TITLE RESOLUTION DIRECTING THE COUNTY MAYOR OR COUNTY MAYOR�S DESIGNEE TO DEVELOP AN ILLEGAL DUMPING AND ENCAMPMENT PLAN FOR MIAMI-DADE COUNTY COMMISSION DISTRICT 2; AND REQUIRING A REPORT BODY WHEREAS, illegal dumping in Miami-Dade County (the �County�) is a serious issue that creates a range of continuing problems; and WHEREAS, illegal dumping is a crime that can harm the environment and negatively impact neighborhood aesthetics; and WHEREAS, illegal dumping may also be an economic threat to the County and its residents; and WHEREAS, the County takes pride in its image as a clean and inviting destination to live, work, and visit; and WHEREAS, on December 5, 2017, this Board adopted Resolution No. R-1201-17 creating the 2017 Illegal Dumping Task Force (the �Task Force�), to analyze and investigate the causes and effects of illegal dumping in the County, and the applicable laws and regulations, enforcement, and punishment related to illegal dumping, and to make recommendations to the Board and County Mayor to better address and combat illegal dumping; and WHEREAS, on October 1, 2018, the Task Force issued its Illegal Dumping Task Force Report which (i) identified and explained five factors which lead to illegal dumping, and (ii) provided ten recommendations to combat illegal dumping through prevention, remediation, and punishment; and WHEREAS, this Board desires to remediate and remove illegally dumped debris more quickly; and WHEREAS, in an effort to remove illegally dumped debris more quickly this Board has taken numerous actions including the creation of the Illegal Dumping Trust Fund created pursuant to Resolution No. R-907-21 on October 5, 2021 and the creation of a pilot program with the City of Miami Gardens and City of Opa Locka for said municipalities to collect, transport, and dispose of illegally dumped debris pursuant to the program guidelines, at no cost to the County; and WHEREAS, despite these efforts illegal dumping remains a problem throughout the County and in Commission District 2; and WHEREAS, in addition to the illegal dumping of debris, there is the problem of encampments which bring not only debris but other hazards to the health and safety of those in surrounding areas; and WHEREAS, it is in the best interest of the County to prevent or minimize negative aesthetic impacts to the public of illegal dumping and encampments, wherever feasible, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that: Section 1. The foregoing recitals are incorporated in this resolution and are approved. Section 2. This Board directs the County Mayor or County Mayor�s designee to provide a plan that assesses the extent of illegal dumping and encampments within Miami-Dade County Commission District 2 and sets forth measures to address the issue. The plan shall include, but not be limited to, the following elements: (a) The current extent of illegal dumping and encampments within District 2, including a heat map identifying recurring illegal dumping/camping sites; (b) The identification of specific actions to be taken to reduce or eliminate illegal dumping and encampments along with a timeline; (c) A list of funding sources that may be legally used to address the illegal dumping and encampments, and the proposed cost of implementation of the plan; (d) Information on how the Illegal Dumping Trust Fund (IDTF) can be used to fund implementation of the plan and any changes that may be necessary to the IDTF; (e) Information on whether and how the recommendations from the Illegal Dumping Task Force Report can be implemented; (f) Recommendations from the Miami-Dade County Homeless Trust including, but not limited to, recommendations related to dealing with individuals experiencing homelessness who may be sexual offenders; and (g) Recommendations from the Miami-Dade Sheriff�s Office (MDSO) including, but not limited to, recommendations related to the role of MDSO in addressing illegal dumping/camping and the illegal activities on those sites including illegal disposal of vehicles. This Board further directs the County Mayor or County Mayor�s designee to submit to this Board a final report, including the plan that addresses each of the elements, set forth above, within 45 days of the effective date of this resolution and to place the completed report on an agenda of this Board without committee review pursuant to rule 5.06(j) of the Board�s Rules of Procedure. |
