  REPORT: Chairwoman Edmonson, the Board of County Commissioners meeting recessed at 6:00 p.m. on Tuesday, October 20, 2020, and reconvened on, Thursday, October 22nd, 2020, at 9:30 a.m.

Commissioners Jordan and Monestime voted in favor of agenda item 8H1 regarding Miami Wilds Project at Zoo Miami. A vote of 10-1 was initially taken at the Board of County Commission meeting held on (10/20). Commissioners Jordan and Monestime voted at today 10/22 BCC carryover in favor of the foregoing proposed resolution 12.-1.

First Assistant County Attorney Geri-Bonze-Keenan indicated that Commissioner Monestime asked to be listed as co-sponsor for Agenda Item 11A5 and that he be removed as co-sponsor of Agenda Item 11A8.

  DISCUSSION ITEM REGARDING THE MIAMI HERALD SERIES ON THE STATUS OF THE BLACK COMMUNITY IN MIAMI-DADE Presented
  REPORT: Commissioner Moss referred to the Miami Herald series entitled �The Status of the Black Community in Miami-Dade. He invited Mr. Stephen Hunter Johnson, Chair of Black Affairs Advisory Board to make a presentation before the Commission.

Mr. Johnson presented a video clip of �The Black Miami Documentary� and a PowerPoint presentation of a Miami Herald Article Series, �A History of Broken Promises Miami Remains Separate and Unequal for Black Residents. He highlighted the disparities and impact that African Americans encountered in Miami-Dade County, as follows:

� Miami-Dade County Black Population separate and unequal
� Blacks disparities widened in Miami-Dade County
� Hispanic Factor
� Housing
� Homeownership
� Redlining
� Education
� Employment Opportunities
� Lack of access to qualities schools
� Access to Capital for Black Businesses

Commissioner Moss believed although this was a hard topic of discussion to tackle, but there needs to be a dialogue in the Commission.

Commissioner Sosa thanked Commissioner Moss for bring this topic of discussion about the disparities of the African American community. She noted implementing trade studies in technical schools could be one way the African American Community could prosper. Commissioner Sosa stated she supported any effort to assist the African American Community of being self-sufficient and working towards a better path of living.

Commissioner Moss invited Mr. John Dixon, Director of Miami-Dade Economic Advisory Trust (MDEAT), to speak on the African American PowerPoint and video clip presentation.

Mr. Dixon indicated Miami-Dade County African American community remained unequal and separate. He noted the African American community poverty level was at 18 percent and would get worse because of the Coronavirus Disease 2019 (COVID19). Mr. Dixon indicated MDEAT was working with the residents of Miami-Dade County, but would like to work with the policymakers to make a difference within the African American Community. He noted he wanted to bring to the attention to the policymakers, the issues regarding procurement for Black firms, school board, and housing, as a great need to the African American community.

Commissioner Levine Cava echoed Commissioner Moss and Mr. Dixon sentiments about the African American Communities. She noted as policymakers the Commission should not allow the economic downturn during the pandemic to move the African American Community backward. She noted the Commission must assist in moving these efforts going forward. Commissioner Levine Cava thanked Commissioner Moss, Jordan, Mr. Hunter, and Mr. Dixon for educating the Commission.

Commissioner Jordan thanked Commissioner Moss and the three organizations for bringing the awareness of what existed back then, currently exists today. She noted race was a difficult topic for people to address. Commissioner Jordan stated the schools in Miami-Dade were segregated noting the disparities that exist in African Americans schools was because they could not afford to live in certain neighborhoods. Commissioner Jordan challenged the two candidates running for Miami-Dade County Mayor to acknowledge that systemic racism exist in Miami-Dade County, and come up with a plan on how it would be address.

Commissioner Diaz thanked Commissioner Moss for bringing this discussion to the Commission. He referenced as he was growing up in Miami-Dade County, he experienced racism. He noted that he understood and looked forward to further speaking on this discussion.

Commissioner Monestime thanked Commissioner Moss and Mr. Johnson for bringing forth this discussion. He noted all the African American community wanted was to be given the window of opportunity. Commissioner Monestime indicated if given that opportunity the African American community would be greater leaders within their paths, and by not providing that opportunity there was a greater lost to Miami-Dade County. Commissioner Monestime stated the Commission had presented many legislation to combat these disparities and still the legislations were not implemented. He urged the Commission to be proactive and suggested the Commission create policy that would assist the African American Communities in Miami-Dade County.

Chairwoman Edmonson indicated she hoped that this topic would continue on and asked Commissioner Monestime to continue the dialogue. She thanked Commissioner Moss and Messrs. Johnson Mr. Dixon.

  REPORT: Commissioner Levine Cava introduced an amendment to the foregoing proposed resolution and asked that the county attorney read the amendment into the record.

Assistant County Attorney Melanie J. Spencer read the following amendment to the foregoing proposed item, as offered by Commissioner Levine Cava:

Section 1 to reflect that the County Mayor or Mayor�s designee shall also consider adding a possible facility for use by Miami-Dade Fire Rescue on no more than 2 acres of the County-owned property. The title of the item and an additional whereas clause shall be added to conform to the amended Section 1.

  REPORT: Commissioner Monestime asked that the Commission support the foregoing proposed resolution. He noted the inflation of housing cost was impacting families in Miami-Dade County and indicated the community was urging the government to do more for rent control. Commissioner Monestime noted although the Commission did not have authority over control rent, the conversation could be sparked at the State Legislative level. He stated it was important to the Community that dialogue was presented about rent control.

Commissioner Sosa indicated while she believed it was the government�s job to support building low income and affordable housing, she did not believe it was the government�s duty to implement rent control. She noted government would be overstepping its boundaries if rent control was implemented in the private industry. Commissioner Sosa indicated she was not in favor of the foregoing proposed resolution.

Commissioner Martinez indicated he was not in favor of this foregoing proposed resolution stating the proposal governmental overreach into the private sector. He stressed that he did not want the Florida Legislature to believe the Commission was in support of the idea of rent control.

Commissioner Diaz concurred with Commissioners Sosa and Martinez; noting he would not support the foregoing proposed resolution.

Commissioner Souto pointed out that as a State of free enterprise, the foregoing proposed resolution would not move forward in State Florida Legislature. He indicated he would not support the foregoing proposed resolution.

Commissioner Heyman referenced the Florida Statue where the state law currently prohibit local governments from adopting rent restrictions, accept under narrow conditions. She noted the Commission had not engaged in rent control, but the Commission had developed legislation for affordable housing. Commissioner Heyman indicated she was not in favor of the Commission setting rental rates , and for that reason, would not vote in favor of the proposed resolution.

Commissioner Monestime referenced the Urban Institute reported more than 30 million Americans could encounter eviction. He noted keeping people in their homes should be one of the Commission�s top priorities. Commissioner Monestime indicated government intervene in the financial market all the time, noting that just having dialogue on rent control was a start to assist the Community.

  REPORT: Commissioner Moss opposed the recommendation and revision of the Better Bus Project services. Commissioner Moss was not in favor of route 35 and 35A, because it would no longer go to the Community Health of South Florida Inc. (CHI), and passengers for 35A would wait up to 30 minutes longer.

Assistant County Attorney Bruce Libhaber advised that a motion to accept the report could be taken, and request a directive to the administration to reconsider the implementation or reconfiguration of those three itemized routes as recommended by Commissioner Moss. .

Assistant County Attorney Libhaber advised a directive in preparing the agenda would have to be a public hearing item to implement these route changes and adjustments. Therefore, he noted a directive could be presented to state the following: �to the mayor or mayor designee in preparing potential route adjustments to not include those three routes or the adjustment contemplates to those three routes in any future agenda�.

First Assistant County Attorney Geri-Bonze-Keenan advised to accept the recommendations to direct the mayor to take action with exception of the routes mentioned by Commissioner Moss.

Responding to Commissioner Levine Cava�s question regarding the impact on 35A cross over route between district 8 and 9, along route 104th Avenue and 248, Ms. Alice N. Bravo. Director, Transportation and Public Works explained the Better Bus plan was prepared to balance the reallocation of resources. She noted the actions of leaving out the routes would be revised to keep the balance and bring back to the Commission for approval.

With regards to Commissioner Levine Cava�s inquiry as to whether the major service route changes suggested by Commissioner Moss would come back before the board, Assistant County Attorney Libhaber indicated if routes were being added, deleted, or adjusted at 25 percent by mileage, then it would come before the board, however if the routes were being added, deleted, or adjusted at less than 25 percent, then it could be done administratively without board action.

Commissioner Levine Cava suggested the amendment be revised to specify that the routes in question would come before the board.

Commissioner Jordan raised concerns that the Downtown and Miami Beach routes had shorter wait time than in the African American neighborhoods. She stressed the outline area would be suffering more than the suburb and stated for that reason she would not be supporting the foregoing proposed resolution.

Discussion ensued amongst Commissioner Moss and Ms. Bravo regarding how the improvement needed to be balance to service all neighborhoods and not selected neighborhoods; and Ms. Bravo also stated a ridership program was being implemented to assist with the improvement.

  REPORT: Commissioner Moss indicated the resolution allowed a six month extension on the contract agreement.

Commissioner Diaz wanted to ensure that the contractors were aware of the panels not interfering with the entrance of the 735 aircrafts. He asked that it be communicated to the contractors so that the project could proceed as planned.

Commissioner Moss reiterated his pervious statement that the foregoing proposed resolution only extends the time the group would have to continue to garner their finances to move forward with the project. He stressed that nothing of the foregoing proposed resolution had changed.

  REPORT: It was moved by Commissioner Sosa that the Board adopt the foregoing proposed resolution as amended. Page 331 first line item on exhibit 2 with the Activity title, �Provide public services for COVID-19 Response Countywide, amended to specify that $95,234.00 of the total of $546,939.00 of this line item be allocated to the following agencies as 2020 District 9 Commission District Funds Allocations. This motion was seconded by Commissioner Heyman, and upon being put to a vote, passed by a vote of 11-0 (Commissioners Bovo and Suarez were absent).

The amended version was assigned Resolution No. R-1118-20.

Pursuant to Commissioner Levine Cava�s question regarding the implications should the proposal of this item not be adopted at this time; Mr. Michael Lui, Director of Public Housing and Community Development, indicated there would be no access to the Community Development Block Grant (CDBG) funds, Commissioner Levine Cava expressed concerns about the redirection of eliminating the Neighborhood Revitalization Strategy Areas (NRSA) and asked Mr. Lui to further expound on it.

Mr. Lui explained the administration was taking a data driven analysis of the areas in need. He noted the administration was working with Mr. Manuel Armada, Chief of Regulatory and Economic Resources (RER), to conduct data to map out ethnicity, income, access to amenities etc.

Mr. Clarence Brown, Director for Community Development for the Public Housing and Community Development (PHCD) Department stated the primary goal in the planning was to align issues, such as the housing crisis, climate change, sea level rise, and selling septic systems to help families connect to a sewer system. Also, he noted the funds would remain for low income neighborhoods and individuals.

Commissioner Sosa asked to bifurcate the foregoing proposed resolution because the language in the resolution would take away the Commissioners� authority to allocate distributing funds within their districts.

Assistant County Attorney Brenda Kuhns Neuman explained the proposed resolution could be amended to address section 9 through bifurcation or removal of the language.

Discussion ensued amongst Commissioners Sosa, Martinez, and Mr. Lui regarding the amendment to section 9 of the foregoing proposed resolution.

Assistant County Attorney Neuman read the foregoing proposed resolution as follows: Page 331 first line item on exhibit 2 with the Activity title, �Provide public services for Covid-19 Response Countywide, amended to specify that $95,234.00 of the total of $546,939.00 of this line item be allocated to the following agencies as 2020 District 9 Commission District Funds Allocations.

Mr. Lui confirmed that section 8, which was section 9 in the memorandum had to be removed/deleted. He noted section 11 state that any agreement presented would come back to the Board of County Commission (BCC) for approval.

With regards to Commissioner Souto�s inquiry about the intent of removing the authority of the Commission; Assistant County Attorney Neuman stated section 9 was a recommendation to delegate part of the authority to the administration. She noted under certain conditions the district funds would be recaptured and reallocated by the administration without coming before the board.

Commissioner Sosa asked that the foregoing proposed resolution be amended to remove the language delegation, eliminate/delete sections 8, 9, 11, and 12, and provide a yearly report to the Commission, as well as all approvals to come before the BCC.

There being no further comments or questions, the Board proceeded to vote on the foregoing proposed ordinance as presented.

  REPORT: Commissioner Martinez voiced his concerns about the distribution of funds allocated for this project; noting districts 2 and 11 did not receive funding out of the $25 million project. He emphasized although he supported the project, the distribution was not fairly allocated to all Miami-Dade County residents.

Commissioner Sosa indicated the funding was only allocated to districts 6 and 10, because district 10 had allocated funds for their district, while it was her turn to allocate funds to her district.

Commissioner Martinez clarified that districts 4, 5, 8, 9, 12, 13, 3, 1, 7, 6, and 10 received the $25 million general distribution of funds, while 2 districts did not receive any funding.

There being no further comments or questions, the Board proceeded to vote on the foregoing proposed resolution as presented.
