REPORT:
Commissioner Heyman mentioned future legislation regarding the conveyance of County owned property and asked Chairman Diaz to consider merging their items together.
In reference to the concerns raised by several Board members regarding the identity of this business owner, Ms. Tara Smith, Director, Internal Services Department, (ISD) noted her department conducted due diligence on this entity to whom the property was being conveyed. She reported the Sunbiz registration was reviewed as well as previously purchased properties for low to moderate income housing and she stated no County violations were found, therefore the entity was deemed appropriate.
Discussion ensued amongst the Board members regarding the current process for conveying County owned property, executing the reverter clause and the need for transparency relating to the principals and businesses that have been allocated county land for the development of affordable housing.
Commissioner Monestime suggested a workshop be held to discuss this issue in more detail.
Commissioner Sosa asked for legislation regarding background information on companies doing business with the County.
Commissioner Regalado requested the County Attorney�s office provide information on the amount of lots conveyed, the development timeline, impact on the market, the length of time the owner retained the property and how often the reverter clause was executed. She opined the Board should have a broader conversation about the County�s affordable housing plan and take a more comprehensive and pragmatic approach moving forward.
Commissioner Gilbert remarked the allocation of property should align with the goals of the County and the specific city or municipality to ensure the development was appropriate for the area.
In reference to the question asked regarding the definition of development in relation to the reverter clause; Assistant County Attorney Terrence Smith advised the Board the deed stated the developer must develop the property with a single family home and obtain a certificate of occupancy within two years and he clarified enforcement of the reverter clause was at the sole discretion of the County due to varying factors such as leans or other encumbrances on the property that the County may not want to inherit. He reported the deed was crafted to allow the County Mayor or designee the option to exercise the reversionary clause upon the completion of due diligence.
Chairman Diaz indicated it was not the intent of the Board to give away County owned property in mass numbers. He announced a workshop would be held on this matter and asked Mr. Michael Liu, Director, Public Housing and Community Development Department, to provide the Board members with information from the last 10 years regarding the amount of property transferred and to whom, and he asked his colleagues to submit to any other requested information to Mr. Liu�s office.
Commissioner Monestime stated he looked forward to working with the other members of this Public Housing and Community Services committee to ensure the best use of County assets and to prevent the conveyance of properties to the wrong entities. He also noted he would utilize the Office of Policy and Budgetary Affairs as well as the Commission Auditor�s Office to conduct additional research on these items.

DISCUSSION ITEM REGARDING EXCESSIVE DELIVERY APPLICATION COMMISSION FEES BEING CHARGED TO OUR LOCAL INDEPENDENT RESTAURANTS

REPORT:
Commissioner Monestime announced the purpose of this discussion item was to bring awareness to the Board regarding the excessive delivery fees imposed upon local independent restaurants by delivery services apps such as Uber Eats, DoorDash and Grubhub. He asked for his colleagues support to draft a resolution requesting the State of Florida lift the preemption relating to delivery fees and alleviate the burden on small businesses.
Commissioner Monestime mentioned other cities such as Los Angeles, New York, Seattle and St. Louis have passed legislation to keep delivery service fees between ten and twenty percent and he would like for the Board to also consider capping delivery service fees.
Mr. Jeremy Miller, 1200 West Avenue, #1201 Miami Beach, appeared before the Board representing Yardbird South Beach and provided information regarding third-party delivery service companies and how it affected the restaurant industry. He declared if the delivery service fees were not capped, many restaurants would not be able to survive during this pandemic.
Chairman Diaz announced this item would be discussed in the future and stated a Sunshine meeting had been scheduled with Mayor Daniella Levine Cava to discuss various pandemic issues.

REPORT:
Discussion was held amongst the Board members regarding the expenditure requests listed in Items 8F6, 8F9 and 8F11 and concern for the financial welfare of the County due to the many expenses incurred as a result of the Coronavirus 2019 (COVID-19) pandemic. A suggestion was made to defer these items to allow the department an opportunity to provide the Board with additional details including the funding sources and budget allocations.
In reference to the questions raised concerning the amount of money paid for furnishings and vehicles, Ms. Jennifer Moon, Chief, Office of Policy and Budgetary Affairs explained the previous Board requested these items be brought for review on an annual basis. She communicated the items listed as furnishings, furniture, or fixtures were not solely furniture, but also included interior equipment required for new facilities. Ms. Moon added that five years ago the fleet vehicles were in dire conditions and it was more cost effective to purchase vehicles through the developed purchasing program which included financing. She reported the amounts shown were not being paid on an annual basis, but was the total price as listed in the budget. Ms. Moon advised the Board additional information would be provided in the future, but pointed out these items were funded in a very efficient and economical way in order to continue conducting business and providing services in County facilities.
Further discussion ensued about the importance of having safe vehicles in the fleet, the budget process, and recommendations for the Board to review these matters in a comprehensive manner. During the discussion, a motion was made to defer and bifurcate certain departments due to the importance of moving forward with those purchases.
Mayor Levine Cava stated she was not opposed to the deferral, but requested an exception be made for the Police, Fire, and Solid Waste vehicles due to the urgent nature. She reassured the Board detailed information would be provided in the future.
County Attorney Bonzon-Keenan clarified Items 8F6, 8F9 and 8F11 would be bi-furcated and adopted, as amended, to approve, the Police, Fire, Solid Waste, Airport and Seaport departments and all other remaining departments be deferred to the February 2, 2021, Board of County Commissioners meeting.

REPORT:
Commissioner Monestime asserted illegal dumping of materials was a serious issue that created a wide range of County problems, noting the illegal dumping signs also contributed to the slum in the neighborhood. He stated this resolution would replace the no dumping signs with the planting of trees and shrubs on the County right of way in an effort to eliminate illegal dumping and illegal parking of vehicles. Commissioner Monestime commented the planting of trees would help to enhance the natural beauty and aesthetics of the neighborhood, while meeting the County�s goal of one million trees planted.
Extensive discussion was held concerning the pilot program not being inclusive of all thirteen districts and the appropriate distribution of funding.
Commissioner Monestime pointed out that all districts were not created equal and noted certain districts, experienced a higher amount of illegal dumping which contributed to the devaluing of the surrounding neighborhoods.
Several Board members agreed with the sentiments made by Commissioner Monestime and added specially the poor, forgotten areas with lower property values, no commercial stability and lack of development suffered higher levels of illegal dumping.
Commissioner Monestime accepted the amendments offered by Commissioners Sosa and Regalado to ensure that appropriate native trees would be planted in the proper areas, to allow the non-participating districts flexibility in reference to donations, and to provide information regarding alternatives to signage in right of ways without incurring additional financial impacts.
Commissioner Souto requested a Sunshine meeting with the Parks, Solid Waste and Public Works department to address this problem.
Commissioner Sosa asked the department to provide information regarding the funding to ensure it was being distributed equitably among all of the districts.
Mayor Daniella Levine Cava stated she would acknowledge a directive to provide the Board with an analysis of different options for expanding the administration�s ability to address this ongoing issue.

REPORT:
Commissioner Cohen Higgins commented that since March 2020 essential workers have been highly exposed, and announced this item requested Governor Ron DeSantis to prioritize teachers, law enforcement officers and other frontline workers in the next round of vaccinations. She announced hotel and restaurant workers were not included at this time, but informed the Board future legislation would include additional essential frontline workers.
Commissioner Regalado suggested in order to shift from the age group and to submit a more comprehensive item to the Governor, she opined the hotel and restaurant workers should be included.
Commissioner Garcia mentioned the vulnerability of the home health aides who were also being excluded and asked to include this population for the next round of vaccines.
Commissioner Higgins commented the hotel and restaurant workers were the driving force for the South Florida economic tourism industry and agreed they should be prioritized for the next round of vaccines.
Commissioner Heyman added the Board should focus on the frontline workers that were essential to Miami-Dade County and the economy; and opined the hotel, restaurant and transportation industry should be included.

Commissioner Higgins indicated this item would provide assistance to people who were not able to pay their fines or fees due to the Coronavirus 2019 pandemic (COVID-19).
Commissioner Regalado mentioned the �Operation Green Light� program, of which she stated assisted with the reduction or suspension of fees. She opined the notice requirement was a factor concerning license suspensions and alluded to future legislation to address this matter.

REPORT:
An amendment was read into the record by Commissioner Regalado as follows: in the �whereas clause�; whereas August 2020, odyssey was modified to separate residential and commercial eviction filings and as a result, odyssey has been able to ascertain that from September 1, 2020 to January 7, 2021, there were approximately 4,893 residential evictions filed and between March 13, 2020 and January 7, 2021, there were approximately 7,793 residential and non-residential evictions filed.
Commissioner Regalado stated using the additional data moving forward would help the Board to make decisions and to create programming that would be tied to the direct need as identified through this system.

A motion was made at the January 20, 2021 Board meeting by Commissioner Sosa that the 2021 Board of County Commissioners (BCC) calendar be amended to reschedule the Tuesday, February 16, 2021 regular meeting to Wednesday, February 17, 2021 at 9:30 a.m. and to also reschedule the Zoning and CDMP meeting previously scheduled for Wednesday, February 17, 2021 to Thursday February 18, 2021 at 9:30 a.m.
This motion was seconded by Commissioner Gilbert and upon being put to a vote, the item passed by a vote of 13-0.
During today's (1/21) carryover meeting, County Attorney Geri Bonzon-Keenan announced Commissioner Martinez requested the Board suspend the rule requiring committee review to further amend Item 15B1 to reflect the public hearing and second ordinance for Item 4A, Legislative File No. 210033, be held at the February 2nd , 2021 Board of County Commissioners meeting.
