REPORT: Chairwoman Edmonson introduced the foregoing proposed special agenda item. Commissioner Levine Cava moved this item for discussion. This motion was seconded by Chairwoman Edmonson. Commissioner Martinez raised concern regarding the percentage rate the United Way charged for administrative fees. Office Management and Budget Director Ms. Jennifer Moon confirmed to Commissioner Martinez the administrative fees for the United Way were under 15% and not 40% in this particular instance. Commissioner Diaz requested that Special Agenda Item No. 9 be reconsidered to determine the percentage rate the United Way charged for administrative fees. This motion was moved by Commissioner Levine Cava and seconded by Commissioner Higgins and upon being put to a vote, the vote passed unanimously. Ms. Jennifer Moon confirmed to Commissioner Diaz that the United Way did not charge 40% administrative fee in this particular case. She indicated the administrative fee was 15% and was needed to administer the program. There being no further questions or comments, the Board proceeded to vote on the foregoing proposed special item.

RESOLUTION APPROVING TERM SHEET FOR A GRANT AGREEMENT WITH UNITED WAY OF MIAMI-DADE INC. WHEREAS, this Board desires to accomplish the purposes outline in the accompanying memorandum, a copy of which is incorporated herein by reference,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that:

Section 1. This Board approves the term sheet attached hereto as Exhibit 1 (�Term Sheet�), for a grant agreement (�Agreement�) with United Way of Miami-Dade Inc. (�UWMD�) in an amount not to exceed $20,000,000.00 in CARES Act funds for UWMD, in collaboration with local community-based organizations, to provide a short-term, hardship assistance program to assist Miami-Dade County residents affected by the COVID-19 pandemic.

Section 2. This Board authorizes the County Mayor or County Mayor�s designee to negotiate and execute the Agreement with UWMD. The Agreement shall include terms that are consistent with those set forth in the Term Sheet and such other customary grant provisions in County grant agreements, including, but not limited to, provisions related to the Florida Public Records Act and the County�s right to audit, review and monitor the expenditure of the grant funds.

Section 3. This Board authorizes the County Mayor or County Mayor�s designee to execute other required agreements and documents to effectuate the purpose of this resolution subject to subsequent approvals by the Board, if such agreements propose to commit additional funding from Miami-Dade County. This Board further authorizes the County Mayor or the County Mayor�s designee to exercise amendments, extensions, renewals, termination, waiver, and other provisions set forth in such agreements and documents necessary to further the purpose of this program, subject to approval for legal form and sufficiency by the Miami-Dade County Attorney�s Office.

Section 4. This Board hereby waives the requirements of Resolution No. R-130-06, which requires the underlying contract be fully negotiated prior to placement on the Board�s agenda, in order to provide the County Mayor or the County Mayor�s designee sufficient time to negotiate the Agreement with the UWMD.
Section 5. This Board directs the County Mayor or the County Mayor�s designee to provide a written report to this Board within 30 days, and every 30 days thereafter, detailing the status of the negotiations of the Agreement with UWMD until an Agreement is executed, and thereafter the monthly reports provided by UWMD. Such reports shall be placed on an agenda of the Board pursuant to Ordinance No. 14-65.

STAFF RECOMMENDATION
Recommendation
It is recommended that the Board of County Commissioners (Board) approve the attached resolution and term sheet authorizing a grant agreement between Miami-Dade County and United Way of Miami-Dade, Inc. (UWMD) for $20,000,000 in 2020 Coronavirus Aid, Relief and Economic Security Act (CARES Act) funding for its short-term, hardship assistance pandemic relief program assisting Miami-Dade County residents affected by the coronavirus disease 2019 (COVID-19) pandemic. UWMD will work in collaboration with community-based organization�s in accordance with the requirements set forth in the term sheet. It is further recommended that the Board authorize the County Mayor or County Mayor�s designee to negotiate and execute the grant agreement with UWMD, other required agreements and documents, as well as amendments, extensions and renewals of such agreements and documents to implement the program; and to exercise termination, waiver and other provisions set forth therein. It is further recommended that the Board waive Resolution No. R-130-06, which requires the underlying contract be fully negotiated prior to placement on the Board�s agenda, in order to give the County Mayor or the County Mayor�s designee time to negotiate the terms set forth in the term sheet shown as Exhibit 1 to the attached resolution. Finally, it is recommended that the County Mayor or the County Mayor�s designee provide reports as described in the term sheet.

Scope
This award will assist income constrained residents countywide whose income has been adversely affected due to the COVID-19 pandemic.

Fiscal Impact/Funding Source
The impact to Miami-Dade County for the provision of these services is $20,000,000 from the CARES Act funding. No general fund dollars will be used to support this initiative.

Track Record/Monitor
Office of Management and Budget Assistant Director, Daniel T. Wall, will be responsible for monitoring and compliance with all local, state and federal programmatic, fiscal and administrative requirements.

Background
The public health emergency caused by COVID-19 has created an immediate and serious economic impact in Miami-Dade County, particularly on income constrained households. As the pandemic continues, families across the County have lost their jobs, seen their income decrease and now face challenges when it comes to being able to meet their basic expenses such as housing, food, transportation, healthcare and utilities. Through funding received by Miami-Dade County through the CARES Act, and in partnership with the UWMD, we are able to support families during these uncertain times.

The UWMD, in collaboration with several community-based organization non-profit partners, established the Miami Pandemic Assistance Program to address the negative short-term impacts of COVID-19 on working families in the County. Current non-profit implementation partners were selected based on previous experience working with UWMD to provide post-disaster emergency financial assistance, geographic location, experience with various target populations and their capacity to process client applications and payments. These community-based organization non-profit partners and their respective primary target population are: Branches, Inc. (countywide); Catalyst Miami, Inc. (countywide); Centro Campesino-Farmworker Center, Inc. (migrant community); ConnectFamilias, Inc. (Little Havana); Jewish Community Services of South Florida, Inc. (countywide); Miami-Dade County Community Action and Human Services department (countywide); Mujeres Unidas en Justicia y Reforma, Inc. (migrant community); Haitian Neighborhood Center, Sant La, Inc. (Haitian community); CCDH, Inc. dba The Advocacy Network on Disabilities (households with a disability); UWMD � Mission United (veterans); UWMD � Center for Financial Stability (clearinghouse); Youth Co-op, Inc. (countywide); and YWCA South Florida, Inc. (countywide). Based on available funding and demand, UWMD may consider adding additional nonprofit partners as needed.

UWMD began accepting online applications for assistance from households on March 25, 2020 and, as of June 22, 2020, had received 6,637 requests for assistance and provided assistance to 1,120 households, representing 4,167 individuals impacted by COVID-19. A total of 5,159 households remain on a waiting list and the application portal will be reopened pending the receipt of additional funding. Approximately 350 applications have been placed on hold or stopped based on either not meeting eligibility criteria or possible duplication.

In an effort to assist local income-constrained residents who have experienced a reduction or loss of income due to COVID-19, the County will develop and execute a grant agreement with UWMD in accordance with the term sheet and CARES Act requirements to provide hardship assistance for basic living expenses. This includes food, utilities, medical expenses, childcare, transportation, temporary alternative accommodations (isolation) and rental assistance, if not otherwise receiving these benefits from other programs or funding sources. The effective term of the agreement will be June 30, 2020 to December 30, 2020. Applicants may apply online at the UWMD website or in-person at one of the community-based organization nonprofit partner sites. Applications are reviewed by the UWMD�s clearinghouse, Center for Financial Stability, and screened for possible duplication. Following this, they are referred to a community-based organization nonprofit partner for processing. The anticipated impact of this grant is that approximately 8,500 households will receive assistance ranging from $750-$2,000 per household.

Eligibility is determined based on the applicant�s driver�s license and prior year tax return indicating that the household is at or below the United Way�s 2020 Florida Report - Asset Limited, Income Constrained, Employed (ALICE) threshold for Miami-Dade County. Using 2018 data, the Household Survival Budget threshold for the county is: $28,008 for a single adult; $43,716 for two adults; and $76,692 for two adults with two children in childcare. The United Way�s 2020 Florida Report and ALICE criteria for Miami-Dade County may be found at https://www.uwof.org/alice. Applicants that do not have a prior year tax return are referred for free tax preparation services and may be qualified through that process. In isolated instances, applicants may be qualified based on alternative financial eligibility documentation. Applicants must also attest that all information provided is true and accurate and acknowledge that the program reserves the right to reclaim any assistance acquired through fraudulent or misleading claims.

A 25 percent advance will be issued upon execution of the grant agreement, and additional disbursements released in advance on an as needed basis based on documented expenditures. Any funding projected to remain unspent at the end of the agreement will be recaptured by the County. The UWMD will provide monthly reports to the County, which will be shared with the Board. These reports will identify the number of households receiving assistance per zip code, the race/ethnicity of households being served, the type of assistance provided per household, the family size per household, dollar amount allocated per household and total expenditures.
