TITLE
RESOLUTION DIRECTING THE COUNTY MAYOR OR COUNTY MAYOR�S DESIGNEE TO DETERMINE THE FEASIBILITY OF CONDUCTING WEEKLY BULKY WASTE COLLECTION SERVICES USING A SWEEP SYSTEM OF BOTH THE WASTE COLLECTION SERVICE AREA (''WSCA'') CUSTOMERS AND NON-WSCA CUSTOMERS AND TO PREPARE A REPORT

BODY
WHEREAS, illegal dumping in Miami-Dade County is a serious issue that creates a wide range of problems; and
WHEREAS, illegal dumping may pose serious environmental challenges and sometimes occurs on environmentally sensitive areas, such as wetlands; and
WHEREAS, illegal dumping may also be an economic threat to the County and its residents; and
WHEREAS, illegal dumping is a problem in the County�s residential areas, such as when violators illegally dump materials on a resident�s otherwise legal bulky waste pickup pile, causing an excess beyond the services included within the annual service fees; and
WHEREAS, illegal dumping is a problem in the County�s rural, agricultural areas, where violators illegally dump materials on the right-of-way or on another person�s real property; and
WHEREAS, this Board previously adopted Resolution No. R-1201-17 and directed the administration to create the Miami-Dade County 2017 Illegal Dumping Task Force (�the Task Force�); and
WHEREAS, the Task Force was created to investigate the causes and effects of illegal dumping in the County, and the applicable laws and regulations, enforcement, and punishment
relating to illegal dumping, and to make recommendations to the County�s Board of County Commissioners (the �Board�) and the County Mayor to better address and combat illegal dumping; and
WHEREAS, the Task Force issued its Illegal Dumping Task Force Report (�the Report�) on October 1, 2018; and
WHEREAS, at its December 4, 2018 meeting, the Board accepted the Report; and
WHEREAS, currently, the bulky waste collection service utilized by the Department of Solid Waste Management (�DSWM�) is �on-demand� or �scheduled,� where customers call-in or go online to schedule a bulky waste pickup; and
WHEREAS, bulky waste may not be placed curbside until a pickup is scheduled; and
WHEREAS, bulky waste collected by DSWM includes furniture, appliances and �white goods,� house fixtures (such as kitchen cabinets, bathtubs, sinks), mattresses, tree cuttings, electronic equipment, and disabled power tools (provided they are completely free of fluids and fuels), as well as construction and demolition materials; and
WHEREAS, DSWM�s Waste Collections Service Area (�WCSA�) currently consists of unincorporated Miami-Dade County and nine additional municipalities consisting of Aventura, Cutler Bay, Doral, Miami Gardens, Miami Lakes, Opa-Locka, Palmetto Bay, Pinecrest, and Sunny Isles Beach; and
WHEREAS, each residential unit in the WCSA is entitled to two bulky waste pickups per year of up to 25 cubic yards each, except that construction and demolition materials are limited to one cubic yard; and
WHEREAS, if a DSWM customer has used their available bulky waste pickups or they have more than 50 cubic yards for collection, they can take their remaining bulky waste to one of the 13 Neighborhood Trash and Recycling Centers, or pay DSWM a fee based on the cubic yardage, or they can hire a private hauler permitted by DSWM to remove the bulky waste; and
WHEREAS, in an effort to prevent illegal dumping, the Report recommended, among other things, a study of the feasibility of performing bulky waste collection on a weekly basis using a sweep system, which involves driving by specified locations on a set schedule; and
WHEREAS, the Report also recommended studying the feasibility and cost of extending the bulky waste collection delivery model using a sweep system to non-WCSA customers in an effort to prevent illegal dumping,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board:
Section 1. Directs the County Mayor or County Mayor�s designee to determine the feasibility of moving the bulky waste collection delivery model to a sweep system with pickups occurring on a weekly basis (�sweep system�), and the feasibility of extending the sweep system to nonWSCA customers. The County Mayor or County Mayor�s designee shall ensure that the feasibility study, at a minimum:
1) determines whether the sweep system can be accomplished based on variables like number of bulky waste collection crews, bulky waste set-out rate, pile size, and time between pickups;
2)� evaluates the cost and efficiency of using and implementing the sweep system Countywide;
3) evaluates the impact on traffic and local infrastructure of the sweep system, and of extending the sweep system to non-WSCA customers;
4) evaluates the impact and cost of implementing and using the sweep system on the Department of Solid Waste Management, and
5) evaluates by geographical location, with particular emphasis on areas where illegal dumping is most prevalent, the need, and demand, for the sweep system to non-WSCA customers as well as a price structure for non-WSCA customers.
Section 2. Directs the County Mayor or County Mayor�s designee to provide a report to this Board detailing the findings and recommendations of the feasibility study required herein within 120 days of the effective date of this resolution. Such report shall be placed on the agenda of the Board as required by Miami-Dade County Ordinance No. 14-65.
