TITLE
RESOLUTION DELEGATING AUTHORITY TO THE COUNTY MAYOR OR COUNTY MAYOR�S DESIGNEE TO EXECUTE AND FILE PLAT OR WAIVER OF PLAT APPLICATIONS ON BEHALF OF MIAMI-DADE COUNTY FOR COUNTY-OWNED PROPERTIES UNDER THE JURISDICTION OF THE WATER AND SEWER DEPARTMENT, SUBJECT TO THE LIMITATIONS SET FORTH HEREIN

BODY
WHEREAS, Miami-Dade County, through its Water and Sewer Department (�WASD�), owns and operates various properties throughout the County for the purpose of providing essential public utility services; and

WHEREAS, in the course of development, improvement, or maintenance of these properties, it may be necessary to apply for a Plat or Waiver of Plat pursuant to Chapter 28 of the Code of Miami-Dade County; and

WHEREAS, the Board of County Commissioners (the �Board�) finds it is in the best interest of the County to delegate to the County Mayor or County Mayor�s designee the authority to execute and file such applications on behalf of the County in order to streamline the administrative process and ensure timely project delivery,

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that:

Section 1. The Board hereby delegates to the County Mayor or County Mayor�s designee the authority to execute and file Plat or Waiver of Plat applications on behalf of Miami-Dade County for County-owned properties that are under the jurisdiction of WASD.

Section 2. The delegation set forth in section 1 shall be limited to applications necessary for the development, improvement, operation, or maintenance of County-owned utility infrastructure and shall be exercised in accordance with all applicable laws, regulations, Implementing Orders, and administrative procedures. No delegation is made herein to convey fee title to County-owned property, which shall remain subject to separate Board approval.

Section 3. The County Mayor or County Mayor�s designee shall coordinate, as necessary, with the County Attorney�s Office, the Department of Regulatory and Economic Resources (RER), and any other affected County departments or agencies to ensure that applications are complete, accurate, and compliant with the applicable requirements.

STAFF RECOMMENDATION
Executive Summary
This item seeks approval from the Board of County Commissioners (the Board) to delegate limited administrative authority to the County Mayor or County Mayor�s Designee to execute and file Plat or Waiver of Plat applications. This delegation would be strictly confined to properties owned by Miami-Dade County (the County) under the control of the Miami-Dade Water and Sewer Department (WASD) that require minor boundary or platting adjustments for the development, improvement, or maintenance of essential utility infrastructure. The primary purpose of this action is to streamline the administrative process and prevent delays in the execution of critical Capital Improvement Projects (CIP) and mandated utility upgrades, thus enhancing operational efficiency without sacrificing necessary legal compliance or core Board oversight.

The Miami-Dade Water and Sewer Department (WASD) continues to advance strategic improvements that strengthen operational efficiency, accelerate project delivery, and modernize internal processes. This approach is fully aligned with my Administration�s WISE305 initiative by cutting red tape that can delay essential infrastructure projects, particularly those involving minor plat or boundary adjustments on County-owned utility properties. By streamlining these routine actions, the County can maintain project schedules, control unnecessary cost escalations, and ensure timely completion of critical WASD improvements. Collectively, these efforts promote future-ready utility and government while ensuring the continued delivery of efficient and reliable services to County residents.

Recommendation
It is recommended that the Board adopt the attached resolution, which delegates authority to the County Mayor or County Mayor�s Designee to execute and file Plat or Waiver of Plat applications on behalf of the County for County-owned properties under WASD's operational control.

Scope
The scope of this item is Countywide in nature.

Fiscal Impact/Funding Source
This item has no fiscal impact to the County.

Track Record/Monitoring
The County Mayor or County Mayor�s Designee will be responsible for exercising this delegated authority in accordance with all applicable laws and County procedures.

Delegation of Authority
Upon approval of this item, the County Mayor or the County Mayor�s designee will have the authority to execute and file Plat or Waiver of Plat applications on behalf of the County for County-owned properties under WASD's operational control.

Background
WASD operates and maintains a vast network of water and sewer utility infrastructure across the County. The timely execution of new construction, repairs, and improvements is critical to meeting regulatory compliance deadlines. In the course of developing or modifying County-owned utility parcels, WASD is often required to adjust boundary lines (e.g., to dedicate new easements or consolidate parcels). Chapter 28 of the Code of Miami-Dade County requires that a plat or a Waiver of Plat be filed for such boundary adjustments.

Currently, the preparation, filing, and execution of a Plat or Waiver of Plat application requires a specific resolution and approval from the Board. This legislative step adds significant time to the pre-construction phase of a utility project, which is often on a tight schedule. Plat or Waiver of Plat applications for utility sites are largely technical, administrative matters that confirm boundary adjustments and do not negatively impact public access, drainage, or overall infrastructure planning. These reviews are already handled by technical staff within the County's platting and zoning division.

This item would delegate the authority to execute and submit these routine Plat or Waiver of Plat applications from the Board directly to the County Mayor or the County Mayor�s Designee. The delegation is strictly limited to applications necessary for the development, improvement, or maintenance of County-owned utility infrastructure under the jurisdiction of WASD and utilized for public utility purposes (e.g., pump stations, water treatment plants, transmission lines). This item represents a targeted administrative action designed to expedite the processing of regulatory Plat and Waiver of Plat applications associated with existing, fully funded utility projects. Ensuring the timely execution and filing of these documents helps prevent unnecessary project delays, minimizes schedule disruptions, and reduces the risk of cost escalation within the CIP. The delegated authority is limited in scope and does not alter Board oversight of policy matters. The County Mayor or the County Mayor�s Designee will exercise this authority in strict compliance with all applicable federal, state, and local laws as well as established County administrative and platting requirements, thereby preserving transparency, accountability, and regulatory integrity.

This delegation is consistent with other authorities granted to the County Mayor or the County Mayor�s Designee for administrative execution of routine tasks, and it will significantly enhance WASD's ability to efficiently manage its CIP and deliver essential services without compromising the Board's legislative oversight on major policy or land use decisions.
