REPORT:
Mr. Gary Hartfield, Division Director of the Internal Services Department, Division of Small Business Development (SBD), provided information about the item�s winning bidder, Chi-Ada Corporation (Chi-Ada), which included when it was certified in the Small Business Enterprise (SBE) and the Disadvantaged Business Enterprise (DBE) Programs from December 31, 2016 to December 31, 2019. He said Chi-Ada graduated from the program because it was no longer a small business.
Chairwoman Edmonson requested clarification about Chi-Ada being awarded the contract in the proposed resolution while it was investigated about its SBE status. Mr. Hartfield corrected that the company was not under investigation at the time it was awarded the contract.
Ms. Tara Smith, Director of the Internal Services Department (ISD), explained how Chi-Ada won the bid; at the time of their bid in July 2019 the company was part of the SBE and received a five-percent bid preference as per County policy. Commissioner Sosa pointed out that two and a half hours after Chi-Ada won the bid, the company received notification they were not a small business anymore.
Commissioner Heyman voiced her concerns with the existing Code and how it permitted the awarding of bid preference points; she suggested the County Attorney�s Office prepare legislation to amend the process. She also asked about the high amount of funding for janitorial services at the County�s downtown buildings because most of the County�s workforce worked remotely due to the coronavirus disease 2019 (COVID-19) pandemic. Commissioner Martinez also concurred about thesewith the funding concerns raised and added there appeared to be overcharges for the services.
Ms. Smith explained the enhanced janitorial services cost more because of COVID-19 concerns and acknowledged that cleaning costs had increased. Even though most of the County workforce was virtual, she noted there were County facilities which still had a large on-site workforce. However, Ms. Smith said ISD would examine the costs and adjust them.
Mr. Hartfield stated that SBD was aware of Chi-Ada�s changing status six months before its graduation, partly from the fact the company earned more than $5 million in October 2019.
According to Mr. Hartfield, Chi-Ada was eligible to bid on the contract because at the time of their initial bid, the company was still in the SBE. He added even though Chi-Ada graduated from the SBE program it was still entitled to the contract because it placed its bid before graduation. Mr. Hartfield also reported in October 2019, SBD was aware that Chi-Ada�s eligibility status would change.
Commissioner Sosa questioned Chi-Ada�s eligibility because of the close timeline at the time of its bid. She also pointed out that another company, which was not part of the SBE, made a lower bid but lost because Chi-Ada applied the five-percent bid preference and won the contract.
Commissioner Levine Cava stated the procurement process was confusing and appeared unfair. Mr. Hope reiterated that under SBD guidelines even if a company transitioned from a small business it was eligible for the contract because at the time of bid the company was a small business. Mr. Hartfield added that SBD was responsible for vetting the eligibility of bidders, which included Chi-Ada. After Mr. Hope confirmed the process followed an implementing order, Commissioner Levine Cava agreed the process was consistent with Code, though she still had concerns about the process.
Commissioner Diaz opined Chi-Ada received an unfair benefit, even though it was a small company at the time of the bid, because it was about to graduate into a larger business.
After Mr. Hartfield confirmed that, at times, a company could fall back under the SBE criteria and detailed Chi-Ada�s history in the program and its bid, Commissioner Jordan said she did not see any issue with the Code.
Ms. Namita Uppal, Chief Procurement Officer at ISD, used the janitorial services at the Stephen P. Clark Government Center as an example to explain the high cleaning costs, broken down by hours worked by janitorial employees.
Commissioner Martinez had more questions about the budget, Ms. Uppal�s breakdowns, and other aspects of the item, but needed more time to examine them.
Commissioner Martinez moved to defer the item, which was seconded by Commissioner Heyman.
There being no further comments, the Board proceeded to vote to defer the foregoing proposed resolution.

REPORT:
Commissioner Jordan raised an issue with the proposed resolution which asked the Board to approve an emergency contract to Vista Building Maintenance Services, Inc. for janitorial services at the Internal Services Department�s (ISD) downtown facilities. She stated the item should have come to the Board 120 days after the emergency declaration. However, the item was before the Board more than 300 days after the declaration and Commissioner Jordan wanted an explanation for the delay.
Ms. Tara Smith, Director of ISD, admitted ISD had difficulties adhering to the deadline because of an extensive review process. She also said during this time period (March 2020) ISD was heavily involved with protecting their facilities from the coronavirus disease 2019 (COVID-19), which added to the delay. Ms. Smith suggested deadlines should be extended to 180 days; Commissioner Jordan agreed with her.
Commissioner Martinez recommended the item include an amendment allowing an extension on a month to month basis.
It was moved by Commissioner Jordan that the foregoing proposed resolution be adopted, as amended. This motion was seconded by Chairwoman Edmonson, and upon being put to a vote, the item passed 12-0; Commissioner Bovo was absent.

Commissioner Levine Cava commented on how the South Corridor Bus Rapid Transit Small Starts Project (BRT) would be convertible to rail service. She said rail service was promised by the Board to County residents who wanted the service. She also confirmed she would work diligently to convert the project to rail service.
Commissioner Sosa voiced her support for the item, but added the convertibility of the project was not guaranteed because of the uncertainty of future budgets.
Hearing no questions or comments, the Board proceeded to vote to adopt the foregoing proposed resolution.

Assistant County Attorney Michael Valdes read an amendment into the record as proposed by Commissioner Martinez.
�Item 11A7 is being amended to clarify that the departments will be required to ensure that full and timely payment by one violator of any civil penalties owed serves as full satisfaction of the civil penalties for that violation as long as the violation has been timely corrected. REPORT:
Commissioner Levine Cava discussed the crisis at Biscayne Bay, which had recent algae blooms and fish kills. She noted the Board already declared an emergency and would address the situation. She also reminded the Board of overdue reports from the Administration regarding Biscayne Bay�s polluted waters and suggested the Board remain active and engaged with the environmental emergency.
Commissioner Levine Cava noted the septic tank systems in County households were a major cause of the bay�s pollution. She affirmed that converting the systems to sewage was a major priority, as well as all other possible measures.

REPORT:
Commissioner Heyman opined medical personnel who dealt with coronavirus disease 2019 (COVID-19) patients should be considered first responders and entitled to hazard pay.
Commissioner Heyman asked Deputy Mayor Jennifer Moon if the medical personnel�s hazard pay was eligible for reimbursement by the Coronavirus Aid, Relief, and Economic Securities (CARES) Act. Ms. Moon answered the hazard pay for first responders was eligible.
Commissioner Heyman pointed out the first responders� pay were reimbursed through the County�s general fund and should be done through the CARES Act.
Ms. Moon informed the Board all the CARES Act funds were fully allocated. However, not all programs the County allocated funds to would spend all of their allocated funds and the County would be able to recapture the leftover funds. Also, there were available grants. Ms. Moon said the personnel would be paid by any legally available funds and assured Commissioner Heyman the general fund would only be accessed as a last resort.
Commissioner Heyman proposed an amendment to include the CARES Act as a means of paying the first responders.
It was moved by Commissioner Jordan that the foregoing proposed resolution be adopted as amended. This motion was seconded by Commissioner Heyman, and upon being put to a vote, the item passed 12-0; Commissioner Bovo was absent.

Assistant County Attorney Debra Herman read a motion by Chairwoman Edmonson about the item as follows:
�With respect to item 14B1, the purchase of Lincoln Memorial Park Cemetery, the Chair�s motion is to direct the County Mayor or Mayor�s designee to proceed in accordance with the Mayor�s recommendation as follows:
�Assuming the motion to vacate judgment is denied the County should proceed to execute on the judgment and force the property to public auction where the County can bid in order to seek to acquire title. �
�The County would be authorized to bid up and expend an amount up to $340,000, but in no way exceeding the sum of the County�s judgments, liens and known incumbencies at the time of the bid, currently estimated at $226,250, to purchase the property at auction. �
�The Board further authorizes the expenditure of typical closing cost to finalize the purchase in the event the County has the winning bid. The net out-of-pocket cost to the County would be limited to closing cost.�
Commissioners Jordan, Levine Cava, Sosa, Monestime and Higgins requested to co-sponsor the report, while Commissioner Moss confirmed he was a co-prime sponsor.
Chairwoman Edmonson made a motion to approve the acceptance of the report and the motion as referenced above, which was read into record by Assistant County Attorney Debra Herman. This motion was seconded by Commissioner Moss; and upon being put to vote, the final vote was 12-0; Commissioner Bovo was absent.

REPORT:
Chairwoman Edmonson raised concerns with the large amount of County Advisory Board members who had not completed the County�s mandatory sexual harassment prevention training, as listed in the item�s report. She requested what was being done to address the situation.
Ms. Erin A. New, Division Director of the Miami-Dade County Human Resources, Human Rights and Fair Employment Practices Department (Human Resources), explained that when Human Resources launched the training there were 1,130 advisory board members that needed training. Since July 2018, Human Resources held 21 training sessions (both live and virtually) and 86 percent of the members completed training. She reported only 150 members had not completed training and Human Resources was actively communicating with the Clerk of the Board staff to have the remaining members complete the training. Ms. New assured the Board the remaining advisory board members would complete the training.
Chairwoman Edmonson noted since 2014 through 2019 some of the non-compliant Board members had not completed the training and should have completed this task already. She suggested the commissioners should receive notice about their members appointed through 2019, who have not completed training. Ms. New reiterated that Human Resources would coordinate with the Clerk of the Board to complete the task suggested by Chairwoman Edmonson.
Commissioner Levine Cava recalled that when that when the sessions were originally posted, they had specific dates. She opined the members may not have been able to attend those dates. She asked Ms. New if the members can attend virtual sessions according to their own schedules or otherwise. Ms. New replied her department was scheduling new dates for virtual sessions and all options were being explored.

REPORT:
Commissioner Sosa made an emergency motion regarding the cruise lines based in the County which were shut down because of the coronavirus disease 2019 (COVID-19) pandemic. Her motion read:
�This motion is necessary to restart an industry that is currently on pause in the United States through September 30, 2020, yet is vital to the economy of Miami-Dade County. Three major cruise lines operating out of PortMiami-Carnival, Royal Caribbean/Celebrity Cruises, and Norwegian Cruise Line-are among the 15 largest employers in the County. These cruise partners, combined with PortMiami's other cruise partners-MSC and Disney-generate more than $5.8 billion for Miami-Dade County's economy, with Virgin Voyages soon adding to those economic impacts.
"Therefore, I move that we urge the United States Centers for Disease Control and Prevention to expedite and conclude any analysis necessary for the establishment of the public health guidance and preventative measures that are required prior to the resumption of travel on cruise ships, during and after the Coronavirus Disease 2019 (COVID-19) Pandemic.
"I move that this motion be converted to a resolution format and direct:
"(1) The Clerk of the Board to transmit this action as formatted in the resolution to the President of the. United States, the Members of the Florida Congressional Delegation, the Secretary of the United States Department of Health and Human Services, and the Director of the CDC; and
"(2) The County's federal lobbyists to advocate for the legislative action set forth in the motion and authorize the Office of Intergovernmental Affairs to amend the 2020 federal legislative package to include this item, and to include this item in the 2021 federal legislative package when it is presented to the Board.�
Commissioner Diaz seconded the motion and upon being put to a vote, the motion passed 9-0; Commissioners Bovo, Jordan, Higgins and Moss were absent.
