TITLE RESOLUTION REQUESTING THE BOARD OF COUNTY COMMISSIONERS TO WAIVE TERM LIMITS BY A 2/3 VOTE FOR ENVIRONMENTAL QUALITY CONTROL BOARD MEMBER DR. WILLIAM E. HOPPER AND TO REAPPOINT DR. HOPPER TO ANOTHER THREE-YEAR TERM BODY WHEREAS, on January 21, 2010, the Board of County Commissioners adopted Ordinance No. 10-06, amending Chapter 2, Section 2-11.38.2 of the Code of Miami-Dade County, to allow the Board of County Commissioners to waive term limits for advisory board members by a resolution adopted by a two-thirds (2/3) vote of members present; and WHEREAS, the Miami-Dade County Environmental Quality Control Board is a quasi-judicial board, highly scientific and technical in nature; and WHEREAS, due to the highly scientific and technical nature of the matters which the Environmental Quality Control Board hears, the composition and membership of the Environmental Quality Control Board requires members with advanced degrees and qualifications unique to environmental disciplines; and WHEREAS, Dr. William E. Hopper is highly qualified and has served with distinction on the Environmental Quality Control Board and has reached his term limit as a member of the Environmental Quality Control Board; and WHEREAS, Dr. William Hopper�s continued service ensures the effective operation of the Environmental Quality Control Board, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board hereby waives the term limits for Dr. William Hopper by a two-thirds (2/3) vote of members present and reappoints him to serve another three-year term as member of the Environmental Quality Control Board. Gimenez County Mayor Subject: Resolution Requesting the Board of County Commissioners to Waive Term Limits for Environmental Quality Control Board Member Dr. William E. Hopper and to Reappoint Dr. Hopper to Another Three-Year Term STAFF RECOMMENDATION Recommendation It is recommended that the Board of County Commissioners (Board) approve the attached resolution requesting that term limits for Environmental Quality Control Board member Dr. William E. Hopper be waived and that Dr. Hopper be reappointed to serve another three-year term on the Environmental Quality Control Board. Scope The Environmental Quality Control Board hears cases from all areas of the County. Fiscal Impact/Funding Source This resolution has no fiscal impact as members of the Environmental Quality Control Board are not compensated for their duties. Track Record/Monitor The Assistant Director of the Department of Regulatory and Economic Resources/Environmental Resources Management, Mr. Lee Hefty, will monitor the outcome of this resolution. MANAGER'S BACKGROUND Background On January 21, 2010, the Board of County Commissioners enacted Ordinance No. 10-06, allowing the term limit of eight (8) consecutive years for County board members to be waived by a vote of the Board of County Commissioners. The Environmental Quality Control Board is a quasi-judicial County board that hears appeals, variances and time extension requests for highly scientific and technical matters under Chapter 24 of the Code of Miami-Dade County. The composition and membership of the Environmental Quality Control Board require advanced degrees and qualifications unique to environmental disciplines. The Environmental Quality Control Board is composed of five (5) members, of which two (2) must have Ph.D. degrees in biology, one (1) must have a Ph.D. degree in biochemistry and two (2) must have professional engineering licenses and experience in sanitary engineering. Members are appointed by the Board of County Commissioners and serve staggered 3-year terms. Dr. Hopper has a Ph.D. degree in biochemistry, is highly qualified, and has served with distinction on the Environmental Quality Control Board. Dr. Hopper is currently a member of the Environmental Quality Control Board and his term expires in December 2012. His continued service ensures the effective operation of the Environmental Quality Control Board. The attached resolution requests that the term limit for Dr. Hopper be waived and that he be reappointed to serve another three-year term on the Environmental Quality Control Board. _______________________________ Jack Osterholt, Deputy Mayor |
