She also gave a statement regarding public participation during Board of County Commissioners (BCC) meetings, noting provisions were made so that in January 2021 the public will have the opportunity to call in or attend meetings to address the commission.

Chairwoman Sosa opened the hearing for the reasonable opportunity to be heard; the following persons appeared virtually to address the Board:
Ms. Marsha Dufran 169 E Flagler Street, Miami, Florida on behalf of Transit Alliance, spoke in support of 11A9 and 11A10; she urged the Board to support these items.
Mr. Derrick Holmes 17605 SW 112th Court, Miami, Florida urged the Board to halt the plans for the Bus Rapid Transit (BRT) on the South Dade Transitway in order to study feasibility of alternative modes of transportation, particularly heavy rail.
Pastor Alphonso Jackson Sr. 11111 Pinkston Drive, Miami, Florida asked that agenda item 11A10 be deferred for 60 days and presented at another time.
Seeing no one else come forward to speak, Chairwoman Sosa closed the reasonable opportunity to be heard.

County Attorney Geri Bonzon-Keenan advised the Board of the following preliminary changes to today�s agenda:
-Commissioner Martinez requested to add his name to the Pull List on Agenda Item 8E1.
-Commissioner Higgins released Agenda Items 11A1 and 11A1 Substitute.
-Commissioner Garcia requested to add Agenda Item 11A5 to the Pull List.
-Commissioner McGhee requested to add his name to the Pull List on Agenda Items 11A6 and 11A6 Substitute.
Commissioner Regaldo requested to add her name to the Pull List on Agenda Items 11A9, 11A9 Substitute #1 and 11A9 Substitute #2.
Commissioner Souto requested to be listed as a Co-sponsor of Agenda Items 4B, 11A4 and 11A15.

The Board will approve all of those items by a single vote setting the agenda except for Agenda Item 2B1 the Mayor�s Appointment of the Director of the Regulatory and Economic Resources Department, Agenda Item 2B2 the Mayor�s Appointment of the Director of the Juvenile Services Department, Ordinances for First Readings, Public Hearings, Ordinances for Second Reading, Agenda Item 8F1 a Commercial Service Airport contract, which must be voted on separately and is not on the Pull List, Agenda Items subject to the 4-Day Rule and; the following Pull List items:
8E1, 8F3, 11A5, 11A6, 11A6 Substitute, 11A9, 11A9 Substitute, 11A9 Substitute #2, 11A10, 11A17, 15B1, 14A1, 14A2, 14A3, 14A4, 14A5, 14A6 and 14B1.
It was moved by Commissioner Diaz that the Board adopt the agenda with the aforementioned changes, as noted by the County Attorney. This Motion was seconded by Commissioner Sosa, and upon being put to a vote, passed by a vote of 13-0.

REPORT:
Commissioner Martinez expressed his concern regarding Miami-Dade Fire Rescue (MDFR) ladder trucks breaking down and noted it took over 15 months to build and deliver a ladder truck. He also inquired about the expiration of the contract and indicated the cost of the contract would increase if the Board did not act on the resolution today.
Chairwoman Sosa inquired whether the contract was nearing expiration, and whether the proper competitive procurement procedures were followed.
Deputy Mayor Ed Marquez noted that MDFR Chief Kominsky had been working with Namina Uppal, Chief Procurement Officer, Internal Services Department (ISD) to move forward with the purchase of the equipment; the purchase of the fire equipment is scheduled to be on the Agenda in January.
Vice Chairman Diaz noted the first responders needed all the equipment to perform their duties; he indicated there should not be a rush to obtain supplies and asked for clarification on this resolution.
Ms. Uppal responded to Chairwoman Sosa�s inquiry indicating that the information she received was incorrect, the contracts were not expiring; she noted the procurement process did start early, and Ms. Uppal explained the procurement process used for specialized fire equipment trucks and the department searched for the best competitive pricing available. These were multi-year contracts which were available and awarded to national large authorized dealers. She pointed out the possibility of the price being increased on some options available on the trucks, however she was in communication with the dealer regarding the pricing of the trucks.
Responding to Commissioner Martinez� inquiry regarding the current status of the fleet, Fire Chief Kominsky indicated currently the fleet contained 17 front line ladders, five (5) of which were spares. Unfortunately he noted three (3) of the spare ladder trucks were being used because the others had to be red lined due to failing annual testing. Chief Kominsky noted he was looking to purchase an emergency ladder to add to the fleet�s front line units and the spares would be relocated once the emergency ladder arrived. Chief Kominsky stated the issue was the length of time it took to manufacture the ladders, especially during the pandemic, noting it would take 12 to 15 months to receive a newly constructed ladder.
Commissioner Martinez noted the department was in dire need of these fire trucks and ladders. He noted he was in support of the foregoing proposed resolution.
Following further discussion, Mayor Levine Cava indicated that she would do everything in her power to move this resolution and the procurement process expeditiously.
Hearing no further questions or comments, the Board proceeded to vote on the foregoing resolution.

REPORT:
Commissioner Garcia inquired why only certain business receiving financial relief and not all businesses. He spoke of the cost of this financial relief and inquired whether these costs fell on the taxpayers in Miami-Dade County.
Mr. Lester Sola, Director, Aviation Department, responded to Commissioner Garcia�s inquiry noting that the Airport did not receive any revenue from the General Fund or any tax base. He explained the intent of this resolution, and pointed out that the relief being provided came from revenues produced by the concessionaires at the airport. He noted this was a short extension of relief and while the administration to find a long term solution. Mr. Sola also clarified that the resolution indicated �certain� businesses because relief was only being provided to the concessionaires at the airport and not the other businesses that operate at the airport.
Commissioner Garcia expressed his concern that financial relief was being provided to concessionaires that had been operating in the airport for many years while many other small businesses in the community needed financial relief as well; he noted the Board needed to take an in-depth look at what could be done for other small businesses throughout the county.
Following further discussion regarding airport concessions and providing financial relief, Vice Chairman Diaz asked to be listed as a co-sponsor to the foregoing proposed resolution.
Commissioner Gilbert noted he was in support of the foregoing proposed resolution and asked to be listed as a co-sponsor.
Chairwoman Sosa relinquished the chair.
Commissioner Garcia asked that the Administration construct a plan to ensure financial relief was extended to all small businesses within the community, not only airport concessionaires.

Chairwoman Sosa retained the Chair.
Commissioner McGhee explained the intent of the foregoing proposed resolution and provided details regarding the �Save Charlie Act�, which would established the Miami-Dade County �no-kill� animal shelter policy; he urged the Board to support the foregoing proposed resolution.
Commissioner Heyman noted the Board had already voted to bring the animal shelter to 90% no kill, and inquired how this ordinance was different from the original resolution the Board had previously voted on.
Responding to Commissioner Heyman�s inquiry, Mr. Alex Munoz, Director, Animal Services Department, explained that the original resolution enacted programs that prevented 97% of dogs from being euthanized and overall 93% of animals were not euthanized. He indicated the first resolution also prevented animals from being euthanized due to breed, age, treatable medical conditions or if the animal could be placed in a home/adopted. Mr. Munoz explained, the foregoing proposed resolution detailed medicinal treatments, veterinarian practices and included state statues regarding animal cruelty. He noted this resolution had a more specific approach to animal care.
Commissioner Heyman expressed her concern regarding Miami-Dade County being the only county in the State of Florida that had a ban on Pit Bulls. She noted this was a problem with the owner, not the specific breed of dog; this prohibition prevented Miami-Dade County from being equal with to other counties animal services and shelters.
Vice Chairman Diaz clarified that Miami-Dade County was and has been a no-kill county since 2015, and that this proposed resolution improved the current resolution.
Commissioner Regalado concurred with Commissioner Heyman regarding the prohibition on Pit Bulls, noting she felt it was time to revisit this legislation and make a decision based on data rather than the emotions of people that did not like that breed of dog.
Mr. Munoz clarified that Pit Bulls were not euthanized at Miami-Dade Animal Services, noting these dogs were taken to other cities to be adopted.
Hearing no further questions or comments, the Board proceeded to vote on the foregoing resolution.

Discussion ensued between Commissioner Regalado and Chairwoman Sosa regarding whether or not Sunshine meetings or a discussion should be held regarding legislative priorities. Following this discussion Chairwoman Sosa suggested Commissioner Regalado meet with Assistant County Attorney Jess McCarty to inquire about the legislative priorities; she also recommended this item be carried over to Thursday�s (12/17) meeting.
Chairwoman Sosa indicated she would have her staff to distribute a list off all resolution and ordinances relating to the legislative priorities to each Commissioner, and Attorney McCarthy could answer any inquiries.
Chairwoman Sosa recessed the Board of County Commissioners (BCC) Meeting held on December 15, 2020, and reconvened a Carry over Board of County Commissoners meeting on Thursday December 17, 2020 to consider the foregoing item.
The foregoing resolution was amended to waive Resolution 764-13 which limits Legislative Priorities to ten and incorporate the final thirteen priorities read into the record.
The Board by motion duly made, seconded and carried, adopted the foregoing proposed resolution as amended to include all thirteen 2021 Legislative Priorities.

County Attorney Geri Bonzon-Keenan read the following amendment into the record:
-to direct the County Mayor to work together with the Public Health Trust and evaluate all available FDA authorized diagnostic tests for self-testing at home with rapid results.
Chairwoman Sosa suggested also amending the resolution to utilize any available left-over Coronavirus Aid, Relief, and Economic Security (CARES) Act funding to purchase rapid results testing kits.
Commissioner Cohen Higgins made a motion to amend the foregoing resolution to include Coronavirus Aid, Relief, and Economic Security (CARES) Act funding as avialble.

1). Commissioner Heyman made a motion notwithstanding the provisions of Resolution No. R-1158-20, that the county afford Nanobiosym Diagnostics, Inc. as much time as necessary to finalize an agreement and expend any funds made available in Resolution No. R-1161-20 through the Coronavirus Aid, Relief, and Economic Security (CARES) Act fund before the December 30, 2020 deadline imposed by the CARES Act.

2). Chairman Elect Diaz requested the removal of items from committee to assign items to the appropriate committee during the transition to a new committee structure. Commissioner Diaz made a motion, pursuant to rule 7.01 (O) to suspend the rules to allow, him when he assumes the role as Chairman, effective January 1, 2021 to:
~Remove from committee any item that has not been laid on the table and has been considered by the committee to which the item was referred or has been scheduled for a public hearing before the committee and;
~place the item on another committee agenda for consideration and where applicable, a public hearing.
3). Commissioner Regalado made a motion, notwithstanding Resolution No. R-1158-20, the county shall provide the Residential Landlord Financial Assistance Program established pursuant to Resolution No. R- 686-20 until December 30, 2020 to expend any allocated Coronavirus Aid, Relief and Economic Security (CARES) Act funds.
Commissioner Regalado�s motion was not approved.
