REPORT:
Chairwoman Edmonson announced today�s (6/16) virtual meeting was structured to emulate a regular Board of County Commissioners (BCC) meeting therefore all rules of procedure would be adhered to with all public comments and live call comments from attendees queued in at the appropriate time. She advised the reasonable opportunity for the public to speak would be opened first and noted the two minute rule which was applicable to all formats of public comments would be reduced to one minute in light of the number of speakers registered to speak at today�s (6/16) meeting. Chairwoman Edmonson asked her colleagues to use the �raise the hand� icon on the participant tab to indicate they had a question or comment and asked her colleagues to remain muted until called upon by either herself or Vice Chairwoman Sosa.
Chairwoman Edmonson requested her colleagues verbally announce their departures to keep an accurate count for quorum and also noted only one person should speak at any given time for clarity of the record. She indicated essential County staff would participate as �attendees� in the event questions or clarification was needed on an item and stated in the event a commissioner had a question directed to a department, the commissioner should state the department�s name and allow the department representative an opportunity to speak.
Chairwoman Edmonson opened the floor for the reasonable opportunity for the public to be heard on non-public hearing items and requested State Attorney Katherine Fernandez-Rundle be allowed to speak first.
State Attorney Katherine Fernandez-Rundle spoke in support of Agenda Item 4B to reinstate the Independent Review Panel (IRP) and investigate law enforcement officers who violate the law. She also spoke of the need to address the misconduct of officers before excessive or unnecessary forceful behavior occurred and commented on recent protests and cries for help from the public. Ms. Fernandez-Rundle highlighted the need for an active, inclusive, and fully funded IRP to help restore public trust in the Miami-Dade Police Department (MDPD).
Discussion ensued between Chairwoman Edmonson and Commissioner Diaz regarding the schedule for today�s (6/16) meeting and subsequent �Carry-over� meeting tentatively set for Thursday, June 18, 2020 (6/18) at 9:30 a.m.

Chairwoman Edmonson subsequently closed the reasonable opportunity to speak.
Commissioner Levine Cava stated she was made aware that several speakers had difficulties accessing the system, specifically Mr. Rodney Jacobs, and inquired about the status of the callers.
Mr. Majekodunmi reassured the Board members that the County�s Information Technology Department (ITD) had been notified about the registration issue encountered by users and noted all live callers registered to speak during the public�s reasonable opportunity to be heard portion of today�s (6/16) meeting had already spoken.

MOTION TO SET THE AGENDA AND "PULL LIST"

REPORT:
First Assistant County Attorney Geri Bonzon Keenan stated in addition to Chairwoman Edmonson�s Memorandum entitled �Changes Sheet�, the Joint County Commission and Public Health Trust meeting originally scheduled for today (6/16) was rescheduled for July 21, 2020. She noted Commissioner Levine Cava was requesting Agenda Item 4L be deferred to the July 21, 2020 Board of County Commissioners (BCC) meeting and Commissioner Monestime requested Agenda Items 5C and 5C Supplement be deferred to the July 8, 2020 BCC meeting.
First Assistant County Attorney Bonzon Keenan announced Agenda Item 5H Supplement contained a scrivener�s error on Page 2, under the �Scope of Agenda Item� section of the Mayor�s memorandum, and noted the number �477� should be inserted between the words �approximately� and �acres.�
First Assistant County Attorney Bonzon Keenan reviewed Commissioner Martinez� requests to release his pull of Agenda Item 11A2 (the item remained on pull list), be added to the pull list for Agenda Item 11A10 and invoke the 4-day rule on Agenda Item 14A4.
Commissioner Suarez released his pull for Agenda Item 11A1.

First Assistant County Attorney Bonzon Keenan advised that the items to be considered at today�s (6/16) meeting would be those listed on the printed final agenda with the additions, deferrals, withdrawals and scrivener�s errors noted in the Chairwoman�s memorandum entitled �Changes Sheet� dated June 16, 2020, including the aforementioned requests. The added the Board would approve all of those items by a single vote; setting the agenda, except for ordinances for first reading, public hearing items, Discussion Items 6A1, 6A1 Supplement and 6B2, and the following �Pull List� items:
2B2; 2B3; 8F1; 8F2; 8I1 8O1; 11A2; 11A4; 11A6; 11A7; 11A10; 11A12;11A13; 14A1; 14A2; 14A3; 14A5; 14A6: 14A7; AND 14B1.
Commissioner Diaz expressed concern regarding Agenda Item 4B Substitute and argued the substitute item differed greatly from the original item. He pointed out the substitute item proposed reallocating over $2 million from the Miami-Dade Police Department�s (MDPD) budget to fund the Independent Review Panel (IRP) and reiterated this component was not stated in the original item.
Discussion ensued between Chairwoman Edmonson and Commissioner Diaz regarding the term �defund.�
Chairwoman Edmonson clarified that the item sought to allocate one percent of MDPD�s budget to fund the IRP and stressed that she would not allow the 4-Day Rule to be invoked with reference to the item.
Commissioner Jordan further clarified that the item would not take funds from the police department.
It was moved by Commissioner Sosa to approve Chairwoman Edmonson�s Changes Memorandum for the June 16, 2020 Board of County Commissioners (BCC) Meeting with the additional changes noted by First Assistant County Attorney Bonzon Keenan and those additional requests made by Board members. This motion was seconded by Commissioner Higgins and upon being put to a vote, passed by a 13-0 vote

Commissioner Sosa stated while she recognized the Request for Proposal (RFP) was currently under the Cone of Silence, she asked whether the Mayor had an updated report.
Miami-Dade County Mayor Carlos A. Gimenez explained that the foregoing item had previously been approved and was reconsidered at the June 2, 2020 Board of County Commissioners (BCC/Board) meeting when Commissioner Martinez questioned the outcome of a related situation. He stated he could not investigate the matter because he was advised it could be a Cone of Silence violation; however, the Commission on Ethics did investigate the incident and determined the individual did not receive the information from the Administration, but from another source.
Mayor Gimenez maintained his original position that the request for proposal (RFP) should be evaluated and plans for the North and Beach corridors continue along a parallel path with plans to take the Beach Corridor up to Midtown.
Commissioner Sosa noted the foregoing item was brought back to the Board because more information was needed since the item was reconsidered and the previous actions were rescinded.
In response to comments and concerns expressed by Chairwoman Edmonson, Mayor Gimenez stated the administration would evaluate the RFP and return with a recommendation to the Board.
Commissioner Levine Cava indicated she did not support the item.
Chairwoman Edmonson clarified the motion before the Board was to accept the foregoing report and direct the administration to return with a recommendation regarding the RFP (RFP-01353).
Commissioner Sosa recommended the motion be bifurcated to 1. Accept the report; and 2. Direct the administration to return with a recommendation regarding the RFP.
Commissioner Heyman moved to accept the foregoing report and Chairwoman Edmonson seconded the motion.
There being no further questions or comments, the Board proceeded to vote to accept the foregoing report; and upon being put to a vote, the motion failed 4-7. (Commissioners Higgins, Martinez, Monestime, Suarez, Levine Cava, Diaz, Sosa voted �no�; Commissioners Jordan and Bovo were absent).
Commissioner Diaz pointed out public-private partnerships (P3s) must follow a particular process and as such no special directive was needed from the Board.
Mayor Gimenez clarified while the foregoing proposal was a response to a RFP and did not require a response/recommendation from the administration, he would evaluate the RFP and return with a recommendation pursuant to the Board�s request.
Following further discussion among the Board members, First Assistant County Attorney Bonzon Keenan and Assistant County Attorney Eddie Gonzalez, it was determined that a separate motion was not needed and no further action was required from the Board.
Commissioner Higgins spoke about the importance of continuing to evaluate parallel processes and pointed out the Transportation Planning Organization (TPO) selected a Locally Preferred Alternative (LPA) for the Beach Corridor to extend the Metro-mover system north and into more urban corridors. She noted the LPA also made the project eligible for federal funding.
Commissioner Higgins requested to meet with Deputy Mayor Jennifer Moon, and Ms. Alice Bravo, Director, Miami-Dade Department of Transportation and Public Works (DTPW) regarding the progress of the environmental studies related to the trunk line and status of alternative paths.
Commissioner Sosa expressed her interest in seeing alternatives paths, funding sources and plans.
Commissioner Martinez voiced his objections to the Beach Corridor Trunk Line and argued funds allocated to the Baylink or North Corridor would divert funds from the East/West corridor where he believed the money would be better utilized.

Chairwoman Edmonson questioned why over 25 percent of the reported deaths (166) were classified as �unknown� race.
Dr. Emma Lew, Chief Medical Examiner, reviewed and explained the Medical Examiner (ME) office�s role and process in reporting Coronavirus Disease 2019 (COVID-19) related deaths. She noted the ME relied on hospital records which often times omitted information about the race and/or ethnicity of the deceased. Dr. Lew advised the Board members that the funeral homes were able to fill in the missing information with the help of family members during finalization of the death certificate and asked the Board for additional time for the ME�s office to review the completed death certificates and update the report.
Responding to Chairwoman Edmonson�s inquiry about testing and confirmed cases statistics, Miami-Dade County Mayor Carlos A. Gimenez noted County�s �dashboard� provided updated daily statistics.
Deputy Mayor Jennifer Moon reported to date, just over 240,000 tests had been administered with 22,471 positive cases. She noted the State of Florida did not provide a break-down of the demographics being tested/testing positive.
Chairwoman Edmonson voiced her concerns about testing/confirmed cases among the African American and Hispanic communities.
Commissioner Monestime questioned the County�s use of State statistics to update the County�s �dashboard� despite the State�s lack of transparency.
Mayor Gimenez pointed out the State of Florida administered the tests and compiled all the information.
Commissioner Monestime spoke about the importance of accessing and reporting accurate data, particularly in light of the fact that the African American community was affected and dying at a higher rate than their counterparts.
Discussion ensued between Commissioner Monestime and Mayor Gimenez regarding the incomplete demographic information contained in the ME�s report.
Commissioner Monestime recommended establishing a Commission to study and evaluate the testing statistics to determine the demographics of the population affected/dying from COVID-19.
Dr. Lew recounted the ME�s efforts to retrieve and provide a more complete report, specifically demographic details for �deaths by race.� She reassured the Board members that a more complete report would be available by the end of the week.
Chairwoman Edmonson recommended deferring the foregoing item to allow the ME the time needed to access the information and revise the report.
Discussion ensued between Commissioner Martinez and Dr. Lew regarding the ME�s role in determining/classifying deaths as COVID-19 related.
Commissioner Moss defended the administration�s efforts to provide accurate information to the public despite the lack of transparency from the State of Florida. He argued contact tracing was just as important, if not more important, than determining the demographics of the people testing and confirmed positive COVID-19 testing results.
Commissioner Higgins concurred with the comments made by Commissioner Moss and spoke about integrating a contact tracing component into the County�s contract with the State to predict which areas and demographics should be given additional attention.
Commissioner Levine Cava voiced her support for the deferral of the item.
Hearing no further questions or comments, the Board proceeded to vote on the motion to defer the foregoing report to the July 8, 2020 Board of County Commissioners (BCC/Board) meeting.

REPORT:
First Assistant County Attorney Geri Bonzon Keenan read into the record the titles of the foregoing proposed items and reminded the Board members that Agenda Items 5C and 5C Supplement were deferred to the July 8, 2020 BCC during consideration of the motion to set the agenda.
Chairwoman Edmonson opened the public hearing on the aforementioned items (Agenda Items 5A Substitute and 5A Sub Supplement, 5B, 5D, 5E and 5E Supplement, and 5G.
Commission Auditor, Yinka Majekodunmi, read the names of the callers into the record and the following speakers appeared telephonically:
Mr. Jose Medina, 3005 SW 155 Avenue, Miami, Florida, appeared on behalf of the Venetian Isles Homeowners Association (HOA), in opposition of Agenda Item 5B. He stated while the HOA acknowledged the recent completion of a lighting project, the HOA opposed any increases to the Special Taxing District (STD) for Venetian Isles since the STD had been dormant for over 15 years and there was no explanation provided for the proposed increase or citizen representation.
Ms. Ginger Wald, Partner at Billing, Cochran, Lyles, Mauro & Ramsey, PA, appeared on behalf of Lennar Homes LLC., and stated she was available to answer any questions the Board members may have pertaining to the Agenda Items 5C, 5D; and 5E.
Upon being notified by Mr. Majekodunmi that there were no more speakers registered to appear before the Board with regards to Agenda Items 5A Substitute, 5B, 5D, 5E or 5G, Chairwoman Edmonson closed the public hearing on the foregoing items.
Commissioner Martinez clarified Agenda Item 5B only pertained to special taxing districts with decreasing or flat rates. He informed his colleagues that his office was in communications with Mr. Medina and noted that he was currently awaiting a response from the Special Assessment Districts Division (formerly known as the Special Taxing District Division).
Commissioner Levine Cava asked staff to address the comments and concerns raised by Mr. Medina.
Ms. Christina Salinas-Cotter, Assistant Director, Miami-Dade Parks, Recreation and Open Spaces (MDPROS), reiterated Agenda Item 5B only pertained to districts with decreasing or flat rates and noted Venetian Isles was not included in the foregoing item. She explained staff was currently reviewing special taxing districts with proposed increases, specifically those attributed to lighting improvement projects and the subsequent projected utility rate increase, and would provide a report to the Board.
Responding to Commissioner Levine Cava�s question regarding Venetian Isles, Ms. Salinas-Cotter confirmed at present there would be no rate increases for Venetian Isles.
Commissioner Moss pointed out specific STDs located in Commission District 9 recently converted to LED lighting in an effort to cut utility costs and asked for the report to address whether the projected cost savings were realized.

First Assistant County Attorney Geri Bonzon read into the record the title of the foregoing proposed resolution and noted there was a proposed amendment to the item.
Assistant County Attorney Terrence Smith announced the foregoing proposed item would be amended to include the following language on typewritten Page 8, Section 4: �The County Mayor or the County Mayor�s designee would only execute the Second Amendment to the Interlocal Cooperation Agreement after the approval of the City.�
Chairwoman Edmonson reviewed the intent of the proposed amendment.
Assistant County Attorney Smith clarified the proposed amendment required the City to ratify the Second Amendment to the Interlocal Cooperation agreement, and noted any changes made by the City was subject to further approval by the Board of County Commission (Board).
Additional discussion ensued between Chairwoman Edmonson and Assistant County Attorney Smith regarding the intent of the foregoing proposed amendment and the Board�s role as final arbiter on all Community Redevelopment Agencies (CRAs) matters.
Chairwoman Edmonson proffered the following proposed amendment:
�The County Mayor or the County Mayor�s designee shall be directed to use the funds that were to be refunded to the County by the Omni CRA in accordance with the Second Amendment to the Interlocal Cooperation (Interlocal/IC) agreement to fund cultural facilities and programs in the Omni area.�
Chairwoman Edmonson opened the public hearing and Commission Auditor, Yinka Majekodunmi, read the names of the callers into the record.

Upon being notified by Mr. Majekodunmi that there were no more speakers, Chairwoman Edmonson closed the public hearing and relinquished the chair to Vice Chairwoman Sosa.
Responding to Miami-Dade County Mayor Carlos Gimenez� question as to whether the foregoing item contemplated assigning a County representative to the CRA Board, Chairwoman Edmonson explained while the original item did not include this option, the item could be amended to do so. She pointed out that it would be easier if a representative from the CRA Board approved the proffered amendment at today�s (6/16) meeting so as not to prolong the process which could result in the Miami-Dade School Board (School Board) losing the housing and parking planned for the OMNI development.
Mayor Gimenez argued the County should have representation on the OMNI CRA Board in light of the fact that the County was providing 40% of the funding for the initiative.
Chairwoman Edmonson stated while she concurred with Mayor Gimenez regarding the need for County representation on the CRA Board, she was concerned about amending the item without the CRA Board�s approval and the subsequent delay the process would cause.
Mr. David Tolces, attorney for OMNI CRA, stated he believed amending the IC agreement was not enough to change the composition of the CRA Board.
Discussion ensued between Chairwoman Edmonson and Vice Chairwoman Sosa regarding the Board�s reluctance to approve the item without the County having representation on the OMNI CRA Board.
Mr. Jason Walker, Omni/Midtown CRA Director, suggested the Board approve the item as presented and return at a later date to discuss representation on the CRA Board.
Chairwoman Edmonson stated she was willing to pass the item until Mr. Walker secured a verbal agreement with the CRA Board members that would allow the County to have representation on the OMNI CRA Board.
Chairwoman Edmonson noted the floor amendment proposed by Commissioner Higgins requiring entities or contractors to comply with the Miami-Dade County�s Responsible Wage Ordinance (MDCRWO) was already included in the item and could be found on Page 151.
Responding to Commissioner Higgins� request for clarification as to whether the item included a �responsible wage� component, Assistant County Attorney Terrence Smith explained when policies related to CRAs were adopted in 2016 they did not include any language regarding the responsible wage ordinance, nor did the second IC agreement between the County, City of Miami and OMNI CRA, thus Commissioner Higgins� proposed agreement.
Discussion ensued between Chairwoman Edmonson and Assistant County Attorney Smith about the difference between the living wage requirement included in the item (Page 151) and the �responsible wage� requirement proffered by Commissioner Higgins.
Assistant County Attorney Smith advised the proposed amendment would require community benefits contract agreements exceeding $1 million dollars comply with MDCRWO.
Commissioner Higgins stated the School Board had advised her that there was no rush to approve the foregoing item and reiterated her intent to move to amend the item to include the �responsible wage� component.
The foregoing item was passed to the end of today�s (6/16) meeting to provide Mr. Walker an opportunity to secure a verbal agreement with the OMNI CRA Board which would provide the County representation on the Board.
Later in the meeting, Chairwoman Edmonson stated while she recognized the urgency of the item, she was concerned about the lack of County representation on the OMNI CRA Board and as such she moved to defer the foregoing item to amend to include the �responsible wage� requirement as proffered by Commissioner Higgins and to allow the OMNI CRA Board additional time to amend the IC to include County representation.
Commissioner Sosa voiced her concern about delaying the item and asked whether the item could be adopted as presented and the �responsible wage� requirement and County representation issue be addressed with an emergency item at the next Board meeting.
Chairwoman Edmonson indicated she would prefer to defer the item so as not to lose any leverage the Board may have to negotiate the need for County representation on the OMNI CRA Board.
Mayor Gimenez suggested approving the item with a requisite that the County have representation on the OMNI CRA Board.
Discussion ensued between Chairwoman Edmonson and Commissioner Sosa about approving the foregoing item with an amendment that provides for County representation on the OMNI CRA Board.
Chairwoman Edmonson accepted the amendment as proffered by Commissioner Sosa.
Assistant County Attorney Smith stated in addition to the amendment proffered earlier in the meeting by Chairwoman Edmonson, the foregoing proposed resolution would be amended to also:
~ Strike the provisions waiving Resolution Nos. R-611-15 and R-499-16;
~ Strike Section 5;
~ Apply the same redevelopment plans as set forth in Section 4 to Section 3 (Handwritten Page 8);
~Include language in Section 4 (Handwritten Page 8), that �The Omni CRA agrees that its Board of Commissioners shall include a County Commissioner or representative of the County appointed by the Board in accordance with Section 163.357, Florida Statutes, and this Board�s Resolution Nos. R-1382-09 and R-499-16;
~ Include additional language in Section 4 (Handwritten Page 8) as follows: �and the Omni CRA agrees to include in all community benefit agreements with entities or contractor receiving grants of $1,000,000.00 or more a requirement that such entities or contractors also comply with the Miami-Dade County�s Responsible Wage Ordinance.�
Assistant County Attorney Smith advised the Board members that the IC would return to the Board for further consideration in the event the OMNI CRA or City of Miami approved any additional changes not set forth in the amended item.
Discussion ensued among Commissioner Martinez, Deputy Mayor Moon and Assistant County Attorney Smith as to how the current IC differed from the newly proposed IC.
Deputy Mayor Moon clarified the new IC would extend the life of the OMNI CRA to provide enough funding to redevelop the area as negotiated by the School Board and OMNI CRA. She noted the development would also provide much needed parking for the Adrienne Arsht Center (AAC).
Chairwoman Edmonson noted while the proposed development was yet to be named, it would provide affordable housing and commercial space with parking, as well as space for the School Board.
Mayor Gimenez stated he believed the development would serve as the new headquarters for the School Board.
Discussion ensued between Commissioner Martinez and Deputy Mayor Moon regarding the fiscal impact of the item to the County.
Commissioner Martinez stated he could not support the foregoing item and reiterated his objections to CRAs.
In response to Commissioner Heyman�s request for clarification as to whether museums were considered �cultural facilities� since the term was not explicitly stated in the item, Chairwoman Edmonson confirmed that museums would be considered �cultural facilities.�
Commissioner Heyman argued that the proposed extension of the OMNI CRA to 2047 was the County�s biggest leverage point in the negotiations with the OMNI CRA.
Commissioner Moss pointed out the Board previously approved the construction of the Black History Museum and the Cuban Exile Museum in the OMNI area and asked for both museums to be recognized and considered for County funding.
Commissioner Diaz inquired as to how funding was distributed to the AAC.
Deputy Mayor Moon explained the County currently had an agreement with AAC where a multi-year projection and five-year capital and operational forecast was used to determine the budget allocated to the center. She noted the foregoing proposed resolution clarified the availability of the funding beyond the length of the debt service obligation for AAC.
Discussion ensued between Chairwoman Edmonson and Commissioner Diaz regarding the amendment proffered by Commissioner Higgins regarding compliance with the Miami-Dade County�s Responsible Wage Ordinance (MDCRWO).

Responding to the Board members� request, Assistant County Attorney Smith reviewed and listed all the proposed amendments as follows:
~Strike any reference to the waiver of the two resolutions (Resolution Nos. R-611-15 and R-499-16) related to the members of the Board of County Commissioners or County representative sitting on the OMNI CRA Board;
~Strike Section 5;
~ Apply the same redevelopment plans as set forth in Section 4 to Section 3 (Handwritten Page 8);
~ Include language in Section 4 (Handwritten Page 8), that �The Omni CRA agrees that its Board of Commissioners shall include a County Commissioner or a designee of the District Commissioner in accordance with Section 163.357, Florida Statutes, and this Board�s Resolution Nos. REPORT:
Commissioner Levine Cava spoke about the impending �evictions� crisis which she anticipated would occur upon expiration of the evictions moratorium currently in place due to the coronavirus disease 2019 (COVID-19) pandemic. She estimated over 22 percent of the labor force was impacted financially due to COVID-19 and discussed the importance of being proactive to avoid future economic decline by leveraging all Sadowski Act and Coronavirus Aid, Relief and Economic Security (CARES) Act funding.
Commissioner Diaz stated while he recognized the gravity of the situation, it was important to also acknowledge the burdens rental property owners and landlords were also facing due to the pandemic and loss of rental income. He pointed out that many rental property owners were at risk of losing their properties and cautioned his colleagues against introducing a criminal component which could ultimately punish all concerned.
Commissioner Levine Cava noted today�s (6/16) discussion item was not tied to any specific legislative item and clarified her intent for today�s discussion was to develop a plan and/or explore options to help residents impacted by the pandemic and facing evictions. She reassured her colleagues that there were no plans to criminalize the evictions process.
Discussion ensued among the Board members regarding the impact on landlords and tenants and the need to consider assistance for both parties during the decision-making process.
Commissioner Bovo voiced his concerns about government overreach and advocated for reopening the economy so that people could return to work and earn an income. He spoke about the importance of ensuring consistent information and messaging was being disbursed on a municipal and County level and concurred with his colleagues about the need to be mindful about tenants taking advantage of the pandemic and the current evictions moratorium to not pay rent. Commissioner Bovo encouraged landlords and tenants to maintain an open dialogue to resolve matters privately and reiterated his apprehensions about government interference in private matters.
Commissioner Monestime stated while he agreed there should be aid offered to tenants unable to pay their rents, he was concerned about unscrupulous tenants taking advantage of the system.
Chairwoman Edmonson suggested the Board consider introducing legislation to urge the State/Federal government to provide CARES Act funding to assist rental property owners and landlords.
Commissioner Sosa noted she was working on legislation which would ask the State to provide free and/low cost mediation for tenants to renegotiate lease agreements with their landlords which could include early termination of a lease to avoid an eviction. She spoke about the benefits of the mediation process and stressed the importance of the State�s collaboration on the initiative.
Commissioner Monestime indicated his desire to co-prime sponsor legislation with Chairwoman Edmonson regarding the use of CARES Act funding to assist tenants and landlords/rental property owners.
Commissioner Heyman agreed with the comments made by her colleagues and requested to be included as a co-sponsor on the aforementioned legislation referenced by Commissioner Monestime.
Commissioner Levine Cava concurred with the comments and suggestions made by her colleagues and requested the urging suggested by Chairwoman Edmonson also include a component that would urge the Senate to consider the Health and Economic Recovery Omnibus Emergency Solutions (HEROS) Act which would disburse monies directly to landlords. She stated while she recognized the importance of open dialogue/mediation between landlord and tenant, she was concerned about landlords taking matters into their own hands and unlawfully �self-evicting� vulnerable tenants. Commissioner Levine Cava briefly reviewed the intent of Agenda Item 11A4 as the prime sponsor; and asked her colleagues to consider the inevitable impact of the impending 700 residential and commercial eviction petitions filed since March 12, 2020 (as reported by the Miami Herald newspaper.) She pointed out 55,000 households not only experienced layoffs but also paid more than 50% of the household income in rent, and noted more than 30% of households were unable to pay rent in June.

Chairwoman Edmonson relinquished the chair to Vice Chairwoman Sosa.
Commissioner Edmonson pointed out the Miami-Dade County Mayor�s memorandum indicated the most recent lift purchase for the department was done as a one-time purchase in 2008 and asked whether there had been any other more recent purchases. She also pointed out the item did not specify the amount of lifts being purchased and inquired about the average cost per lift.
Ms. Alice Bravo, Director, Miami-Dade Department of Transportation and Public Works (DTPW) advised six column lifts were purchased in 2018 and the �2008� date included in the Mayor�s Memorandum was a scrivener�s error. She reported the proposed contract would be used to purchase 96 lifts at an average cost of $11,000.00 per lift.
There being no further questions or comments, the Board proceeded to vote on the foregoing proposed resolution, as amended, to correct the last sentence in the �Recommendation� paragraph of the Mayor�s Memorandum to read: �The most recent lift purchase for the department was a one-time purchase in 2018.� This motion was made by Commissioner Heyman and seconded by Chairwoman Edmonson and upon being put to a vote, passed by a vote of 11-1 (Commissioner Jordan was absent; Commissioner Bovo voted no).

Commissioner Martinez voiced his objections to allocating more funds to conduct yet another study on the Beach Corridor and indicated he was not in support of the item.
Commissioner Bovo noted he was not in support of the item.
Commissioner Sosa asked whether the Beach Corridor Trunk Line could be bifurcated so as not to hinder the other portions of the project.
First Assistant County Attorney Geri Bonzon Keenan confirmed the Beach Corridor Trunk Line portion of the work order could be bifurcated.
Commissioner Higgins pointed out the Transportation Planning Organization (TPO) decided to proceed with a Locally Preferred Alternative (LPA) for the Beach Corridor Trunk Line and argued the studies should be conducted simultaneously to provide the residents of the County two parallel paths.
Ms. Tara Smith, Director, Miami-Dade Internal Services Department (ISD) reviewed the intent of the foregoing item and expressed her preference for both corridors (Beach and North) to be considered simultaneously. She pointed out the fiscal impact for the three year term was $500,000.00 for both corridors.
Commissioner Martinez inquired why none of the $10 million originally allocated for the corridors was used to fund the financial services component.
Ms. Alice Bravo, Director, Miami-Dade Department of Transportation and Public Works (DTPW), explained the scope of the work to be performed by the consultant under the foregoing work order was unrelated to the corridor studies but instead involved the review of the financial models submitted by the proposers in response to the County�s Request for Proposals (RFP).
Discussion ensued between Commissioner Martinez and Ms. Bravo regarding the fact that there was only one proposal to evaluate.
Commissioner Martinez inquired as to how much of the $10 million was spent on the Beach Corridor study and suggested allocating the amount needed for the financial consultant from the remaining balance, if any existed. He spoke about the need for transparency regarding the cost of the studies and the work done to date.
Ms. Bravo stated she did not have the most current numbers but noted half the amount was refunded by the Florida Department of Transportation (FDOT). She also pointed out the item before the Board today was simply to approve the contract for the consultant and not allocate funding.
Deputy Mayor Jennifer Moon clarified the contract in question was specific to financial advisory services which was not included in the analysis performed for the LPA. She assured the Board members any unspent monies from the initial $10 million could be used to fund the services and pointed out financial review process would not begin until a proposal was selected.
Commissioner Martinez noted while there was no rush to proceed with the foregoing item he would prefer for any unused People�s Transportation Plan (PTP) funds to be reallocated to cover the cost of the financial advisory services contract.
Mayor Gimenez indicated the item should be deferred.
Commissioner Heyman requested the item include additional information as to what was considered �required� expenditure, the source of the funds and next steps to advance the project, when next it was presented to the Board for consideration.
Deputy Mayor Moon indicated the administration would provide a report detailing what was needed to proceed and a balance of the amounts expended on the other consulting contracts to date.
Commissioner Diaz concurred with his colleagues regarding the need for greater transparency and accountability.
Hearing no further questions or comments, the Board proceeded to vote to defer the foregoing item to no date certain.
Responding to Commissioner Diaz�s question as to whether the deferral would negatively impact the selection of an advisor and cause a delay, Deputy Mayor Moon assured the Board members that the proposed item sought to access an existing pool with a work order and as such there would be no delay.

REPORT:
Commissioner Levine Cava stated while she recognized the intent of the item, the reduction in the original proposed amount of reclaimed wastewater to be used to cool the Florida Power and Lights (FPL) Company�s Turkey Point Complex from 90 million gallons to 15 million gallons, would not address the County�s wastewater problem. She pointed out the item did not include a restoration plan which was another critical issue for the wetlands in which FPL�s facility was located and argued the foregoing proposed resolution would not produce the environmental benefit as originally intended.
Commissioner Levine Cava asked if the agreement required any additional treatment of the reclaimed wastewater and whether the proposed expansion (second pipeline) was also a part of the agreement. She also inquired about funding for the foregoing item and any future expansions.
Mr. Kevin Lynskey, Director, Miami Dade Water and Sewer Department (WASD), explained the County�s South District plant currently satisfied both the State of Florida and FPL�s reclaimed wastewater standards. He noted FPL would further treat the piped reclaimed wastewater before using it in its� cooling towers and clarified the second pipeline was an option available to the County in the event more water was needed by FPL. Mr. Lynskey indicated all costs for the first pipeline would be borne by FPL with an annual subsidy of $6.5 million provided by the County and stated while the second pipeline would be constructed by FPL, the County would be responsible for all construction costs.
Responding to Commissioner Levine Cava�s question as to the County�s plans to comply with the State requirements that 117.5 million gallons of wastewater be recycled and reused daily by 2025, Mr. Lynskey clarified the mandate included three caveats which required the wastewater to be environmentally allowed and the process be economically and technically possible. He explained the current water treatment process presented financial difficulties and stated while there were no other large projects planned, the County was exploring the possibility of identifying funding partners to provide relief to the coastal wetland areas.
Commissioner Levine Cava asked staff to review and update the �Plan B� option she previously presented and asked how the foregoing item would impact the County�s clean-up targets for the cooling canals and saltwater plumes.
Mr. Lee Hefty, Assistant Director, Division of Environmental Resources Management, Department of Regulatory and Economic Resources (RER), advised the Board members that the County entered into a Consent Agreement with FPL which required FPL to install an extraction well system to remove hypersaline water from the Biscayne Aquifer and dispose of said water into the deep Floridan Aquifer. He noted the system was currently operational and added that FPL had also tapped into the upper portion of Floridan Aquifer to provide water to help maintain the salinity in the cooling canal system. Mr. Hefty stated while staff anticipated the hypersaline plume to take a number of years to retract, preliminary data from the initial reports indicate the wells located in the Northwest areas of the cooling canal system already show positive signs of improvement.
Mr. Hefty reviewed the intent of the foregoing item and FPL�s plans to treat and reuse the wastewater for the cooling tower system for Unit #5. He noted the water would then be disposed of in the deep boulder zone as done by the Water and Sewer Department. Mr. Hefty pointed out FPL could also seek approval to use the Floridan Aquifer waters currently used on the cooling towers and divert said waters to the cooling canals to also help manage the salinity of the system.
Discussion ensued between Commissioner Levine Cava and Mr. Hefty about the benefits of diverting the Floridan water from the cooling towers to help manage and maintain the salinity of the cooling canal system.
Commissioner Levine Cava reiterated the importance of reusing/recycling wastewater and stated while she was disappointed in the reduction in the amount of wastewater now proposed for the project she was still in support of the item.
Commissioner Sosa provided a brief historical background regarding the item and spoke about herself and Commissioner Bovo�s efforts, as co-prime sponsors, to advance the project. She indicated her firm support for the item and thanked FPL and everyone who advocated for the item.
Mayor Gimenez echoed the comments made by Commissioner Sosa and briefly spoke about the provisions put in place to ensure the project could be expanded should the need arise. He pointed out the project would double the amount of Floridan Aquifer water in the cooling canal systems to help with the desalination process at twice the current rate. Mayor Gimenez recognized FPL and the co-prime sponsors of the item, Commissioners Sosa and Bovo, and thanked them for their commitment and dedication to the project.
Hearing no other questions or comments, the Board proceeded to vote to adopt the foregoing proposed resolution, as presented.

REPORT:
Commissioner Levine Cava requested an update on the status of the small business forgivable loan program.
Mr. Michael Liu, Director, Miami-Dade Public Housing and Community Development (PHCD) Department, advised the Board members that a report was forward to each commissioner detailing the number of applications received to date. He reported out of approximately 2600 applications sent out to various parties, 272 were returned with 122 fully completed. Mr. Liu noted staff was in the process of approving and funding 20 applications this week and estimated the average approval amount was $8500.00. He pointed out the applications were received from different commission districts and indicated both entities involved in the program, Partners for Self Employment and Tools for Change, were completely engaged and ready to proceed.
Commissioner Levine Cava spoke about the success of the program to date and urged the Board to keep the existing program in tact without any changes.
Commissioner Bovo stated while he was in support of the item he was concerned about the equity of the distribution of funds and cited the number of business approved or in the process of being approved for funds from Commission Districts 1 (28 businesses), 3 (37 businesses) and 5 (20 businesses), as opposed to only 15 from his Commission District (13).
Commissioner Martinez reminded his colleagues he initially voted against the item based on his concerns about the equitable distribution of funds.
Commissioner Heyman pointed out every one expressed concerns about equitable distribution when the item was first considered and spoke about the intent of the Board to ensure each Commission District was allocated the same amount of funds to distribute with an understanding that any unallocated funds would be recaptured and redistributed as needed.
Chairwoman Edmonson reminded her colleagues the money needed to be spent by the end of the year.
Commissioner Sosa indicated per the report received from the department, only four (4) businesses were awarded funds to date from her Commission District.
Hearing no other questions or comments, the Board proceeded to vote to adopt the foregoing proposed resolution, as presented.

REPORT:
Commissioner Levine Cava explained the intent of the foregoing item.
Commissioner Sosa stated she could not support the foregoing item and argued the best solution included helping both landlords and tenants. She voiced her apprehensions about landlords being accused of inaction due to financial hardships which could then result in criminal action.
Commissioner Diaz echoed the concerns voiced by Commissioner Sosa and suggested the sponsor include language to clarify the types of actions which would result in stricter penalties being imposed.
Chairman Edmonson pointed out there was already an evictions process in place and maintained landlords should not be penalized and their economic hardships minimized simply because they were property owners.
Commissioner Levine Cava contended Florida law favored landlords and reassured her colleagues that the foregoing item was not about preventing lawful evictions. She reiterated the intent of the item was to ensure landlords did not take it upon themselves to force tenants out of a property without a legal process. Commissioner Levine Cava indicated she was willing to amend the item to address the concerns voiced by her colleagues.
Assistant County Attorney Terrence Smith announced the foregoing item would be amended to strike the requirement and/or language reference of criminal penalties but keep any enhanced penalties determined by the Florida Legislature.
Commissioner Levine Cava accepted the proffered amendment.
Hearing no further questions or comments, the Board voted to adopt the foregoing proposed resolution, as amended.

REPORT:
Chairwoman Edmonson requested the County Attorney�s office read her proffered amendments into the record.
Assistant County Attorney Terrence Smith announced the foregoing proposed resolution should be amended as follows:
~On typewritten page 4, in the last �whereas� clause, to insert the words �to assist residents living� after �NANA� and before �within the Overtown area;� and
~On typewritten page 5, Section 2 to insert the words �to assist residents living� after �Miami-Dade College� and before �in the Overtown area.�
Assistant County Attorney Smith stated the item would be further amended to include the following language at the end of typewritten page 5, Section 2: �In the event there are any remaining Grant Funds, then NANA shall return such funds to the County. Upon receipt of such funds, this Board hereby directs the County Mayor or the County Mayor�s designee to deposit such funds for use by the �Employ Miami-Dade� program to assists residents living in the Overtown area.� He noted these changes would also be reflected in the grant agreement with NANA, which was attached to Exhibit B and located on handwritten pages 11-47.
Chairwoman Edmonson relinquished the Chair to Vice Chairwoman Sosa.
Commissioner Heyman pointed out the item stated that the program administrator, Neighbors and Neighbors Association, Inc. (NANA), would be allowed to sell or lease the food trucks at the conclusion of the program and asked who would keep the proceeds of the sale/lease of the trucks.
Commissioner Edmonson explained the intent of the second proffered amendment and noted the amendment specifically states that any remaining grant funds would be returned to the County and subsequently deposited into the a reserve fund for use by �Employ Miami-Dade� to help residents living in the Overtown area.
Assistant County Attorney Smith acknowledged Commissioner Edmonson�s intent with regards to the proffered amendment and assured the Board members that the revised grant agreement would include language to ensure any and all proceeds gained through the lease or sale of the food trucks would be returned to the County.
Discussion ensued between Commissioner Edmonson and Assistant County Attorney Smith about further amending the item and the grant agreement to include language to recapture funds derived from the leasing or sale of the food trucks at the conclusion of the program.
Chairwoman Edmonson accepted the proffered amendments and explained the intent of the food truck program
Commissioner Diaz indicated his support for the item and the proffered amendments.
There being no further questions or comments, the Board proceeded to vote on the foregoing proposed resolution, as amended.

REPORT:
Commissioner Martinez asked what was meant by the term �investigatory agency� as outlined on handwritten page 5, Section 2, Subsection C of the memorandum.
Commissioner Bovo clarified any third party entity such as a review panel would be considered an �investigatory agency.�
Commissioner Martinez stated while he understood the intent of the item he was concerned about the language contained in Section 2, Subsection C of the memorandum and argued the subjective review/findings of an agency should not be used to prohibit the hiring of new officers.
Commissioner Bovo acknowledged the concerns voiced by his colleague, Commissioner Martinez and explained the intent of the item was to codify what was already being done by the department. He indicated he was open to amending the item to clarify the intent and welcomed Board input.
Commissioner Martinez explained his only concern was the use of findings from an �investigatory agency� such as a citizen review panel.
Commissioner Bovo recognized the subjective nature of citizen review panels particularly related to police practices and reiterated the intent of the item, noting that he would be willing to limit the item to the use of an internal review report.
Commissioner Martinez provided an example of the difficulties encountered by officers dealing with a diverse population and stated he would support and co-sponsor the item if Subsection C was completely eliminated.
In an effort to further define the term �investigatory agency�, Commissioner Bovo asked whether the Florida Department of Law Enforcement (FDLE) would be considered an �investigatory agency�, to which Commissioner Martinez stated he considered FDLE a law enforcement agency and suggested they schedule a Sunshine Meeting to allow further discussion the specifics of the item.
Hearing no further questions or comments, the Board proceeded to vote on the motion to defer the foregoing report to the July 8, 2020 BCC meeting.

REPORT:
Assistant County Attorney Oren Rosenthal announced the foregoing proposed resolution would be amended as follows:
~On handwritten page 6, after the first sentence in Section 3, to add the following language: �The option to deliver vote-by-mail ballots to the drive-through vote-by-mail drop-off locations from a vehicle shall be in addition to all other legal means of delivery of vote-by-mail ballots.�
Chairwoman Edmonson explained there were only four (4) locations identified for the drive-through drop off boxes on election-day because the boxes needed to be monitored and adding more locations would complicate and delay the ballot delivery and counting process for the elections department. She pointed out all absentee/early voting ballots could be dropped off at any one of the early voting sites during the early voting period.
Commissioner Diaz spoke about the importance of protecting the absentee voting process and indicated his support for the item.
Commissioner Higgins pointed out the proffered amendment did not specify voters were allowed to �walk up� to drop off absentee ballots and asked for the amendment to include language to clarify the intent.
Chairwoman Edmonson argued including language that voters were allowed to walk-up to drop off their absentee ballots was not necessary and would require further modification of the item to list all legal means of delivery.
Discussion ensued between Commissioner Higgins and Assistant County Attorney Rosenthal regarding what was considered �legal means of delivery.�
Vice Chairwoman Sosa and Commissioner Levine Cava thanked Chairwoman Edmonson for sponsoring the item and leading the initiative.
There being no further questions or comments, the Board proceeded to vote on the foregoing proposed resolution, as amended.

REPORT:
Assistant County Attorney Javier Zapata announced the foregoing proposed resolution was amended to include the following language on handwritten page 4, Section 2, �Within 30 days of the effective date of this resolution, the County Mayor shall identify legally available funding within the current fiscal year to implement and conduct a public awareness campaign designed to educate businesses in Miami-Dade County on the options available to them to help mitigate employee childcare issues during the COVID-19 pandemic. The campaign shall include, at a minimum, further information regarding the potential measures described in section 1 above. Within 90 days of the effective date of this resolution, the County Mayor or the County Mayor�s designee shall provide a report to this Board and place the completed report on an agenda of the Board pursuant to Ordinance No. 14-65. The report shall describe the campaign, the methods used, and any other information available to indicate the campaign�s effectiveness.� He explained the amendment also renumbered the remaining sections accordingly and makes a conforming amendment to the title.

REPORT:
Commissioner Monestime referenced the lengthy discussion by the Board earlier in today�s meeting regarding Agenda Items 6B2 and 11A4 and asked if the foregoing item could be amended to include mortgage relief assistance. He also requested he be added as a co-sponsor in the event the item could be amended to include mortgage relief assistance.
Assistant County Attorney Shannon Summerset-Williams indicated there was no legal issue in extending the program to include mortgage relief assistance.
Responding to Commissioner Monestime�s question whether the $10 million currently allocated would be enough and if there were any other funds available to allocate to the program.
Deputy Mayor Moon indicated more money could be allocated to expand the program to help residential and business tenants, as well as provide rental and mortgage relief to the community and offered to return with a report on a proposed expansion.
Chairwoman Edmonson reminded her colleague, Commissioner Monestime, that a request was made earlier in today�s (6/16) meeting during discussion of Agenda Item 6B2, for the County Attorney�s Office to draft legislation urging the State/Federal government to provide CARES Act funding to assist rental property owners and landlords.
Commissioner Levine Cava requested she be added as a co-prime sponsor on the foregoing item.
Commissioner Higgins reviewed the intent of the foregoing item and explained how the program would be administered. She spoke about the �trickle up� effect of unpaid rent and the financial impact on landlords and expressed her disappointment that the program would be delayed based on Commissioner Bovo�s intent to invoke the 4-Day Rule.

REPORT:
Commissioner Bovo requested clarification from the administration regarding the amount of students and teachers/instructors allowed to participate in summer camp/youth camp activities.
Miami-Dade County Mayor Carlos A. Gimenez stated the additional accommodations were made for camps catering to special needs children.
Commissioner Bovo reviewed the intent of the item noting it was geared more toward orthodox Jewish schools and indicated he was advised that two adults and ten children would be permitted per class.
Deputy Mayor Jennifer Moon confirmed the current emergency order allowed for ten children per class.
Commissioner Levine Cava inquired about the County�s contact tracing plan and whether additional testing of nursing home and Assisted Living Facility (ALF) patients would be done to supplement the testing performed by the State.
Mayor Gimenez pointed out the State of Florida was currently overseeing testing at nursing homes and ALFs and agreed more testing was needed.
Deputy Mayor Moon reported the County was collaborating with the Florida Department of Health (FDOH) to develop an agreement where the County would provide the resources to expand the existing contact tracing.
Responding to Commissioner Levine Cava�s question as to the County�s plan for the next reopening phase, Mayor Gimenez clarified that municipalities� reopening plans were bound to the County�s plans and noted the County was currently in phase �yellow� which allowed bowling alleys and movie theatres to reopen upon submittal of a plan of operation. He stated bars and night clubs remained closed and explained the next phase would include easing of specific restrictions based on the contagion rate. Mayor Gimenez stressed that he had no plans to re-close the County and spoke about the importance of enforcing the rules implemented. He noted refusal to comply with the rules by businesses would result in them being shut down.
Commissioner Levine Cava spoke about the complacent attitude of some residents and asked what measure was being used to guide the County into the next reopening phase.
Mayor Gimenez indicated he would like to see a decrease in the positivity rate and number of hospitalizations before moving to the next phase and reemphasized his intent was not to re-close the County.
Addressing Commissioner Levine Cava�s concerns about increasing awareness and education about the coronavirus disease 2019 (COVID-19) in hotspot areas, Mayor Gimenez stated he did not think there was much more the County could do and reassured the Board members that the County would continue to utilize all forms of media, digital print and online communication to continue spreading information.
Discussion ensued between Mayor Gimenez and Commissioner Levine Cava about recently identified hotspots and the County�s plans to direct more information to those specific areas as well as try to determine the reason for the increase.
Mayor Gimenez stated several hotspots were identified in South Miami-Dade and voiced his concerns about increased positivity rates at migrant camps which may be contributing to the overall increase in positivity rates for the County. He spoke about the need for residents to take personal responsibility, especially the vulnerable, to ensure the virus did not spread and pointed out all the basic precautionary measures such as wearing a mask, washing hands and refraining from touching one�s face; remained the same.

Commissioner Diaz indicated his support for the item and noted he has been working with the administration in excess of twenty years to reduce water levels in secondary canals as needed during the hurricane season. He added that he was currently awaiting a report from the South Florida Water Management District about recurrent flooding in affected areas.

REPORT:
Responding to Chairwoman Edmonson�s question as to whether the Minimum Annual Guarantee (MAG) payments would be extended and the proposed timeframe for the extension, Mr. Lester Sola, Director and Chief Executive Officer of the Miami-Dade Aviation Department, explained the Board of County Commissioners (BCC/Board) approved a six month relief program beginning in March and set to expire at the end of August. He stated if an extension was needed, a separate item would be presented to the Board for consideration.
Commissioner Moss voiced his concerns about waiting until August to extend the program given the Board�s schedule and asked for the County Attorney�s input.
Chairwoman Edmonson concurred with Commissioner Moss� concerns and suggested proffering a motion which would give the Mayor or Mayor�s designee the authority to extend the program in the event the Board was out on recess in August.
Assistant County Attorney David Murray reviewed the proposed language for the motion.
Commissioner Sosa noted that she sponsored the original item and reassured her colleagues that she was already working with staff to bring an item back to the Board in July to extend the existing program.
Mr. Sola clarified that it was staff�s intent to return to the Board before the program expired in August to extend the program period.
Commissioner Moss stated he was satisfied with Commissioner Sosa�s assurance that the item would be brought before the Board before the program expired in July and as such a separate motion was not necessary.
Commissioner Diaz indicated his support for extending the program past August.
Hearing no further questions or comments, the Board voted to accept the foregoing report, as presented.

REPORT:
First Assistant County Attorney Geri Bonzon Keenan read a procedural motion made by Commissioner Martinez for Legislative File No. 200886, which was adopted on first reading at the June 2, 2020, Board of County Commissioners (BCC) meeting, into the record. She advised the item pertained to the building code requiring homeowners to provide a real estate disclosure related to illegal construction and code violations and noted the public hearing scheduled for June 9, 2020 before the Infrastructure Capital Improvement Committee (ICI) did not take place because the item was not timely advertised. First Assistant County Attorney Bonzon Keenan stated in an effort for the item to be considered expeditiously, Commissioner Martinez moved to suspend the rules for Committee review to allow
the public hearing and second reading to be heard at the July 8, 2020 BCC meeting.
Hearing no objections, the Board proceeded to vote on the foregoing non-agenda item to include the aforementioned terms.
