1A INVOCATION AS PROVIDED IN RULE 5.05(H)  
  REPORT: A moment of silence was taken followed by the Pledge of Allegiance.  
1B ROLL CALL  
  REPORT: In addition to the members of the Board, the following staff persons were present: First Assistant County Attorney Geri Bonzon-Keenan; Clerk of the Board Director Melissa Adames; and Deputy Clerk Tawana Parker.

First Assistant County Attorney Geri Bonzon-Keenan read into the record the Board of County Commissioners rules and procedures as it related to special meetings and advised only Special Item #1 would be considered at today�s (11/16) agenda as listed in the printed final agenda.

It was moved by Commissioner Souto that today�s (11/16) agenda be approved, this motion was seconded by Commissioner Diaz and upon being put to a vote, passed by a vote of 8-0. (Commissioners Bovo, Levine Cava, Higgins, Jordan, and Suarez were absent.)

  RESOLUTION SUSPENDING, FOR THE DURATION OF THE CORONAVIRUS DISEASE 2019 (COVID-19) STATE OF EMERGENCY, ANY PROVISION OF COUNTY LAW, RULE OR REGULATION THAT WOULD PREVENT MEMBERS OF THE BOARD OF COUNTY COMMISSIONERS OR ANY OTHER COUNTY BOARD OR COMMITTEE FROM USING COMMUNICATIONS MEDIA TECHNOLOGY TO PARTICIPATE IN AND VOTE ON MATTERS WHEN (1) THE QUORUM OF SUCH BOARD OR COMMITTEE IS PHYSICALLY PRESENT AND (2) THE REMOTE PRESENCE IS MEDICALLY NECESSARY Adopted

  REPORT: First Assistant County Attorney Geri Bonzon-Keenan read the foregoing item into the record.

Commissioners Diaz, Heyman, Martinez, Monestime, Moss, Sosa and Chairwoman Edmonson requested to be listed as co-sponsors for this item.

Commissioner Sosa suggested amending the item to ask Florida Governor Ron DeSantis to allow the local governments the flexibility to conduct virtual or physical meetings based on the number of coronavirus disease (COVID-19) cases in their respective locations.

In response to Commissioner Martinez, Assistant County Attorney Oren Rosenthal clarified the physically unable clause referred to an attorney general opinion rendered in 2000, but noted this was a limited exception that was being created which differed from the prior opinions given because of the COVID-19 pandemic and the risk involved with gathering. He further explained a medical necessity included a medical reason for not being present such as being quarantined or having a prior medical underlying condition which can cause an increased risk of contraction and negative consequences from the Covid-19 disease.

Commissioner Martinez questioned which seven commissioners would be in attendance at the Board meetings to ensure quorum was met, who would be exempt from attending the meeting and under what conditions.

Assistant County Attorney Rosenthal reiterated the medical necessity conditions and advised the resolution allowed any commissioner to take advantage of this provision and provide advance notice to the chairperson to ensure physical quorum was met in order to comply with state law. He informed the Board the medical condition would not include a commissioner taking care of someone else with a medical condition.

Commissioner Moss inquired how individuals who fell under the medical necessity category would be able to participate in the meeting.

Assistant County Attorney Rosenthal replied the chairperson would be responsible for establishing procedures for video participation that was also in compliance with communication media technology as previously implemented under the executive order from Governor DeSantis.

Discussion ensued amongst the Board members in reference to asking the governor to extend the virtual meetings due to the rise in the number of COVID-19 cases in Miami-Dade County.

Assistant County Attorney Jess McCarty recommended the Board send a letter to the governor�s office concerning an extension of the virtual meetings and he suggested the request be executed as an urging item. He opined the resolution on today�s (11/16) agenda should be submitted to the governor�s office separately from the virtual meeting request.

First Assistant County Attorney Bonzon- Keenan announced the amendment proffered by Vice Chairwoman Sosa would not be addressed at today�s (11/16) meeting and informed her an urging item could be prepared for the November 19th, 2020, Board meeting. She noted this would allow the County Attorney�s Office to explore various options and alternatives that would speak to the final goal of allowing 100% virtual participation due to the higher COVID-19 percentage rates in Miami-Dade County.

Commissioner Sosa asked the County Attorney�s office to draft a letter to send to the governor�s office.
