TITLE RESOLUTION AUTHORIZING THE CONVEYANCE OF COUNTY-OWNED LAND, REFERRED TO AS "PARCEL 108," TO THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION FOR ROAD IMPROVEMENTS TO STATE ROAD 934 (HIALEAH EXPRESSWAY/ N.W. 74th STREET CONNECTOR) AT STATE ROAD 969 (MILAM DAIRY ROAD/ N.W. 72nd AVENUE) IN MIAMI-DADE COUNTY, FLORIDA BODY WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board hereby authorizes the conveyance of County-owned land by County Right-of-Way Deed, in substantially the form attached hereto and made a part hereof, to the State of Florida Department of Transportation; authorizes the Mayor to execute said County Right-of-Way Deed for and on behalf of Miami-Dade County and authorizes the Miami-Dade Transit Director to cause said instrument to be recorded in the Public Records of Miami-Dade County and to be delivered to the State of Florida Department of Transportation. HEADER To: Honorable Chairperson and Members DATE: Board of County Commissioners FROM: Steve Shiver SUBJECT: Resolution Authorizing County Manager Conveyance of County-owned Land to Florida Department of Transportation for Road Improvements to S.R. 934 (Hialeah Expressway) STAFF RECOMMENDATION It is recommended that the Board adopt the attached resolution authorizing the conveyance of County-owned land, referred to as "Parcel 108," to the Florida Department of Transportation (FDOT) for road improvements to State Road (SR) 934 (Hialeah Expressway). MANAGER'S BACKGROUND Managing Department Miami-Dade Transit (MDT) FDOT Reference Parcel 108 Size and Location 5,441 sq.ft. at the SE corner of SR 934 (Hialeah Expressway/NW 74th Street Connector) and SR 969 (Milam Dairy Road/NW 72nd Avenue) running North/South on a portion of SR 969 and East/West on a portion of SR 934. The vacant parcel is approximately 600 feet long, 23 feet at its widest point and narrow and tapering. Section Section 14, Township 53 South, Range 40 East Acquisition Parent tracts were acquired by Warranty Deed to Miami-Dade County for the purpose of constructing the Stage I Metrorail Rapid Transit System and its associated rail maintenance facility known as the Lehman Center in accordance with all federal acquisition guidelines in place at the time. O.R. Book 10531, Page 788, dated September 28, 1979, filed October 3, 1979; O.R. Book 10744, Page 1935, dated September 28, 1979, filed May 8, 1980. Zoning RTZ (Rapid Transit Zone) per Chapter 33C Value Using the County's 2001 Assessed Value per square foot of the parent tracts, Parcel 108 would be assessed at $27,205. Legal Description Parcel 108 is legally described in Exhibit "A". Sketch Parcel 108 is depicted in Exhibit "B". Florida Statute No advertisement is required for property transactions between Miami-Dade County and the State of Florida pursuant to Florida Statute No. 125.38. Justification FDOT proposes to widen a 1.96 mile stretch of (SR) 934 between SR 823 (Red Road or N.W. 57th Avenue or West 4th Avenue) and SR 826 (Palmetto Expressway) and requests conveyance of Parcel 108 of Miami-Dade County land to help upgrade and improve the intersection and one right-hand turn lane in this area. The project, referred to as Financial Project I.D. No. 2499851, is expected to commence in March, 2003. It will serve the Hialeah-Medley area through the year 2022 and is consistent with the approved Year 2015 Long-Range Transportation Plan of the Metropolitan Planning Organization (MPO). Exchange FDOT, in exchange for the County's conveyance of Parcel 108, has agreed to design and build, at no cost to the County, a concrete retaining barrier wall at the Lehman Center for MDT purposes. The wall will be included in the project plans for SR 934. The northernmost Metrorail tracks at the Lehman Center are located on state property under a Deed of Easement recorded November 10, 1981 in O.R. 11266, Page 1836. This Easement lies immediately east of Parcel 108 and immediately south of the proposed new roadwork on SR 934. The new wall will replace an existing wood tie retaining wall, approximately 60 feet in length and transitioning in height from 2 to 5 feet. MDT had planned on replacing the wood wall, at its sole expense, in 2007. FTA Approval The Federal Transit Administration (FTA) approved the conveyance of this parcel, which was purchased with federal funds for the Stage I Rapid Transit System, to FDOT. |
