REPORT: Commissioner Levine Cava commented on the need to continue observing the directive of wearing face masks and maintaining social distancing to reduce the risk of contamination. Commissioner Bovo asked Mayor Gimenez to schedule a Special meeting of the Board of County Commissioners (the Board) in late summer to discuss and review all of the measures taken to date to address the coronavirus disease 2019 (COVID-19) and how best to address this issue to be able to better engage and react if it were to ever happen again in the future. He asked that the Mayor provide at the Special meeting an in-depth briefing of how COVID-19 had been addressed in order to be able to write a manual on to address similar future state of emergency reoccurrences. Chairwoman Edmonson stated the proposed Special meeting of the Board would be scheduled for a time after the Coronavirus state of emergency was over. Commissioner Moss suggested Mayor Gimenez take similar steps with the banks, as it related to the lending of funds to provide assistance to businesses impacted by COVID-19, as its being currently done with the accountability of hospital beds in order to put pressure on banks to lend the funds provided by the federal government. Commissioner Jordan noted she supported the foregoing legislation as drafted, but she wished to have addressed the issues relating to the delivery of senior meals and the furloughs Jackson Memorial Hospital (JMH) was imposing on its employees. Pursuant to Commissioner Moss’s remarks, Mayor Gimenez responded he would ask banks for a report card on the lending of the funds provided by the federal government to assist businesses impacted by COVID-19 if it was found he had that authority. Mayor Gimenez advised the County Attorney had expressed concerns regarding the enforcement of having to wear a face mask; but the County needed to have a clear, unified message if another state of emergency were to happen again. He also stated food supplies needed to be local as much as possible. Chairwoman Edmonson asked Mayor Gimenez to require that the senior meals be labeled with its content and the preparation time.

TITLE
RESOLUTION RATIFYING CORONAVIRUS/COVID-19 STATE OF EMERGENCY ORDERS AND AMENDMENTS THERETO ENACTED BY THE MIAMI-DADE COUNTY MAYOR

BODY
WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference; and

WHEREAS, this Board wishes to ratify the County Mayor�s Emergency Orders,

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board ratifies the following Emergency Orders and amendments thereto enacted by the County Mayor: 01-20, 02-20, 03-20, 04-20, 05-20, 06-20, 07-20, 08-20, 09-20, 10-20, 11-20, 12-20, 13-20, 14-20 and 15-20.

Subject: Ratification of Emergency Orders Issued in Response to COVID-19 Pandemic

STAFF RECOMMENDATION
As you are all aware, I have signed a series of emergency orders and amendments to protect the health, safety and well-being of the 2.8 million residents of Miami-Dade County since first declaring a local State of Emergency due to the COVID-19 pandemic on March 12, 2020. These orders are posted on the miamidade.gov/coronavirus website, and I have also attached them as part of this memorandum for your convenient reference. Following is a quick summary of my Emergency Orders signed to date:

� Emergency Order 01-20 ordered the closure of certain congregate meal sites and community centers and directed County staff to provide food service for the duration of the state of emergency.

� Emergency Order 02-20 ordered the closure of restaurants, bars, taverns, pubs, night clubs, banquet halls, cocktail lounges, cabarets, breweries, cafeterias and any other alcohol or food service establishments between 11 p.m. and 6 a.m., with certain exceptions for grocery stores, delivery services, and similar operations.

� Emergency Order 03-20 ordered the closure of restaurants, bars, taverns, pubs, night clubs, banquet halls, cocktail lounges, cabarets, breweries, cafeterias and any other alcohol or food service establishments at all hours, with certain exceptions for grocery stores, delivery services, and similar operations.

� Emergency Order 04-20 prohibited gatherings of more than 10 people in any parks, beaches, or recreation facilities owned or operated by Miami-Dade County.

� Emergency Order 05-20 prohibited the use of mopeds, common use motorized scooters, common use motorized bicycles, common use bicycles or any micromobility device on any public street or sidewalk within the limits of Miami-Dade County.

� Emergency Order 06-20, as amended, ordered the closure of all parks, beaches, and recreational facilities in the incorporated and unincorporated areas of Miami-Dade County.

� Emergency Order 07-20, as amended, ordered the closure of all non-essential retail and commercial establishments.

� Emergency Order 08-20 prohibited rafting, defined as the practice of tying together boats and vessels when the proximity is five feet or less, with certain emergency exceptions.

� Emergency Order 09-20, as amended, ordered hotels, motels, short-term vacation rentals and other commercial lodging establishments to not accept new reservations for persons other than essential lodgers, as defined in the order and further ordered short-term vacation rentals to limit their occupancy and no longer accept nightly or weekly rental agreements.
� Emergency Order 10-20 prohibited gatherings of 10 or more individuals on public streets, alleys, public ways, sidewalks or government facilities open to the public, with certain exceptions.

� Emergency Order 11-20 urged persons over 65 years of age and persons with serious underlying medical conditions that place them at a high risk of severe illness to stay home and take such other measures as necessary to limit their risk of exposure to COVID-19.

� Emergency Order 12-20 ordered the totality of the Mayor�s Emergency Orders be referred to as the �Safer at Home� protocols and urged all residents and visitors to remain in their homes other than to engage in essential activities as outlined in the �Safer at Home� protocols.

� Emergency Order 13-20 ordered all essential commercial and retail establishments in Emergency Order 07-30 to use reasonable efforts to maintain appropriate social distancing, particularly in checkout, pick-up or take-out areas, employee breakrooms and common use areas.

� Emergency Order 14-20 ordered suspension of all laws, statutes, codes and regulations relating to County employees performing building code functions, including, but not limited to, the review of plans, issuance of permits, performance of inspections and issuance of certificates of occupancy and completion and temporary certificates of occupancy, and all activities related thereto.

� Emergency Order 15-20 ordered closure of all pools, hot tubs, golf courses, tennis courts, basketball courts, fitness centers, gymnasiums and other common use amenities, whether of a commercial or non-commercial nature, for all purposes.

These orders in their totality reinforce the day-by-day monitoring approach that my administration and I took in consultation with medical experts to protect our community every step of the way, while allowing essential activity to continue to take place, as necessary.

As of the date of this memorandum, we have reached a point where I must articulate the need for all residents to stay at home except for when there is a need to perform essential activities like going to a medical appointment, getting gas, groceries or prescriptions from pharmacies, and to practice social distancing at all times, even within families. We are indeed �Safer at Home� as a community, and medical experts agree that this is the best way to prevent the spread of COVID-19 in the long term.

Pursuant to Section 8b-7 of the Miami-Dade County Code, all of the orders that I have signed since March 12, 2020 require ratification by the Board of County Commissioners. Therefore, I respectfully request that you ratify these orders so that we can continue to slow down the spread of COVID-19 in our community. I will continue to monitor the spread of the virus in consultation with our health and public safety experts, and will sign additional orders that are in the best interest of our entire community as this pandemic evolves. Thank you for your support.
