REPORT:
In addition to the members of the Board, the following staff persons were present: Mayor Carlos Gimenez; Deputy Mayor Jennifer Moon; County Attorney Abigail Price-Williams, First Assistant County Attorney Geri Bonzon-Keenan, Clerk of the Board Division Director Melissa Adames; and Deputy Clerks Diana Hern�ndez and Nelson Diaz.
It was moved by Commissioner Jordan that today's (08/04) agenda be approved. This motion was seconded by Commissioner Cava and, upon being put to a vote, passed by a vote of 13-0.
SETTING OF THE AGENDA:
The Board, by motion duly made and seconded, carried adopted today's (08/04) agenda as presented.
First Assistant County Attorney Geri Bonzon-Keenan advised this special meeting had been called to consider Special Item No.1, a resolution for special election to be held for the purpose of submitting to the electors of the County the question to establish an Independent Civilian Panel (ICP).
First Assistant County Attorney Geri Bonzon-Keenan indicated, according to the Board's Rules of Procedures regarding Special Meetings, no other business shall be transacted other than matters provided in the notice for items to be considered today, Special Item No.1.
Vice-Chairwoman Sosa inquired about the existence of an ordinance that regulates the amount of questions placed on the ballot.
Assistant County Attorney Oren Rosenthal stated there were three valid items and each would need a two-thirds vote by County Commissioners present in order to be adopted.

In accordance with Rule 6.06 of the Board of County Commissioners' Rules of Procedure, Chairwoman Edmonson opened the reasonable opportunity for the public to be heard and called for members of the public wishing to speak on any non-public items to come forward.

RESOLUTION CALLING A COUNTYWIDE SPECIAL ELECTION IN MIAMI-DADE COUNTY, FLORIDA, TO BE HELD IN CONJUNCTION WITH A GENERAL ELECTION ON TUESDAY, NOVEMBER 3, 2020, FOR THE PURPOSE OF SUBMITTING TO THE ELECTORS OF MIAMI-DADE COUNTY THE QUESTION OF WHETHER TO AMEND THE HOME RULE CHARTER TO ESTABLISH AN INDEPENDENT CIVILIAN PANEL AS SET FORTH BY ORDINANCE

REPORT:
Assistant County Attorney Oren Rosenthal read into the record the foregoing proposed resolution.
Commissioner Jordan stated this resolution was about creating an Independent Civilian Panel, which has been discussed in previous years. She indicated the item first appeared on July 8, 2020, Board of County Commissioner meeting agenda and was adopted; however, it did not sustain the veto and failed. She urged the commissioners who did not vote at that time, to reconsider supporting the item.
Commissioner Jordan quoted Commissioner Bovo's expression � "voters should have a voice"- stated at the July 8, 2020, Commission meeting and noted the subpoena power's value. She also expressed her support for Commissioner Martinez's opinion about the importance of supporting voters.
It was moved by Commissioner Jordan that the Board approve the foregoing proposed resolution, and this motion was seconded by Chairwoman Edmonson for discussion.
In response to Commissioner Sosa's inquiry regarding the removal of the subpoena power, Assistant County Attorney Rosenthal indicated the Home Rule Charter amendment as proposed, would eliminate subpoena power; therefore, the Charter would not be granting the Independent Civilian Panel (ICP) any subpoena authority independent from the Board. He stated the Board could grant subpoena power that would be subject to the creation by an ordinance.
Commissioner Sosa noted this proposed resolution did not disclose the cost to the constituents of how much money would be a need if the ICP was created. She stated she could not support the resolution at this time.
Commissioner Martinez expressed concern regarding raising taxes to implement an Independent Civilian Panel and noted he would not support this resolution.
Discussion ensued among the commissioners regarding the consequences this resolution would have on constituents without knowing the cost to amend the Home Rule Charter to create and establish the ICP as an independent Home Rule Charter entity.
Commissioner Levine Cava pointed out this resolution would be positive for the community by allowing the panel to investigate civilian complaints and make final recommendations about police department policies. She noted that submitting the ballot question outlined in this proposed resolution would give the people the right to vote on this matter. Commissioner Levine Cava concluded her comments by urging the Board's support on this item.
Commissioner Heyman concurred with Commissioner Martinez regarding raising taxes and educating the community about the proposed resolution's intent in terms of cost.
Commissioner Bovo voiced his concern about this resolution's proactivity and stated Miami-Dade Police Department (MDPD) should not be compared to other police departments across the nation since the procedures and policies were different. He also pointed out the issues regarding the movement of radicals in our community on policing. Commissioner Bovo concluded his comments by stating he could not support this item.
Chairwoman Edmonson commended Commissioner Jordan for her courage and efforts by always working to ensure the community's good. She supported this resolution and opined that people had the right to voice their opinion on the issues that were impacting the community.
In response to Commissioner Jordan's comments regarding the two-thirds vote requirement for approval of this item, Assistant County Attorney Oren Rosenthal clarified that while there was a two-thirds vote requirement of the Board members, the Home Rule Amendment and Charter required a majority vote for all Charter amendments. He noted 50 percent plus one vote of the people would approve this and place it on the ballot.
Commissioner Jordan indicated this resolution would only cost less than a million dollars and encouraged commissioners to vote and support the constituents.
Hearing no questions or comments, the Board proceeded to vote on the foregoing proposed resolution, as presented, and the motion failed.
