REPORT: County Attorney Robert Cuevas advised that the members of the public should be given an opportunity to speak on Agenda Items 14A18 to 14A21. Chairman Monestime asked whether any members of the public wished to speak on Agenda Items 14A18 to 14A21. Mr. Matthew Land, 14 NE 1st Ave., Suite 1200, Miami, Florida, appeared before the Board in support of this resolution implementing an ordinance that was passed by this Board in March 2014. He stated that once this resolution was implemented, projects over $1 million, using tax payer dollars, or located on County-owned property, would aspire to achieve 51 percent of the labor hours performed by Miami-Dade County residents. He thanked Chairman Monestime for bringing forth this item. Commissioners Jordan and Moss requested to be listed as co-sponsors to Agenda Item 14A21. Commissioner Sosa pointed out that if the Board members passed this item, they would be mandating the creation of another Contract Compliance Officer position; and this position would be funded through the budget. She suggested that this position be funded by one of the community agencies tasked with helping residents who lived in neighborhoods with on-going development projects find work. Deputy Mayor Edward Marquez reported that the funds for the position had already been included in the proposed budget. He said that he would look into the possibility of supplementing the funds through other sources. Ms. Jennifer Moon, Budget Director, Office of Management and Budget, explained that the ordinance had already passed; and this item was its implementing order. She said the ordinance indicated that another position would be required; therefore, it was included in the proposed budget. Commissioner Moss requested a follow-up presentation to the Board on all programs, such as First Source, and Community Workforce, to ensure that they were helping residents who lived in neighborhoods with on-going development projects find work. He requested that the presentation be made prior to receiving the required initial report. Commissioner Edmonson requested to be listed as a co-sponsor to Agenda Item 14A21, and said she agreed with Commissioner Moss’ request. Commissioner Jordan noted in order to perform the departments and agencies must have sufficient resources. She lamented that employees were expected to do more with less, noting it was disingenuous to create programs, yet not allocate sufficient resources to carry out these programs. Commissioner Jordan stated that Residents First Training and Employment Program was an initiative that should have come with staffing. She noted the Small Business Development Division (SBD) should be monitoring every major County contract to ensure that local residents were given the preference. In response to Commissioner Jordan’s question regarding the threshold at which the division started monitoring contracts, Mr. Gary Hartfield, Director, Small Business Development Division, Internal Services Department, informed her that the division started monitoring contracts over $100,000 at the time of award of contract; this represented eight percent of all contracts. Commissioner Jordan stressed that the Board needed to be committed to small businesses being a part of County government. She mentioned Commissioner Edmonson’s request to sponsor the recommendations from the Disparity Study. She noted one of the recommendations was that SBD should be a department and not a division; and she requested to be a co-sponsor of that item once Commissioner Edmonson brought it forth. Commissioner Moss pointed out that the SBD division was only one of the actors responsible to ensure that diversity was considered in hiring decisions; other actors, such as the Water and Sewer Department, and the Miami Airport should also be encouraged to take into consideration diversity when hiring for openings. Commissioner Jordan stressed that not all of those departments had a small business component; the Water and Sewer Department was only now getting one. She requested to receive a report on the volume of contracts that were being monitored by SBD, compared to the volume of contracts that were not being monitored. Mr. Hartfield said that his office was currently preparing such a report. Commissioner Sosa requested to receive a report on the efforts of all Community-Based Organizations that received County funding for job creation. Hearing no further questions or comments, the Board proceeded to vote on the foregoing proposed resolution, as presented.

REPORT: The foregoing proposed resolution was initially carried over due to the loss of a quorum by the Economic Prosperity Committee. SPECIAL NOTE: The Clerk of the Board received the appropriate memorandum from Chairman Monestime dated July 13, 2015 entitled “Waiver of Item to the July 14, 2015 BCC Meeting” requesting that the Board’s Rules of Procedures be waived to allow the foregoing proposed resolution to be heard at the July 14, 2015 Board meeting.

TITLE
RESOLUTION CREATING AND APPROVING IMPLEMENTING ORDER NO. 3-61 RELATED TO THE RESIDENTS FIRST TRAINING AND EMPLOYMENT PROGRAM

BODY
WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum and Implementing Order, copies of which are incorporated herein by reference,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that the Board approves the attached Implementing Order (�IO�) No. 3-61, created for the County�s Residents First Training and Employment Program pursuant to Ordinance No. 14-26, and authorizes the County Mayor or County Mayor�s designee to exercise any and all rights conferred therein.

STAFF RECOMMENDATION
Recommendation
Pursuant to Ordinance No. 14-26, which was adopted by the Board of County Commissioners (Board) on March 4, 2014, the accompanying resolution and proposed Implementing Order No. 3-61 relating to the Residents First Training and Employment Program (Program) is recommended for Board approval.

As directed under Ordinance No. 14-26, Implementing Order No. 3-61 establishes the procedures relating to compliance with the Program, review and investigation of allegations of noncompliance, sanctions for failure to comply with the Program, and inclusion of all Program requirements in applicable solicitation documents and resulting contracts.

Scope
The scope of the Residents First Training and Employment Program is countywide in nature.

Fiscal Impact/Funding Source
At least one additional Contract Compliance Officer 2 (estimated at $70,000 per year) would be required to monitor the Program. At this time, there is no funding in the FY 2014-15 Adopted Budget for this position. However, the position will be added in the FY 2015-16 Proposed Budget.

Track Record/Monitoring
The Small Business Development Division Director, will be responsible for countywide oversight of the Program. Individual departmental contract managers will also be essential to ensure contractor compliance with the Program.

MANAGER'S BACKGROUND
Background
The overall goal of the Program is to promote employment and skill training opportunities for County residents, which in turn are expected to promote the successful execution and delivery of construction contracts throughout the County. The Program applies to: (1) the construction, demolition, alteration and/or repair of public buildings or public works projects valued in excess of $1,000,000, funded completely or partially by Miami-Dade County; and (2) privately-funded projects or leases valued in excess of $1,000,000 for the construction, demolition, alteration or repair of buildings or improvements on County-owned land, and which are subject to Section 2-11.16 of the Code of Miami-Dade County.

Some of the main requirements of the Program are as follows: (1) all persons employed by the contractor to perform construction shall have completed the �10-Hour - Construction� training course established by the Occupational Safety & Health Administration of the United States Department of Labor; and (2) contractors will make best reasonable efforts to promote employment opportunities for local residents and seek to achieve a project goal of having 51 percent of all construction labor hours performed by Miami-Dade County residents.

The attached Implementing Order No. 3-61 has been drafted to establish Program procedures, including monitoring and enforcement provisions, that will ensure countywide inclusion/adoption of the Program. The Small Business Development Division of the Internal Services Department will ensure that all necessary communications, memoranda, and guidance regarding this Program are provided to all County departments.
