Board of County Commissioners 12/3/2024 11A13 Adopted P
REPORT: Commissioner Higgins stated the foregoing proposed resolution was no longer a revenue source and the County would be facing a difficult budget year. She pointed out the Board was not aware of the full impact of the Constitutional Officers on the County’s budget and added that the new Courthouse would be brought online, and the Department of Transportation and Public Works had no reserves left which would result in service cuts next year to bus and Metrorail. Commissioner Higgins indicated that she was supportive of a revenue source for the County that could fill important service gaps; however, she could not vote to proportionately divide the school zone speed enforcement penalty funds among all 13 County Commission Districts. She stated that she would be voting “no” and cautioned that in June and July 2025, the Board would be discussing potential service cuts or increased taxes. Chairman Rodriguez explained the intent of the foregoing resolution was for children’s safety and was not intended to generate revenues for the County. He clarified the funds were being divided based on school location in the Unincorporated Municipal Services Area (UMSA) by population and square miles of the UMSA regulations. Chairman Rodriguez stated Florida Statutes regulated the funds be used for school safety for the areas they were generated from, and this was one of the fairest distribution of funds. Commissioner Regalado concurred with Commissioner Higgins’ comments regarding the need to prepare for difficult times. She opined it was fair that the funds be allocated to the districts that had the technology and noted some areas in UMSA would be impacted more than others. Commissioner Regalado said she understood the restrictions regarding the funds and suggested they be used to address congestion in the area. She opined the Statutes were broad as it related to school safety and should address more crossing guards, intersections and bike lanes. Commissioner Regalado recommended narrowing the scope and making it more specific so that the neighbors who would be ticketed would see some benefit to the congestion and the issues in the neighborhood. Chairman Rodriguez commented that State Statutes designated a portion of the funds generated from the citations to additional crossing guards. He remarked that if extra crossing guards were needed the Board could have that discretion but could not make that decision if it was narrowed to only traffic congestion. Chairman Rodriguez acknowledged Commissioner Regalado’s comments; however, he pointed out every District had different needs regarding school safety or other options that may secure safety. Commissioner Regalado noted crossing guards were funded from the General Fund and if the County would be receiving extra funds, the Board should try to address that gap first before creating something else. Chairman Rodriguez clarified that the foregoing resolution would bridge that gap as funds were already allocated for crossing guards from the $100.00 citation. He noted the Board could add more crossing guards or if it continued with the same, then it would bridge the gap and close the delta on the countywide budget. There being no further discussion, the Board proceeded to vote on the foregoing resolution as presented.

WHEREAS, HB 657 created section 316.1896, Florida Statutes, establishing, among other things, how the penalties assessed and collected by counties for violations of the applicable speed limits in school zones during school sessions are to be remitted and allocated; and
WHEREAS, specifically, section 316.1896(5) provides that the penalties to be assessed and collected by the county must be remitted or retained as follows: (a) Twenty dollars ($20.00) must be remitted to the Department of Revenue for deposit into the General Revenue Fund; (b) Sixty dollars ($60.00) must be retained by the county and must be used to administer speed detection systems in school zones and other public safety initiatives; (c) Three dollars ($3.00) must be remitted to the Department of Revenue for deposit into the Department of Law Enforcement Criminal Justice Standards and Training Trust Fund; (d) Twelve dollars ($12.00) must be remitted to the county school district in which the violation occurred and must be used for school security initiatives, for student transportation, or to improve the safety of student walking conditions; and (e) Five dollars ($5.00) must be retained by the county or municipality for the School Crossing Guard Recruitment and Retention Program pursuant to section 316.1894; and
WHEREAS, on November 7, 2023, this Board, pursuant to the statutory authority provided under HB 657, adopted Ordinance No. 23-99 to authorize the placement or installation of speed detection systems to enforce applicable speed limits on roadways maintained as school zones within the unincorporated areas of Miami-Dade County (the County); and
WHEREAS, on January 17, 2024, this Board adopted Resolution No. R-40-24 authorizing a County contract with a vendor, RedSpeed Georgia, LLC (RedSpeed), for the installation and operation of an automated speed detection and enforcement system at school zones within the unincorporated areas of the County; and
