REPORT: Commissioner Diaz said he wished to release the foregoing proposed resolution. He thanked all of the commissioners who requested to be listed as co-sponsors. Commissioner Levine Cava commended Commissioner Diaz for bringing forth this item, and for working on the task force. Commissioners Jordan, Sosa, Heyman and Souto requested to be listed as co-sponsors to the foregoing proposed resolution. Commissioner Souto recalled that in the past he had constantly complained about the illegal disposal of trash throughout the County. He emphasized the importance of educating the public about littering, of monitoring the entire community, and of imposing fines for those who violate the law. Commissioner Souto stressed the importance of keeping the County clean, not only for residents but also for tourists. Hearing no further questions or comments, the Board proceeded to vote on the foregoing proposed resolution, as presented.

TITLE
RESOLUTION URGING THE FLORIDA LEGISLATURE TO IMPLEMENT STRONGER PENALTIES FOR DUMPING LITTER

BODY
WHEREAS, dumping materials like tires, debris, old furniture and hazardous materials harms the environment, lowers property values and results in millions of dollars spent on enforcement and cleanup costs; and
WHEREAS, Florida Litter Law, codified in section 403.413, Florida Statutes, prohibits the unauthorized dumping of litter on any public property, private property and in any bodies of water; and
WHEREAS, pursuant to Florida Litter Law, any person who dumps 15 pounds or less of litter is guilty of a noncriminal infraction; any person who dumps 15 to 500 pounds of litter is guilty of a misdemeanor of the first degree; and any person who dumps more than 500 pounds of litter or hazardous waste is guilty of a felony of the third degree; and
WHEREAS, because of the harsh effects of illegal dumping, this Board would like the Florida Legislature to implement stronger penalties for illegal dumping,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board:
Section 1. Urges the Florida Legislature to implement stronger penalties for dumping litter.
Section 2. Directs the Clerk of the Board to transmit certified copies of this resolution to the Governor, the Senate President, the House Speaker, and the Chair and Members of the Miami-Dade State Legislative Delegation.
Section 3. Directs the County�s state lobbyists to advocate for the action described in Section 1 above, and authorizes and directs the Office of Intergovernmental Affairs to include this item to the 2018 State Legislative Package when it is presented to the Board
