TITLE
RESOLUTION AUTHORIZING THE CONVEYANCE OF AN EASEMENT TO THE FLORIDA POWER AND LIGHT COMPANY (FPL), FOR $1.00, TO SERVICE THE WEST LOT MULTI-USE FACILITY, THROUGH COUNTY-OWNED LAND LOCATED AT 220 N.W. 3 STREET, MIAMI; AND AUTHORIZING THE COUNTY MAYOR OR COUNTY MAYOR’S DESIGNEE TO EXECUTE AN EASEMENT

WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference,

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board hereby authorizes the conveyance of an Easement to the Florida Power and Light Company (FPL), for $1.00, as described in the Easement, in substantially the form attached hereto and made a part hereof, and authorizing the County Mayor or County Mayor’s Designee to execute said Easement on behalf of Miami-Dade County.

STAFF RECOMMENDATION
RECOMMENDATION
It is recommended that the Board approve the attached resolution authorizing the conveyance of an easement to the Florida Power and Light Company (FPL), to service the West Lot Multi-Use Facility, through County-owned land located at 220 N.W. 3 Street, Miami, FL. The item was prepared by the Internal Services Department.

ZONING: G/I – Government and Institutions. According to Permitting, Environment and Regulatory Affairs, the existing use is a permitted use under the current zoning.

BACKGROUND: On February 8, 2010, the County Manager approved the Recommendation for Award for a design-build contract for the West Lot Multi-Use Facility, located at 220 NW 3 Street, Miami, FL. The construction commenced on February 25, 2010 and is expected to be completed by February 24, 2012.

JUSTIFICATION: FPL has requested a ten foot wide easement, located in close proximity to the building along the north side of the property, for the construction, operation and maintenance of underground electrical facilities to service the FPL Vault.

FISCAL IMPACT/
FUNDING SOURCES: The grant of easement has no fiscal impact to the County. The West Lot Multi-Use Facility project is funded by Capital Asset Acquisition Bonds 2009 proceeds. Index Code CPES9BGSMUFC Sub object Code 94210.

AUTHORITY: Authorizes the County Mayor or County Mayor’s designee to execute this easement in substantially the form attached hereto.
