  REPORT: A moment of silence was taken followed by the Pledge of Allegiance.

  REPORT: In addition to the members of the Board, the following staff persons were present: Mayor Carlos Gimenez; First Assistant County Geri Bonzon-Keenan; Clerk of the Board Acting Director Melissa Adames; and Deputy Clerks Tawana Parker and Kelly Delille.

Chairwoman Edmonson announced today�s (5/19) virtual meeting was structured to emulate a regular Board of County Commissioners (BCC) meeting therefore all rules of procedure would be adhered to with all public comments and live call comments from attendees queued in at the appropriate time. She stated the two-minute rule was applicable to all formats of public comments and asked her colleagues to use the �raise the hand� icon on the participant tab to indicate they had a question or comment. Chairwoman Edmonson asked her colleagues to remain muted until called upon in the order in which they �raised� their hand. She requested her colleagues verbally announce their departures to keep an accurate count for quorum and also noted only one person should speak at any given time for clarity of the record. Chairwoman Edmonson advised due to the virtual format all votes for public hearing items and ordinances would be done via roll call; to vote wait for the Clerk to call each Commissioner�s name, unmute to vote and mute again. She noted whenever possible the items would be taken in blocks to expedite the time. Chairwoman Edmonson indicated essential County staff would participate as �attendees� in the event questions or clarification was needed on an item and stated in the event a commissioner had a question directed to a department, the commissioner should state the department�s name and allow the department representative an opportunity to speak.

First Assistant County Attorney Geri Bonzon-Keenan announced the items to be considered at today�s (5/19) meeting would be those listed in the printed final agenda with the additions, deferrals, withdrawals, and scrivener�s errors noted in the Board of County Commissioners� Chairwoman Audrey M. Edmonson�s memorandum entitled �Changes for the May 19, 2020 BCC meeting� and include the items previously mentioned. The Board would vote on all these items by a single vote to set the agenda except ordinances on first readings, public hearings, discussion items 6A1 and Supplement and Item 6B1, ordinances on second reading and the following pull list items: 2B4 and Supplement, 8F2, 8F3, 8F9, 8F11, 8L14, 11A1, 11A5, 11A14, 11A16, 11A17, 11A18, 11A20, 12A1, 14A1, 14A2, 14A3, 14B1, 15B2, 15C1 and Supplement.

It was moved by Commissioner Sosa that today�s (05/19) agenda be approved, along with the changes listed in the Chairwoman�s Memorandum entitled �Changes Sheet,� and the additional changes noted by First Assistant County Attorney Geri Bonzon-Keenan. This motion was seconded by Commissioner Levine Cava and, upon being put to a vote, passed by a vote of 13-0.

  REPORT: Mr. Daniel Junior, Director, Miami-Dade Corrections and Rehabilitation Department (MDCR) provided information on the preventive and ongoing measures taken to mitigate the spread of COVID-19 within the Dade County jail facilities and mentioned a written report was also provided to the Board. He advised on April 5, 2020 a number of inmates filed a lawsuit in Federal Court regarding preventive measures at Metro West Detention Center and reported on April 7, 2020, the courts issued a temporary restraining order requiring MDCR to implement efforts that were previously being utilized. Mr. Junior stated as a part of the litigation the court ordered two infectious disease doctors to tour Metro West and the experts found the laundry facilities were available, housing units were available and clean, shower and bathroom facilities were accessible and clean, the availability and adequate stock of cleaning supplies, hand sanitizer, Personal Protection Equipment (PPE) and surgical masks for inmates and staff. He announced the experts recommended the department engage in efforts to decrease the jail population which was currently at a thirty percent (30%) vacancy. Mr. Junior informed the Board on March 12, 2020 approximately 1300 individuals were released either to house arrest or pre-trial release and early sentence release was granted for those previously scheduled for release in 2020. He announced on April 29, a preliminary injunction was issued, and he opined the injunction regurgitated efforts previously communicated by the department to the Courts and the judge ordered the preventive measures be taken for an additional forty-five (45) days. Mr. Junior briefly reviewed the other requirements including weekly reports to the courts and criminal justice partners; and to develop a social distancing plan. He reported on May 5, 2020, Miami-Dade County appealed the injunction which was stayed by the Appeals Court. Mr. Junior indicated the written report issued by the MDCR Department outlined the proactive and ongoing methods put into place to combat the COVID-19 pandemic and highlighted key sections of the report that listed implementation dates and preventive measures taken.

In response to Commissioner Levine Cava�s question, MDCR staff advised there were ten visits to the hospital for inmates who needed additional treatment during the pandemic and two inmates were transferred to the hospital upon release. She also announced there was one death of an inmate who had other co-morbidities. In regard to treatment, staff advised symptomatic inmates received treatment per their symptoms and asymptomatic inmates did not receive treatment unless required. Staff stated the inmates were monitored throughout the day, along with a temperature check and infectious disease screening. Staff advised there was currently 155 inmates in isolation and retesting was not conducted, pursuant to the Center for Disease Control (CDC) guidelines.

Mr. Junior envisioned the new normal for the MDCR department to coincide with the current measures, which included providing masks for incoming inmates and PPE for staff and employees.

Commissioner Heyman and Commissioner Moss acknowledged the work accomplished by Director Junior and his staff to mitigate the spread of COVID-19 within the jail facilities.

  JAY MALINA INTERNATIONAL TRADE CONSORTIUM EXECUTIVE DIRECTOR INTERVIEWS AND SELECTION Presented
  REPORT: The following candidates provided a brief background on their qualifications and specified their various languages spoken; their resumes are attached as a part of the exhibit list:

Mr. Joseph Bell, Mr. Fabricio Lima and Mr. Jonathan Ward.

Commissioner Levine Cava asked Mr. Bell about his knowledge of the Miami-Dade County (MDC) local trade and business sector.

Mr. Bell advised he worked two years in Miami-Dade as an International Trade Development Manager and observed the diversity of businesses in the County. He announced during his time as a participant in the Growing Global Workshops he recognized the need to educate small businesses on the benefits of exporting and expanding their opportunities outside of MDC.

Mr. Bell stated MDC was known as an economic hub and gateway to Latin American, the Caribbean and the Western hemisphere, therefore any opportunity to create diversity and bring various types of jobs would benefit the County long-term.

In response to Commissioner Heyman�s question regarding his pursuit for job growth in MDC, Mr. Ward mentioned his passion for logistics and supply chain, and stated MDC was in a unique position based on location. He opined current trends were accelerated by the COVID-19 crisis and centered on restoring industries to the United States. Mr. Ward mentioned the vulnerable industries within the county but noted MDC could benefit from these trends/changes by recruiting national and foreign companies to bring factories from to MDC. He announced working with the Beacon Council, the Greater Miami Chambers and having assets such as a great climate, geographic location, wonderful healthcare and school system could be used to market MDC as a destination for investments.

Commissioner Sosa inquired about bringing pharmaceutical manufacturing to the United States and Mr. Ward stated moving forward this could be explored as a critical sector.

Chairwoman Edmonson provided voting directions to her colleagues as outlined by the County Attorney�s Office.

In response to Commissioner Levine Cava�s question regarding the urgency of filling this position based on the current environment, Commissioner Sosa replied now was the time to expedite and move forward so residents could benefit from having an International Trade Consortium Director with experience to bring jobs to MDC and have the vision to establish relations in other countries.

The first round of votes consisted as follows:

Due to the tie vote between Mr. Bell and Mr. Ward, a second round of voting was conducted.

The Clerk of the Board Acting Director, Ms. Melissa Adames read into the record the (7-6) vote; and announced Mr. Jonathan Ward was selected as the Jay Malina International Trade Consortium Executive Director.

Ms. Virginia Washington, Recruitment Director, Human Resources Department advised the next step was salary negotiations with Mr. Ward, followed by Board approval.

  DISCUSSION ITEM REGARDING EMERGENCY MANAGEMENT PREPAREDNESS FOR THE 2020 HURRICANE SEASON Presented
  REPORT: Mr. Frank Rollason, Assistant Director, Office of Emergency Management (OEM) provided information on the measures taken in preparation for the 2020 Hurricane season. He mentioned the hurricane guides were being delivered to homes by the United States Postal Service and a COVID-19 insert was also included in the guide. Mr. Rollason mentioned door hangers were provided for residents to use in case assistance was needed following a hurricane along with the use of the drones to quickly identify the most vulnerable citizens. He encouraged everyone to download the �ReadyMDC� mobile App and to sign up for alerts on miamidade.gov to receive up to date storm related information, evacuation orders and evacuation center locations. Mr. Rollason reported eighty-one (81) schools, housing a total of 112,000 people were identified and designated as emergency evacuation centers and stated staff was currently exploring the use of hotels to ensure proper social distancing due to the COVID-19 pandemic as an alternative. He announced additional shelters would also be opened to comply with social distancing requirements and noted the additional shelters would allow up to 40 feet between people; significantly more than the 20 feet requirement. Mr. Rollason stated there were 3,397 people currently on the call down list and indicated additional calls would take place during the first week of June to verify the listed individuals needed to remain on the list. He explained upon arrival of a storm, arrangements would be made to move residents from their homes to hospitals or to the medical evacuation centers. Mr. Rollason recognized the urgency of evacuating residents who live in evacuation zones and spoke about the challenges associated with encouraging residents to leave their homes to go to an evacuation center during the COVID-19 pandemic. He reassured the Board the evacuation centers would be safe and noted procedures were in place to screen and take the temperature of incoming individuals and separate exposed individuals from the general population.

In response to Commissioner Moss� question regarding the use of hotels to house individuals during a potential hurricane, Mayor Carlos Gimenez advised the Center for Disease Control (CDC) recommended the use of hotels in light of COVID-19, but noted many of the hotels in MDC were in evacuation zones. He stated schools would be used for the majority of evacuees, but hotels could be used for the COVID-19 positive individuals. Mayor Gimenez advised the Board members with regards to the reopening of businesses and parents returning to work, a discussion group was reviewing the issue of opening summer camps as well.

Mr. Rollason announced pet friendly shelters would be open and the OEM would work closely with the Animal Services Department (ASD) to locate more segregated areas from the general population.

She noted there were two other groups for future parks and services that would also be pooled. Ms. Uppal stated the parks were being kept together under one contract umbrella to track the expenses and announced this was a common practice routinely performed by the department.

Commissioner Diaz expressed concern about voting on a single legislation item which combined prequalification pools and contractual agreements and recommended separating each component for clarity and transparency.

  REPORT: Chairwoman Edmonson advised she would allow a representative from each company to make a ten-minute presentation and the following persons made a presentation to the Board:

Mr. Miguel De Grandy, representing Horsepower Electric, Inc. (Horsepower) quoted Code 2-8.4(G) which states when the hearing examiner�s findings are presented to the BCC �the matter shall be resolved on the basis of the record before the hearing examiner and no evidence or issue which was not presented or raised at such hearing shall be considered.� He commented Siemen�s representatives engaged in a negative campaign publicly accusing Commissioners of misconduct and of driving this award towards Horsepower, because the Chairwoman�s Policy Council unanimously chose to give credence to a hearing examiner�s determination that the process was flawed. Mr. De Grandy asked the Board to focus on the findings of the hearing examiner and quoted the findings listed on page one of the report which stated �there has been no challenge to the adequacy of the Bid Protest or its satisfaction of the requirements of the Code of Miami-Dade County (MDC) and the County has not challenged Horsepower�s standing to bring the bid protest. No other party has moved to intervene in these proceedings and although representatives were present at the hearing, they did not participate in the proceedings�. He opined their failure to participate was to cause a distraction to their deficient bid. In response to Siemen�s statement that this was an insignificant timing issue, Mr. De Grandy quoted the findings from page 15 of the report stating �Mr. Frank Aria testified there is an economic impact in reducing the review and approval period, while he was unsure of the amount of that impact, but conceded the amount could be �significant�. He noted procurement law stated a proposal which contained a significant or material deficiency rendered the proposal non-responsive. He disputed Siemens� argument that this material deficiency was a part of the process that came up after the negotiations and could be corrected and quoted the findings from page 14 and page 16 of the report. In reference to the price differential, Mr. De Grandy indicated the $86 million was a talking point that had no basis and concluded the hearing examiner based his decision on the law and asked the Board to do the same.

Mr. Miguel Diaz De la Portilla representing Siemens announced the evaluation committee heard from all parties and recommended the award be given to Siemens based on technical scoring and price. He stated Horsepower filed a Bid Protest and pointed out, out of the nine (9) issues raised by the protestor, eight (8) items were rejected and only one item was accepted by the hearing officer. Mr. Diaz De la Portilla reported the only issue found by the hearing examiner was the change in the contract during the negotiation session, the County�s review period from 21 days to 10 days. He then noted the County Attorney�s Office advised the Mayor this was curable and was changed back to the 21-day review period. Mr. Diaz De la Portilla directed the Board to review the Office of the Inspector General�s (OIG) report, (pages 11 and 12) to receive confirmation that Horsepower submitted a shorter review period consisting of 7 and 12 days during their proposal and received points before the technical selection committee due to their shortened schedule, but ultimately lost the bid because their price was deemed to be out of range. He added Siemens won because they offered the best price, superior technology and a faster implementation period. Mr. Diaz De la Portilla declared the Siemens bid was within 4% of the County engineers� estimate for the job and opined Horsepower�s objective was to take advantage of the County; therefore, submitting a bid which exceeded Siemen�s price by $86 million. He reported Horsepower was involved in the pilot project and charged the County $37,133.00 per intersection, but then doubled the price in their RFP. He commented that Horsepower was an installer who bought their technology from a third-party entity and noted Siemens was virtually integrated and manufactured its own hardware and software. In conclusion Mr. Diaz De la Portilla stated the IG report supports the award of this contract to Siemens for the following reasons: best deal for the taxpayers, best effort by the County that produced value and best technology at the best possible price. He urged the Board to review the OIG report and Mayor�s recommendation and make the right decision for MDC.

It was moved by Commissioner Higgins and seconded by Commissioner Levine Cava that the foregoing proposed resolution be amended to award Contract No. RFP- 01058 to Siemens Mobility, Inc., for the purchase of the Advance Traffic Management (ATM) System for the Department of Transportation and Public Works in a total amount not to exceed $160,173,671.00 with a nine-year term consistent with the Mayor�s recommendation filed with the Clerk of the Board on February 19, 2020 and the original version of Agenda Item 3B from the May 7, 2020 Chairwoman�s Policy Council (CPC) meeting.

Assistant County Attorney Oren Rosenthal advised the Board the motion on the floor was legal and the Board was permitted to move forward.

Discussion ensued amongst the Board members regarding the pros and cons of awarding the contract based on the Mayor�s recommendation.

Commissioner Sosa stated she was a proponent of a clear competitive process and commented she could not overlook the findings of the hearing examiner which indicated certain actions taken during this process were arbitrary and capricious.

Mayor Gimenez indicated he did not agree with the comments of the hearing officer and reiterated the points made earlier by Mr. Diaz de la Portilla that the issue found by the hearing examiner to be arbitrary and capricious was corrected. He advised the reduction of the 21-day review period to 10 days, which occurred during negotiations was returned back to the original 21-day review period. Mayor Gimenez proclaimed he clearly supported the Siemens bid that was $86 million cheaper and he strongly urged the Commission to proceed with the original recommendation.

Assistant County Attorney Bruce Libhaber clarified that the hearing examiner found that original contract should not be awarded to Siemens due to disparity in the review time. He explained the change took place during the negotiation stage and subsequent to the ruling from the hearing examiner the Mayor directed the reconvening of the negotiation committee with instructions to eliminate the provision stated by the hearing examiner as beyond the authority of the committee, removed that provision and reinstated the 21 day review time, which was then followed by the Mayor�s recommendation.

Commissioner Suarez argued that all bids should be rejected and the County should use a sealed competitive process bid.

Hearing no further comments or questions, the Board proceeded to vote on the item as amended.

Assistant County Attorney Abbie Schwadererer-Raurell advised the foregoing proposed ordinance would allow the Environmental Resources Management director to issue one combined class 3 and class 4 permit that would last up to ten years. She noted this process did not address blasting vibrations and differed from the States rock mining permitting process.

  REPORT: Chairwoman Edmonson offered a friendly amendment to decrease the Florida law requirement from thirty five percent (35%) to twenty five percent (25%) of affordable housing surtax revenues be used to provide homeownership assistance.

Commissioner Martinez accepted the friendly amendment and stated the intent of the item was to give the Board the option to use the funds for rental assistance or housing ownership.

Commissioner Levine Cava expressed concern with making changes to jeopardize the program. She opined the money should be spent and the Board needed to address the crisis regarding the lack of affordability of homes in Miami-Dade County.

In reference to Commissioner Levine Cava �s statement, Assistant County Attorney Jess McCarty noted risk was always a factor when pursuing state legislation and stated changes could be pursued up to a point where no concern would be raised at the State level.

Mr. Michael Liu, Executive Director, Public Housing and Community Development announced in an effort to facilitate the use of homeownership dollars, the department was reviewing a guaranteed home loan program which works in conjunction with the private sector to issue first mortgages along with other modifications to the program. He also mentioned pursuing a demonstration program with the Regulatory and Economic Resources (RER) Department for the County to build individual lots with multi-family units under the new zoning laws passed by the Board.

Discussion ensued amongst the Board members and the County Attorney�s office regarding the current language of this urging. Several Board members agreed home ownership was not affordable at this time and recommended reducing the current amounts to provide more flexibility for rental assistance.

  REPORT: In response to Commissioner Bovo�s question, Assistant County Attorney David Murray stated the process the Board allowed in 2008 was authorized under a statute that did not require a competitive process but a negotiated process. He noted aspects of the process were similar to a competitive bid process because the Administration was required to advertise, solicit and utilize a committee to rank the firms they would engage in negotiation.

Commissioner Bovo stated he was not convinced the item underwent a competitive process and requested to amend the item to create a ninety-day competitive process.

Commissioner Sosa asked the sponsor to consider making this a Public Private Partnership (P3) and to include meeting rooms and a convention center.

Commissioner Levine Cava stated she supported moving forward with an expedited timeline and suggested limiting the footprint of the hotel to the current site.

The Board members agreed this should be a competitive and expedited process to at least launch the hotel under the current Board.

Mayor Gimenez stated he was not keen on conducting an expedited process in the post COVID-19 era and opined there would be a change and decrease in business travel.

Commissioner Bovo clarified the amendment was to create a ninety-day competitive process, along with a thirty-day review process to provide the Administration the ability to make an award recommendation by November 2020. This amendment would also take into consideration a convention center, meeting room and trade show component.

Commissioner Levine Cava noted she was in support of the item with the understanding that the amendment would also include labor peace.

  REPORT: Mayor Carlos Gimenez announced Miami-Dade County (MDC) planned to have 800-1000 contact tracers as a part the phase one reopening strategy and stated a robust testing program was necessary in nursing homes, Assisted Living Facilities (ALF) and long-term care facilities. He stated his administration would be moving forward with testing, Personal Protection Equipment (PPE), contact tracing and the implementation of a testing program to coincide with the State of Florida, for testing of the workers, providers and residents of those facilities.

Deputy Mayor Jennifer Moon advised the administration was working on a pilot program to conduct contact tracing and would initially hire contract workers, but if needed long term, County employees would be used to back fill those positions. She reported a meeting was held with State officials regarding contact tracing and announced while MDC was currently conducting 17,000 tests per week, the County had the capacity to perform 38,000 tests weekly. Ms. Moon pointed out the State had the ability and resources to conduct 200,000 tests throughout the State for nursing home workers and residents and added that MDC currently had the capability to ensure everyone could be tested. She informed the Board the miamidade.gov website provided information on the locations and requirements to get tested at each location and she also stated an individual could get tested by their private doctors. Ms. Moon advised the case summary dashboard was posted daily and displayed the different indicators such as new positive cases, average of all tests taken, Intensive Care Unit (ICU) and regular hospital capacity and phase one guidelines. She further advised the MDC dashboard was specific to creating measures and criteria for reopening in our community, while the State dashboard provided hot spot information for each municipality and zip code. Regarding necessary isolation provisions, Ms. Moon declared the Administration was updated daily on the vulnerable populations and resources were made available to different facilities to accommodate this population.

Commissioner Martinez expressed concern with Emergency Order 21-20 and suggested adding an amendment for child riders and persons from same households. He also mentioned the hard-cap of ten (10) people placed on barbershops and personal grooming would not provide them an opportunity to operate.

Commissioner Moss commended the Mayor, staff and the Commission for the processes taken to ensure the health and welfare of the community while trying to reopen the economy in MDC.

Commissioner Heyman suggested creating a task force for the personal care and grooming businesses to establish different variables and provide inclusiveness for these unique businesses to survive while following the required guidelines. She also recommended obtaining insight from the users and businesses to implement criteria for valet personnel. Commissioner Heyman requested the parks be reopened for dogs and lastly, suggested revisiting the four (4) people maximum currently in place for fishing boats.

Commissioner Sosa expressed concern about a swift reopening and recommended reviewing the results of testing after the first phase of reopening and take into consideration the life and safety of the residents. She also asked the Mayor to track the number of cases arising from the ALF�s versus the general population.
Mayor Gimenez informed the Board further review would be conducted on the possibility of allowing the gathering of cars for outside concerts and movie watching.

  REPORT: Commissioner Martinez requested to bifurcate the public service award from the economic and emergency solutions aid portion of the item. He expressed concern with the guidelines for distribution of funds to small businesses.

Assistant County Attorney Brenda Kuhns Neuman advised the small business loan component could be bifurcated from the item.

Mr. Michael Liu, Executive Director, Public Housing and Community Development advised the $7.7 million came from the Coronavirus Aid, Relief and Economic Security (CARES) Act fund as a result of COVID-19 to assist families with food and help small businesses in low- and moderate-income districts. He reported to eliminate duplication the funds were targeted to businesses that have not been assisted by other special or local small business programs. Mr. Liu announced the funds would be filtered through two local community development financial institutions: Partners for Self-Employment and Tools for Change.

A motion was made by Commissioner Martinez and seconded by Chairwoman Edmonson to bifurcate the Public Service award from the Economic Development portion of the item and upon being put to a vote, the motion passed unanimously.

Commissioner Monestime suggested providing the grants in a range of amounts applicable to those businesses applying for the small business loans.

Commissioner Martinez reiterated his concerns regarding the economic development portion of the item and opined the Board should have input on the allocation of funds.

Mayor Gimenez noted a report would be provided and reassured the Board the funds would be distributed equally throughout the County.

Mr. Liu advised the money would be split equally between two community development financial institutions and the program would be managed similar to the regular Community Development Block Grant (CDBG) programs. He mentioned in reference to the suggestion made by Commissioner Monestime, the guidelines provided for amounts that were geared towards the needs of small businesses for amounts up to $25,000.00. Mr. Liu added this was a forgivable loan program and reiterated a report would be provided to the Board to ensure the program funds were distributed equitably.

A subsequent motion was made by Commissioner Levine Cava to move the Economic Development portion of the Item. This motion was seconded by Commissioner Higgins and upon being put to a vote, passed by a vote of 12-1, (Commissioner Martinez voted No).

  REPORT: Commissioner Martinez asked staff what was being requested of the Board regarding this proposal.

In response to Commissioner Martinez� question, Ms. Alice Bravo, Director, Department of Transportation and Public Works stated this was a status report regarding the proposal received in response to the Request For Proposal (RFP) issued for the Beach corridor, as requested by the Board.

Mayor Carlos Gimenez announced originally there were four proposers; two dropped off and out of the remaining two, one proposer asked for an extension of time which was denied.

Ms. Bravo advised the proposals were due in March and upon release of the summary report in January, one team requested additional time to review the added information, but she noted no new information was added, therefore their extension was denied.

Commissioner Martinez mentioned the report indicated one team was dissolved prior to the due date and pointed out the report did not mention why the extension was denied.

Ms. Tara Smith, Director, Internal Services Department (ISD) clarified the written report was correct and that particular partnership dissolved before the proposal due date. She stated the request for extension was from the firm who chose not to submit, and the department was notified of their decision after the due date.

Ms. Beth Goldsmith, Chief Procurement Negotiator, ISD, informed the Board the RFP explicitly stated the proposer would be entitled to revenues for food and beverage, naming rights and other advertisement, but the County was entitled to the parking revenues since it was not explicitly stated in the RFP.

Mayor Gimenez explained the Board�s input was being requested to determine whether or not to proceed and/or accept or reject the proposal.

Commissioner Martinez acknowledged the item was pulled to inquire about the revenues the County would receive to help pay for this project and commended Mayor Gimenez for bringing this matter before the Board. He stated he did not have an issue with the item moving forward as an evaluation process but expressed concern if the item returned as a recommendation without Board feedback.

Mayor Gimenez recommended moving forward with the evaluation process and indicated funds may be received from the Federal government.

Commissioner Higgins opined the Board should allow the evaluation process to move forward and moved to accept the Mayor�s report and direct the process proceed to allow a full evaluation of the technical and financial aspects of the proposal the County received in response to the Beach Corridor RFP; and provide said evaluation back to the Board within in 45 days.

In response to Commissioner Sosa�s question, Mayor Gimenez advised the funding source was unknown at this time and noted that was a part of the evaluation process.

Commissioner Sosa expressed concern with the lack of competition for this item.

Discussion ensued amongst the Board members regarding the details of the proposal.

Mayor Gimenez stated the process began with an unsolicited proposal, followed by direction from the Board to complete the RFP process within six months. He apprised the Board on how three of the four groups were eliminated, therefore resulting in the single response before the Board.

Commissioner Diaz indicated additional information was needed prior to the Board making any recommendations, but stated he supported moving forward with an evaluation process.

Assistant County Attorney Eduardo Gonzalez clarified this was a noticed public meeting, consequently the discussion being held was an exception under the cone of silence, therefore staff was allowed to answer questions.

In response to the questions raised by Commissioner Diaz, Ms. Goldsmith told the Board, the technology was a monorail proposal and the proposer included a number of supporting documentation from financial institutions to demonstrate a plan to finance the project. She stated the model of the RFP included the project being fully financed by the proposer with the County making availability payments to the proposer.

Commissioner Moss mentioned the lack of information and stated he could not support the use of all funds to complete the Beach Corridor, which would subsequently leave no funding for the remaining corridors. He stated the unsolicited proposal was appealing due to limited county investment and significant contributions from the private sector partnership. Commissioner Moss announced his support for moving forward with the evaluation process.

Commissioner Levine Cava stated she supported an administrative review to seek federal funding to drive down the cost for the County.

Commissioner Jordan announced she supported moving forward with an evaluation but noted all corridors should be advocated for and treated equitably during the process.

Commissioner Higgins pointed out she agreed with the comments made by Commissioner Moss regarding significant private sector participation in order to continue expansion on other County corridors. She clarified her motion directs the Mayor to use the evaluation process to include negotiations, while determining if the proposal contained a financial path forward that would not penalize the rest of the Strategic Miami Area Rapid Transit (SMART) Plan process. Commissioner Higgins announced she would remove the 45 day time constraint on the requested report in order to provide ample time to ascertain if the proposer would be able to construct a deal that was beneficial for the residents of Miami-Dade County.

Commissioner Martinez commented if the County was required to pay $59.5 million per year for this project, then the other corridors would be penalized due to the lack of available County funding. He opined it depended on the priority of the Board to decide which corridor would receive the initial funding.

Mayor Gimenez reported while the RFP did not allow for any local, state or federal funding to be evaluated, and the $59.5 million consisted of County funding only, the administration would not recommend that type of proposal to the Board.

Discussion ensued amongst the Board members and Administration regarding the parameters of the RFP, wherein Mayor Gimenez advised any funds received would reduce the County�s availability payment to the proposer.

Commissioner Bovo opined the Board should proceed with negotiations and urged his colleagues to decide on a corridor to show residents progress was being made.

Commissioner Sosa expressed concern about the location of the company, as well as the evaluation versus the negotiation process.

Assistant County Attorney Eduardo Gonzalez advised Commissioner Higgins� motion was for a full evaluation and after the evaluation the Mayor could decide to negotiate a contract, but the recommendation to award or not award the contract would be decided by the Board.

Ms. Goldsmith advised a required federal certification exempted the use of vendors located in various countries around the world including China, and reported there were no Chinese components to the proposal.
