TITLE RESOLUTION APPROVING CONTRACT MIAMI INTERNATIONAL AIRPORT FUEL STORAGE FACILITY EXPANSION - PHASE 1 NO. W019A BETWEEN MIAMI-DADE COUNTY AND CHEROKEE ENTERPRISES, INC. IN AN AMOUNT NOT TO EXCEED $45,856,233.51; AUTHORIZING THE COUNTY MAYOR OR COUNTY MAYOR�S DESIGNEE TO EXECUTE THE SAME, AND TO EXERCISE THE PROVISIONS THEREOF, INCLUDING TERMINATION BODY WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum and documents, copies of which are incorporated herein by reference, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board: Section 1. This Board approves the contract between Miami-Dade County and Cherokee Enterprises, Inc., for MDAD Project No. W019A to provide construction services for MIA Fuel Storage Facility Expansion � Phase 1 at Miami International Airport in the amount of $45,856,233.51, in substantially the form attached to the accompanying memorandum as Attachment G and made a part of hereto. A complete set of contract documents is on file and available upon request from the Miami-Dade Aviation Department. Section 2. Pursuant to Section 2-285 and 2-285.2 of the Miami-Dade County Code, this Board authorizes the County Mayor or County Mayor�s designee to exercise the provisions thereof, including the authority to execute Contract No. W019A and the authority to exercise its termination provisions. HEADER Date: To: Honorable Chairman Anthony Rodriguez and Members, Board of County Commissioners From: Daniella Levine Cava Mayor Subject: Approval of a Contract Award Recommendation for Fuel Storage Facility Expansion at Miami International Airport; Contract No. W019A STAFF RECOMMENDATION EXECUTIVE SUMMARY Miami-Dade County continues to advance the transformation of Miami International Airport (MIA) into a world-class aviation hub through the expanded $12 billion Modernization In Action (M.I.A.) Plan. Aligned with the goals of MIA�s Forward Flight Team and the CARE-MIA Advisory Board, this long-term program delivers critical capital improvements that enhance infrastructure, support growing passenger demand, and strengthen MIA�s role as a leading U.S. airport and the premier Gateway to Latin America and the Caribbean. As these upgrades progress, maintaining reliable infrastructure remains critical to the airport�s continued operations. The expansion of the airport�s fuel storage facility will increase fuel reserves, improve operational efficiency, and enhance resilience. Delivered in two phases, the project will significantly expand MIA�s storage capacity and better protect essential airport functions during periods of heavy air traffic, unexpected supply disruptions, and natural disasters. Phase I will add one 4-million-gallon fuel storage tank, while Phase II will consist of two additional fuel storage tanks, each with a 4-million-gallon capacity for a total capacity increase of 12 million gallons of jet fuel. MIA�s current fuel storage capacity stands at 12 million gallons of jet fuel, sufficient for around three (3) days of fuel reserves. Upon completion, Phases I and II of the expansion will yield a doubling in capacity to 24 million gallons. This item seeks approval from the Board of County Commissioners (Board) to award a competitive construction contract to Cherokee Enterprises, Inc. (Cherokee) for MIA Fuel Storage Facility Expansion � Phase 1 at Miami International Airport; Contract No W019A. The Engineer of Record (Burns & McDonnell) reviewed the project�s bid tally and determined that Cherokee, the lowest bidder, is qualified for the award of this construction contract. Cherokee�s base bid of $39,775,546.79 is 10.6 percent below the $44,483,884.00 base estimate prepared by the Miami-Dade Aviation Department�s (MDAD) cost consultant, RIB US Cost, Inc. The County has agreed to pay Cherokee a total compensation amount of $45,856,233.51, which includes a 10 percent Contingency Allowance of $3,977,554.68; a Dedicated Allowance Account of $1,988,777.34; and an Inspector�s General Fee of $114,354.70. The total contract term consists of 730 consecutive calendar days from the effective date of the Notice to Proceed. RECOMMENDATION It is recommended that the Board approve the attached resolution awarding Contract No. W019A to Cherokee, for the project entitled: �MIA Fuel Storage Facility Expansion � Phase 1� pursuant to Section 2-8.1 of the Miami-Dade County Code. SCOPE The scope of work involves the expansion of the existing fuel storage system through the installation of a new above-ground jet fuel storage tank with American Petroleum Institute (API) 650 standards, along with associated jet fuel piping and infrastructure. The work also includes the construction of a jet fuel pumping and filtration system, complete with emergency fuel shut-off systems and integration of fuel instrumentation and controls. The project elements include: � Maintenance of Traffic (MOT) and mobilization � Identification, handling and disposal of contaminated soil � Dewatering � Demolition of existing site items and pavements in tank construction area � Fence modifications and new gates � Grading and site elevation � Topographic survey and geological testing � New fire access, service road and sidewalks � New galvanized steel stair platform crossovers � Fire protection piping relocation � Construction of new jet fuel storage tank with ring wall foundation, secondary containment, � Leak detection, cathodic protection, and instrumentation and oil/water separation � Dike area waterproofing � Prep and painting steel tank � New concrete containment area � Jet fuel storage tank deluge system � Modifications to jet fuel inbound piping and three (3) new sets of filtration equipment � New inbound building � New fire foam building � Monitoring well � New fire suppression and fire alarm systems for tank � Power and control system for Inbound Filtration Building & Fire Foam Building � Power service pole relocation in Dike Area #3 � Electrical service and motor connections to new tank � Test and commissioning of tank piping and equipment � FPL underground duct bank relocation � New CCTV system � New inbound filtration system and storm lift station � Relocate fiber optics � Site lighting � Cathodic protection system � Grounding and lighting protection system MIA is located within District 6, which is represented by Commissioner Natalie Milian Orbis; however, the impact of this agenda item is countywide, as MIA is a regional asset. Project Name: MIA Fuel Storage Facility Expansion � Phase 1 Project No.: W019A Contract No: W019A Project Location: MIA Project Description: MDAD requires professional services for the construction and commissioning of a new jet fuel storage tank and associated fueling infrastructure at MIA. The project consists of expanding the existing fuel storage system through the installation of a new above ground Jet A fuel storage tank designed and constructed in accordance with API 650 standards. The new tank will integrate with the airport�s existing fuel farm and include all required jet fuel piping, containment, and supporting infrastructure. The project also includes the construction of a new jet fuel pumping and filtration system to improve fuel delivery efficiency and maintain fuel quality. This system will incorporate emergency fuel shut off capabilities and full integration with the airport�s fuel instrumentation and control systems to ensure safe, reliable, and automated operations. Approval Path: Board of County Commissioners, Section 2-8.1 of the Miami-Dade County Code BACKGROUND: The projected growth in jet fuel consumption, combined with the potential for unplanned supply disruptions, has created a critical need to expand on-site jet fuel storage capacity at the MIA Fuel Storage Facility. Adequate fuel storage is essential for maintaining uninterrupted jet fuel availability during periods of increased air traffic, supply chain disruptions, and emergency events such as hurricanes. To meet this requirement, the project calls for constructing an additional Jet A fuel storage tank together with the necessary fueling equipment and supporting infrastructure. MIA�s current fuel storage capacity stands at 12 million gallons of jet fuel, sufficient for around three (3) days of fuel reserves. Upon completion, Phases I and II of the expansion will yield a doubling in capacity to 24 million gallons. This expansion will strengthen the airport�s operational reliability and help maintain a consistent fuel supply capable of supporting current activity levels as well as projected future growth at MIA. Liquidated damages for the construction phase have been established and will be deducted from the Contract amount of $8,020.00 for each calendar day delay due to a non-excusable delay. Liquidated Indirect Costs recoverable by the Contractor, shall be $3,831.23 per day for each day the project is delayed up to 30 days due to a Compensable Excusable Delay. These sections of the code, together with the I.O. 8-8, are referred to as the �Sustainable Buildings Program.� While the project does not require formal certification, it must comply with �Maximum Measures� outlined in the above policies and complete an ENVISION self-assessment. The �Maximum Measures� include: � Use of concrete for the dike. � If available�paints and coatings for the tanks that meet industrial and fire safety standards and are low-VOC. � Installation of LED lighting, along with controls and sensors for exterior lighting. � Use of energy-efficient pumps, if available. � Installation of an oil/water separator to treat water in the dike area and remove any oil contamination. � Excavation activities that include the removal and proper disposal of contaminants. � Contractor adherence to ISO 14001 procedures, which require recycling and the implementation of best management practices. Sea Level Rise (Ord, 14-79): Yes, awarded Contractor shall ensure that all tasks performed comply with Miami-Dade County Ordinance 14-79 - including building elevation, design and installation of mechanical and electrical systems, and the design of buildings and infrastructure - shall consider sea level rise projections and potential impacts as best estimated at the time of the project, using the regionally consistent Unified Sea Level Rise Projections, during all project phases including but not limited to planning, design, and construction, in order to ensure that infrastructure projects will function properly for fifty (50) years or the design life of the project, whichever is greater. TRACK RECORD/MONITOR MDAD Project Manager Gustavo Leal will monitor the implementation of this construction project. Due Diligence Pursuant to Resolution No. R-187-12, due diligence was conducted to determine General's responsibility, including verifying the firm�s corporate status and reviewing its safety records (per R-1181-18), as well as confirming that there are no performance or compliance issues. The following lists were reviewed: 1) Occupational Safety and Health Administration (OSHA) logs of work-related injuries and illness (Form 300), including OSHA inspection data, and 2) convicted vendors, debarred vendors, delinquent contractors, suspended vendors, and the federal-excluded parties list. The Florida Department of State Division of Corporations records show the company�s status as active. SBD History of Violations: No Procurement History This construction project, known as Contract No. W019A, was advertised on March 12, 2026, by the County under full and open competition and closed on May 1, 2026, resulting in two (2) bids received from Gonzalez & Sons Equipment, Inc. and Cherokee Enterprises, Inc. On May 5, 2026, the County�s Strategic Procurement Department (SPD) issued its Compliance Review memorandum, concluding that a compliance review for W019A cannot be conducted due to the Interim Final Rule (IFR) released by the U.S. Department of Transportation on October 3, 2025 (see Attachment �B� as attached). This Interim Final Rule temporarily suspended the requirements of the Disadvantaged Business Enterprise (DBE) program. The project remains subject to all other applicable federal requirements including, but not limited to, Davis-Bacon Wage Rates. A copy of the SPD Project Worksheet for W019A shows that this project is a DBE, and no measures are assigned to this construction project due to the Interim Final Rule, resulting in the temporary suspension of the requirements under the DBE Program. A copy of the SPD Project Worksheet is enclosed. (See Attachment �C� as attached) In a letter dated May 12, 2026, addressed to MDAD, the Engineer of Record, Burns & McDonnell, confirmed that the recommended low bidder qualifies for the award of this construction contract. (See Attachment �D� as attached) SBD�s Capital Improvements Information System (CIIS) database has 126 evaluations for Cherokee, with an average evaluation rating of 3.3 out of 4.0 points, which is indicative of satisfactory performance. (See Attachment �E� as attached) According to SPD�s �Firm History Report,� Cherokee has been awarded seven (7) contracts in the last three (3) years with a value of $2,126,589.00. For the period March 2009 to March 2023, Cherokee received eighteen (18) contracts as a Prime Contractor, totaling $60,498,097.00, for a total value of $62,624,686.00. (See Attachment �F� as attached) The Contract Summary, Bid Bond, and Required Affidavits (also called �Combined Affidavit�) executed by Cherokee are enclosed.
