TITLE RESOLUTION RATIFYING THE MAYOR OR MAYOR�S DESIGNEE�S ACTION OF APPLYING FOR, RECEIVING, AND EXPENDING STATE OF FLORIDA DEPARTMENT OF LAW ENFORCEMENT ANTI DRUG ABUSE FUNDS FROM THE U.S. DEPARTMENT OF JUSTICE; AUTHORIZING THE MAYOR OR MAYOR�S DESIGNEE TO EXECUTE SUCH CONTRACTS, AGREEMENTS, MEMORANDA OF UNDERSTANDING, AND AMENDMENTS AFTER APPROVAL BY THE COUNTY ATTORNEY; AUTHORIZING THE MAYOR OR THE MAYOR�S DESIGNEE TO APPLY FOR, RECEIVE, AND EXPEND ADDITIONAL FUNDS THAT MAY BECOME AVAILABLE BODY WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference; and WHEREAS, this Board has adopted Resolution No. R-613-11, authorizing the County Mayor or County Mayor�s designee to administer County business during the Board of County Commissioners� 2011 summer recess as provided therein, and has directed that all actions taken pursuant to such authority be submitted to this Board for ratification at its October 4, 2011 meeting, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board ratify the County Mayor or County Mayor�s designee�s action of applying for, receiving, and expending grant funds from the State of Florida Department of Law Enforcement Anti-Drug Abuse Act Fund, through the Edward Byrne Memorial Justice Assistance Grant (JAG) Program of the U.S. Department of Justice in the amount of $978,151; authorizes the Mayor or the Mayor�s designee to execute such contracts, agreements, Memoranda of Understanding (MOU), and amendments, after approval by the County Attorney, as required by program guidelines; authorizes the Mayor or the Mayor�s designee to apply for, receive, and expend additional funds that may become available during the term of the grant; to file and execute any amendments to the application for and on behalf of the County; and to exercise amendments, modifications, renewal, cancellation, and termination clauses of any contracts and agreements, subject to the approval of the County Attorney�s Office. Gimenez Mayor Subject: Ratifying Miami-Dade County�s State of Florida Department of Law Enforcement Anti-Drug Abuse Act Fund Grant Application in the Amount of $978,151 STAFF RECOMMENDATION Recommendation It is recommended that the Board of County Commissioners (Board) approve the attached resolution ratifying the County Mayor or County Mayor�s designee�s action of applying for, receiving, and expending grant funds from the State of Florida Department of Law Enforcement Anti-Drug Abuse Act Fund, through the Edward Byrne Memorial Justice Assistance Grant (JAG) Program of the U.S. Department of Justice, in the amount of $978,151. With approval of this resolution, the Board authorizes the County Mayor or the County Mayor�s designee to execute such contracts, agreements, Memoranda of Understanding (MOU), and amendments, after approval by the County Attorney, as required by program guidelines. It is further recommended that the Board authorize the County Mayor or the County Mayor�s designee to apply for, receive, and expend additional funds that may become available during the term of the grant; to file and execute any amendments to the application for and on behalf of the County; and to exercise amendments, modifications, renewal, cancellation, and termination clauses of any contracts and agreements, subject to the approval of the County Attorney�s Office. Scope This initiative consists of 36 sub-projects that will be implemented by three County Departments (Human Services, Juvenile Services, and Miami-Dade Police); Miami-Dade County Public Schools Police Department; and 30 municipalities. As such, the services to be provided with this grant funding throughout the County with the exception of those municipalities not participating, which are: Bal Harbor, Bay Harbor Islands, Indian Creek, Islandia, and Virginia Gardens. The project goals are to: 1) increase public safety for the residents of Miami-Dade County by providing funding for projects that address the problems of illegal drug use and violent crime; 2) provide crime prevention and education; and 3) improve the criminal justice system�s response and performance in processing drug-related cases. Fiscal Impact/Funding Source This grant will provide a one-year grant award in the amount of $978,151. Matching funds are not required. Funding will serve to help offset anticipated budget reductions in funding of criminal justice and law enforcement services and programs in Miami-Dade County by the State of Florida. Track Record/Monitor The Miami-Dade County Office of Grants Coordination (OGC) will handle project administration and management. OGC will handle the disbursement and expenditure of grant funds, and manage programmatic and fiscal reporting in accordance with project reporting and auditing procedures stipulated by the U.S. Department of Justice, and the State of Florida Department of Law Enforcement. MANAGER'S BACKGROUND Background Local Share JAG funds have been awarded to Miami-Dade County since 1991. Beginning in 2009, the Edward Byrne Memorial Justice Assistance Grant (JAG) has been administered by OGC. The Anti-Drug Abuse Act funds are used to implement criminal justice projects designed to reduce drug-related crime and violence, and initiate criminal justice system improvements. Miami-Dade County's application will continue to fund the JAG program, which includes 30 participating local municipalities, each utilizing their funds in one of three project areas: 1) School Resource Officer support, 2) Criminal Justice Records Improvement, and 3) Domestic Violence as well as five countywide projects: * Byrne Grant Administration, * Civil Citation Enhancement Project, * Miami-Dade Police Department Crime Prevention Project, * Miami-Dade Schools Police Gang Abatement Project and * Intensive Day/Night Treatment Program. The short turnaround time imposed by the application deadline did not allow sufficient time for the processing of the resolution, and its submission to the Board prior to submission of the application. ____________________ Deputy Mayor |
