TITLE
ORDINANCE IMPLEMENTING THE CHARTER AMENDMENT CHANGING NAME OF DADE COUNTY TO MIAMI-DADE COUNTY AND PROVIDING SEVERABILITY, INCLUSION IN CODE AND EFFECTIVE DATE

BODY
WHEREAS, the Dade County Home Rule Amendment, Article VIII, Section 6 of the Florida Constitution granted the electors of Dade County the power to adopt and amend a home rule charter of government for Dade County, Florida, which could, among other things, change the name of Dade County; and
WHEREAS, Section 8.07 of the Home Rule Charter (hereinafter, "Charter") adopted pursuant to the foregoing Amendment provides that the Charter may be amended upon approval of a majority of the electors; and
WHEREAS, by Resolution No. R-1016-97, this Board called a special election for November 13, 1997 for the purpose of submitting to the electors of Dade County a proposal to amend the Charter by changing the name of Dade County to Miami-Dade County; and
WHEREAS, a majority of the electors voting at the special election approved the foregoing Charter amendment; and
WHEREAS, the Charter amendment provides for this Board to implement the name change by ordinance,
NOW THEREFORE BE IT ORDAINED by the Board of County Commissioners of Dade County, Florida,
Section 1. "Miami-Dade County" is hereby recognized as the official name of Dade County, Florida.
Section 2. All references to Dade County, Metropolitan Dade County or Metro-Dade County in the Florida Constitution, Florida Statutes, Code of Metropolitan Dade County, federal law, case law, court orders, codes, regulations, public records, tax and special assessment rolls, and any and all other documents, papers, letters, maps, plats, books, tapes, photographs, films, sound recordings, data processing software, or other material, regardless of the physical form, characteristics, or means of transmission, shall deemed to be references to Miami-Dade County. This ordinance, and this section, shall apply to all such references without regard to whether they precede, are contemporary with, or occur subsequent to the effective date of this ordinance.
Section 3. Except for a change in name, the County remains the same political subdivision of the State of Florida as previously for all purposes and retains all rights, privileges, immunities, obligations and claims thereof unaffected thereby.
Section 4. The change of name shall not affect the authenticity, legal validity or enforceability of any item.
Section 5. If any section, subsection, sentence, clause or provision of this ordinance is held invalid, the remainder of this ordinance shall not be affected by such invalidity.
Section 6. It is the intention of the Board of County Commissioners, and it is hereby ordained that the provisions of this ordinance shall become and be made a part of the Code of Metropolitan Dade County. The sections of this ordinance may be renumbered or relettered to accomplish such intention, and the word "ordinance" may be changed to "section," "article," or other appropriate word.
Section 7. This ordinance shall become effective ten (10) days after the date of enactment unless vetoed by the Mayor, and if vetoed, shall become effective only upon an override by this Board.
Section 8. This ordinance does not contain a sunset provision.
Section 9. The Clerk of the Board is directed to record a certified copy of this ordinance in the public records of the County.
