AC042A BETWEEN MIAMI DADE COUNTY AND GENERAL ASPHALT CO., LLC IN AN AMOUNT NOT TO EXCEED $10,541,788.93; AUTHORIZING THE COUNTY MAYOR OR COUNTY MAYOR�S DESIGNEE TO EXECUTE THE SAME, AND TO EXERCISE THE PROVISIONS THEREOF, INCLUDING TERMINATION

WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum and documents, copies of which are incorporated herein by reference,

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board:

Section 1. This Board approves the contract between Miami-Dade County and General Asphalt Co. LLC, for MDAD Project No. AC042A to provide construction services to for Miami-Opa Locka Executive Airport (OPF) RIM Hot Spot 3 in the amount of $10,541,788.93, in substantially the form attached to the accompanying memorandum as Attachment H and made a part of hereto. A complete set of contract documents are on file and available upon request from the Miami-Dade Aviation Department.

Section 2. Pursuant to Section 2-285 and 2-285.2 of the Miami-Dade County Code, this Board authorizes the County Mayor or County Mayor�s designee to exercise the provisions thereof, including the authority to execute Contract No. AC042A and the authority to exercise its termination provisions.

STAFF RECOMMENDATION
EXECUTIVE SUMMARY
Miami Dade County continues to advance the transformation of Miami International Airport (MIA) into a world class aviation hub through the expanded $12 billion Modernization In Action (M.I.A.) Plan. Aligned with the goals of MIA�s Forward Flight Team and the CARE MIA Advisory Board, the County�s long term capital improvement strategy also supports the mission of its general aviation airports (GAA). This strategy enhances general aviation facilities, expands capacity for private-sector businesses and corporate aviation, and strengthens the County�s airport system�s ability to provide regional mobility and drive economic growth across the County.

As these improvements advance, preserving the reliability and integrity of existing infrastructure remains essential to sustaining safe and efficient airport operations. To support this objective, the Miami Dade Aviation Department (MDAD), through this agenda item, is procuring the Runway Incursion Mitigation (RIM) Project at Hot Spot 3 at Miami-Opa Locka Executive Airport (OPF). This critical safety enhancement project will reduce the risk of runway incursions by improving airfield geometry and signage and by enhancing situational awareness for pilots and ground operations personnel. It will include modifications to taxiway geometry, updated pavement markings, enhanced airfield signage and lighting, and other Federal Aviation Administration (FAA)-recommended safety improvements intended to minimize pilot confusion and strengthen operational safety.

This item seeks approval from the Board of County Commissioners (Board) to award a competitive construction contract to General Asphalt Co, LLC (General Asphalt) for OPF RIM Hot Spot 3; Contract No AC042A. The Engineer of Record (AtkinsR�alis USA, Inc.) reviewed the project�s bid tally and determined that General Asphalt is fully qualified for the award of this construction contract. General Asphalt�s base bid of $9,559,545.62 is 18.22 percent below the $11,689,350.00 base estimate prepared by MDAD�s cost consultant, RIB US Cost, Inc. The differences between the two estimates are detailed on page 3 of this memorandum.

The County has agreed to pay General Asphalt a total compensation amount of $10,541,788.93, which includes a 10 percent contingency of $955,954.56 and an Inspector�s General Fee of $26,288.75. The total contract term consists of 480 consecutive calendar days from the effective date of the Notice to Proceed.

RECOMMENDATION
It is recommended that the Board approve the attached resolution awarding Contract No. AC042A to General Asphalt, for the project entitled: �OPF RIM Hot Spot 3� pursuant to Section 2-8.1 of the Miami-Dade County Code.

SCOPE
The project work scope includes all project management, on site supervision, labor, materials, tools, equipment, trade subcontractors, licenses, and permits necessary to execute the reconfiguration of Hot Spot 3 at OPF. The work includes, but is not limited to, the following airfield improvements:

� Demolition of existing airfield pavements and existing taxiways.
� Lighting and signage appurtenances.
� Construction of new full-strength taxiway pavements, new shoulder pavements, installation of new taxiway lighting,
� Signage and connection(s) to the existing airfield lighting system,
� Infield grading and drainage modifications, along with removal of existing pavement markings and installation of new pavement markings.

OPF is located within District 1, which is represented by Commissioner Oliver G. Gilbert III; however, the impact of this agenda item is countywide, as OPF is a regional asset.

Description: This project will enable MDAD to meet the most recent standards and recommendations published by the Federal Aviation Administration (FAA) in the 2024 Airport Design Advisory Circular, AC 150/5300-13B, which was crafted with the purpose of minimizing runway incursions and surface incidents. The proposed project will implement specific airfield improvements to comply with regulatory standards and reduce the risk of collision and/or runway incursion.

BACKGROUND:
Runway incursion risks are regarded as a top priority by the FAA, requiring airport owners and operators to take proactive measures to avoid runway incursions and surface incidents, defined as the incorrect presence of an aircraft, vehicle or person on the protected area of a surface designated for the landing and takeoff of aircraft. Hot Spot 3 at OPF has been identified as an area with elevated potential for runway incursions due to complex taxiway configurations and operational challenges.

Hot Spot 3 is an area bounded by Runways 12/30 and 09R/27L, and the convergence of Taxiways T, Y, D, and connectors T8 and Y7. The proposed project will reconfigure this complex intersection by adding no-taxi islands, decommissioning pavement, modifying pavement geometry and fillets, and updating associated runway and taxiway lighting and markings. These improvements directly support the FAA�s requirements outlined in Advisory Circular 150/5300 13B, which calls for proactive measures by airport operators to mitigate surface movement hazards. Given that runway incursions remain a top FAA safety priority, the proposed work is essential to improving operational safety, reducing pilot and vehicle operator confusion, and ensuring long term compliance with current airfield design standards.

Although General Asphalt�s base bid of $9,559,545.62 is 18.22 percent lower than the $11,689,350.00 base bid estimate prepared by RIB U.S. Cost, Inc., AtkinsR�alis USA, Inc, the Engineer of Record, conducted a comprehensive bidder spread analysis of the bids received and provided justification for the price differential. The review determined that (i) the pricing for the major cost items remained within reasonable competitive range relative to the bidder pool, median values, and anticipated market conditions, (ii) no significant unbalanced bidding patterns were identified, and (iii) the close alignment between the lowest and second-lowest bidders� estimates, (i.e., $9.6 million � 18.22 percent; $9.8 million � 16.03 percent) indicates that the reduced pricing is supported by current market conditions rather than being an outlier.

The following Liquidated Damages will be deducted from the Contract amount for each calendar day/hour of delay due to a Non-Excusable Delay. Measurement shall be per day or part thereof, and hour or part thereof.
i. Phase 1 � Taxiway T � 180 Days � 2 sub-phases $5,500 per day of delay in opening Taxiway T.
ii. Phase 2 � Runway 12-30 Connectors and Taxiway T8, Y7, and D � 60 Days � $5,500 per day of delay in opening Taxiway D, Taxiway T8, and/or Taxiway Y7. $1,300 per hour of delay in opening Runway 12-30.
iii. Phase 3 � Taxiway Y and Taxiway D � 60 Days - $5,500 per day of delay in opening Taxiway Y and/or Taxiway D.
iv. Closeout � Taxiway Electrical, Final Markins and all Punch List Items � 60 Days � $5,500 per day of delay in completing all Taxiway Electrical, Final Markins and all Punch List items

Due Diligence
Pursuant to Resolution No. R-187-12, due diligence was conducted to determine General Asphalt�s responsibility, including verifying the firm�s corporate status and reviewing its safety records (per R-1181-18), as well as confirming that there are no performance or compliance issues. The following lists were reviewed: 1) Occupational Safety and Health Administration (OSHA) logs of work-related injuries and illnesses (Form 300), including OSHA inspection data, and 2) convicted vendors, debarred vendors, delinquent contractors, suspended vendors, and the federal-excluded parties list. The Florida Department of State Division of Corporations records show the company�s status as active.

SBD History of
Violations: Yes, all identified underpayment amounts have been recovered.

Procurement History
This construction project, known as Contract No. AC042A, was advertised on February 24, 2026, by the County under full and open competition and closed on April 22, 2026, resulting in four (4) bids received from Ranger Construction Industries, Inc., Quality Construction Performance, Inc., OHLA USA, Inc., and General Asphalt Co, LLC. On April 27, 2026, the County�s Strategic Procurement Department (SPD) issued its Compliance Review, concluding that a compliance review for AC042A cannot be conducted due to the Interim Final Rule (IFR) released by the U.S. Department of Transportation on October 3, 2025 (see Attachment �B� as attached). This Interim Final Rule temporarily suspended the requirements of the DBE program. This project remains subject to all other applicable federal requirements, including, but not limited to, Davis-Bacon Wage Rates.

During the evaluation process, MDAD staff identified possible responsive irregularities where General Asphalt failed to acknowledge Addendum No. 5, as well as submitted their bid bond using the original form issued in the solicitation, which had been replaced with a revised bid bond form via Addendum No. 1. Accordingly, General Asphalt�s bid was referred to the County Attorney�s Office (CAO) for review. On May 6, 2026, the CAO issued its determination, deeming General Asphalt�s bid responsive. (See Attachment �C� as attached).

A copy of the SPD Project Worksheet for AC042A shows that this project is a DBE and no measures are assigned to this construction project due to the Interim Final Rule, resulting in the temporary suspension of the requirements under the DBE Program. A copy of the SPD Project Worksheet is enclosed. (See Attachment �D� as attached)

In a letter dated May 11, 2026, addressed to the Aviation Department, the Engineer of Record, AtkinsR�alis USA, Inc., confirmed that the recommended low bidder qualifies for award of this construction contract. (See Attachment �E� as attached)

SBD�s Capital Improvements Information System (CIIS) database has 50 evaluations for General Asphalt, with an average evaluation rating of 3.5 out of 4.0 points, which is indicative of satisfactory performance. (See Attachment �F� as attached)

According to SPD�s �Firm History Report,� General Asphalt has been awarded four (4) contracts in the last three (3) years with a value of $45,745,258.00. For the period March 2012 � October 2022, General Asphalt received nine (9) contracts as a Prime Contractor with a value of $117,019,789.00 for a total value of $162,765,047.00. (See Attachment �G� as attached)

The Contract Summary, Bid Bond, and Required Affidavits (also called �Combined Affidavit�) executed by General Asphalt are enclosed. (See Attachment �H� as attached)
