REPORT: Commissioner Cohen Higgins provided an overview of the foregoing proposed resolution and noted today’s (2/2) vote was to place the item on the Transportation Planning Organization (TPO) agenda. Assistant County Attorney Annery Alfonso confirmed that, if the proposed resolution was approved today, it would direct the Mayor to work with the TPO Director to prepare and place the item on the TPO agenda. In response to Commissioner Martinez’s concern regarding whether the proposed resolution would establish a County policy that would affect every Commission District, Assistant County Attorney Alfonso advised the proposed resolution would establish a general County policy. Commissioner Cohen Higgins offered to remove the language related to establishing County policy from the item to reflect that it would only be specific to County Commission District 8. Commissioner Martinez requested to be added as a co-sponsor once the language was removed. Commissioner Higgins recused herself from voting on the proposed resolution. She stated that she was unable to review this proposal due to the late distribution of the item and opined it should undergo Committee review to allow public input. Chairman Diaz stated, as a courtesy, he placed several items on the agenda; however, in the future; an item would not be placed on the following agenda if it was not an emergency. Commissioner Garcia expressed concern regarding the $3.1 million costs and the establishing of a countywide policy. He thanked Chairman Diaz for his comments. Commissioner Gilbert indicated he would support the proposed resolution. County Mayor Levine Cava asked Commissioner Cohen Higgins to consider deferring the resolution to Committee; and then, forwarding it to the Board to provide an opportunity for the community to provide feedback to the Board. Chairman Diaz stated he did not have any objections as the item would be considered by the TPO. There being no further discussion, the Board proceeded to vote on the foregoing proposed resolution as amended to remove within the title of the resolution the language “establishing County policy that the County arterial network extend without dead-ends, within traffic engineering standards, throughout the County and in furtherance of that policy. . .”

BODY
WHEREAS, SW 87th Avenue is an arterial road that runs north and south through the County from the Black Point areas south of Cutler Bay to almost the Broward County line north of Miami Lakes; and
WHEREAS, currently, the stretch of the Cutler Drain Canal C-100 which runs east and west between SW 164th Street and SW 163rd Terrace in Palmetto Bay, Florida, blocks northbound and southbound traffic along SW 87th Avenue and forces drivers to take circuitous routes along local roads in order to get to the other side of the canal; and
WHEREAS, the construction of a bridge that would extend SW 87th Avenue from SW 164th Street to SW 163rd Terrace crossing over the Cutler Drain Canal C-100 (the �bridge project�) would address roadway connectivity and capacity needs in the area; and
WHEREAS, the bridge project was recommended as part of a 2014 Transportation Planning Organization (�TPO�) arterial road study that focused on providing missing links throughout the County arterial network; and
WHEREAS, the County estimates that the cost of design and construction for the bridge project is approximately $3,100,000.00; and
WHEREAS, one of the best ways to improve mobility in the County is to connect missing links within the County�s arterial network; and
WHEREAS, the bridge project would allow traffic to redistribute to a more appropriate location that has a normal roadway grid; and
WHEREAS, the completion of the bridge project is in the best interest of all County residents as it is expected to resolve significant traffic gridlock that is created during peak traffic hours and will provide connectivity for public safety and emergency service vehicles; and
WHEREAS, the Office of Management and Budget and the Department of Transportation and Public Works has advised that there are sufficient, unallocated road impact fee carryover funds in the Fiscal Year 2020-2021 Countywide General Fund Budget to fund the design and construction of the bridge project; and
WHEREAS, specifically, the Reserves for Future Capital Projects category of the Transportation and Public Works Impact Fee Program � Roadway Construction, Fund CI 340, has sufficient unallocated funds to cover the costs of design and construction of the bridge project,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that:
Section 1. Approves the foregoing recitals, which are incorporated herein by reference.
Section 2. This Board directs the County Mayor or County Mayor�s designee to take all actions necessary to construct a bridge that would extend SW 87th Avenue from SW 164th Street to SW 163rd Terrace crossing over the Cutler Drain Canal C-100. The County Mayor or County Mayor�s designee shall, at a minimum, coordinate with the TPO Executive Director to prepare and place all necessary agenda items on the first available TPO Governing Board�s agenda to amend the Long Range Transportation Plan and the Transportation Improvement Program to include this bridge project, and at the appropriate time, to issue the necessary procurement documents in order to construct the bridge.
Section 3. To the extent consistent with the requirements of Chapter 33E for expenditure of road impact fee funds, this Board appropriates $3,100,000.00 in unencumbered road impact fee funds, including but not limited to any carryover funds, from the fiscal year 2020-2021 County Budget for the design and construction of the bridge project identified in section 2 above. Should additional funds be necessary to complete the design or construction of the bridge project, this Board further directs the County Mayor or County Mayor�s designee to identify and appropriate, in accordance with the authority set forth in section 2-1796 of the Code of Miami-Dade County, Florida, legally available funds from the fiscal year 2020-2021 County Budget that independently or combined may be utilized to fund the bridge project, and to include the implementation of said bridge project, as necessary, in the Mayor�s Proposed Budget for fiscal year 2021-2022.
