TITLE RESOLUTION RATIFYING ACTION BY THE COUNTY MAYOR OR COUNTY MAYOR�S DESIGNEE RELATED TO MIAMI-DADE WATER AND SEWER DEPARTMENT�S CONSENT DECREE AND CAPITAL IMPROVEMENT PROGRAMS ACCELERATION ORDINANCE PURSUANT TO SECTION 2-8.2.12 OF THE CODE OF MIAMI-DADE COUNTY, FLORIDA, SPECIFICALLY APPROVAL OF CHANGE ORDER NO. 1 TO CONTRACT NO. S-16094 BETWEEN MIAMI-DADE COUNTY AND MAGNUM CONSTRUCTION MANAGEMENT, LLC, FOR THE CONSTRUCTION OF THE CENTRAL DISTRICT WASTEWATER TREATMENT PLANT (CDWWTP) NEW MATERIALS MANAGEMENT BUILDING AND STORAGE AREAS, WHICH CHANGE ORDER GRANTS A 51-DAY NON-COMPENSABLE TIME EXTENSION BODY WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying memorandum, a copy of which is incorporated herein by reference, NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board ratifies the action of the County Mayor or County Mayor�s designee, as authorized by section 2-8.2.12 of the Code of Miami-Dade County, Florida, specifically, approval of the Change Order No. 1 to Contract No. S-16094 for the construction of the Central District Wastewater Treatment Plant (CDWWTP) New Materials Management Building and Storage Areas, between Miami-Dade County and Magnum Construction Management, LLC. Change Order No. 1 grants a 51-day non-compensable time extension, thereby revising the Contract�s Substantial Completion date from March 21, 2026 to May 11, 2026 and the Contract�s Final Completion date from April 20, 2026 to June 10, 2026. A copy of Change Order No. 1 is attached to the accompanying memorandum as Exhibit A. HEADER Date: To: Honorable Chairman Anthony Rodriguez and Members, Board of County Commissioners From: Daniella Levine Cava Mayor Subject: Resolution Ratifying Change Order No. 1 to Contract No. S-16094 for the Central District Wastewater Treatment Plant New Materials Management Building and Storage Areas with Magnum Construction Management, LLC STAFF RECOMMENDATION Executive Summary The item seeks ratification by the Board of County Commissioners (the Board) of the action of the County Mayor or County Mayor�s designee approving Change Order No. 1 to Contract No. S-16094 (the Contract) between Miami-Dade County (the County) and Magnum Construction Management, LLC (the Contractor) for the Central District Wastewater Treatment Plant (CDWWTP) New Materials Management Building (the Project). Change Order No. 1 has no additional fiscal impact to the County and solely grants a 51-calendar day non-compensable time extension due to a delay in permitting. The specialized nature of this structure, coupled by both the geographical and environmental sensitivity of the area can result in additional data submissions which lead to longer review periods. The Project, ratified by the Board via Resolution No. R-615-25, includes the replacement of an existing storage building and warehouse to meet sea level rise guidelines and the expansion of the space to accommodate the over 6,000 parts needed to maintain operations at Miami-Water and Sewer Department�s (WASD) largest wastewater treatment plant. The new facility will allow WASD to demolish the existing storage building at the CDWWTP in order to make room for a new LEED Silver Certified Electrical Distribution Building No. 3 that will replace Electrical Distribution Building No. 1, which is more than 50 years old. Through Change Order No. 1, the Project�s Substantial Completion Date will be extended from March 21, 2026 to May 11, 2026 and the Final Completion Date will be extended from April 20, 2026 to June 10, 2026, addressing the delays in securing the Class VI Permit. Given the CDWWTP's coastal location, the facility is particularly vulnerable to storm surges, high winds, and flooding during major weather events. This upgrade was designed to protect essential electrical equipment from these hazards, ensuring the plant's operational continuity and resilience in the face of extreme weather conditions. As part of its $8.6 billion Capital Improvement Program WASD continues to invest in the hardening of critical infrastructure systems to address flood surge, sea level rise, and extreme rainfall to be able to maintain operations throughout severe weather events, future-proofing infrastructure and ensuring uninterrupted service for Miami-Dade County. Recommendation It is recommended that the Board ratify Change Order No. 1 to the Contract. Change Order No. 1 grants a 51-calendar day non-compensable time extension. A copy of Change Order No. 1 is attached hereto as Exhibit A. Basic details about the Project are set forth on Exhibit B attached hereto. Scope The Project is being performed at WASD�s CDWWTP, located in Commission District 7, which is represented by Commissioner Raquel A. Regalado. Delegation of Authority The Contract was awarded pursuant to Section 2-8.2.12 of the Code of Miami-Dade County, Florida (WASD�s Acceleration Ordinance), which delegates authority to the County Mayor or County Mayor�s designee to execute change orders that do not exceed ten percent (10%) of the base contract amount, subject to ratification by the Board. Fiscal Impact/Funding Source There is no fiscal impact to the County. Change Order No. 1 to the Contract provides for a non-compensable time extension of 51-calendar days. Track Record/Monitoring WASD�s Deputy Director of Planning, Regulatory Compliance and Capital Infrastructure, Marisela Aranguiz-Cueto, P.E., will oversee the implementation of Change Order No. 1 to the Contract. Background The Contract was awarded to the Contractor on October 3, 2024. The award was ratified by the Board on June 26, 2025, via Resolution No. R-615-25. The total Contract award was $28,095,287.50 with a Contingency Allowance of $1,987,250.00 and a Contract duration of 425 calendar days for Substantial Completion and 455 calendar days for Final Completion with a Contingency Time Allowance of 46 calendar days. The Notice to Proceed was issued on January 20, 2025, which established March 21, 2026, as the Substantial Completion Date and April 20, 2026 as the Final Completion Date. Change Order No.1 will extend the Project�s Substantial Completion Date from March 21, 2026 to May 11, 2026 and the Final Completion Date from April 20, 2026 to June 10, 2026. The New Materials Management Building at the CDWWTP will provide 3,525 square feet of office space, warehousing, receiving areas, a second-floor storage area, and two outdoor storage canopies. The scope of the Project includes earthwork, paving, grading, a pile foundation system, structural roofing, HVAC and plumbing systems, fire pumps, electrical manholes, duct banks, switchgear, fiber patch panels, and a MIS Network Switch Cabinet. The facility is designed to enhance operational resilience, improve storage capacity, and support long-term sustainability goals, and will achieve LEED Silver Certification, reinforcing the County�s commitment to sustainable infrastructure. Additionally, the relocation of the Materials Management Building will allow for the demolition of the existing facility, creating space for the future construction of Electrical Distribution Building No. 3, which is planned to replace the existing Electrical Distribution Building No. 1 and enhance the plant�s electrical reliability and capacity. WASD issued a Stop Work Order on March 3, 2025, due to a delay in obtaining the required Class VI Permit. The Stop Work Order was lifted on April 18, 2025, after the Class VI Permit was issued. The Contractor remobilized on April 23, 2025. As a result of the Stop Work Order, a 51-calendar day non-compensable time extension was granted through this Change Order to account for the time required by WASD, to obtain and provide the Class VI Permit to the Contractor, because of the structure�s specialized design, along with the geographic and environmental sensitivity of the area, additional data may be required�resulting in longer review timelines. Small Business Enterprise Measures This Project does not have any small business measures, workforce, or responsible wage and benefits requirements.
