  REPORT: An attendance roll call was performed by Deputy Clerk Basia Pruna at 9:40 a.m. which established quorum for the regular Board of County Commissioners (BCC/Board) meeting. During this attendance roll call, Deputy Clerk Pruna announced that the Clerk of the Board (COB) had received notice that Commissioner Higgins and Senator Garcia would be absent from today�s meetings.

Chairman Rodriguez recessed the regular BCC and convened the Comprehensive Development Master Plan (CDMP) and Zoning meeting at 9:49 a.m.

In addition to the Board members, the following staff members were present:
~ Assistant County Attorneys (ACA) Abbie Schwaderer Raurell and James �Eddie� Kirtley, Jr.;
~ Mr. Jerry Bell, Assistant Director, Planning Division, Department of Regulatory and Economic Resources (RER);
~ Mr. Eric Silva, Assistant Director, Development Services, RER; and
~ Deputy Clerks Basia Pruna, Kerry Khunjar Breakenridge and Bryce Stephenson-Pickett, COB.

SETTING OF THE AGENDA

ACA Kirtley noted there were no changes to today�s CDMP and Zoning agenda, and advised that a motion to set the agenda was in order.
Commissioner Gilbert III moved to approve today�s CDMP and Zoning agenda, as presented. This motion was seconded by Commissioner Milian Orbis, and upon being put to a vote, passed 10-0 (Commissioners Gonzalez, Hardemon and Higgins were absent).
Mr. Eric Silva read the statutory statement into the record, announcing that, in accordance with Miami-Dade County�s Code, all items to be heard today�s meeting were legally advertised, notices mailed, with required postings at the properties. He announced the parliamentary procedures to be followed during today�s hearing, noting additional copies of the agenda were available in the Commission Chambers.

ALL WITNESSES AND OFFICIAL INTERPRETERS WERE SWORN IN BY THE CLERK PRIOR TO PRESENTING TESTIMONIES BEFORE THE BOARD.

  REPORT: ACA Kirtley read the titles of the foregoing proposed ordinance, its supplements, and the accompanying resolution (Agenda Item 3A1) into the record. He stated in the event the Board decided to take final action on the ordinance (Agenda Item 3A), the companion resolution (Agenda Item 3A1) would be deemed withdrawn. ACA Kirtley Jr. explained the foregoing application was being processed concurrently with Zoning Application Number Z2024000023 (Zoning Agenda Item 8C1) and noted a single public hearing would be conducted for both the CDMP and Zoning application. He advised that the CDMP hearing would be conducted in accordance with the procedures applicable to quasi-judicial applications, with all speakers sworn in prior to addressing the Board. ACA Kirtley Jr. further noted that all public hearing testimony would be transcribed and all exhibits submitted as part of the CDMP hearing would be incorporated into the Zoning record.

Chairman Rodriguez opened the public hearing; and seeing no one appear wishing to speak, closed the public hearing.

Vice Chairman McGhee inquired about staff recommendations.

Mr. Jerry Bell explained that staff recommended adoption with acceptance of proffered declaration of restrictions.

There being no questions or comments, the Board voted to approve the foregoing application per staff�s recommendation, with acceptance of the proffered Declaration of Restrictions; and the accompanying proposed resolution (Agenda Item 3A1) to transmit, was deemed withdrawn.

This motion was seconded by Commissioner Gilbert III, and upon being put to a vote, failed by a 6-4 (Commissioners Steinberg, Cohen Higgins, Senator Garcia and Vice Chairman McGhee voted �no�; Commissioners Gonzalez, Hardemon and Higgins were absent).

Discussion ensued among the Board members and the County Attorney�s office regarding the required number of votes for passage.

ACA Schwaderer Raurell advised that 7 votes were needed to approve the motion.

Senator Garcia moved to reconsider the foregoing application. This motion was seconded by Commissioner Steinberg; and upon being put to a vote, passed 10-0 (Commissioners Gonzalez, Hardemon and Higgins were absent).

Following motion to reconsider, Chairman Rodriguez restated his motion to reject staff�s recommendation and approve the application as originally filed with the 1:1 ratio.

There being no other questions or comments, the Board voted to reject staff�s recommendation and approve the application as presented.

She requested the Board approve the application as presented subject to the applicant�s latest declaration of restrictions and that such approval include specifically the non-use variance to waive the road dedication.

Commissioner Regalado thanked the residents for their input and recognized the applicant�s efforts to work with the residents.

Mr. Miguel Diaz De la Portilla, Attorney, Gunster Law, 600 Brickell Avenue, Miami, FL, appeared on behalf of the applicant, Garcia Carrillo 56 Street Revocable Trust; and advised that all parties involved had reached an amicable agreement which supported the application as presented. He noted since the application was an appeal of a CZAB ruling, a supermajority vote was needed.

Mr. Silva read into the record staff�s modified recommendations which included the approval of request #2, deletion of condition #5, and modification of condition #2 to delete the requirement to dedicate the road.

In response to Commissioner Regalado�s request to add the non-use variance, Mr. Silva noted that this condition was addressed under request #2.

Mr. De la Portilla further clarified that the two modifications to the non-use variance removed all requirements for a dedication. He requested the Board approve the application as presented with the proffered declaration of restrictions.

There being no comments or objections, the Board voted to approve the foregoing application per staff�s recommendation, with acceptance of the proffered Declaration of Restrictions.
