RESOLUTION RETROACTIVELY APPROVING THE COUNTY MAYOR OR COUNTY MAYOR�S DESIGNEE�S ACTIONS IN (1) COMPLETING STANDARD FORMS AND REQUIRED MATERIALS TO RECEIVE FISCAL YEAR 2023 ECONOMIC DEVELOPMENT INITIATIVE/COMMUNITY PROJECT FUNDING PROGRAM GRANT AWARD FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT(HUD) IN AN AMOUNT NOT TO EXCEED $4,000,000.00, FOR THE SWEETWATER AFFORDABLE HOUSING PROJECT; AND (2) EXECUTING THE GRANT AGREEMENT BETWEEN MIAMI-DADE COUNTY AND HUD; AUTHORIZING THE COUNTY MAYOR OR COUNTY MAYOR�S DESIGNEE TO: (1) RECEIVE AND EXPEND SUCH GRANT FUNDS; (2) EXECUTE AN AGREEMENT WITH THE DEVELOPER, CREI HOLDINGS, LLC, WITH THE CORE PROVISIONS SUBSTANTIALLY SIMILAR TO THE GRANT AGREEMENT; (3) EXERCISE THE PROVISIONS OF ANY SUCH AGREEMENTS, INCLUDING TERMINATION AND AMENDMENT PROVISIONS CONTAINED THEREIN; AND (4) EXECUTE ALL NECESSARY AGREEMENTS AND AMENDMENTS AS MAY BE REQUIRED FOR THE RECEIPT AND EXPENDITURE OF THE GRANT FUNDS, AND TO EXERCISE ALL PROVISIONS CONTAINED THEREIN

WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference,

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that:

Section 1. This Board ratifies and adopts the matters set forth in the accompanying justification memorandum as if fully set forth herein.

Section 2. This Board retroactively approves the County Mayor or County Mayor�s designee�s actions in completing standard forms and required materials to receive Fiscal Year 2023 Economic Development Initiative/Community Project Funding program grant funding in an amount not to exceed $4,000,000.00 (�grant funds�) from the United States Department of Housing and Urban Development (HUD), for the Sweetwater Affordable Housing project, as provided for in the May 8, 2023 award letter provided by HUD to the County, a copy of which is attached hereto as Exhibit A.

Section 3. This Board retroactively approves the County Mayor or County Mayor�s designee�s execution of the grant agreement between the County and HUD, in substantially the form attached hereto as Exhibit B and incorporated herein by reference, subject to the approval of the County Attorney�s Office for form and legal sufficiency. This Board further authorizes the County Mayor or County Mayor�s designee to exercise the provisions contained in such grant agreement, including termination and amendment provisions, so long as such amendments are consistent with the purpose of this resolution. This Board further authorizes the County Mayor or County Mayor�s designee to execute other necessary documents as may be required by HUD for the grant project.

Section 4. This Board authorizes the County Mayor or the County Mayor�s designee to receive and expend the grant funds, execute all necessary agreements and amendments as may be required for the receipt and expenditure of the grant funds, and exercise all provisions contained therein, subject to the County Attorney�s Office�s approval for form and legal sufficiency.

Section 5. This Board authorizes the County Mayor or County Mayor�s designee to execute an agreement with the developer of the Sweetwater Affordable Housing project, CREI Holdings, LLC, provided that the core provisions of the agreement are substantially similar to the grant agreement, attached hereto as Exhibit B and incorporated herein by reference, subject to the County Attorney�s Office�s approval for form and legal sufficiency. This Board further authorizes the County Mayor or County Mayor�s designee to exercise the provisions contained therein, including termination and amendment provisions, so long as such amendments are consistent with the purpose of this resolution. This Board further authorizes the County Mayor or County Mayor�s designee to execute other necessary documents as may be required by HUD for the grant project.

Developer CREI Holdings, LLC and any Agreements Required by HUD

STAFF RECOMMENDATION
Executive Summary
The purpose of this item is to seek the Board of County Commissioners� (Board) approval of the following: (1) retroactive approval of the County Mayor or County Mayor�s designee�s actions in
completing standard forms and required materials to receive Fiscal Year 2023 Economic Development Initiative/Community Project Funding program grant award from the United States Department of Housing and Urban Development (HUD) in the amount of $4,000,000.00, for the Sweetwater Affordable Housing project; (2) retroactive approval of the County Mayor or County Mayor�s designee actions in executing the grant agreement between Miami-Dade County and HUD; (3) authorization for the County Mayor or Mayor�s designee�s to receive and expend such grant funds; (4) authorization for the County Mayor or County Mayor�s designee to execute an agreement with the developer, CREI Holdings, LLC, with the core provisions substantially similar to the grant agreement, and any other documents required by HUD for this grant project.

Recommendations
It is recommended that the Board:
1. Retroactively approve the County Mayor or the County Mayor�s designee�s actions in completing the standard forms and required materials to receive Fiscal Year 2023 Economic Development Initiative/Community Project Funding program grant funding in an amount not to exceed $4,000,000.00 (�grant funds�) from the United States Department of Housing and Urban Development (HUD), for the Sweetwater Affordable Housing project, as provided for in the May 8, 2023 award letter provided by HUD to the County, a copy of which is attached the resolution as Exhibit A; and

2. Retroactively approve the County Mayor or County Mayor�s designee�s execution of the grant agreement between the County and HUD (�grant agreement�), in substantially the form attached to the resolution as Exhibit B and incorporated therein by reference, subject to the approval of the County Attorney�s Office for form and legal sufficiency; authorize the County Mayor or County Mayor�s designee to exercise the provisions contained in such grant agreement, including termination and amendment provisions, so long as such amendments are consistent with the purpose of this resolution; and further authorize the County Mayor or County Mayor�s designee to execute other necessary documents as may be required by HUD for the grant project; and

3. Scope
The proposed project is in the City of Sweetwater within County Commission District 12, represented by Juan Carlos Bermudez, but will have countywide impact because of the proposed number of affordable housing units.

Delegation of Authority
This item requests a delegation of authority to authorize the County Mayor or the County Mayor�s designee to complete standard forms and required materials to receive grant funds, execute the grant agreement with HUD, receive and expend grant funds, execute an agreement with the developer, CREI Holdings, LLC, and execute all necessary agreements for the receipt and expenditure of such funds, and exercise all provisions contained therein, subject to the County Attorney�s Office�s approval for form and legal sufficiency.

Fiscal Impact/Funding Source
This grant project provides for a positive fiscal impact to the County in the amount of $4,000,000.00, with no matching funds required.

Track Record/Monitor
Alex R. Ballina, Director, Public Housing and Community Development Department (PHCD), will oversee the Economic Development Initiative/Community Project Funding project and grant funds. PHCD will monitor all projects to ensure compliance with Federal, State and County guidelines and policies.

Background
On January 24, 2023, PHCD received an award notification from the U.S. Department of Housing and Urban Development (HUD) for the FY 2023 Economic Development Initiative/Community Project Funding (CPF) grant program for the Sweetwater Affordable Housing project. The notification was accompanied by a joint explanatory statement (JES). According to the JES, the CPF grant was requested by U.S. Congressman Mario Diaz-Balart. PHCD did not apply for or request the awarded funding.

In the Consolidated Appropriations Act, 2023 (Public Law 117-328), Congress made $2,982,285,641 in funding available for grants for the CPF program. CPF grants are selected through a congressionally-directed application process, providing investments in a wide variety of projects such as housing, homelessness prevention, workforce training, public facilities, parks, resilience planning, and other critical infrastructure and services. HUD is responsible for administering the funds but does not facilitate the grant application process.

On May 8, 2023, PHCD received the Grant Award Letter (GAL), a copy of which is attached the resolution as Exhibit A. The GAL outlines initial grant award requirements and information needed to prepare and execute the grant agreement. Among the requirements are HUD standard forms, which includes Standard Form�424 Application for Federal Assistance.

The Sweetwater Affordable Housing project is Li�l Abner III (the �Project�), a 328-unit, senior, affordable mixed-income multi-family housing development to be located on a 4-acre� site in the City of Sweetwater (the �City�). The Project is being developed by CREI Holdings, LLC (�CREI�). CREI is the subrecipient of the grant funds. CREI is the Project developer. CREI has been and continues to be wholly responsible for developing and causing to be approved the building plans, constructing the Project, managing the leasing, and maintenance of the Project.

The project site is generally located on NW 4th Terrace, between NW 112th and 114th Avenues, straddling two folioed parcels (25-4006- 087-0010 and 25-4006-001-2431) (the �Project Site�). The Project Site is vacant, occupying land that previously constituted part of the common areas of the surrounding Li�l Abner Mobile Home Park. The Project Site is wholly owned by CREI and is the third in a series of senior housing projects in and abutting the Project Site, also developed by CREI. Li�l Abner 1, located to the west of the Project Site, is an 87-unit multi- family rental community, and Li�l Abner 2, located to the east of the Project Site, is a 244-unit multi-family rental community; both are also senior, affordable mixed income projects.

The Project will contain 328 1- and 2-bedroom units distributed in one eight-story building. The Project will have one hundred eighty-four (184) 1-bedroom units, one hundred twenty-eight (128) 2-bedroom units, and sixteen (16) 3-bedroom. Each unit is well apportioned with ample living spaces and walk-in closets and features central cooling and heating and in-unit washers and dryers. The Project will also contain communal amenities, including fitness center, residents� lounge, green spaces, and storage. The Project is an affordable housing community, though it will have a mix of incomes within the appropriate affordability range. The target populations for the project are as follows:

* Forty percent of the units, or 131 units, at eighty percent of area median income (AMI);
* Sixty percent of the units, or 197 units, at one-hundred twenty percent AMI.

Additionally, approximately forty percent (40%) of the Project will be restricted to individuals 55 years of age and older, qualifying the Project as Senior Housing.

As the grantee, Miami-Dade County will have sole access to the grant funds. Miami-Dade County will ensure the proper use of the grant funds and will be responsible for disbursing the funds to the subrecipient for eligible costs, as approved by HUD, during the grant term, which ends on August 31, 2031.

PHCD requests that the Board adopt a resolution authorizing the recommendations described above.
