Chairwoman Sosa opened the public hearing; and hearing no one wishing to speak, the public hearing was closed.
Successor County Attorney Bonzon-Keenan announced this item required two (2) public hearings, and the appropriate motion would be to forward the item for its second public hearing at the Board�s December 15, 2020, meeting. She noted Commissioner Regalado would proffer a motion in regards to the time of the second public hearing.

Pursuant to Chairwoman Sosa�s question, Ms. Alice Bravo, Director of Transportation and Public Works Department (TPWD), advised the road was a dead end alley with no connectivity to roads; and the closing of the road would prevent illegal dumping and allow police to patrol.

DISCUSSION TO FILL THE VACANCY IN COMMISSION DISTRICT 8 [SEE AGENDA ITEM NO. 11A4]

REPORT:
It was moved by Vice Chairman Diaz that the Board of County Commissioners establish a uniform process to consider candidates who ran in District 8�s election. This motion was seconded by Commissioner Gilbert III, and the floor was opened for discussion.
Vice Chairman Diaz noted Chairwoman Sosa wished to open the process to consider any interested parties residing within District 8, who met qualifications, and have those individuals send their credentials to county commissioners for their review.
Chairwoman Sosa clarified that she believed everyone interested in filling the vacancy should be considered and not just those running in the election; and it should be the Board�s decision to determine who to appoint.
Vice Chairman Diaz proposed to hold a Special meeting of the Board on December 7, 2020, in order for the Board to vote on the appointment to fill the vacancy in County Commission District 8 without having the need to have an extended discussion on the matter.
Chairwoman Sosa noted the application process would be opened effective December 1, 2020, and the candidates needed to submit a letter of intent with their resume to each county commissioner with a copy to the County Attorney prior to the closing deadline.
Chairwoman Sosa clarified the motion on the table was to establish an uniform process for individuals interested in applying for the vacancy and require that all candidates submit their qualifications to the Commission Auditor so that the Commissioner Auditor could distribute to the members of the Board by December 3, 2020, 12:00 p.m., the candidates� information with the background checks.
The motion was seconded by Commissioner Gilbert III, and the floor was opened for discussion.
Commissioner Regalado spoke in support of the motion and requested the meeting be scheduled to begin in the afternoon.
Successor County Attorney Geri Bonzon-Keenan advised her office would have to circulate a call and be able to confirm seven (7) signatures to schedule the Special meeting of the Board.
Discussion ensued among the members of the Board regarding the time of the Special meeting.
Commissioner Garcia expressed his objections regarding making an appointment to fill the vacancy and spoke in favor of upholding the voters� rights, even though this Board had complete authority under the Charter to make such appointment.
Commissioner Souto spoke in support of holding an election.
Chairwoman Sosa clarified the Board�s Rules of Procedures; and she noted that, at the last Board�s meeting (11/19), there were two (2) available options; but the item before them today (12/1) only allowed to establish the meeting date to make the appointment. She advised the intent of the motion was to open the process to anyone interested in applying for the vacancy.
Commissioner Martinez recommended the opening of the process be advertised and commented voters preferred to have an election.
In response to Commissioner Gilbert III�s comments relating to verification of qualifications prior to the Board taking a vote to appoint a candidate, Chairwoman Sosa explained the establish process whereby the Commission Auditor was responsible to perform background checks and present that information to the members of the Board. Therefore, the application process would be closed on December 3, 2020, 12:00 p.m. to provide the Commission Auditor to perform the background checks.
Commissioner Heyman advised that this Board voted on November 19, 2020, to make an appointment; and it was published in the Miami Herald and NPR, which constituted a public advertisement of the Board�s decision.
Pursuant to Commissioner Heyman�s request, Ms. Christina White, Miami-Dade County Supervisor of Elections, explained the four (4) applicants were announced candidates, who had filed their intention to run for office. She stated none of the candidates had yet qualified for the seat since that happens when the qualification period was officially opened, and the qualification period was not opened at that time. She noted the candidates provided under the penalty of perjury oath their information saying the qualifications to run for office were met.
Discussion ensued among the members of the Board regarding the qualifications of the candidates and the process to qualify for office.
Assistant County Attorney Oren Rosenthal explained the eligibility requirements and explained that the candidates were not required to qualify with the Elections Department since they were not applying for campaign funds; but the County�s Charter would require that the candidate live within the district for six (6) months and live within the County for three (3) years.
Pursuant to Commissioner Heyman�s inquiry, Assistant County Attorney Rosenthal explained the qualifications verification process, noting the candidates had signed an affirmation.
Following a brief discussion among the members of the Board regarding the qualification process, Commissioner Heyman commented an election should be held if the members of the Board wished to increase participation; and the decision should be made by the voters of the district.
Commissioner Higgins proposed to amend Vice Chairman Diaz� motion by having an email address setup through the Commission Auditor�s Office to have all candidates submit their letter of intent and resumes directly to him by the deadline date.
Vice Chairman Diaz accepted the amendment to his motion.
Vice Chairman Diaz concurred with Commissioner Heyman�s comments and noted he only wished to establish a uniform process.
Discussion ensued among the members of the Board regarding the date on which the office seat for District 8 became vacant and the qualification period for the office.
Pursuant to Chairwoman Sosa�s question regarding the process, Successor County Attorney Bonzon-Keenan stated that it was her understanding the Board would be making two (2) motions whereby the first motion would establish a process for the appointment of interested parties wishing to fill the vacancy and would submit their credentials for this Board�s consideration potentially as amended by Commissioner Higgins to have that information directly submitted to the Commission Auditor. She stated that, if that motion were to pass, she understood this Board would like to call a special meeting to consider those applications for appointment at a Special meeting of the Board to be held on December 7, 2020, at 1:00 p.m.
Vice Chairman Diaz clarified that the Special meeting was intended to take a vote on the appointment because all commissioners should have been able to review all of the candidate�s information prior to the meeting.
Successor County Attorney Bonzon-Keenan noted that the Board�s Rules of Procedures required seven (7) signatures be collected to approve the Special meeting. She also noted the County Attorney� Office had prepared a call for the special meeting; and if the required amount of signatures was collected for that matter to be considered, the appropriate motion was to defer Agenda Item 11A4 relating to making the appointment to the vacant position.
Discussion ensued among the members of the Board regarding the procedural process under consideration.
Discussion ensued between Commissioner Hardemon, Assistant County Attorney Rosenthal, and Ms. White regarding the remedy and avenue to pursue to remove an elected official from office if it was found at a later time that the elected official had not met the residency requirements.
Chairwoman Sosa reviewed the motion on the table.
Upon conclusion of the foregoing discussion, Vice Chairman Diaz� motion to have the Board of County Commissioners establish a uniform process for persons interested in applying for the vacancy, requiring that all candidates submit qualifications to the Commission Auditor, as suggested by Commissioner Higgins, and have the Commission Auditor distribute to the members of the Board by December 3, 2020, at 12:00 p.m., all of the information submitted by the candidates including the background checks. This motion was seconded by Commissioner Gilbert III; and upon being put to a vote, the motion passed by a vote of 7-5 (Commissioners Heyman, Higgins, Martinez, Monestime, and Souto voted no, District 8-Vacant).
Pursuant to Chairwoman Sosa�s question regarding whether the process on the table met legal sufficiency, Successor County Attorney Bonzon-Keenan and Assistant County Attorney Rosenthal advised the process established was appropriate.
Commissioner Hardemon pointed out that the process was currently opened to all interested parties and extending the process would not increase interest.

DISCUSSION REGARDING COVID-19

Miami-Dade County Mayor Daniella Levine Cava advised she had asked various departments that were working on COVID-19 to provide a status update.
Mr. Edward Marquez, Chief Financial Officer (CFO), presented three (3) reports with exhibits projecting the costs and projections. He pointed out the Board enacted a resolution at its last Board meeting to recapture all COVID-19 related municipal allocations to utilize those funds for the County�s COVID-19 related expenses. He asked the Board to provide guidance on the reallocation of those funds and noted many of the cities had asked about the enactment of that resolution. He stated he would meet with all commissioners to discuss the options on this matter.
Mayor Levine Cava pointed out the rules were changed, and it would now be easier for the cities to utilize their funding allocations. She recommended the municipalities be allowed to use their funds.
Mr. Marquez recommended the County should maximize the opportunities for the municipalities to utilize their funding allocations rather than recapture the funds.
Chairwoman Sosa concurred with the recommendation to provide every opportunity possible to the municipalities to utilize their funding allocations.
It was moved by Commissioner Gilbert III that the Board of County Commissioners set County policy that, notwithstanding the provisions of Resolution Number R-1158-20, the County shall afford any municipalities that have received funds from the County made available through the Coronavirus Aid, Relief, and Economic Security (CARES) Act Coronavirus Relief Fund for COVID-19 pandemic response, as much time as necessary to expend such funds before the December 30, 2020, deadline imposed by the CARES Act. This motion was seconded by Vice Chairman Diaz; and upon being put to a vote, the motion passed by a vote of 11-0 (Commissioner Martinez was absent, District 8-Vacant).
This motion would be memorialized and assigned Agenda Item 15F1, Legislative File Number 202427, and Resolution Number R-1231-20.
Commissioner Hardemon asked Mr. Edward Marquez, Chief Financial Officer (CFO), to meet with him to discuss how best to make the cities the County�s partners in this effort and develop opportunities for them to utilize their funding allocations.
Chairwoman Sosa concurred with the recommendation to assist and work together with cities to ensure unification of efforts.
Vice Chairman Diaz asked Mr. Edward Marquez, Chief Financial Officer (CFO), to ensure the funding allocated to the Unincorporated Municipal Service Area (UMSA) was intact to provide county commissioners representing that area the opportunity to accomplish whatever needed to be done within that area.
Vice Chairman Diaz asked Mr. Edward Marquez, Chief Financial Officer (CFO), to review with him the funding allocations, in particular funds allocated to veterans; and on December 31, 2020, he would like to revisit the funding allocations with Mr. Marquez to ensure available funds were not recaptured by the federal government and reallocate those funds.
Commissioner Gilbert III commented he wished to ensure the cities were given as much time as necessary to utilize their funding allocations.
Commissioner Regalado explained the different funding sources and the creation of flexibility to be able to allow sufficient time for last minute changes and transfer of funds before the deadlines expired.
Pursuant to Chairwoman Sosa�s request, Mr. Marquez provided new county commissioners with a brief explanation on the foregoing issue, the Federal Emergency Management Agency (FEMA) funds, Coronavirus Aid, Relief, and Economic Security (CARES) Act Program funds, the $25 million program established by this Board, and how the funds were utilized.
Mr. Marquez advised the municipal funding allocations would be revisited to determine if funds could be reallocated to municipalities with a funding shortage. He stated the County will continue to work with the cities through December 31, 2020, due to the County�s ability to file paperwork up to three months afterwards.
Chairwoman Sosa advised she would gladly provide additional information at every Board meeting if requested by the members of the Board due to the need to keep everyone informed on the virus.
Mayor Levine Cava noted the report contained some key data points and wished to acknowledge the service provided by County employees, who continued to risk themselves to provide those services. She advised Mr. Robert Gonzalez, a 28-year veteran County employee, who served as a micrographic supervisor, passed away from coronavirus; and she wished to send a condolences message, together with the Board, to his family and friends.
Chairwoman Sosa requested Mayor Levine Cava review the County�s departmental guidelines for departments located outside of the Stephen P. Clark (SPC) Center to ensure the County�s face mask wearing policy and coronavirus prevention guidelines were enforced at every County department.
Mayor Levine Cava provided an overview on the County�s coronavirus prevention guidelines.
Commissioner Higgins pointed out the information contained in the weekly status reports had improved. She noted the restaurant program had been slow at utilizing the fund allocated to them; consequently, the program would be unable to utilize all of its funds by December 30, 2020. She explained those funds could utilized by the program working with community-based and faith-based organizations, which already had processed applications that qualified under the CARES Act. She stated her motion would provide the County with the ability to reallocate all of those funds to organizations located within all thirteen (13) county commission districts.
It was moved by Commissioner Higgins that, notwithstanding section 3 of Resolution Number R-1158-20, from any unspent or recaptured CARES Act funds allocated by this Board to the Hospitality Industry Grant Program authorized by Resolution Number R-703-20, or to any other program that is not on track to spend the allocated CARES Act funds by the December 30, 2020, deadline, a total of not to exceed $1,911,530.38 of such funds be allocated to The Miami Foundation for the small non-profit support grants program, as authorized by Resolution Number R-750-20.
Commissioner Higgins further moved to direct the County Mayor or County Mayor�s designee to negotiate and execute any documents necessary to effectuate the purposes of this motion, following approval of such documents by the County Attorney�s Office for form and legal sufficiency.
This motion was seconded by Commissioner Monestime, and the floor was opened for discussion.
Commissioner Monestime asked Mr. Edward Marquez, Chief Financial Officer (CFO), to apprise him by the Board�s next meeting (12/15) how to best facilitate the release of the CARES Act funds allocated to cities to ensure individuals and entities in need of financial relief were able to receive financial assistance. He also asked that the needs of the jitneys and taxi industries be addressed. He noted the information and documents requested from these industries were unavailable.
Chairwoman Sosa asked Mr. Edward Marquez, Chief Financial Officer (CFO), to review the Senior Meals Program and that the home delivery service be extended another month from County surplus funds. She asked to be apprised about the status of this request by December 7, 2020.
Mr. Marquez advised those services had already been scheduled through December 31, 2020, but he would report back on the extension of the Senior Meals Program. He noted that he hoped FEMA would also extend the timeframe.
Commissioner Gilbert III pointed out the directive to recapture municipal funds to extend the Senior Meals Program was completely inconsistent with the instruction given earlier to assist and create sufficient opportunities for the cities to spend their funds.
Discussion ensued regarding from which category the Board wished to reallocate the funds to address Commissioner Higgins� motion.
Commissioner Higgins clarified her motion would redistribute the available funds allocated to the Hospitality Industry Grant Program for the restaurant industry, as mentioned in the motion, since that program had insufficient recipients and had been slow at releasing the funds.
Mr. Marquez noted the available balance to be redistributed, under Commissioner Higgins� motion, would probably be approximately $10.7 million.
Commissioner Hardemon expressed his objections to the motion due to the short timeframe given to review and assess the information provided.
Upon concluding the foregoing discussion, Commissioner Higgins� motion was put to a vote. Consequently, due to the objections and preference to have the motion deferred, a vote was not taken and deferral to the next Board meeting was recommended.
Commissioner Monestime recommended deferral of the foregoing motion.
Discussion ensued among the members of the Board regarding the deferral of the motion to the Board�s meeting of December 15, 2020.
Commissioner Gilbert III spoke on the lack of clarity of the instruction contained in the motion and referenced the clause in the motion saying �or to any other program that is not on track to spend the allocated CARES Act funds by the December 30, 2020, deadline.� He pointed out that clause was subjective and provided the County Administration with the prerogative to determine which programs were not on track to reallocate the funds.
Commissioner Regalado commented on the issue of the County�s eviction moratorium and its impact on the community. She advised that she would like to discuss this issue and its logistics at the Board�s next scheduled (12/15) meeting.
Pursuant to Chairwoman Sosa�s question, Mr. Marquez responded that the Board could not safely establish its own guidelines to distribute CARES Act funds.
Chairwoman Sosa advised the motion would be reconsidered at a Special meeting of the Board of County Commissioners to be held on December 7, 2020, at 12:00 p.m.; and a call would be circulated by the County Attorney�s Office to collect the seven (7) required signatures.

REPORT:
Commissioner Garcia expressed his preference to hold an election to fill the vacancy for County Commission District 8 in order to uphold the democratic rights of voters; and he recommended the opinion of Miami-Dade County Mayor Daniella Levine Cava should be taken into consideration as the former commissioner for that district.
Pursuant to Commissioner Garcia�s question regarding the process to fill the vacancy, Successor County Attorney Geri Bonzon-Keenan responded the County Charter set forth the process by which to fill the district vacancy of District 8; and the Charter required that either this Board within thirty (30), or by December 16th, appoint a candidate, or call for a special election to be held within ninety (90) days.
Successor County Attorney Geri Bonzon-Keenan clarified that the only motion made at the last Board meeting in respect to the appointment to fill the vacancy was to defer the foregoing item. However, statements were made on the record indicating they would like to consider for the appointment those applicants that had applied to potentially run or showed interested in running for the vacancy had the resignation not be effective. She stated a motion was not made to limit the candidacy to those applicants; however it was discussed. She advised the process that could be followed today (12/1) was to appoint someone as set forth in Agenda Item 11A4; therefore, any of the applicants could be appointed provided the applicant met the qualification requirements for the district as set forth by the Assistant County Attorney Oren Rosenthal earlier today (12/1), which were to live within the district six (6) months and within the County for three (3) years.
Pursuant to Commissioner Garcia�s question, Successor County Attorney Bonzon-Keenan responded the foregoing resolution was still under consideration; and the Board could motion to make an appointment to fill the vacancy since a motion to defer had not been approved yet.
Following a brief discussion among the members of the Board on the intent to defer the foregoing resolution, Chairwoman Sosa clarified the intent to defer Agenda Item 11A4 to December 7, 2020, was to open the process to provide the opportunity for more individuals to apply for the vacancy based on the motion previously approved.
Successor County Attorney Bonzon-Keenan advised there was a motion to defer the foregoing item to a Special meeting of the Board to be called for December 7, 2020, at 12:00 p.m. pending confirmation there were seven signatures collected to approve the meeting for that date and time.
Upon conclusion of the foregoing discussion, the members of the Board proceeded to take a vote on the motion to defer the foregoing resolution to a Special meeting of the Board of County Commissioners to be held on December 7, 2020, at 12:00 p.m. to make an appointment to fill the vacancy in the Office of County Commissioners for District 8 pending confirmation that there were seven (7) signatures collected to approve the meeting for that date and time.
Pursuant to Chairwoman Sosa�s question, the County Attorney advised a call would be circulated for a Special meeting of the Board for December 7, 2020, at 12:00 p.m.; and as soon as the required seven (7) signatures were collected, a notice would be filed on the Clerk; and the deferral of the item to that date would be confirmed.
Commissioner Garcia commented the Board had the right to make an appointment to fill the vacancy, but the people from the district had indicated they wished to have an election. He noted the voter�s right to vote should be upheld.
Pursuant to Chairwoman Sosa�s request, Successor County Attorney Bonzon-Keenan advised the item was dispensed at the Board�s last meeting (11/19); however, it was at the chair�s discretion to allow this conversation to continue. She noted the item had its reasonable opportunity to be heard at the last Board meeting; and the Board�s Rules of Procedures provided it only had be afforded once.
Discussion ensued among the Board members whether the item from the previous Board meeting (11/19), Agenda Item 11A10, should be reconsidered.
Successor County Attorney Bonzon-Keenan clarified Commissioner Garcia had a standalone motion to hold a special election on February 9, 2021.
Following a discussion among the Board members on Commissioner Garcia�s motion to hold a special election, Chairwoman Sosa asked for a show of hands in favor of the motion; and only three (3) Board members indicated they would vote in favor of that motion.
