ACA James �Eddie� Kirtley, Jr. noted that there were no changes to today�s CDMP and Zoning agenda, and advised that a motion to set the agenda was in order.

Commissioner Cohen Higgins moved to approve the agenda, as presented. This motion was seconded by Commissioner Bastien, and upon being put to a vote, passed 7-0 (Chairman Gilbert III, Senator Garcia, and Commissioners Gonzalez, Hardemon, Regalado and McGhee were absent).

Mr. Eric Silva presented the statutory statement, announcing that, in accordance with the Code of Miami-Dade, County all items to be heard today were legally advertised, notices were mailed, and the properties were posted. He stated into the record the parliamentary procedures to be followed during today�s Zoning hearing, noting additional copies of the agenda were available in the Commission Chambers.

  REPORT: ACA Kirtley, Jr. read the title of the foregoing proposed application into the record, and noted a concurrent Zoning application - Z2023000445, Zoning Agenda Item 8A4. He explained that the applications would be considered concurrently, with a single public hearing in accordance with the procedures applicable to quasi-judicial applications, with all speakers sworn in prior to addressing the Board and that all public hearing testimony would be transcribed and incorporated into the Zoning record.

Vice Chairman Rodriguez opened the public hearing, and the following individuals appeared before the Board in opposition:

Seeing no one else come forward to speak, Vice
Chairman Rodriguez closed the reasonable opportunity to be heard.

Mr. Hugo Arza, Holland & Knight, 701 Brickell Avenue Suite 3300, Miami, Florida, appeared on behalf of the applicant, South Dixie 29, LLC ET AL and South Dixie Land, LLC. He addressed the comments made by the speakers, clarifying a site plan with staff's recommendation for approval at 600 units was filed a year ago. He noted following community input and the prior month's deferral, the applicant had revised the proposal to include townhomes on the western portion and reduced the unit count to 500 units (approximately 17% reduction), with these modifications incorporated into the project covenant.
Mr. Arza explained that the application included a comprehensive site plan and noted that the proposed four-story buildings adjacent to the orchid nursery would be replaced with two-story townhomes to address shading impacts.

Mr. Arza clarified the covenant deletion. He emphasized the project provided 12.5% workforce housing and highlighted the property's unique opportunity with 18 acres and 1,850 feet of busway frontage (about one-third mile), which he believed was unmatched in the south corridor.

Commissioner Cohen Higgins thanked residents and applicant for their collaborative approach, noting it was unusual to hear residents praise a developer's accessibility. She acknowledged the substantial differences in content and community relations between the foregoing application and the one presented three years prior.

Responding to Commissioner Cohen Higgins� question regarding the site plan, Mr. Silva confirmed receipt of the original site plan and a new plan showing the four-story apartment building replacement with townhomes, noting a full set of plans would be submitted within 30 days.

Commissioner Cohen Higgins inquired about homeownership opportunities.

Mr. Arza explained that while the project was originally planned as a rental community, the applicant intended to subdivide townhome portions to preserve fee simple sale options, potentially offering rental townhomes for residents needing space but unable to purchase immediately, while designing for eventual sale capability.

Commissioner Cohen Higgins highlighted that the property�s large frontage was near the busway, and inquired if there were any access points to the South Dade trail along the south end of the development.

Regarding South Dade Trail access, Mr. Arza explained no mid-block crossing would be provided for safety, but residents could access sidewalks leading to safe crossing points at the north end. He emphasized additional commitments to work with neighbors on focal points at the southwest corner and 280th Street entrances to develop distinctive architectural and landscape elements in lieu of basic landscaping.

Commissioner Cohen Higgins acknowledged the applicant's design commitments and stressed that representations made during the public hearing would be monitored for compliance by her office.

Commissioner Higgins requested that staff locate the roads still labelled as �South/Old Dixie� and rename them properly to �Harriet Tubman Highway,� where legally permissible.

Commissioner Cohen Higgins noted that while the application properly referenced "Harriet Tubman Highway," residents sometimes used former names out of habit.

ACA Kirtley, Jr. clarified the vote taken at this juncture applied only to the CDMP component.

There being no further comments or objections, the Board voted to adopt the foregoing application per staff�s recommendation with acceptance of the proffered covenant. The accompanying proposed resolution (Agenda Item 3A1) to transmit, was deemed withdrawn.

  REPORT: Mr. Silva read the title of the foregoing application into the record, noting 220 protests and 158 waivers of support. He explained that these protests and waivers were filed prior to the January 2023 Community Zoning Appeals Board (CZAB) appeal consideration and advised that since the Board had previously heard the application, the Board�s approval was required for the applicant's withdrawal request.

Vice Chairman Rodriguez advised that while several speakers had registered for the item, given the withdrawal request, public testimony would not be taken unless there were objections from the registered speakers. No objections were raised.

Mr. Ben J. Fernandez, Bercow Radell Fernandez Larkin & Tapanes, 200 South Biscayne Boulevard, Miami, Florida, appeared on behalf of the applicant and requested withdrawal of the application.

Commissioner Cohen Higgins supported the withdrawal request, and thanked the residents for attending today�s meeting to voice their concerns. She noted that a substantially different application would be submitted with hopes for continued applicant-community collaboration.

ACA Schwaderer Raurell explained the Board's withdrawal options: to withdraw with prejudice (18-month waiting period), to withdraw without prejudice (6-month waiting period), or to withdraw without prejudice and provide another timeframe for good cause.

Commissioner Cohen Higgins advised that she would follow staff�s recommendation which was to withdraw the application without prejudice with a six (6) month waiting period.

Mr. Silva advised that the applicant had requested a waiver of the waiting period, which staff supported given that 20 months had already elapsed since the BCC hearing and the applicant's efforts to acquire additional land for neighborhood compatibility.

Mr. Fernandez stated that the applicant had been in communication with Mr. Tucker Gibbs, P.A., who represented the community. He requested the Board to approve the waiver to allow for a three (3) waiting period to submit a new plan for the neighbors to review.

Mr. Tucker Gibbs, P.A., 3835 Utopia Court, Coconut Grove, Florida, representing affected neighbors, confirmed the three-month agreement and sought confirmation that any new application would be brought as a zoning application requiring the complete process including community council review.

Commissioner Cohen Higgins confirmed that the application would be considered a new application, and would require it to start the process from the beginning.

There being no further comments or objections, the Board approved the applicant�s request to withdraw the foregoing proposed application without prejudice, and approved the three (3) month waiting period before the applicant could resubmit another application.

The foregoing resolution was subsequently assigned Zoning Resolution Number Z-45-24.

Vice Chairman Rodriguez announced that there would be no public hearing for this application because the public hearing was heard at a previous meeting.

Commissioner Higgins expressed concerns about lack of follow-up documentation from the previous September 25th meeting. She reiterated requests for the traffic coordination with the neighboring 888 building, pedestrian street flow solutions, and noted the public benefits contribution was not comparable to neighboring properties. Commissioner Higgins compared community benefit contributions, noting that a less dense residential project provided over $3 million in combined workforce housing and transit improvements, while the adjacent 888 Brickell project on a smaller lot contributed $1.5 million in transit improvements. She expressed concern about approving a 50-story, 1,000-car garage development with an initial community benefit offer of only $500,000.

Mr. Dennis Kerbel, Akerman, LLP., 98 Southeast Seventh Street, Miami, Florida, appeared on behalf of the applicant, 848 Brickell, LLC., with partners Nathan Kazdan and Ben Hedrick, Colin Gorsuch (Vice President), architect Greg Smith (Skidmore, Owings and Merrill), and traffic engineer Maximo Polanco (Langan). He explained that traffic engineers from both 848 and 888 Brickell had coordinated on circulation issues and note that the project�s garage design eliminated ground-floor security gates to prevent vehicle queuing concerns. Mr. Kerbel stated the applicant was prepared to submit a revised covenant specifying improvements and believed the $1.1 million contribution to identified improvements, combined with economic benefits from office development and job creation, provided significant public benefits.

In response to Commissioner Higgins inquiry about a revised declarations of restrictions., Mr. Silva confirmed distribution of the revised declarations showing the $1.1 million increase from $500,000 but noted these included cost calculations rather than the construction improvements requested by Department of Transportation and Public Works.

Commissioner Higgins reviewed the revised document noting concerns that $600,000 for items like stamping crosswalks did not constitute meaningful public benefits as these were considered standard construction practices. She stressed the need for written coordination plans, noting the buildings would effectively become one city block requiring comprehensive planning. Commissioner Higgins highlighted the County's stricter traffic management requirements compared to City of Miami.

Mr. Kerbel outlined the division of improvement responsibilities between the two projects which included the following:
- The 848 Brickell development would be responsible for pedestrian enhancements along Brickell Plaza, sidewalk improvements on Southeast 10th Street from Diagio Las Americas to Brickell Plaza, and traffic signal analysis and installation at the Brickell Plaza and 10th Street intersection.
- The 888 Brickell project would handle pedestrian improvements at Brickell Avenue and Southeast 10th Street, sidewalk enhancements along Southeast 10th Street east of the alley to Brickell Avenue, and signal analysis and installation at the Southeast 10th Street and South Miami Avenue intersection.

Commissioner Hardemon commended Commissioner Higgins' advocacy for community benefits and asked when she would like the application to be deferred to.

Commissioner Higgins requested complete written traffic reports with coordination documentation, emphasizing need for advance submission for proper Board review.

Vice Chairman Rodriguez voiced his support for deferring the application while seeking clarification about whether promised documentation had been provided to staff.

Mr. Kerbel acknowledged that the applicant had misunderstood Commissioner Higgins' requirements, believing she wanted oral explanations during the hearing rather than comprehensive written documentation submitted in advance, and committed to providing the requested materials.

Mr. Silva emphasized the need for construction improvement documentation beyond cost calculations, requesting all materials within one week.

Commissioner Higgins asked whether the PowerPoint presentation had been uploaded to the official record for her review.

ACA Schwaderer Raurell confirmed that the presentation was available in the record and clarified Commissioner Higgins' requirements for written coordination documentation with the 888 Brickell project should be submitted to the Zoning Director in advance for Board distribution and review.

Mr. Silva requested the documentation be submitted to the administration within a week.

Mr. Kerbel requested that the applicant be allowed to make financial contributions for the required improvements rather than undertake direct construction, citing the complex permitting process that would involve coordination with both Miami-Dade County and City of Miami jurisdictions for off-site improvements.

Commissioner Higgins referenced a previously approved application from earlier in the meeting, noting that the applicants had committed to performing the actual street improvements and construction work, and stated she expected the same standard of commitment from this applicant.

There being no other comments or objections, the Board voted to defer the foregoing application to the November 21, 2024 CDMP and Zoning meeting, with a requirement that the requested documents be submitted by the applicant within a week.

Mr. Jorge Navarro, Greenberg Traurig, 333 SE 2 Avenue Suite 4400, Miami, Florida, appeared before the Board on behalf of the applicant, Jamestown CCP, LP., and explained that the applicant wanted to enhance and beautify the existing Country Club Shopping Plaza, which would include landscaping and parking upgrades.

Senator (Sen.) Garcia asked for further explanation regarding the greenery enhancements.

Mr. Navarro stated that the shopping center had not been remodeled for years, and now the applicant was working with the Publix and CVS on the parcel to move tenants and reconfigure the building space. He noted that there was a vacant gas station on the parcel that the CVS wanted to use as a drive through for their pharmacy needs. Mr. Navarro stated that the main improvements would include a net gain of 5,000 square feet, which would not affect the current number of parking spaces.

Sen. Garcia stated that landscaping was important to the administration, and inquired about what type of trees would be planted.

Mr. Navarro stated that the applicant would add an estimate of 189 trees.

Vice Chairman Rodriguez asked if the trees would be acquired locally.

In response to Vice Chairman Rodriguez, Mr. Navarro was unsure about the type of trees that would be planted and where they would be sourced from.

Sen. Garcia emphasized that the trees should be sourced locally, and that the applicant would need to provide landscaping that was in compliance with the County�s requirements.

Assistant County Attorney (ACA) Abbie Schwaderer Rauell clarified that approval of the application would include an additional reference that the new site plan would be added to the current Zoning covenant in lieu to replace the existing plan.

There being no comments or objections, the Board proceeded to approve the foregoing application, per staff�s recommendation, with the additional reference that the new site plan be added and replace the existing plan within the current Zoning covenant. The foregoing resolution was subsequently adopted by the Board and set forth in the Record of Resolutions and assigned Zoning Resolution Number Z-49-24.
