  REPORT: Chairwoman Edmonson called the meeting to order at 9:30 a.m. and welcomed everyone to today�s (10/8) Board of County Commissioners� (Board) meeting which was a continuation of the October 6, 2020 Board meeting. She announced today�s (10/8) virtual meeting was structured to emulate a regular Board of County Commissioners (Board) meeting and the rules and procedures presented on October 6th would be adhered to.

Commissioner Jordan announced she had to leave for approximately half an hour and requested that any items under her sponsorship be postponed until she returned.

Prior to consideration of Agenda Item 8N2, Chairwoman Edmonson took a point of personal privilege and commented on an article in the Miami Herald which stated that one of the developers to whom property was transferred to under legislation sponsored by her and approved by the Board, had only been in business for one year. She clarified the company was not one year old and the developer had built over 30 homes with the help of the City of Miami, Miami-Dade Empowerment Trust and the Housing Finance Authority of Miami-Dade County. Chairwoman Edmonson stated the developer was an equity partner with Atlantic Pacific in developing multi-family units in Overtown and South Dade; developed the first affordable green house and was nationally recognized for their leadership in energy and environmental design.

Commissioner Moss explained the process he used in allocating lots to developers who offered to develop infill housing in his Commission District 9, noting the reverter clause which was approved by the Board ensured that undeveloped lots could come back to the County. He stated by developing these lots slum and blight would be cleared; overgrown lots would be cleared; and affordable units would be built on the properties which would result in the addition of funds to the tax roll.

Chairwoman Edmonson remarked that infill housing had decreased crime, slum and blight in neighborhoods.

Commissioner Diaz stated he understood and respected infill housing; however, a bidding process should have occurred for the properties.

Commissioner Jordan stated the company had been in business for more than 10 years, and had developed lead certified homes with quality material.

In addition to the members of the Board and Mayor Carlos Gimenez, the following staff persons were present: Deputy Mayor/Budget Director Jennifer Moon; County Attorney Abigail Price Williams, First Assistant County Attorney Geri Bonzon-Keenan; Assistant County Attorneys Oren Rosenthal, Shanika Graves, Leigh Kobrinski, David Hope and Melanie Spencer; Clerk of the Board Assistant Director Linda Cave; and Deputy Clerks Judy Marsh and Kely Delille.

  REPORT: Prior to consideration of the foregoing proposed resolution, Chairwoman Edmonson inquired about the status of the Beach Corridor.

Ms. Tara Smith, Director, Internal Services Department (ISD), responded that ISD recently finalized negotiations and the issue was moving forward as an award recommendation for consideration by the Board of County Commissioners.

Commissioner Levine Cava spoke in support of the foregoing proposed resolution and noted representatives from the City of Homestead were available to respond to any questions.

Commissioner Moss also spoke in support of the proposed resolution and commended the City of Homestead for projects they accomplished in the past with funding support from the County.

In response to Chairwoman Edmonson�s inquiry regarding the Beach Corridor, Mayor Gimenez stated this item would be presented at the next Board meeting.

There being no further discussion, the members of the Board proceeded to vote on the foregoing proposed resolution, as presented.

  REPORT: Commissioner Higgins provided an overview of the foregoing proposed resolution. She stated this issue was discussed by the Community Disparities Subcommittee in conjunction with the Public Defender�s Office, the State Attorney�s Office, the Clerk�s Office and the Dade Chiefs Association. Commissioner Higgins mentioned changes were made at the Subcommittee to remove funding. She noted the new President of the Dade Chiefs Association expressed his desire to participate on the proposed Driver License Suspension Task Force (Task Force; however, he was not an elector in Miami-Dade County, and she asked Assistant County Attorney Monica Rizo to read into the record a proposed amendment that would allow him to serve on the Task Force.

Pursuant to Commissioner Higgins� request, Assistant County Attorney Monica Rizo read into the record a proposed amendment to Section 2 of the �Now, Therefore� section of the resolution to delete the requirement that Task Force members be electors of Miami-Dade County and subject to forfeiture of their position on the Task Force if they cease to be an elector of the County.

It was moved by Commissioner Higgins that the foregoing proposed resolution be adopted as amended. This motion was seconded by Commissioner Diaz.

Commissioner Martinez requested the proposed Task Force, upon convening, consider the burden uninsured drivers created on law abiding citizens.

In response to questions from Commissioner Sosa, Assistant County Attorney Rizo advised the proposed resolution did not require the expenditure of any funds; and she explained the various reasons under State law which could result in a driver license suspension.

Commissioner Sosa proffered a proposed amendment to require the Task Force recommendations to come back to the Board and that two members of the Task Force be appointed by the Board.

Commissioner Higgins concurred with the report coming back to the Board but noted the Task Force was comprised of technical experts and she was satisfied with its structure.

Commissioner Sosa expressed concern regarding the lack of representation from Unincorporated Dade on the proposed Task Force.

Commissioner Heyman offered, and Commissioner Higgins accepted, a friendly amendment to require the Task Force to work with the Dade-Miami Criminal Justice Council. She thanked Commissioner Higgins for removing the consulting fees for the Task Force�s creation.

Commissioner Diaz spoke in support and requested to be listed as a co-sponsor.

Commissioner Sosa indicated her support since Commissioner Higgins accepted the amendment that the report would come back to the Board.

Commissioner Heyman mentioned in December 2020 the National Association of Counties (NACo) would be addressing the monetary impact on punishment and incarceration. She noted this included not only suspended licenses but also technical violations for parole and other issues which placed individuals back into the system and then resulted in a suspended license.

There being no further discussion, the members of the Board proceeded to vote on the foregoing proposed resolution, as amended to 1) delete the requirement that Task Force members be electors of Miami-Dade County and subject to forfeiture of their position on the Task Force if they cease to be an elector of the County in Section 2 of the �Now, Therefore� section; 2) to require the Task Force recommendations to come back to the Board; and 3) to require the Task Force to work with the Dade Miami Criminal Justice Council.

  REPORT: Commissioner Moss spoke in support of the foregoing proposed resolution and thanked Commissioner Diaz for being a Co-Prime Sponsor. He stated it was important to add additional aviation facilities when feasible and noted the proposed Fixed Base Operator (FBO) development project would include maximum citizen participation.

Commissioner Diaz expressed support for the proposed resolution. He concurred with Commissioner Moss that Miami was the gateway to South America and opined that one day it would also be the gateway to Africa. Commissioner Diaz stated this proposal would provide an economic support for the community.

Mr. Lester Sola, Aviation Director, Miami-Dade Aviation Department (MDAD), stated this proposal was for a general aviation use with a small operation utilizing one building to house small airplanes. He noted MDAD was in the process of discussing and finalizing a plan for property within the fence line of Homestead Air Reserve Base (HARB) to allow for a small civilian use operation.

Mayor Carlos Gimenez spoke in support of the foregoing proposed resolution and echoed Mr. Sola�s comments. He stated all interested parties would be allowed to speak once the resolution came back to the Board. Mayor Gimenez added this proposal would reduce the need for takeoffs and landings and subsequent takeoffs.

In response to Commissioner Levine Cava�s request, Mr. Sola provided background information regarding this item and the status of negotiations regarding a joint use agreement with the United States Air Force (Air Force) to allow for a fixed base operator development at the HARB. He stated the County was closer to having a civilian use operation at the HARB. Mr. Sola noted staff received a letter from the Air Force indicating they were willing to negotiate the location of this operation, but an agreement had not been reached. He added if an agreement had been reached, the agreement and the use had to come back to the Board for approval.

Commissioner Levine Cava inquired whether the Environmental Impact Statement banning commercial aviation included cargo flights and Assistant County Attorney Cynji Lee opined the ban on the commercial aviation labeling would limit the amount of cargo operations, but did not ban cargo activity.

Commissioner Levine Cava proffered a friendly amendment to Commissioners Moss and Diaz that would address residents� concerns and clarify the negotiations were only for general aviation and did not include commercial aviation.

Pursuant to Commissioner Levine Cava�s request, Assistant County Attorney Cynji Lee advised the proposed amendment would be to insert the language �limiting the allowable uses for the property to general aviation operations and services only� after small roman numeral (i) in Section 2 on page 4 of the proposed resolution. She further advised the remaining roman numerals would be modified accordingly in conformance with the item.

In response to Commissioner Levine Cava�s inquiry whether the letter Mr. Sola referenced from the Air Force was included as part of the item, Mr. Sola stated it was not included in the proposed resolution; however, he would provide a copy of the letter received in March 2020 from the Air Force regarding HARB.

Mayor Gimenez stated the Administration would support the proposed amendment and noted this was strictly for general aviation uses.

Commissioner Moss accepted the proposed amendment.

Commissioner Diaz expressed concern regarding the proposed amendment restricting the possibility of cargo on a limited basis that may go along with general aviation.

Commissioner Martinez expressed that he was not supportive of commercial aviation at the HARB; however, he had no issue with leaving it open at this time as it related to cargo.

Commissioner Souto requested to be listed as a co-sponsor.

Commissioner Diaz reiterated his concern but noted he would support Commissioner Moss� decision.

Mayor Gimenez stated it should be clearly delineated in the item that this was general aviation only; not cargo.

Commissioner Moss stated the federal government was interested in County-owned land as they wanted to bring additional missions to HARB. He noted the County had a desire, based upon the Board�s approval, to create an FBO at HARB on federal-owned land. Commissioner Moss explained the federal government wanted to move forward and now was the time for the County to ensure that it could create a transactional relationship with the federal government. Commissioner Moss pointed out that while he understood Commissioners Diaz and Martinez� comments, he wanted to proceed with creation of the FBO, and to clarify that general aviation was the Board�s desire. He indicated that he was prepared to accept Commissioner Levine Cava�s proposed amendment, and to consider the Mayor�s comments.

There being no further discussion, the members of the Board proceeded to vote on the foregoing proposed resolution, as amended.

Chairwoman Edmonson took a Point of Personal Privilege and requested to be listed as a Co-Prime Sponsor on an ordinance Commissioner Bovo submitted to be heard on first reading on October 20, 2020 relating to adding the Metromover to the Rapid Transit Zone.

Commissioner Bovo concurred with Chairwoman Edmonson�s request.

Commissioner Higgins also requested to be listed as a Co-Prime Sponsor and Commissioner Bovo concurred.

  REPORT: In response to Commissioner Sosa�s inquiry whether Amigos for Kids could be included as part of the advisory board responsible for overseeing and approving the decisions regarding the Future Bound Miami children�s savings accounts program, Commissioner Higgins said she would ask the advisory board.

Commissioner Sosa further inquired whether checks and balances could be included to ensure the money would be spent on postsecondary education, and if not, it would be returned to the County.

Commissioner Higgins said she would ensure reports were provided annually but would not add constraints regarding the seed money.

In response to Commissioner Sosa�s inquiry whether a requirement could be included in the proposed resolution that if the money was not used as intended, it would return to the County, Assistant County Attorney Leigh Kobrinski advised certain terms could be included in the grant agreement to ensure the funds were used appropriately by Catalyst Miami, Inc. and the regional consortium. She further advised it was always negotiable as far as recapturing those funds if they were misused.

Deputy Mayor/Budget Director Jennifer Moon stated this was a one-time allocation from the reserve which was created in the fiscal year (FY) 2019-2020 budget.

Commissioner Sosa asked Commissioner Higgins to include the language Assistant County Attorney Kobrinski suggested in the negotiations.

At 11:00 a.m. Commissioner Diaz announced that he had to leave for a funeral and may not return.

Commissioner Bovo said he would be more comfortable if other companies that would be funding and supporting the program were identified, and expressed concerned that families might be unable to keep adding money into the account.

Commissioner Martinez expressed concern that not everyone who participated in the program would gain something from it unless the program was accessible to every child in Miami-Dade County, and he suggested they be given a savings bond. He agreed that a caveat could not be placed on the program that if it was not used for education it would be returned to the County.

Commissioner Higgins spoke in support of the foregoing proposed resolution, noting this program was a proven investment in children�s future, and would help to level the playing field for some public education students. She noted other participants in the program included Citi, Bank of America and the Jorge M. Perez Family Foundation who was also providing seed money. Commissioner Higgins said the idea was to ensure every kindergartener began participating in this program.

The foregoing proposed resolution was moved by Commissioner Higgins and seconded by Commissioner Levine Cava.

Commissioner Sosa inquired if approval of the proposed resolution included the caveat that Commissioner Higgins would consider including Amigos for Kids in the resolution, and Commissioner Higgins indicated that she would.

Assistant County Attorney Kobrinski advised Commissioner Sosa was requesting that the Administration include language in the agreement to ensure that the grant funds were used for the purpose of the Future Bound Miami program, and if misused, that the funds be returned to the County.

Commissioner Higgins did not accept Commissioner Sosa�s request. She opined the Administration was capable of negotiating this grant agreement to ensure the County�s best interest and the taxpayers.

Commissioner Sosa further suggested the Inspector General be allowed to verify if the money was used improperly; however, Chairwoman Edmonson stated Commissioner Higgins indicated she would not accept this suggestion.

There being no further discussion, the members of the Board proceeded to take a roll call vote on the foregoing proposed resolution, as presented.

  REPORT: In response to Commissioner Sosa�s inquiry, Assistant County Attorney Shanika Graves explained the appointment process to the Independent Civilian Panel (Panel) ICP. She advised each County Commissioner had the option of appointing a member to the Panel without going through the Office of Community Advocacy.

Commissioner Martinez indicated he would vote �no� on the proposed resolution.

There being no further discussion, the members of the Board proceeded to take a roll call vote on the foregoing proposed resolution, as presented.

Upon conclusion of the foregoing item, Chairwoman Edmonson relinquished the Chair to Vice Chairwoman Sosa.

It was moved by Commissioner Jordan that Agenda Item 11A17 which was considered on Tuesday, October 6, 2020, be reconsidered in order to change the timeline. This motion was seconded by Commissioner Edmonson, and upon being put to a vote, the motion passed by a vote of 10-0 (Commissioners Diaz, Monestime and Suarez were absent).

Pursuant to Commissioner Jordan�s request, Assistant County Attorney David Hope read the proposed amendment as follows:

~ on handwritten page 6, in the �Now, Therefore� clause, line 5 that states contracts issued for construction and architectural and engineering services within 120 days of the adoption of this resolution to allow Small Business Development to complete a full three years of data collection and to recommend the award of a contract resulting from this solicitation within 165 days of the adoption of this resolution.�

It was moved by Commissioner Jordan that the foregoing proposed resolution be adopted with the amendment read into the record by Assistant County Attorney Hope. This motion was seconded by Commissioner Edmonson.

Following Vice Chairwoman Sosa�s request for clarification on the motion, Assistant County Attorney Hope explained the amendment increased the time from adoption of the resolution for the County to issue the solicitation from 30 days to 120 days and because of that additional period, it also increased the time to come back to the Board with an award recommendation from 120 days from the issuance of the resolution, to 165 days from the issuance of the resolution.

Commissioners Levine Cava and Moss requested to be listed as co-sponsors.

Chairwoman Edmonson resumed the Chair.

There being no further discussion, the members of the Board proceeded to vote on the foregoing proposed resolution, as presented.

  REPORT: In response to Chairwoman Edmonson�s inquiry whether responsible wages were included in the proposed resolution, Commissioner Jordan provided an overview of the resolution.

Following comments from Mr. Gary Hartfield, Director, Small Business Development (SBD), regarding AA Acquisitions, LLC�s efforts to locate and pay employees responsible wages, Chairwoman Edmonson noted her support for the proposed resolution.

Following questions from Commissioners Levine Cava and Sosa, Assistant County Attorney Cnji Lee advised this was a clarification that the responsible wage requirement only applied to the public infrastructure improvement for which $5 million of General Obligation Bond funds were granted.

  REPORT: Pursuant to Commissioner Moss� request, Assistant County Attorney Melanie Spencer read into the record the following amendments to the foregoing proposed resolution:

� The allocations in Section 3 from the FY 2020-2021 District 9 CBO Discretionary Reserve shall now be funded from unspent funds from the FY 2019-2020 District 9 Office Funds.
� The allocation for Sugar 4 Kids Foundation, Inc. in the amount of $7,500,00 shall be moved from Section 3 to Section 1, and shall be funded from the FY 2019-2020 District 9 Discretionary Reserve.
� The allocation to Hard Knocks Foundation, Inc. in the amount of $3,000.00 in Section 3 shall be deleted.
� An allocation to Rebuilding Together Miami Dade, Inc. in the amount of $20,000.00 for home repairs for a disabled family in District 9 shall be added to Section 3 and funded from unspent funds from the FY 2019-2020 District 9 Office Funds.

Finally, the whereas clauses shall be amended to conform to the previously stated amendments in Sections 1, 2, and 3.

  NON-AGENDA REPORTS
  REPORT: Commissioner Bovo requested to appoint Javier Mojeron (phonetic) to the Historic Preservation Board.

Commissioners Jordan requested that outgoing Commissioners be given an opportunity at the October 20, 2020 Board meeting to say goodbye to the public, and Chairwoman Edmonson concurred.

Commissioner Sosa stated a special ceremony was being planned in November for all outgoing Commissioners and the Chairwoman Edmonson would be sending out invitations.

Commissioner Sosa announced the Mayor was working to ensure the Commission Chambers was properly prepared for the November 2020 Board meeting as the Governor stated there would be no more extensions.

Commissioner Moss suggested the Board discuss transitioning to a new phase in life and providing additional guidance to incoming Commissioners.
Commissioner Moss withdrew his suggestion after Chairwoman Edmonson stated she would not accept any additional items at the next meeting.

Chairwoman Edmonson announced another special meeting relating to the Coronavirus Disease 2019 (COVID-19) would be held before the outgoing Commissioners left office.

There being no further business to come before the Board, the meeting adjourned at 11:58 a.m.
