areas. She explained the Federal Transit Administration�s rules prohibited permanent structures in the area; however, movable structures like kiosks or food trucks were allowed in permanent locations.

Ms. Daly reminded the Board the Underline had health and wellness programs which were planned for civic and educational engagements and had concessions specific to the programs. She specified special events permits were needed to sell alcohol, which was governed by The Underline�s management organization.

Mr. Kogon informed the Board the special events permits had clearly defined start and end dates.

Commissioner Jordan announced she would not support the item because it contained a waiver which allowed schools and churches to be closer to the events held at The Underline.

It was moved by Commissioner Higgins that the foregoing ordinance be amended. This motion was seconded by Vice Chairwoman Sosa, and upon being put to a vote, the item passed 10-1 ( Commissioner Jordan voted no, Commissioner Souto was absent and Commissioner Heyman was excused).

The amended version of this Ordinance has been assigned Ordinance No.20-16.

  REPORT: Chairwoman Edmonson opened the floor for a public hearing on the item.

The following persons came before the Board and voiced their opposition to the proposed resolution:

Commissioner Moss explained the legislation which renamed the West Dixie Highway to the Harriet Tubman Highway. He noted Ms. Tubman was the antithesis of slavery and what it stood for, as well as other racist policies and systems in the South. He concluded with a quote by Dr. Martin Luther King, Jr. �The time is always right to do what is right.�, and opined the name Dixie was offensive.

Vice Chairwoman Sosa stressed this item united the Board, which was reflected with the co-prime sponsorships of the resolution by 12 commissioners. She noted the highway renaming would leave a better legacy for future generations.

Commissioner Martinez announced his support for the item even though he noted he received calls from residents who were against the renaming. He recognized the name Dixie was offensive to some residents.

Commissioner Jordan recalled her personal history of when her brother�s school was first desegregated. He refused to perform music in his school�s band because the school celebrated the South�s Confederate past. Eventually, his and other students� actions led to the removal of Confederate remembrances in the school.

Commissioner Diaz questioned the cost of renaming the highway and how it would be paid. Nevertheless, he joined the other commissioners, including Commissioners Levine Cava, Suarez, and Monestime, with supporting the item.

Commissioner Souto spoke about his late Afro-Cuban colleague, Mr. Erneido Andres Oliva, commander of the Brigade 2506 in the U.S. Air Force. He opined Mr. Oliva needed to be recognized for his service and recommended renaming a street or another location in his honor.

Mayor Gimenez admitted if he could he would vote in favor of the item and thanked Commissioner Moss for sponsoring the item.

Commissioner Moss reported he received emails that both supported and opposed the proposed resolution. He thanked the Board for their support and the County Attorney�s Office for assistance with getting the item to the Board.

There being no further comments or questions, the Board proceeded to vote on the foregoing proposed resolution as presented.

  REPORT: County Attorney Abigail Price-Williams read the title of the foregoing proposed ordinance into the record.

Assistant County Attorney Eddie Kirtley read a proposed amendment by Commissioner Bovo to the proposed ordinance:

�On handwritten pages 7 and 8, the language in sections 20-43.2 and 20-45 of the Code providing that whether a conflict of interest exists is determined by formal or informal opinion of the Miami-Dade or Florida Commission on Ethics, whichever has jurisdiction, shall be amended to make clear that such determination applies whether made prospectively by informal or formal opinion or after the fact by probable cause finding in an enforcement action. Those provisions shall also be amended to require that the Miami-Dade Commission on Ethics communicate its findings to the Board of County Commissioners.�

Commissioner Monestime announced he would not support the item. He stated he was in favor of removing members for conflict of interest, but opined this ordinance should have been two separate items. He supported his opposition with his statement that the majority of community council members did not have an issue with quorum.

Chairwoman Edmonson announced her support for the item. She recalled past problems in her and Commissioner Heyman�s districts when projects were constantly delayed because of a lack of quorum. This forced her to appoint people to the community council in order to achieve quorum in past meetings.

It was moved by Commissioner Bovo that the foregoing ordinance be amended. This motion was seconded by Vice Chairwoman Sosa, and upon being put to a vote, the item passed 10-2 (Commissioners Monestime and Levine Cava voted no; Commissioner Heyman was excused).

  REPORT: County Attorney Abigail Price-Williams read the title of the foregoing proposed ordinance into the record.

Assistant County Attorney Dennis Kerbel read a proposed amendment to the proposed ordinance which corrected a scrivener�s error:

�The amendment is to correct a scrivener�s error regarding cross-references to the provisions that are being renumbered in this item as section 33-193.7.1. On handwritten page 9, existing text will be inserted as follows:

�An ordinance that adopts the standards set forth in Section 33-193.7.1 of this article and that protects the rights of legally established nonconforming lots, uses, and structures to at least the same extent provided in section 44-35 of this chapter. Each municipality shall be responsible for collecting and administering any monetary contributions in lieu of construction of WHUs that the municipality receives. The County shall indemnify and defend any municipality from a facial challenge to the municipality�s adoption of an ordinance adopted in accordance with this paragraph.��

  REPORT: Chairwoman Edmonson stated for the record the floor would not be open for comments about the proposed ordinance, which revised zoning regulations in Miami Gardens� stadium district and required approval after public hearing for automotive racing at the Hard Rock Stadium and surrounding areas. The reason was the owners of the Miami Dolphins and Formula 1 racing did not have any comments about the proposed ordinance. Additionally, public hearings had been held in previous meetings, and there were not any public speaker�s cards about the item.

Commissioner Jordan expressed it was unfair the residents of Miami Gardens were not allowed to speak about the item because the stadium owners had chosen not to speak.

Commissioner Jordan presented a video which showcased Miami Gardens� residents rallying against automotive racing in the stadium. After it concluded, she opined the residents were being ignored. She also thanked the commissioners who supported her with this issue, and expressed her disappointment with those commissioners who did not support her. She reminded the Board she lived near the stadium and empathized with her district�s concerns about automotive racing. She added that Mayor Gimenez and the opposing commissioners based their support for automotive racing in her community solely on information provided by the Dolphins� owners.

Reverend Carl Johnson of the Seaboard Church Association appeared before the Board but was not allowed to speak. Commissioner Jordan stated the pastor was against automotive racing in Miami Gardens and praised him for his stance. She voiced her objections about the nature of the negotiations to bring Formula 1 racing to her district and how the Dolphins� owners ignored the residents� wishes.

Commissioner Jordan brought up an agreement between the City of Austin, Texas and the Circuit of the Americas for a race held in the city. The agreement stipulated that races must be held outside the city�s ozone period from April through October. She pointed out the County�s ozone period lasted most of the year because of high temperatures. She reminded the Board her district�s residents endured various events held at the Hard Rock Stadium throughout the years, but she supported the events, even though they created heavy traffic.

Commissioner Jordan recalled in the past, she offered the other commissioners the Formula 1 event and only Commissioner Moss was willing to have it held in his district. According to her, a meeting held which discussed holding the races in Homestead was not attended by the Dolphins� owners, who insisted Homestead was too far away. In her conclusion, she voiced her disappointment with Mayor Gimenez and his actions.

Mayor Gimenez addressed Commissioner Jordan�s concerns and objections. He declared the Dolphins� owners made concessions during meetings held with residents. These included: Formula 1 races would not be held for 10 years and only within the Hard Rock Stadium; the races would take place in the daytime and not during school hours for a three-day period in each May. These concessions, he declared, addressed traffic and noise concerns.

A study sponsored by the Dolphins� owners reported the noise levels generated by auto racing were at 76 decibels, which was less than other events held at the stadium, including the recent Super Bowl and related events. Mayor Gimenez also expressed that the Board�s commission auditor report on air pollution from automotive racing was flawed. He concluded Formula 1 racing was a major international event which benefited the County. These were the reasons why he opposed the proposed ordinance.

Commissioners Monestime and Moss voiced their support for the item. Commissioner Moss extended an offer to the Dolphins� owners for Formula 1 racing to be held in Homestead. He elaborated the infrastructure was in place at Homestead for automotive racing and considered it incredulous the owners were unwilling to consider the city.

Commissioners Suarez and Levine Cava agreed with him about Homestead being a more suitable and welcoming location for automotive racing. Both commissioners also expressed that Miami Gardens� residents had the right to decide on the issue.

Mayor Gimenez confirmed with Vice Chairwoman Sosa the races would only be held once a year during a three-day period for eleven hours total and within the stadium grounds. He also declared the stadium and its events, including Formula 1 racing, were regional assets. The economic impact from Formula 1 racing, he opined, would be similar to a Super Bowl game.

Assistant County Attorney Abbie Schwaderer Raurell answered Commissioner Diaz� question if the item passed. She informed him the proposed ordinance created a new process for a zoning application to the City of Miami Gardens and a public hearing before the City Council. If the application was denied, the applicant could appeal to the Board.

Commissioner Diaz expressed his concerns with the item. He met with Homestead officials, who informed him Homestead�s infrastructure needed to be altered to make it suitable for Formula 1 racing, and it would be expensive. He agreed that moving the event to any other location in the County would be cost prohibitive, and automotive racing benefitted the entire County. This was why he did not support the item.

Commissioner Martinez pointed out the Dolphins� owners were unwilling to pay to move the event to Homestead. He suggested the Miami-Opa-Locka Executive Airport area as an alternative. He also would not support the proposed ordinance because he felt the owners� concessions sufficiently addressed Commissioner Jordan�s concerns.

Mayor Gimenez stated he did not have any concerns if Formula 1 were held in Homestead. However, he reminded the Board it was up to the Dolphins� owners to make the decision.

Chairwoman Edmonson recalled how the residents in her district did not want automotive races held in downtown Miami. She pointed out it took some time before she succeeded and prevented the races from being held.

Commissioner Jordan defended the Board�s commission auditor, who completed a report about Formula 1 racing in September 17, 2019. She objected to how the auditor was chastised by the Mayor and not allowed to respond to his report. She referred to a report from the Dolphins� owners which conveyed that the noise levels from automotive racing would be at 76 decibels. According to her, this differed greatly from the auditor�s report, which had the decibel levels at 145. She opined the Mayor�s poor treatment of the auditor was because the auditor did not report to the Mayor.

Commissioner Jordan discussed the concessions made by the Dolphins owners. In regards to races not being held during school hours, she informed the Board the Miami-Dade County Public School Board passed an item which forbid school closure on Fridays. According to her, the concession of only holding the races within the stadium grounds meant moving the races by only 20 feet. She opined this would not protect the community from noise and air pollution from the races. Finally, she noted the racing events would be longer than the 11 hours over a three-day period as reported by the owners; they would be as long as seven hours for the first two days of the Formula 1 race. The event also included practice and qualifying sessions, and non-Formula 1 races, as well.

Commissioner Jordan declared she spoke to podcasters of an ESPN-affiliated podcast called The Formation Lap on Monday, February 17, 2019. They informed her Formula 1 ideally wished to hold city-centered races; she interpreted this meant downtown Miami. She concluded this issue placed profit over people.

There being no further comments or questions, the Board proceeded to vote on the foregoing proposed ordinance as presented.

After the vote and the item failed, Commissioner Jordan announced a lawsuit against the owners of the Miami Dolphins and Formula 1.

  REPORT: Commissioner Martinez read a proposed amendment to the proposed resolution:

�I move that Agenda Item 8A1 be amended to add the following language to Article 3.10 of the First Amendment to the Development Lease Agreement to acknowledge that the Tenant does not need permission from the Aviation Department to conduct aircraft storage and maintenance on the leased premises. In providing services, the Tenant is required to pay all applicable fees, to report revenues received and to comply with the terms and conditions of the Lease.�

Assistant County Attorney Cynji A. Lee read the language that went into the Lease:

�On handwritten page 13 of the item, Article 3.10 �Provision of Services of Others� the following italicized language shall be added in the last sentence:

  REPORT: Commissioner Jordan inquired about the due diligence regarding the award of a construction contract to TGSV Enterprises, Inc. for the Westchester Cultural Arts Center. She also queried how the vendor performed under previous County contracts.

Mr. Michael Spring, Director of the Cultural Affairs Department, declared the bidding process was competitive and all respondents were carefully evaluated before TGSV was chosen. This choice was based on a thorough investigation of the vendor�s prior performance with other County contracts; references were scrutinized, as well.

Commissioner Jordan pointed out based on a work-performance rating scale, TGSV had a below-average rating. Mr. Spring asserted the performance rating was still acceptable; he acknowledged there were past issues with their performance, but those were resolved satisfactorily.

There being no further comments or questions, the Board proceeded to vote on the foregoing proposed resolution as presented.

  REPORT: Commissioner Jordan questioned why the item was delayed, which was ratified an emergency purchase for the Miami-Dade Police Department. Ms. Namita Uppal, Chief Procurement Officer of the Internal Services Department (ISD), responded that the process required 220 days before an item could be brought before the Board.

Commissioner Jordan informed Ms. Uppal since this item was for an emergency ratification to the Board, the request had to be within 120 days. Ms. Uppal admitted the emergency was declared in September 23, 2019, and ISD was late with the request by 20 to 25 days. However, the original request was for $560,000, but when the work was carried out in January, 2020, ISD learned additional money was needed to complete the work. She concluded this was why the emergency contract and item had to be modified to request $602,000 instead.

  REPORT: Mr. Jorge Fernandez, Office of Management and Budget (OMB) Coordinator, came before the Board at Chairwoman Edmonson�s request regarding the City of North Miami�s application for an annexation of two unincorporated areas. These were located northwest of the West Dixie Highway and along the city�s border by NE 121 Street, NE 1 Avenue, 119 Street and west of the city.

Mr. Fernandez confirmed the application was recommended by the County�s consultant group, PMG Associates in October, 2015, and the application has not changed.

Assistant County Attorney Abbie Schwaderer Raurell advised the Board that Items 8G1 and 8G2 had blank areas at the end of the resolutions in terms of the actions because they were annexation applications. When motions were taken for these items, the motions needed to incorporate the requested actions by the Board.

Mr. Fernandez informed Commissioner Martinez OMB did the expenditures based on estimates per revenue and expenses in the area. Mr. Fernandez added the estimated $75,000 used for expenses in the unincorporated areas were based primarily on police calls.

Commissioner Martinez pointed out the County had ceded land in the past to cities such as Doral and Sweetwater, which he opposed because the County gave up revenue from commercial and industrial areas. He predicted this would occur because the unincorporated areas were largely commercial and industrial zones and the County needed the valuable land for future revenue.

Regarding Item 8G2, Commissioner Martinez acknowledged it was a different situation because the annexation application involved Sunkist Grove, an unincorporated residential area surrounded by North Miami (bounded by NW 135 Street, NW 13 Avenue, NW 131 and NW 16 Avenue). However, he opined taxes for Sunkist Grove residents would increase.

Ms. Raurell explained the resolution was not a final action. Once adopted, item 8G1 needed an ordinance to change the boundaries, which would come to the Board along with a new resolution that approved a new agreement between the County and North Miami.

Ms. Raurell added Item 8G2, once adopted, required a resolution for a ballot for residents in the unincorporated area to vote on annexation.

Vice Chairwoman Sosa reminded the Board of a resolution adopted during the November 19, 2019 Board of County Commissioners Meeting, which called for a report on the potential impact of annexation and incorporations on the Miami-Dade Police Department, the Miami-Dade Fire Rescue and the provisions of both services.

Vice Chairwoman Sosa indicated the non-continuous, unincorporated areas in Item 8G1 were not in enclaves. She added, if annexation was approved, enclaves would be created by the Board in the areas. She also pointed out property owners would each pay an additional $4,456 in taxes annually and would not be able to vote on the matter. She declared she would not support the items until the report was presented before the Board in May, 2020, which would allow her to make informed decisions about the annexations.

Commissioner Diaz expressed the need to quickly move forward on this matter, and the residents affected by Item 8G2 had the right to vote on whether or not their area should be annexed.

Vice Chairwoman Sosa voiced her concerns the annexation process led to one municipality being favored over another because related items reached the Board without going through the proper process, while others that went through the process did not pass in committee meetings. She proposed the annexation process should be equal to all applicants, who must adhere to the process.

After Ms. Raurell confirmed the information she previously provided about both items being annexation requests, Commissioner Jordan mentioned a joint report done by her and Commissioner Diaz about annexation and incorporation. She noted it recommended annexation over incorporation. She also reminded the Board the items followed a process unanimously approved by the Board.

Commissioner Monestime explained the two items were applications that were ten years old and never acted upon. The annexations resolved issues of policing and other services, jurisdictional confusion, and did away with fragmented zones. He added these items were based upon Commissioner Jordan and Diaz�s report which favored annexation.

Ms. Tania Wilson, Planning Director for the City of North Miami, appeared before the Board and explained the annexations removed the fragmented, unincorporated areas within North Miami. She added these areas were enclaves efficiently serviced by North Miami itself whose services were closer than the County�s. She also noted these areas were costing the County money because of the services.

Ms. Wilson stated the applications were based on the PNG analysis, which recommended the annexations, and considered the unincorporated areas to be enclaves.

Commissioner Moss concurred with Commissioner Monestime�s point that North Miami was well maintained and serviced the unincorporated areas better than the County.

Vice Chairwoman Sosa declared North Miami submitted an annexation application in 2013, but the required consent forms from the residents in the areas were never provided in the application. Later on, North Miami submitted these forms from less than 20 percent of the residents. She concluded if these two applications were approved, then all pending applications from other cities must be presented to the Board at the next meeting for approval and forego any reports. Otherwise, the Board should wait until reports are completed, which included the one due in May, 2020, before approving applications.

Deputy Mayor Jennifer Moon informed the Board there were 15 annexation applications. Those in the items 8G1 and 8G2 were the most furthest along in the process. Vice Chairwoman Sosa corrected that some applications had not passed the committees and needed to be brought to the Board to be fair.

In the discussion, Commissioner Diaz stated that based on his and Commissioner Jordan�s study the annexation would affect services such as police and fire and would impose more taxes upon businesses located in the annexed areas.

Commissioner Jordan reminded the Board each commissioner was responsible for bringing annexation items before the Board. She emphasized the current items followed the process as directed.

Chairwoman Edmonson concluded the Board should wait until May for the report before a decision was made. She recommended the Board vote separately on both items and would support Item 8G2, but not 8G1.

Commissioner Monestime informed the Board North Miami�s city council approved the resolutions for annexation with the support of its residents and businesses.

Commissioner Suarez opined there was not a net loss of revenue with the annexations because the revenue generated for the County in the areas was negligible. The annexations saved the County money in services it did not have to provide and allowed North Miami to gain a small increase in tax revenue.

Deputy Mayor Moon reported the annexations would be a net benefit to the County because the cost of services the County provided were more than what the County collected in taxes. However, North Miami�s service costs would be less than what they collected in taxes.

Vice Chairwoman Sosa instructed OMB to present before the Board all annexation applications from all the cities located in the County. She reminded the Board this would increase taxes for residents in the annexed areas.

It was moved by Commissioner Monestime that the foregoing resolution be amended. This motion was seconded byh Vice Chairwoman Sosa, and upon being put to a vote, the item passed 9-2 (Chairwoman Edmonson and Commissioner Martinez voted no; Commissioner Souto was absent and Commissioner Heyman was excused).

  REPORT: Vice Chairwoman Sosa asked Ms. Alice Bravo, Director of the Transportation and Public Works Department (TPW), if the current amount of money to be paid to Limousines of South Florida, Inc. (LSF) was part of their one-year contract renewal with the County when the contract was approved. Ms. Bravo answered the amount was an established hourly rate of $45.09 and the contract was procured by the City of Miami. She explained this rate was not an increase, but a continuation for the company�s services to the County.

Vice Chairwoman Sosa noted that according to the item�s language the rate was an increase and asked Deputy Mayor Jennifer Moon for clarification. Deputy Mayor Moon confirmed the contract extension was for an additional $11.6 million and the County was accessing Miami�s contract with LSF. The amount was not an increase and was already budgeted. She advised if this contract was not accessed then the County would have to pay an additional $12 million to LSF.

Vice Chairwoman Sosa raised a concern with the contract. She read from page two of the item, �This future solicitation may include an option for a vendor to utilized DTPW vehicles to provide service, leveraging investments in vehicles, fuel facilities and maintenance facilities.� She questioned how this affected TPW employees and why this was in the renewal. She pointed out to Deputy Mayor Moon this would allow private employees to use public buses and facilities.

Deputy Mayor Moon explained the option was included because there have been concerns from the public about the vehicles and if they were fully ADA compliant. She added the option would encourage more applications from vendors.

Vice Chairwoman Sosa proposed an amendment to the item. She stated contracts had to come to the Board and for the Board to decide on procurements. Also, as part of the language of any procurement, ADA requirements must be included to ensure ADA compliance. She added the Administration would not decide on contracts; instead contracts would come to the Board for the final decision.

Commissioner Levine Cava stated for the record if the County outsourced the bus routes then the vendors should be held to the same standards as the County-operated routes. She acknowledged LSF had improved its service with added buses, but there were still concerns voiced from elderly and disabled residents. These regarded equipment malfunctions such as faulty lifts, and slow boarding times. She stressed the need for addressing these concerns immediately and properly maintaining buses. She concluded she would not support the item.

Commissioner Suarez asked for clarification on the state of the County�s ADA compliance with its buses. Ms. Bravo assured him the buses were ADA compliant and equipped with chair lifts. She added the contracted buses were targeted for lower volume routes with less traffic since they did not affect traffic as much during lift operations.

Commissioner Suarez asked Ms. Bravo about the performance of some drivers with how they operated the lifts. She answered TPW conducted customer surveys on the contracted routes and received positive feedback. The department tracked complaints about the ADA lifts, sent out supervisors to the contracted routes for service spot checks, and held weekly phone conferences with the vendor and addressed the issues. She also stated there were only 13 ADA lift complaints in 2019 out of about 2.3 million boardings.

Assistant County Attorney Bruce Libhaber told Commissioner Moss the County had the right to add or delete routes under the contract, dependent upon approval from the Board. Commissioner Moss declared his intent to run regular buses on the routes, which serviced his district, in order to address complaints from residents.

Commissioner Higgins brought up concerns that some bus operators were not well trained in using the ADA equipment. She mentioned that residents complained a few buses operated by LSF bypassed disabled vehicles. These vehicles were Miami trolleys, which were not controlled by the County, but both entities used the same vendor. She added an amendment for required ADA training and certification for bus operators in the contract renewal as proof they were properly trained.

Ms. Bravo clarified that complaints had dropped considerably and LSF provided ADA training. She stated TPW would work with LSF to enhance training and the vendor promptly addressed issues with personnel.

Mr. Nick Mazorra, Chief Executive Officer of LSF, came before the Board and agreed to Commissioner Higgins� request to amend the item to include training and certifying LSF�s bus operators.


It was moved by Vice Chairwoman Sosa that the foregoing resolution be amended. This motion was seconded by Commissioner Higgins, and upon being put to a vote, the item passed 8-3 ( Commissioners Monestime, Moss and Levine Cava voted no; Commissioner Bovo was absent and Commissioner Heyman was excused).

  REPORT: In the proposed resolution, Commissioner Jordan observed over $60 million was spent on the continued study of the Strategic Miami Area Rapid Transit (SMART) plan.

Commissioner Martinez opined it was not justified to spend this much money on a study.

Ms. Alice Bravo, Director of the Transportation and Public Works (TPW) Department, clarified the contracts were for general engineering consultations assigned to study the SMART plan and other studies. She added the studies had to be paid for with the budget.

Ms. Bravo referenced a resolution (See the February 5, 2019 Board of County Commissioners Meeting Agenda Item 8N8 Legislative File No. 190041) which was approved in the February 5, 2019 Board of County Commissioners (BCC) meeting. The resolution directed that work orders, specifically studies, related to the SMART plan needed annual reauthorization from the Board. She also advised the Board if the proposed resolution was not approved then all work on the SMART plan would stop on March 6, 2020.

Chairwoman Edmonson recommended a deferral until the next meeting for more information from TPW about the proposed resolution. The Board voted to defer the item until the March 3, 2020 BCC meeting.

  REPORT: Assistant County Attorney Bruce Lebhaber read a proposed amendment by Chairwoman Edmonson to the proposed resolution:

�On handwritten page 3, paragraph 1, the third line is amended to correct the invoiced amount to the County from $1.7 million to $40,571.

�On handwritten page 5, the title is amended to add the language �authorizing the use of charter county transportation surtax funds for this project, which was in the original exhibit one of the people�s transportation plan.�

�On handwritten page 8, paragraph 1 of the contract, the whereas clause is amended to correct the date and maximum compensation amount. Also, on handwritten page 8, paragraph 3, the whereas clause is amended to correct the date.

Vice Chairwoman Sosa stated the item increased payment to the vendor, Kimley-Horn and Associates (KHA), for a traffic signal system, which she opined was outdated.

Ms. Alice Bravo, Director of the Transportation and Public Works Department (TPW), informed Vice Chairwoman Sosa the contract expired on July 2021 and KHA was to support the department�s existing Advanced Traffic Management System (ATM) during a transition to a new signal system. She explained the requested $2,500,000 in the contract provided support for the current system and for the transition process, which included coding, programming and changing signals.

It was moved by Chairwoman Edmonson that the foregoing resolution be amended. This motion was seconded by Commissioner Diaz, and upon being put to a vote, the item passed 9-2 (Commissioner Suarez and Vice Chairwoman Sosa voted no; Commissioner Bovo was absent and Commissioner Heyman was excused).

  REPORT: Commissioner Levine Cava discussed the proposed resolution which implemented community-based ID cards for County residents. She explained the program would be administered by a non-profit organization and the ID cards were used to access services from government institutions, law enforcement, cultural and non-profit services; these included hospitals, credit unions, pharmacies and local businesses.

Commissioner Levine Cava emphasized the cards were not state-issued IDs and could not be used to vote or drive vehicles, and cardholders were not entitled to social welfare benefits. She added cardholders underwent a verification process and the IDs would be re-issued frequently. She also explained the cards benefited seniors, homeless, youth and other vulnerable residents.

Vice Chairwoman Sosa suggested the County should issue the IDs because administrative costs would be higher if the system was administered by a non-profit organization. Also, she opined residents� identities and data would be better protected if the system was administered by the County.

Deputy Mayor Maurice Kemp informed Commissioner Martinez the Miami-Dade Police Department would not accept the cards as official state IDs. Commissioner Martinez expressed the community-based IDs were not needed since official IDs like driver licenses or passports sufficed.

Ms. Janet Lewis, Commander, Police Legal Bureau, Miami-Dade Police Department, told the Board that Alfredo Ramirez III, Director of the Miami-Dade Police Department, indicated to her he did not support the program because residents would misinterpret the ID cards and their validity.

According to Commissioner Levine Cava, Director Ramirez informed her he supported the ID program as a second form of ID and the police department was never barred from any meetings or discussions about the program. She noted the program was not to be administered by the County because it would be subject to public records law. She also said the IDs were never intended to be used as state IDs, but only for accessing County services, which were not fully determined yet.

Deputy Mayor Kemp reinforced Commissioner Levine Cava�s point that the program was still in development. He added once the ID program was completely developed, it would come back to the Board for approval.

Commissioner Levine Cava made the motion to defer the item to no date certain, which was approved by the Board.

  REPORT: Chairwoman Edmonson voiced her support for the pilot program in the proposed resolution which provided rental assistance for two years for low-income seniors. She was concerned over what would happen to the low-income seniors after the program ended. Additionally, she pointed out the source for the rental assistance was unclear.

Commissioner Monestime stated there was an amendment to the proposed resolution.

Commissioner Monestime addressed Chairwoman Edmonson�s concern about what would happen to the low-income seniors after the program ended. He assured her his staff would help them find additional resources.

Assistant County Attorney Shannon D. Summerset-Williams read a proposed amendment by Commissioner Monestime to the proposed resolution:

�The title will be amended to reflect the County Mayor is being directed to identify $240,000 to fund the pilot program.

�All references in the item to 62 years old will be changed to 65 years old.

�On handwritten page 4, the fourth whereas clause will be amended and read as follows:

��Whereas, such a program would be locally controlled, would have the potential for quicker placement of persons who apply for such assistance, would have more flexible policies and rules, less paperwork and fewer barriers for applicants when compared to the federal programs.�� Additional language added, ��would provide seniors with information and guidance on County resources and programs such as Meals on Wheels, Meals for the Elderly, the Home Care Program, Senior Companions, Seniors with Disabilities which they could tap into for additional support.��

�On handwritten page 5, Section 2 paragraph ( c) (i) will be amended and read as follows: �Section 2, the Program will be open to residents who are 65 years of age or older that meet all of the following criteria: (i) have household incomes of $1,500 per month or less;� which was changed from 40 percent median.

�On handwritten page 5, Section 3 will be amended and read as follows:

�The Board directs the County Mayor or the County Mayor�s designee to appoint staff to administer and monitor the program.�� and add the language as follows: ��As part of the administration of the Program, staff shall provide all applicants with information and guidance on available County resources and programs for which the applicant may be eligible, including but not limited to, Meals on Wheels, Meals for the Elderly, the Home Care Program, Senior Companions, Seniors with Disabilities that the applicant may tap into for additional support.��

�On handwritten page 6, Section 5 will be amended and read as follows:

�The Board directs the County Mayor or County Mayor�s designee to identify $240,000 in the fiscal year 2019-2020 County Budget which independently or combined may be utilized to fund the Program proposed by this resolution; provided that the expenditure of any additional funds for the Program will be subject to subsequent approvals of this Board.��

Commissioner Monestime added if the program worked well, additional resources would be found to continue the program.

Vice Chairwoman Sosa stated the Board needed to know where the $240,000 would come from and how the money would be divided among the 13 districts. She also mentioned the potential for misuse of the program by disreputable applicants and landlords. She recommended a Sunshine meeting to investigate the program further. Commissioner Diaz agreed with Sosa�s points and that the money should be divided equally among the districts.

Commissioner Martinez cautioned the pilot program could become an entitlement program, but voiced his support.

Chairwoman Edmonson opined the program should be permanent instead of a pilot program.

Commissioner Monestime reminded the Board the Administration would write the guidelines for the program, which would come to the Board. He added if the money was distributed throughout the districts, it would go to some districts that may not need it as much as others.

Ms. Summerset-Williams added an amendment for the money to be distributed equally among the 13 districts.

First Assistant County Attorney Geri Bonzon-Keenan advised the Board the $240,000 included administrative costs. The leftover balance would be distributed equally among the districts.

It was moved by Commissioner Monestime that the foregoing resolution be amended. This motion was seconded by Chairwoman Edmonson, and upon being put to a vote, the item passed 9-0 (Commissioners Bovo, Jordan and Higgins were absent and Commissioner Heyman was excused).

�On handwritten page 4, the fifth Whereas Clause shall be amended to change $1.4 billion $1.0 billion at the end of the clause to, so it will read:

�Whereas, beyond the cost of the deep injection wells and electrical buildings, the investment costs for the additional infrastructure projects and added treatment for the effluent required in order to comply with the legislation is estimated to be approximately $1.0 billion.��

It was moved by Vice Chairwoman Sosa that the foregoing resolution be amended. This motion was seconded by Commissioner Martinez, and upon being put to a vote, the item passed 12-0 (Commissioner Heyman was excused).

  REPORT: Commissioner Daniella Levine Cava stated that Mayor Gabriel Groisman of Bal Harbour informed her of a perceived anti-Semitic exhibit at the Museum of Art and Design, which was funded with County funds. Commissioner Levine Cava requested a report to investigate this matter.
