REPORT: | Commissioner Bermudez inquired which County facilities did not currently accept cash. Regarding Commissioner Bermudez's inquiry, Mayor Levine Cava clarified that all County facilities were required to accept cash for services. Mr. Alex Munoz, Director, Internal Services Department (ISD), reported that based on a survey of various departments in preparation for this matter, the departments surveyed also accepted cash payments. Discussion ensued among the Board members and Mr. Munoz regarding the intent of the foregoing proposed resolution. Commissioner Regalado clarified that the foregoing item requested a feasibility study to come back to the Board; and noted no action would be taken today. Hearing no further questions or comments, the Board proceeded to vote on the foregoing proposed resolution, as presented. | ||||||

REPORT: | Assistant County Attorney Eduardo Gonzalez read the title of the foregoing proposed resolution into the record. Chairwoman Regalado requested the Administration to prepare a report detailing the fiscal impact of the item prior to it being considered by the Board of County Commissioners. Hearing no further questions or comments, the Committee members proceeded to vote on the foregoing resolution, as presented. Following the vote, Commissioner Hardemon inquired if there were in fact places in the County where cash was not accepted. Chairwoman Regalado referenced legislation sponsored by Commissioner Garcia which required all businesses to accept cash and noted the foregoing proposed resolution would explore the feasibility of installing cash-to-card kiosks. Commissioner Hardemon voiced his concerns about charging residents a fee for the cash to card conversion. Commissioner Garcia reiterated the intent of the item was to conduct a feasibility study related to the installation of the cash-to-card kiosks and cited the Kaseya Arena’s implementation of similar machines as an example of how businesses not equipped to handle cash have complied with the legislation. | ||||||

TITLE RESOLUTION DIRECTING THE COUNTY MAYOR OR COUNTY MAYOR�S DESIGNEE TO EXAMINE THE FEASIBILITY OF INSTALLING CASH-TO-CARD KIOSKS, OR OTHER DEVICES DESIGNED TO CONVERT CASH INTO PREPAID CARDS, AT ALL COUNTY FACILITIES WHERE CASH IS NOT ACCEPTED AS A FORM OF PAYMENT FOR GOODS OR SERVICES, AND REQUIRING A REPORT BODY WHEREAS, on May 17, 2022, this Board passed and adopted Ordinance No. 22-53 (�Ordinance�), finding that it is in the best interests of the residents of Miami-Dade County to ensure its economy is inclusionary and accessible to everyone; and WHEREAS, the Ordinance created section 21-60 of the Code, the �Cashless Retail Prohibition�, which prohibits retail businesses from refusing to accept cash payments for goods or services; and WHEREAS, the Ordinance also amended section 8CC-10 of the Code, providing for a warning on first instance of non-compliance, followed by subsequent civil penalties; and WHEREAS, venues that host events are in compliance with the Cashless Retail Prohibition if they have at least one location on the premises where customers are able to purchase payment cards with cash; and WHEREAS, the purpose of the Cashless Retail Prohibition is to ensure that all County residents�including those who lack access to other forms of payment, such as elderly, low-income, and disabled persons�are able to participate in the County�s economic life by paying cash for goods and services; and WHEREAS, cashless policies discriminate against millions of customers who do not have the resources to participate in cashless transactions; and WHEREAS, this Board wishes to allow all customers the freedom to choose a payment option that works for them; and WHEREAS, consequently, this Board desires that the County Mayor or County Mayor�s designee examine the feasibility of installing cash-to-card kiosks, or other devices designed to convert cash into prepaid debit, credit, or gift cards, at any and all County facilities where cash is not accepted as a form of payment for goods or services, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board: Section 1. Directs the County Mayor or County Mayor�s designee to examine the feasibility of installing cash-to-card kiosks, or other devices designed to convert cash into prepaid cards, at all County facilities where cash is not accepted as a form of payment for goods or services. Section 2. Directs the County Mayor or County Mayor�s designee to provide a report or recommendation regarding the directive in section 1, to this Board within 30 days of the effective date of this resolution and to place the completed report on an agenda of the full Board without committee review pursuant to rule 5.06(j) of the Board�s Rules of Procedure. |
