  REPORT: Chairwoman Edmonson convened the Board of County Commissioners Special Meeting at 10:05 a.m. followed by a moment of silence and the Pledge of Allegiance.  
1B ROLL CALL  
  REPORT: Prior to the roll call, Clerk of the Board Director, Melissa Adames, announced Commissioners Souto and Suarez had submitted written notices of their absence from today�s (11/13) Board of County Commissioners (BCC) Special Meeting.

The following Board members were present at roll call: Commissioners Diaz, Moss, Levine Cava, Monestime, Heyman, Martinez, Vice Chairwoman Sosa and Chairwoman Edmonson.

In addition to the members of the Board, the following staff members were also present:

- Deputy Mayors Jennifer Moon and Edward Marquez;

- First Assistant County Attorney Geri Bonzon Keenan and Assistant County Attorneys Bruce Libhaber, Christopher Kokoruda and Lauren Morse;

- Clerk of the Board Director Melissa Adames and Deputy Clerk Kerry Khunjar Breakenridge.
 
1C PLEDGE OF ALLEGIANCE  
1D REASONABLE OPPORTUNITY FOR THE PUBLIC TO BE HEARD AS PROVIDED IN RULE 6.06  
  REPORT: Chairwoman Edmonson opened the floor for a reasonable opportunity to speak and the following persons appeared:

1. Mr. David Burney, Chairman of North Miami Chamber of Commerce (NMCOC), 13100 W. Dixie Highway, North Miami FL 33161, appeared in support of Special Item No. 7. He noted in addition to the NMCOC, the community (residents and businesses) were in favor of the expansion of the Northeast Corridor and the construction of a train station at 123rd/125th Street.

2. Ms. Maite Alvarez, Associate Vice President of Local Government Relations for the University of Miami (UM), 6200 San Amaro Drive, Miami FL, appeared on behalf of UM in support of Special Item No. 7.

3. Mr. Patrick Goddard, President of Brightline Trains, 161 NW 6th Avenue, Miami FL 33136, spoke in support of Special Item No. 7 and the expansion of the Northeast Corridor for commuter rail service.

4. Mr. Paul Lambert, 100 Biscayne Boulevard, Miami FL 33132, appeared on behalf of Miami Wilds, LLC., in support of Special Item No. 8.

5. Mr. Bill Rammos, 120 NE 27th Street, Miami FL 33137, spoke in support of Special Item No. 7 on behalf of the Edgewater community.

6. Mr. G. Eric Knowles, President and CEO of the Miami-Dade Chamber of Commerce, appeared in support of Special Item No. 7 and the expansion of the Northeast Corridor. He thanked the outgoing Board of County Commission (Board) members, Chairwoman Edmonson, Commissioners Suarez, Bovo, Moss and Jordan; in addition to Miami-Dade County Mayor Carlos A. Gimenez for their dedication and commitment to improving the community over the years. Mr. Knowles also congratulated and welcomed Mayor-elect, Commissioner Levine Cava and all the incoming Board members.

7. Mr. Michael Llorente, Llorente & Heckler, PA, 801 Arthur Godfrey Road, Miami FL, appeared on behalf of �Sole Mia� in support of Special Item No. 7.

8. Mr. Jose Gonzalez, Executive Vice President of Florida East Coast Industries (FECI), 161 NW 6th Street, Miami FL, appeared in support of Special Item No. 7.

9. Mr. Max Sklar, Vice President of Plaza Equity Partners (PEP), 6161 NE 3rd Avenue, Miami FL 33137, appeared on behalf of PEP and the Magic City Innovation District (MCID) in support of Special Item No. 7. He noted letters of support for the item were submitted for the record from MCID, the Downtown Little Haiti Stakeholders Association and forty five other individuals and organizations from the Little Haiti and Upper East Side community.

10. Mr. Michael Hearon, Assistant Vice President for Florida�s International University (FIU) Biscayne Bay Campus, 3000 NE 151st Street, North Miami FL, appeared on behalf of FIU in support for the expansion of the Northeast Corridor for commuter rail.

11. Mr. Craig Robins, Chief Executive Officer (CEO) and President of DACRA, 3841 NE 2nd Avenue, Miami FL, appeared on behalf of the Miami Design District and DACRA in support of Special Item No. 7.

12. Mr. Newton Sanon, President and Chief Executive Officer (CEO) of Opportunities Industrialization Center (OIC) of South Florida Inc., 3407 NW 9th Avenue, Oakland Park FL, appeared in support of Special Item No. 6. He spoke about the intent of the item and requested the item be amended to include his organization as a tenant of the facility. Mr. Sanon pointed out OIC of South Florida Inc. had already secured over $5 million of job training opportunities from the United States Department of Labor and was prepared to extend these opportunities to the Floral Heights community. He thanked Chairwoman Edmonson for her service and wished her all the best in her future endeavors.

13. Mr. Leroy Jones, 5120 NW 24th Avenue, Miami FL, appeared in support of Special Item No. 6. He briefly reviewed the organizations and services provided by each organization that would be leasing the facility and thanked the outgoing Board of County Commission (Board) members, Chairwoman Edmonson, Commissioners Suarez, Bovo, Moss and Jordan; in addition to Mayor Gimenez for their dedication and commitment to improving the community over the years.

14. Ms. Sara McDevitt, 14490 NE 10th Avenue, North Miami FL 33161, spoke in support of Special Item No. 7 and the expansion of the Northeast Corridor and specifically a commuter train stop at NE 125th Street.

15. Mr. George Darder, Founder of �The Copper Bridge Foundation, Inc.�, 12500 NE 4th Avenue, Miami FL 33161, appeared in support of Special Item No. 7.

16. Dr. David Polinsky, 31 NW 23rd Street, Miami FL, appeared in support of Special Item No. 7.

17. Mr. Albert Garcia, Chairman and Cofounder of the Wynwood Business Improvement District, 50 NW 24th Street, Miami FL, spoke in support of Special Item No.7.

18. Ms. Elizabeth Berglin, Director of Public Policy at United Way of Miami-Dade (UWMD), 3250 SW 3rd Avenue, Miami FL spoke in relation to Special Item No. 11. She noted that UWMD was in the process of finalizing the remaining applications for the $20 million of Coronavirus Aid, Relief and Economic Security Act (CARES Act) funds and would provide a list to each District office once the list was completed.

MOTION TO SET THE AGENDA

First Assistant County Attorney Geri Bonzon Keenan stated the purpose of today�s (11/13) Special meeting was to consider the items as listed on today�s (11/13) final printed Agenda, Special Items Nos. 1 through 14. She indicated in accordance with the Board�s rules of procedure for special meetings, no other business shall be transacted other than the matters provided for in the notice.
It was moved by Vice Chairwoman Sosa that the Board of County Commissioners (BCC) set the agenda for the today�s (11/13) Special BCC meeting as presented. This motion was seconded by Commissioner Moss and upon being put to a vote, the motion passed by a vote of 9-0 (Commissioners Higgins, Souto, Suarez and Bovo were absent).
Chairwoman Edmonson indicated her intent to consider Special Item No. 9 after Special Item No. 13.

Commissioner Martinez requested Special Item No. 5 be considered simultaneously since the items were related.

First Assistant County Attorney Geri Bonzon-Keenan read the title of Special Item No. 5 into the record.

  REPORT: First Assistant County Attorney Geri Bonzon-Keenan read the title of the foregoing proposed resolution into the record.

Chairwoman Edmonson asked whether the foregoing proposed resolution was retroactive.

Mr. Michael Liu, Director, Miami-Dade Public Housing and Community Development (PHCD) announced the foregoing proposed resolution should be amended to strike from the memorandum and resolution the requirement that the Fiscal Year 2020-2021 Public Housing Agency Plan be submitted to the United States Department of Housing and Urban Development on or before October 18, 2020. He noted the proposed amendment was technical in nature.

Discussion ensued between Chairwoman Edmonson and Mr. Liu regarding the intent of the proposed amendment.

There being no further comments or questions, the Board adopted the foregoing proposed resolution as amended.

  REPORT: First Assistant County Attorney Geri Bonzon-Keenan read the title of the foregoing proposed resolution into the record and noted there was a proposed amendment to the item.

Assistant County Attorney Lauren Morse announced the foregoing proposed resolution should be amended to add Opportunities Industrialization Center (OIC) of South Florida Inc. as an additional subtenant pursuant to the Floral Heights lease. She noted the amendment also added descriptions of OIC of South Florida Inc.�s non-profit work and square footage within the facility to the whereas clauses and adds the sublease to Section 2 along with an additional attachment of the OIC of South Florida Inc.�s sublease as exhibit 8. Assistant County Attorney Morse stated conforming changes would also be made to the title and whereas clauses.

  REPORT: Commissioner Heyman reviewed the intent of the foregoing item and commented on the importance of the forgoing item to the improvement of the County�s transit infrastructure.

Responding to Commissioner Martinez�s question as to whether the foregoing item involved any payments to Brightline at this time, Assistant County Attorney Bruce Libhaber explained while the foregoing item was not a binding contract with Brightline with any obligations to pay Brightline at this time, the directive to staff to exercise due diligence related to the final negotiations would incur staff expenses.

Commissioner Martinez inquired about the funding source for the $50 million to be paid by the County upon final implementation of the commuter rail service along the northeast corridor and asked whether Brightline was currently operational.

Deputy Mayor Jennifer Moon clarified while the agreement did not indicate a funding source, there had been some discussion during the negotiation process that the Florida Department of Transportation (FDOT) could possibly support a one-time upfront payment of $50 million followed by
annual installments to be paid by the County.

Acknowledging the intent of the foregoing proposed resolution, Commissioner Martinez indicated his support for the item at this time but noted his apprehension about the reduced funding for other transit corridors, particularly the east-west corridor which lost financing when the Miami-Dade Expressway Authority (MDX) was dissolved.

Mr. Jose Gonzalez, Executive Vice President of Florida East Coast Industries (FECI) noted Brightline service was suspended and would continue to be suspended until there was an increase in demand. He noted demand for service was monitored on a monthly basis and anticipated a return to service sometime in the first quarter of 2021.

Commissioner Higgins appeared telephonically and inquired as to whether the proposed amounts to be paid by the County; one-time payment of $50 million followed by installment payments of $12 million annually; could be further negotiated and was not the final agreed upon amount.

Assistant County Attorney Libhaber confirmed negotiations on the amount would be ongoing.

Commissioner Higgins asked whether the negotiations moving forward would include all key stakeholders to avoid miscommunication.

Commissioner Heyman reiterated all participants including Brightline and FECI would be included in the negotiations process.

Discussion ensued between Commissioners Higgins and Heyman regarding the intent of the item and noted the item was limited to rail access.

Commissioner Higgins indicated her support for the item and stated she was hopeful when the item returned that Mayor-Elect Levine Cava would include additional input from private entities.

Chairwoman Edmonson, Commissioners Sosa, Diaz, Moss, Monestime, Jordan, Higgins, Levine Cava and Bovo asked to be added as co-sponsors.

Commissioner Heyman welcomed and thanked her colleagues for co-sponsoring the item.

Commissioner Sosa indicated her support for the item and stated she was hopeful the northeast corridor would be the first of many connections. She also urged the administration to pursue alternative funding sources to reduce the financial burden from taxpayers.

Discussion ensued between Commissioner Monestime and Deputy Mayor Moon as to how the proposed access fees were determined.

Commissioner Monestime indicated his support for the item.

Commissioner Moss expressed his support for the item and spoke about the transit legacy left behind by departing Board members for incoming members to build upon and implored his colleagues to continue working to advance other corridors.

Commissioner Bovo stated his support for the item. He echoed the comments and concerns voiced by
Commissioners Martinez and Moss and also urged his colleagues to continue to build upon the work done by the departing Board members to improve the County�s transit system.

Commissioner Levine Cava thanked Commissioner Heyman for her dedication and commitment to the project and spoke about the importance of creating an affordable system.

Discussion ensued between Commissioner Levine Cava and Deputy Mayor Moon regarding the proposed access term (90 years) and the County�s control on the purchase of the rolling stock.

Deputy Mayor Moon explained the proposed 90 year term was based upon cost effectiveness and clarified the County did not intent to pay access fees for 90 years. She reiterated the intent of today�s (11/13) item was limited to rail access and noted there was still a number of outstanding issues left to be negotiated; such as the number of stops, capital required, type of service and who would be operating the service.

Commissioner Diaz indicated his support for the item and expressed optimism that the northeast corridor would be just one step in the future advancement of public transit in the County.

Commissioner Jordan stated she was hopeful the North Corridor would soon follow and asked for a status report update on the Request for Proposal (RFP) process for the North Corridor to be provided at the upcoming November 19, 2020 Board of County Commission (BCC) meeting. She commended Commissioner Heyman on the work done to date and recognized the public private partnership (P3) element of the project.

Chairwoman Edmonson expressed her support for the item. She stated she was proud of the work done by the Board to advance transit projects during her tenure as Chairwoman and spoke about the legacy being left behind for the new Board members to build upon.

Commissioner Heyman pointed out the Miami-Dade Transportation Planning Organization (TPO) Board unanimously supported the project and thanked Commissioner Bovo, Director for Miami-Dade County�s Transportation and Public Works (DTPW) Department, Alice Bravo; and Executive Director of the TPO, Aileen Boucle for their commitment and dedication to advancing the project.

  DISCUSSION ITEM REGARDING THE CORONAVIRUS DISEASE 2019 (COVID-19) PANDEMIC Presented
  REPORT: Deputy Mayor Jennifer Moon provided a brief oral report regarding the County�s Coronavirus Disease 2019 (COVID-19) response detailing the current positivity rate, first responder calls and hospitalization numbers. She stated while cases were expected to peak around Thanksgiving, the County was engaged in an aggressive public service announcement (PSA) campaign to encourage residents to continue wearing masks, practice social distancing and get tested when needed.

Deputy Mayor Moon recognized and thanked Melissa Brown, Joe Di Girolamo, Hector Florin, Giannina Mora, Javier Ruiz, Jose Espinosa and Charles Cyril (phonetic) for their continued work and dedication to ensure the County�s Dashboard was updated daily.

Deputy Mayor Moon reported all nine of the County�s testing locations were fully operational with five locations providing �drive-thru� services and four offering �walk-up� service. She noted none of the testing locations were at capacity and encouraged residents to get tested as needed. She recognized Captain Tracy McGill, Rashad Thomas, Michelle Theurer, Jason Fernandez, Ingrid Bethune, Greg Rubin, Chief Garner, Chief Williams and Chief Fire Officer Webb for their contributions to ensuring testing services were made available to residents. Deputy Mayor Moon also commended the County�s Fire Department for ensuring the County�s personal protective equipment (PPE) supply was well stocked and available when needed.

Deputy Mayor Moon echoed similar commendations for the County�s Police Department and Department of Regulatory and Economic Resources (RER), specifically Miami-Dade Police Department Director Juan Perez and Deputy Director for RER, Lourdes Gomez, for overseeing the enforcement of the County�s COVID-19 related policies. She reported to date; 1,069,943 business contacts had been made with 6,398 warnings issued to businesses, 196 business closures, 1,809 civil citations to businesses and 517 civil citations to individuals. She thanked Carlos Rosario for providing daily status reports and Chief Hanlon, Major Brown and Major Cordero-Stutz for their continued dedication and service.

Deputy Mayor Moon noted the seniors� meal program had delivered in excess of 15.2 million meals since the program�s inception with 51,215 elderly residents currently enrolled in the program. She credited Interim Director for Miami-Dade County�s Community Action and Human Services (CAHS), Anika Holder, and Miami-Dade County�s Director for Emergency Management, Frank Rollason; along with their staff; for saving countless lives.

Deputy Mayor Moon stated the County had received 553 applications from active military and veterans for vouchers and credited Director of Miami-Dade County�s Military Affairs Board, Gus Cruz, and staff for their efficiency in processing the applications.
She noted a total of $302,000.00 in application requests were already approved with another $230,000.00 in requests being verified.

Deputy Mayor Moon reported $5 million in assistance was provided to help adult and child day care centers; and thanked Dan Wall, Jennifer Pimentel and the staff from the County�s Office of Management and Budget (OMB) for ensuring a smooth and efficient contract process was established and adhered to. She pointed out that there were 80 adult day care centers in unincorporated Dade County being reviewed for eligibility and noted there was an additional amount of $2 million earmarked for adult day care centers to be administered through the Alliance for Aging.

Deputy Mayor Moon advised the Board members that �Defense for Tots� boxes which included a hand held electrostatic sprayer to disinfect high contact areas, disinfectant for the sprayer and a free standing temperature screening system; would be provided to the 760 child day care centers located in the unincorporated Dade County area.

Deputy Mayor Moon thanked Jacques Bentolila, Deputy Director for Miami-Dade County�s Internal Services Department (ISD) for collaborating with the County�s Information Technology Department (ITD) and the Florida Department of Health (FDOH) to make the contact tracing �Combat COVID� application a success. She noted over 10,000 people had downloaded the application with 296 people self-reporting a positive COVID-19 test and another 227 people receiving alerts that they may have come into contact with someone who tested positive.

Deputy Mayor Moon spoke recognized the exceptional job done by the �Strategic Unified Response to Guideline Education (SURGE)� teams organized by Director of the Animal Services Department, Alex Munoz. She noted the teams targeted specific residential census tracks with positivity rates exceeding 10% and also provided safety information to and through business and agricultural outreach teams.

Along with Mr. Munoz, Deputy Mayor Moon thanked Alissa Penaloza, Deputy Director at Miami Dade County�s Water and Sewer Department (WASD); Gayle Love, Senior Division Director for Miami-Dade County�s Solid Waste Management; Luis Mendoza, Business Analyst at OMB; Morris Copeland, Director for Miami-Dade County�s Juvenile Services Department (JSD); and the numerous County employees from various departments which comprised the �SURGE� teams.

Deputy Mayor Moon reported utility assistance funding valued at $4.597 million administered via the Department of Economic Opportunity Low Income Home Energy Assistance Program (LIHEAP) Coronavirus Aid, Relief, and Economic Security (CARES) Act helped 6778 low income households restore electricity or prevent disconnection. She noted under the purview of Miami-Dade Cultural Affairs Director, Michael Spring, $10.112 million of CARES Act support was made available to fund the arts and cultural business sector. Deputy Mayor Moon reported out of the 291 grant requests made by arts and cultural organizations, $9.5 million had been approved to date with another 856 artist entrepreneur applications approved for a $625.00 grant award totaling $35,000.00.

Deputy Mayor Moon commended Director of the Miami-Dade Public Library System, Ray Baker, for his department�s help with the distribution and collection of the re-employment and Supplemental Nutrition Assistance Program (SNAP) applications, distribution of free facial coverings at all library locations as well as computer sessions to help meet the County�s technology needs. She also recognized Director for Miami-Dade County Parks, Recreation and Open Spaces (PROS) Department, Maria Nardi and Chief of Operations for PROS, Tom Morgan for their help overseeing free food distribution events and hosting numerous virtual summer classes, including 60 videos and �Zoocademy.� Deputy Mayor Moon noted to date PROS staff hosted 214 events at Tamiami, Homestead Air Reserve Park and Amelia Earhart Park which served 162,000 families.
Deputy Mayor Moon concluded her presentation by reiterating the administration�s recognition and appreciation to the various County employees and departments identified above which continued to provide service during the pandemic.

Deputy Mayor Edward Marquez noted a report memorandum entitled �Update on Coronavirus Relief Fund (CRF)� (See Exhibit 10) had been provided to the Board members for their review and proceeded to summarize the report.

Responding to Commissioner Levine Cava�s question as to the State of Florida�s plan to scale back contact tracing programs, Deputy Mayor Moon reassured the Board members that the County�s local health department had no plans to scale back on a local level.

  REPORT: Commissioner Heyman announced she had a proposed motion related to all Coronavirus Disease 2019 (COVID-19) related items on today�s (11/13) agenda, specifically Special Item Nos. 11 through 13; and reviewed the intent of the motion.

Assistant County Attorney Christopher Kokoruda read the following motion into the record as proffered by Commissioner Heyman:

"From any unspent Coronavirus Aid, Relief, and Economic Security (CARES) Act funds, I move to allocate a total of not-to-exceed $5,000,000 of such funds to Nanobiosym Diagnostics, Inc., to fund further development of an instrument to test for COVID-19 through the use of saliva and to create a viral load database for Miami-Dade County to determine safe standards to reopen Miami-Dade County businesses and schools.

I further move to direct the County Mayor or designee to negotiate and execute any documents necessary to effectuate the purposes of this motion, following approval of such documents by the County Attorney�s Office for form and legal sufficiency."

Commissioner Heyman noted Nanobiosym Diagnostics Inc. was currently working with the University of Miami (UM) and Florida International University (FIU) and would continue to be based out of Miami. She stated the testing would allow the County to continue to make scientifically based decisions regarding COVID-19 issues and reiterated the intent of the item was to utilize any unspent CARES Act funds.

Commissioner Martinez pointed out Special Item No. 13 contained language which directed the administration to recapture any unused CARES Act funds that was unspent as of December 15, 2020 to offset the County�s COVID-19 related expenses.

Responding to Commissioner Levine Cava�s question as to the most current estimate for the amount of funds needed to cover the County COVID-19 related expenses, Deputy Mayor Edward Marquez directed the Board�s attention to Line 15 of Exhibit 1 (Summary of Coronavirus Relief Fund (CRF) Allocations � COVID Regional and Municipal Services by County) of the memorandum report included for Special Item No. 10. He reported while the County originally allocated $61 million for COVID Regional and Municipal Services, $112,039,256.00 had been spent to date with another $52,861,364 projected to be spent by the end of the fiscal year, amounting to a negative balance of $109,900,620.00.

Deputy Mayor Marquez continued to read from Page 2 of the memorandum which identified the various programs, initiatives and services funded by the County under the umbrella �COVID Regional and Municipal Services by County.�

Commissioner Levine Cava noted pursuant to Deputy Marquez�s explanation of the expenses to date, there may not be any funds left to recapture and reallocate.

Subsequent to the discussions, Commissioner Heyman moved to allocate a total amount not-to-exceed $5,000,000 to Nanobiosym Diagnostics, Inc., of any unspent CARES Act to fund further development of an instrument to test for COVID-19 through the use of saliva and to create a viral load database for Miami-Dade County to determine safe standards to reopen Miami-Dade County businesses and schools; and further moved to direct the County Mayor or designee to negotiate and execute any documents necessary to effectuate the purposes of this motion, following approval of such documents by the County Attorney�s Office for form and legal sufficiency. This motion was seconded by Commissioner Sosa and upon being put to a vote, the motion passed by a vote of 8-2; (Commissioners Levine Cava and Monestime voted "no"; Commissioners Higgins, Souto and Suarez were absent).

Commissioner Sosa requested a point of personal privilege to commend and recognize Chairwoman Edmonson�s service as the Board of County Commission (Board/BCC/Commission) Chairperson over the past two years and presented her with a token of appreciation from Board members. She also noted the swearing in ceremony for the new District Commissioners would now be held individually in chambers in light of the increasing coronavirus disease 2019 (COVID-19) cases.

Chairwoman Edmonson thanked her colleagues for their support over the years and commented on the legacy she wished to leave behind.

Commissioners Martinez, Moss, Jordan, Levine Cava and Heyman commended Chairwoman Edmonson for her leadership as Chairperson and for always holding the Board members accountable. They recognized her efforts to conduct meetings effectively and in a timely manner and applauded her for the transition from in-person to virtual meetings as a result of the COVID-19 pandemic.

Commissioner Moss acknowledged the legislative progress made under Chairwoman Edmonson�s leadership and commented on the exemplary working relationship both Chairwoman Edmonson and Vice Chairwoman Sosa shared. He voiced his optimism that the new Commissioners would build on the foundation left by the departing Board members and expressed his gratitude for the years of service he shared with his colleagues.

Chairwoman Edmonson acknowledged and thanked Vice Chairwoman Sosa for her support over the years.

Commissioners Jordan and Levine Cava echoed the comments made by Commissioner Moss as to the teamwork between Chairwoman Edmonson and Vice Chairwoman Sosa over the past two years.

Commissioner Moss requested a point of personal privilege and read into the record a statement from Mrs. Leatha Sherill-Bush, Founder of Survivors Affected by Violence �The Jack Brown III� Foundation and recipient of the Vilomah Award.
