|
TITLE RESOLUTION AUTHORIZING THE COUNTY MAYOR OR COUNTY MAYOR�S DESIGNEE TO RECEIVE AND EXPEND UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FISCAL YEAR 2025 CONTINUUM OF CARE PROGRAM FUNDS IN THE AMOUNT OF $62,512,577.00 FOR HOMELESS HOUSING AND SERVICES, INCLUDING ADDITIONAL FUNDS SHOULD THEY BECOME AVAILABLE, ENTER INTO RENEWAL GRANT AND SUB-GRANT AGREEMENTS, AND EXERCISE AMENDMENT, RENEWAL, TERMINATION, CANCELLATION, AND MODIFICATION CLAUSES OF ANY AGREEMENT ENTERED INTO PURSUANT TO THIS RESOLUTION; AND WAIVING RESOLUTION NO. R-130-06 REQUIRING AGREEMENTS TO BE FINALIZED AND EXECUTED BY ALL NON-COUNTY PARTIES BODY WHEREAS, Congress originally authorized a two-year funding cycle for the Continuum of Care (�CoC�) Program Competition, covering Fiscal Years 2024 and 2025; and WHEREAS, the two-year cycle was disrupted in late 2025 when the United States Department of Housing and Urban Development (�HUD�) issued a new competition that drastically cut funds for permanent housing, triggering lawsuits and eventual congressional intervention; and WHEREAS, while ongoing litigation continues, HUD indicated on May 21, 2026, that it will process all Fiscal Year 2025 CoC renewals projects on a rolling, non-competitive basis; and WHEREAS, with the Fiscal Year 2025 renewals, there are automatic service and rent increases in individual program grants, so the total amount to receive and expend is greater than last year, as indicated in Exhibit A listing of the full awards and start and end dates for projects; and WHEREAS, because the Fiscal Year 2025 grants are in effect for Calendar Year 2026, the County, through its Homeless Trust, must reimburse non-profit providers and select municipalities for expenses incurred; and WHEREAS, this Board desires to waive Resolution No. R-130-06, which requires all contracts to be fully negotiated and signed by all non-County parties, to expedite contract renewal and ensure the seamless delivery of housing and services to households experiencing, and at-risk of homelessness; and WHEREAS, the renewals of grants in this item include grants that were competitively awarded and previously approved by the Board of County Commissioners, via Resolution Nos. R-66-25, R-1145-23, R-906-23, and R-950-23; and WHEREAS, the matters in this item were approved by the Homeless Trust Board on July 26, 2024, September 26, 2024, and June 26, 2026, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board: Section 1. Authorizes the County Mayor or County Mayor�s designee to receive and expend United States Department of Housing and Urban Development Fiscal Year 2025 Continuum of Care program funds in the amount of $62,512,577.00 for homeless housing and services, including additional funds should they become available. Section 2. Authorizes the County Mayor or County Mayor�s designee to execute renewal grant agreements with HUD and sub-recipient contracts and agreements in accordance with applicable regulations and the Program�s guidelines, with the agencies and in the amounts in substantially the form set forth in Exhibit A, attached hereto and incorporated herein by reference, following approval for form and legal sufficiency by the County Attorney�s Office. Section 3. Authorizes the County Mayor or County Mayor�s designee to exercise any modification, termination and renewal clauses of any contracts or agreements, in accordance with applicable regulations and the Programs� guidelines, for and on behalf of Miami-Dade County, Florida. Section 4. Waives Resolution No. R-130-06, which requires all contracts to be fully negotiated and signed by all non-County parties, to give the County Mayor or County Mayor�s designee sufficient time to negotiate the sub-recipient agreements with housing and service agencies. |
