  REPORT: Chairwoman Cohen Higgins convened the Aviation and Seaport Committee (ASC) meeting at 10:32 a.m.

In addition to the Committee members, the following staff members were present:

MOTION TO SET THE AGENDA
ACA Murray advised the items to be considered at today�s meeting were those listed on the final printed agenda, with the addition of Agenda Items 1F1 and 3I as noted in the Changes Sheet. Additionally, he stated that Commissioner Gilbert III had requested to assume sponsorship of Agenda Item 3I.

Vice Chairman Gonzalez moved to approve today�s agenda, as presented. This motion was seconded by Commissioner Milan Orbis, and upon being put to a vote, passed 5-0.

Vice Chairman Gonzalez requested to bifurcate Agenda Items 3A and 3B for a floor amendment.

Commissioner Milan Orbis asked to bifurcate Agenda Item 3H, and Chairwoman Cohen Higgins bifurcated 3I.

Commissioner Milan Orbis moved to simultaneously consider the remaining Agenda Items (3C, 3D, 3E, 3F, 3G and 6A). This motion was seconded by Vice Chairman Gonzalez, and upon being put to a vote, passed 5-0.

NOTE: Agenda Items 3C, 3D, 3E, 3F, and 3G were forwarded to the Board of County Commissioners (Board) with a favorable recommendation, and Agenda Item 6A was approved.

  REPORT: Vice Chairman Gonzalez led the Pledge of Allegiance.  
1D REASONABLE OPPORTUNITY FOR THE PUBLIC TO BE HEARD AS PROVIDED IN RULE 6.06  
  REPORT: Chairwoman Cohen Higgins opened the reasonable opportunity to be heard, and the following individuals appeared before the Committee in support of Agenda Item 1F1:

1. Ms. Nora Domenigo, 21651 SW 97 Court, Cutler Bay, FL, with he aid of an interpreter, described the work performed by subcontracted aviation service workers as essential to keeping Miami International Airport (MIA) operating safely, cleanly, and efficiently. She explained that workers and local leaders had spent years building living wage standards and respectful working conditions, which had also benefited passengers and the airport by retaining experienced staff and protecting its security and reputation. She cautioned that the expiration of living wage protections now placed that progress at risk, and she identified Alliance Ground International (AG)I, a major cargo operator expanding into terminal operations, as a particular concern because it was assuming roles that workers had fought to establish as good jobs.
2. Mr. Peter Dooley, 1866 S Huron Rd, Harrisville, MI, identified himself as a certified industrial hygienist and safety professional with more than 45 years of experience working alongside Occupational Safety and Health Administration (OSHA), unions, and employers. He reported that workers had filed an OSHA complaint at MIA the previous month after management failed to address safety concerns that had been raised. He explained that AGI cargo workers performed high-risk, physically demanding duties that were critical to both worker safety and airport operations, and he noted that safety breakdowns in that environment could lead to property damage, flight delays, and broader disruptions. He outlined several hazards documented in the complaint, including workers being struck by heavy metal fasteners while handling cargo nets, injuries sustained inside aircraft from damaged pallets, and routine reliance on defective equipment with faulty brakes, missing mirrors, and vehicles that stalled on the ramp, along with one parked truck that caught fire. He characterized these conditions as systemic failures that endangered hundreds of workers daily and threatened airport operations, and he commended the workers present for their courage in coming forward.
3. Mr. Carlos Fernando Builes, 14527 SW 94 Lane, Miami, FL, stated that his work as an AGI ramp agent was physically demanding and dangerous, and that it was essential to cargo operations at the busiest airport for international freight in the country. He recounted a recent injury in which a jammed lock caused a heavy pallet to jolt back onto his foot as he loaded it, resulting in a diagnosed foot contusion that kept him out of work and without pay for two weeks. He noted that damaged and warped pallets were a recurring problem and that he and his coworkers were regularly required to operate broken or malfunctioning equipment. He added that some coworkers who spoke only Spanish received their training in English, a language they did not understand and concluded that AGI workers deserved safe conditions, proper training, and functioning equipment, and that the accident he suffered should never have occurred.
4. Mr. Wonder Myer Rodriguez, 5401 SW 7th Street, Miami, FL, with the aid of an interpreter, explained that he worked full time as an AGI ramp worker but depended on overtime pay to make ends meet. He stated that AGI calculated his overtime using a base wage of approximately seventeen dollars per hour rather than the living wage rate of roughly twenty-one dollars per hour, which caused workers to lose nearly six dollars for every overtime hour worked. He added that AGI applied the same reduced base rate to vacation pay. He echoed earlier testimony regarding faulty equipment and inadequate training, and he observed that many workers were reluctant to raise concerns for fear of retaliation or job loss.
5. Ms. Helene O�Brien, Director, 32BJ Service Employees International Union (SEIU) Florida District, 1313 NW 36 Street, Miami, FL, spoke on behalf of Mr. Pedro Fermenta, an AGI cargo worker of three years who was unable to attend. She recounted that Mr. Fermenta, together with approximately 40 coworkers, had signed a petition requesting copies of the company's accident logs, and that he had personally delivered it to AGI. She explained that three weeks later his wife became ill and was diagnosed with pancreatic cancer, and that he remained in regular contact with both his supervisor and the human resources department throughout her hospitalization while following the instructions he was given. She stated that after he requested to begin work one day later in order to accompany his wife to a follow-up appointment, AGI terminated him the following day. She urged the Committee to support his reinstatement and expressed her belief that his termination was tied to his role in delivering the petition rather than to his absence.
6. Mr. Kyle Anderson, Chief Commercial Officer, Margaritaville at Sea, 460 S Orange Avenue, Orlando, FL, spoke in support of Agenda Item 3H, expressed enthusiasm for the opportunity to home port the company's new flagship vessel, the Margaritaville at Sea Beachcomber, at Port Miami. He explained that the company had been established in 2022 in partnership with the Margaritaville hospitality brand and had grown from a single ship serving one destination into a multi-ship operation sailing to more than twenty destinations across the Caribbean and Mexico. He noted that the company had earned several industry honors, including recognition from Cruise Critic, USA Today, and Newsweek. He described the Beachcomber as the fullest expression of the brand, featuring ten dining options, twelve lounges and bars, and the first artist-curated live music venue at sea, developed in partnership with Zach Brown. He stated that the vessel would begin its inaugural sailing on January 9, 2027, offering predominantly seven-night Caribbean itineraries departing from Port Miami.

Seeing no one else come forward to speak, Chairwoman Cohen Higgins closed the reasonable opportunity to be heard.

  MIAMI INTERNATIONAL AIRPORT (MIA) - JD POWER 2025 AIRPORT STUDY AND ACCOMPLISHMENTS Presented
  REPORT: Mr. Michael Taylor, Senior Managing Director of Travel, Hospitality, Retail , and Customer Service Advisory, JD Power, appeared before the Committee to present a PowerPoint presentation regarding MIA�s North America Airport Satisfaction Study, which outlined the following:
- MIA 2026 Wave 3 Year-To-Date Key Takeaways;
- Overall Satisfaction Rank;
- Dimension Performance; and
- Terminal Spending.

Mr. Taylor concluded his presentation by commending the administration on MIA's strong performance and observed that the airport, a previous JD Power award winner, was positioned to earn that recognition again.

In response to a question regarding methodology, he explained that the results were drawn from an annual online survey of approximately 30,000 respondents who had taken a flight within the prior 30 days and were asked to identify the airports they had used.

  MIAMI-DADE BEACON COUNCIL ECONOMIC UPDATE Presented
  REPORT: Mr. Rodrick T. Miller, President and CEO, Miami-Dade Beacon Council, appeared before the Committee to present a PowerPoint presentation regarding the Miami-Dade Beacon Council�s economic update, which outlined the following:

- The Geography of Power: Global Economic Systems and Their Command Cities;
- Forces Reshaping the Global Economy;
- Cities are the New Platforms of Power;
- Miami- Global Hub with Massive Scale;

Chairwoman Cohen Higgins inquired whether Miami was already a top-five global city.

Mr. Miller stated that Miami was a growing global city but had not yet reached that tier, noting that it ranked as the seventh-largest metropolitan area in the United States and 13th in terms of economic performance.

  EMPLOYEE FACILITIES AND WORKING CONDITIONS AT MIAMI INTERNATIONAL AIRPORT Presented
  REPORT: Chairwoman Cohen Higgins provided a brief overview of the discussion item, noting that it concerned the working conditions of employees at MIA, and specifically those employed by AGI.

Mr. Cutie advised that his department had been approached approximately one and a half weeks earlier by the SEIU regarding safety concerns raised by employees. He explained that his team, together with the administration, had met to hear those concerns directly from the employees who spoke that morning.

Mr. Cutie emphasized that he and the administration took the claims very seriously and confirmed that the department was in the process of scheduling a meeting with AGI to address the concerns, several of which involved OSHA matters requiring immediate attention. He concluded by confirming that the administration had been informed and by expressing the airport's full support for the SEIU's position going forward.

Chairwoman Cohen Higgins expressed concerns for the affected employees and advised that she would bring back a follow-up discussion item in approximately three (3) months to assess the progress of the discussions with AGI. She raised the case of former AGI employee Mr. Fermenta, referenced earlier by Ms. O'Brien, and requested that, should he remain unemployed and still be seeking work, the administration work with him toward reinstatement.

Mr. Cutie confirmed that the department would follow up on that specific matter. Commissioner Gilbert III concurred with Chairwoman Cohen Higgins and emphasized that Mr. Fermenta should not remain unemployed. He indicated his preference that the AGI matter be resolved sooner than three months if possible.

Chairwoman Cohen Higgins advised that she understood Mr. Fermenta had intended to attend the meeting but had been unable to do so. Vice Chairman Gonzalez inquired whether AGI had received proper notice of the meeting.

ACA Murray confirmed that the meeting had been publicly noticed in accordance with normal procedure but stated that he had no knowledge of any notice sent directly to AGI.

Mr. Cutie further confirmed that AGI had not been directly notified, though the meeting had been publicly noticed.

  REPORT: Commissioner Milan Orbis expressed appreciation for the revenue that the proposed resolution would generate and noted that she was glad the County was bringing another cruise line into the port. She stated that, in light of the issues currently facing the port, she wished to proceed with caution, and she asked the administration whether it was advisable for the County to enter into long-term agreements and grant berthing rights to new cruise lines.

Mr. Wong explained that the barriers to entry in the cruise industry were significant and noted that the last major cruise line to begin operating at the seaport was Virgin Voyages. He advised that negotiations on the new contract had spanned nearly a year and described the agreement as notable in structure, consisting of a five-year term with two five-year renewal options. Mr. Wong stated that it was unique among the port's cruise agreements and would operate out of Terminal C.

Following a point of order, Commissioner Gilbert III restated the question, and Mr. Wong confirmed that entering into the agreement was advisable.

Commissioner Milan Orbis then asked whether he had any hesitation regarding the grant of berthing rights to a new cruise line, and Mr. Wong confirmed that he did not.

Hearing no other discussion, the Committee proceeded to vote on the foregoing resolution, as presented.

  REPORT: Chairwoman Cohen Higgins, having bifurcated the proposed resolution to question the applicant, asked whether the applicant was amenable to entering into a labor peace agreement, and whether it would do so, or at least work with the airport and the County's labor partners, before the process moved forward.

Mr. Les Pantin, Pantin Gov, appearing on behalf of the applicant, Airport Dimensions, confirmed that the applicant was amenable and indicated its willingness to work with the airport and labor partners.

Chairwoman Cohen Higgins asked the administration whether the proposed resolution needed to be amended on the record. ACA Murray advised that labor peace was a contractual requirement of the agreement, so that if the applicant was not compliant by the time of the award, it would not be awarded the agreement.

Mr. Pantin added that the applicant had submitted a letter as part of its proposal affirming that it would meet all requirements.

Commissioner Gilbert III stated that, in assuming sponsorship, he would ensure that the applicant met all requirements, and that if an agreement was not reached, he would defer the item at the commission meeting.

Hearing no other discussion the Committee proceeded to vote on the foregoing resolution, as presented.

  DISCUSSION RE: AUTONOMOUS VEHICLES AT MIA Presented
  REPORT: Chairwoman Cohen Higgins noted that the potential introduction of autonomous vehicles at MIA, while not on today�s agenda, could be placed on a future agenda for formal discussion. She expressed safety concerns related to the anticipated increase in visitor traffic and to the possibility of items being placed in vehicles operating without a driver, and asked whether the administration had a safety and security plan in place.

Mr. Cutie advised that autonomous vehicle companies would be required to obtain proper permitting before operating at MIA, as they were currently certified to operate only within the City of Miami and had not yet been certified to operate in the County or at the airport. He stated that he shared the concerns, particularly in light of the FIFA World Cup, the G20 Summit, and the upcoming holiday season, and noted that the administration was exercising considerable caution given the potential for traffic congestion.

Mr. Cutie confirmed that the administration would not permit these vehicles until its concerns were addressed, and that it had developed plans, in coordination with operations staff, to remove vehicles quickly and maintain traffic flow if necessary. He further confirmed that no autonomous vehicle service held operational certification at MIA and stated that he did not anticipate any permits being issued prior to the FIFA World Cup.

In response to Vice Chairman Gonzalez�s question as to whether any exclusivity was granted to a particular company for operating autonomous vehicles at the airport, Mr. Cutie confirmed that no exclusivity would be granted to any single company, and that while �Waymo� had approached the administration, any qualified company could operate at the airport upon obtaining the required permit.
