  REPORT: Prior to the roll call, Deputy Clerk Kerry Khunjar Breakenridge announced that the Clerk�s Office had received notice that Chairman Gilbert III, and Commissioners Bermudez and Gonzalez would be absent from today�s (9/25) Comprehensive Development Master Plan (CDMP) and Zoning meeting.

Vice Chairman Gilbert Rodriguez convened the CDMP and Zoning meeting at 9:50 a.m., with a prayer led by Commissioner McGhee, followed by the Pledge of Allegiance.

In addition to the Board members, the following staff members were present:

SETTING OF THE AGENDA

Assistant County Attorney (ACA) James �Eddie� Kirtley, Jr. noted that there were no changes to today�s (9/25) CDMP and Zoning agenda, and advised that a motion to set the agenda was in order.

It was moved by Commissioner Cohen Higgins to approve today�s (9/25) CDMP and Zoning agenda, as presented. This motion was seconded by Commissioner Regalado, and upon being put to a vote, passed by a vote of 8-0 (Chairman Gilbert III, and Commissioners Bermudez, Cabrera, Gonzalez, and Higgins were absent).

Mr. Eric Silva, Assistant Director, Development Services, Department of Regulatory and Economic Resources (RER), presented the statutory statement, announcing that, in accordance with the Code of Miami-Dade, County all items to be heard today (9/25) were legally advertised, notices were mailed, and the properties were posted. He stated into the record the parliamentary procedures to be followed during today�s (9/25) CDMP and Zoning hearing, noting additional copies of the agenda were available in the Commission Chambers.

Mr. Eric Silva, Assistant Director, Department of Regulatory and Economic Resources (RER), read into the record the title of the foregoing application, noting there were no protests and 25 waivers of support filed.

Vice Chairman Rodriguez opened the public hearing; and seeing no one appearing wishing to speak, closed the public hearing.

Ms. Milagros Pedraza, applicant, (with the aid of a translator), stated that she had been requesting a permit for two (2) years to address staff�s concerns, and noted that she needed additional time to rectify the violation. She emphasized that she was willing to do whatever necessary to close the case.

Commissioner Hardemon asked whether the matter had been heard by the Community Zoning Appeals Board (CZAB).

Mr. Silva stated that matter was not heard because the CZAB 8 could not convene due to a lack of quorum. He advised that CZAB 8 now had enough
members to meet quorum therefore the Board could return the matter to CZAB 8 to be considered.

There being no other comments or objections, Commissioner Hardemon motioned for the application to be referred back to the Community Zoning Appeals Board (CZAB) 8. This motion was seconded by Commissioner McGhee, and upon being put to a vote, passed by a vote of 10-0 (Chairman Gilbert III, Commissioners Bermudez and Gonzalez were absent).


1B (ZONING APPLICATION NO. Z202200309)
Mr. Eric Silva, Assistant Director, Department of Regulatory and Economic Resources (RER), announced that the applicant was seeking a deferral and noted the applicant�s deferral request had been forwarded to the Board.

Ms. Melissa Tapanes Llahues, Bercow Radel Fernandez Larkin Tapanes, 200 S. Biscayne Boulevard, Miami, Florida, appeared on behalf of the applicant, 97 & 114 LLC, ET. AL., and requested a deferral to allow the applicant to meet with the surrounding neighbors. She noted that the applicant was able to garner support from the neighbors immediately abutting the subject property, and explained that more time was needed for the neighboring residents to review the new Declaration of Restrictions and resolve any issues.

Commissioner Regalado stressed the importance of the applicant meeting with residents to address their concerns and agreed to grant the applicant one (1) last deferral.

Discussion ensued between Commissioner Cohen Higgins and Assistant County Attorney (ACA) Abbie Schwaderer Raurell regarding the rules related to allowing a resident to speak without opening the public hearing.

Vice Chairman Rodriguez stated that the Board was not considering the application therefore no comments would be heard.

There being no other comments or objections, Commissioner Regalado moved to defer the item to the December 19, 2024 Zoning meeting. This motion was seconded by Commissioner Bastien, and upon being put to a vote, passed by a vote of 9-0 (Chairman Gilbert III, Commissioners Bermudez, Gonzalez, and Higgins, were absent).

1C ( ZONING APPLICATION NO. Z2023000155)
Mr. Eric Silva, Assistant Director, Department of Regulatory and Economic Resources (RER), read into the record the title of the foregoing application, noting there were no protests or waivers filed. He advised that the application was considered at the last Zoning meeting (7/17) and since then the applicant had submitted corrected plans with the appropriate sidewalk width, therefore the applicant was now withdrawing that request (request no. 3) from the application.

Vice Chairman Rodriguez opened the public hearing; and seeing no one appearing wishing to speak, closed the public hearing.

There being no comments or objections, Commissioner McGhee moved to approve the foregoing application per staff recommendation. This motion was seconded by Commissioner Higgins, and upon being put to a vote, passed by a vote of 10-0 (Chairman Gilbert III, Commissioners Bermudez and Gonzalez were absent).

The foregoing resolution was subsequently adopted by the Board and set forth in the Record of Resolutions and assigned Zoning Resolution Number Z-44-24.


3A (ZONING APPLICATION NO. Z2023000342)
Mr. Eric Silva, Assistant Director, Department of Regulatory and Economic Resources (RER), read into the record the title of the foregoing application, noting there were no protests or waivers filed. He announced the applicant was requesting a deferral to no date certain.

Mr. Steve Blazekovic, Principal Officer, Neighborhood Housing Foundation, Inc., applicant, stated that he was requesting an indefinite deferral to explore the option of adding additional land to the subject property.

Commissioner Bastien thanked the applicant for producing affordable housing for the neighborhood, and asked the applicant to consider including additional units. She urged the applicant to reach out to more residents via flyers and door-to-door outreach to receive increased community input on the development.

There being no other comments or objections, it was moved by Commissioner Bastien to defer the foregoing application to no date certain. This motion was seconded by Commissioner Cohen Higgins, and upon being put to a vote, passed by a vote of 9-0 (Commissioners Bermudez, Gonzalez, Higgins, and Chairman Gilbert III were absent).


3B (ZONING APPLICATION NO. Z2023000404)
Mr. Eric Silva, Assistant Director, Department of Regulatory and Economic Resources (RER), read into the record the title of the foregoing application, noting there were no protests or waivers filed. He advised that the a packet including the new covenant and memoranda from the Department of Transportation and Public Works (DTPW), and Miami-Dade Police Department (MDPD) had been distributed to the Board.

Vice Chairman Rodriguez opened the public hearing, and the following individual appeared before the Board:

Mr. Jorge Luis Negrin, 218 SE 14 Street, Miami, Florida, expressed concerns that the Board was considering approving Metrorail and Metromover services that would pass through 14 Street and around Brickell Bay Drive. He stated that he did not receive any notification regarding this change, and opposed the item.

There being no one else appearing to speak, Vice Chairman Rodriguez closed the public hearing.

Mr. Jorge Navarro, Greenberg Traurig, 333 SE 2 Avenue Suite 4400, Miami, Florida, appeared on behalf of the applicant, SW 1015 1st Ave Property, LLC. He stated that the applicant was working closely with staff on the development�s public benefits component and other traffic and transit improvements in the area. Mr. Navarro requested a deferral to the October meeting to address the off-site improvements.

Addressing the speaker�s concerns, Commissioner Higgins clarified that the Metromover and the Metrorail would not pass through 14th Street, and emphasized that the Brickell routes would remain the same.

Commissioner Higgins noted that staff had surveyed the property to assess pedestrian and traffic impacts and asked the applicant to review the parking spaces along 1st Avenue to determine how the space could be reutilized to ensure the sidewalk width was more than six (6) feet.

Commissioner Higgins referenced the proffered Declaration of Restrictions and requested clarification regarding the language contained in Section 1.

Mr. Navarro acknowledged Commissioner Higgins� comments regarding the need to expand the width of the sidewalks and assured the Board members that the applicant would look into the parking spaces referenced by Commissioner Higgins.

Addressing the proffered covenant language, Mr. Navarro explained the language was intended to capture the applicant�s monetary contribution to transit which was increased from $350,000 to $575,000 to effectuate a self-imposed cost-sharing element to contribute towards signalization improvements in the area. He recognized the unique nature of the language and noted that the applicant would meet with staff to finalize.

Commissioner Higgins recognized the merits of the design but emphasized the need for more communal benefits since the development would place additional burden on the current transit system and impact pedestrian traffic.

There being no other comments or objections, Commissioner Higgins moved to defer the foregoing item to the October 23, 2024 Zoning meeting to allow the applicant time to meet with staff to discuss off-site improvements. This motion was seconded by Commissioner McGhee, and upon being put to a vote, passed by a vote of 10-0 (Chairman Gilbert III, Commissioners Bermudez and Gonzalez were absent).


3C (ZONING APPLICATION NO. Z2023000423)
Mr. Eric Silva, Assistant Director, Department of Regulatory and Economic Resources (RER), read into the record the title of the foregoing application, noting there were no protests or waivers filed.

Vice Chairman Rodriguez opened the public hearing; and seeing no one appearing wishing to speak, closed the public hearing.

Mr. Neisen O. Kasdin, Akerman LLP, 98 SE 7 Street Suite 1100, Miami, Florida, appeared on behalf of the applicant, 848 Brickell LLC, and with the aid of a PowerPoint presentation provided a brief overview of the application highlighting the following:

Mr. Kasdin noted that the Zoning legend contained a scrivener�s error and stated references to �restaurant space� should read �retail and restaurant space.�

Commissioner Higgins stated that while she recognized the merits of the proposed development, she was not prepared to approve the application today (9/25). She advised that the Board had approved an application for a Dolce & Gabbana residential building that was located adjacent to the subject property, which included a parking garage and stated she was concerned that this may interfere with the applicant�s proposal to provide 1,000 parking spaces on the same block.

Commissioner Higgins noted that the proposed development would add 600 peak trips per hour as opposed to the estimated 100 trips added by the adjacent residential building. She urged the applicant to meet with the adjacent property to discuss a parking solution that would benefit all parties involved. Commissioner Higgins commended the pedestrian-friendly design of the proposed development, but voiced her concerns regarding the lack of communal benefits. She contended the $500,000 contribution to transit improvements was insufficient given the development�s claims that the building would house a substantial number of employees.

Commissioner Higgins emphasized that the adjacent property was three (3) times smaller than the foregoing proposed development, yet the adjacent property included more communal benefits. She noted that more information regarding Uber and Lyft drop-offs plans was needed by staff, and reiterated her request for the applicant to meet with the adjacent property to discuss traffic flow.

In response to Commissioner Higgins concerns, Mr. Kasdin clarified that the proposed development was a commercial building and not residential. He stated that the applicant had taken the adjacent property (888 Brickell Avenue) into consideration, and noted that the neighboring property utilized 10th Street to provide entrance and exit access for all residents, visitors and guests. Mr. Kasdin further explained that the alleyway between the subject property and the 888 Brickell Avenue property was not currently being used, and noted the applicant planned to use this alleyway as well as access on Brickell Avenue to provide egress and ingress for the proposed development.

Commissioner Higgins reiterated her intent to defer the foregoing application so that the applicant could meet with staff regarding the community benefits and to provide her with the additional information regarding the project�s traffic flow plans including Uber and Lyft drop-off.

There being no other comments or objections, Commissioner Higgins moved to defer the foregoing item to the October 23, 2024 Zoning This motion was seconded by Commissioner McGhee, and upon being put to a vote, passed by a vote of 10-0 (Chairman Gilbert III, Commissioners Bermudez and Gonzalez were absent).

3D (ZONING APPLICATION NO Z202300045)
Vice Chairman Rodriguez introduced the foregoing application along with the concurrent Comprehensive Development Master Plan (CDMP) application (CDMP Agenda Item 3B, CDMP Application No. CDMP20230023).
