202186 Discussion Item     Audrey M. Edmonson
Esteban L. Bovo, Jr.

DISCUSSION ITEM REGARDING THE CORONAVIRUS DISEASE 2019 (COVID-19) PANDEMIC Presented
REPORT: Miami-Dade County Mayor Carlos A. Gimenez provided an update about the Countys positivity rate, which had begun to trend upwards and noted coronavirus disease 2019 (COVID-19/COVID) related hospitalizations were also on the increase. He indicated the number of rescue calls had increased, and medical advisors expected the numbers to rise in a second wave by November.

Mayor Gimenez indicated a lawsuit had been filed by an adult entertainment establishment challenging the Countys curfew measurement, in which the Judge ruled in their favor since the curfew measure violated the governors order. However, he stated a stay was in place and that a ruling from the third district court of appeals was expected later in the day. Mayor Gimenez commended all County employees for their efforts and contribution to support all the measures taken to stay safe. He advised complying with the rules was the goal to keep us safe.

Commissioner Diaz referred to establishments breaking the rules while other businesses were complying and losing money.

Mayor Gimenez spoke of European countries that took drastic measures, noting the need for the County to act proactively, so that this virus was controlled until a vaccine was approved.

Commissioner Martinez noted that while the nature of this virus is still unknown, he inquired about the purpose of continuing the curfew.

Mayor Gimenez responded to Commissioner Martinez inquiry regarding continuation of the curfew given that the nature of the virus is still unknown and on the noise decibel level related to the state of emergency. Mayor Gimenez pointed out while the County could not control whether or not businesses complied with the law, he stated the vast majority were complying and operating under the guidelines.

Commissioner Moss suggested the possibility of scheduling a meeting with medical experts to hear about new recommendations from their medical experience about the spikes of the virus itself.
In response to Commissioner Moss suggestion to meet with medical experts to hear about new recommendations from their medical experience about the spikes of the virus itself, Mayor Gimenez stated a meeting had been scheduled for Wednesday, October 28, 2020.

In response to Commissioner Sosas inquiry regarding the governors executive order regarding meetings, First Assistant County Attorney Geri Bonzon Keenan stated the governors executive order allowing for virtual meetings of the Board would last until October 30, and absent the governor extending that order; the Board could only act in person; all of the form requirements required in-person meetings because of the Sunshine law.

Commissioner Diaz commended Mayor Gimenez for his efforts and recognized it was not an easy task keeping Miami-Dade County safe. He asked whether it was possible to extend one-hour more in restaurants.

Deputy Mayor Edward Marquez made a PowerPoint presentation regarding the unspent funds for the COVID-19 relief program.

In response to Commissioner Sosas inquiry about the number of cities participating in the COVID-19 relief program and small franchises, Mr. Marquez explained that s solution was being sought for the small businesses. He noted it would be at the Boards discretion of how the $25 billion would be released. Mr. Marquez referred to a letter from City of Florida Mayor, and he proceeded to provide an overview of how much each city/municipality could receive in funding and the percentage for each commission district.

Commissioner Sosa expressed her disagreement in leaving any city out of the COVID-19 relief program, pointing out that small cities had needs just as much as the larger cities.

In response to Commissioner Sosas suggestion about finding the best way to help small franchise owners, Assistant County Attorney David Stephen Hope explained the difficulties in differentiating national, region and local franchises. He stated an analysis was being conducted on finding a way to identify small businesses owners located within the threshold limits of Miami-Dade County under the income limit to qualify for the program.

In response to Commissioner Jordans inquiry regarding the City of Opa-Locka qualification for the COVID-19 relief program, Mr. Marquez stated the first distribution made was to cities with a poverty level equal to or greater than 35 percent. He noted the City of Opa-Locka applied for $2.1 million, however the Administration had not provided a recommendation. Mr. Marquez stressed it was a policy call by the Board of County Commissioners on whether to recommend funding or not for the City of Opa-Locka.

A brief discussion ensued between Commissioner Jordan and Mr. Marquez regarding Florida International University (FIU) and additional available funding resources for the relief program.

Later in the meeting, Deputy Mayor Moon clarified for the funding was not for FIU, but for FIU to distribute the funding to restaurant employees.
Commissioner Jordan made a motion to include consideration of FMU being allocated with the additional available funding for the resources that had not been used for students preparation for COVID-19. This motion was seconded by Chairwoman Edmonson.

Discussion ensued among Board members and Mr. Marquez concerning the cities/municipalities that were not receiving funding from the COVID-19 relief program; and reaching a solution for the funding that had not been allocated for distribution, in an equitably way, before the deadline on December 15, 2020.

Deputy Mayor Jennifer Moon suggested reimbursement of those expenditures from the Coronavirus Aid, Relief, and Economic Security (CARES) Act to ensure that revenue would not be returned to the federal government and provide for needed services within the community.

Commissioner Diaz concurred with the previous comments by his colleagues pertaining to need basis; and requested Deputy Mayor Marquez to provide a report regarding the needs and to determine and recommend how the funds would be allocated prior to reallocation of any available funding.

See agenda items 15F2 through 15F7 for various motions which were memorialized in the form of resolutions.

Following consideration of Special Item No. 11, in response to Commissioner Martinez remarks, regarding a letter denying AFSCME employees request for a 1% supplement for childcare, Deputy Mayor Jennifer Moon explained this classification was based on the language provided by the Federal Care Act that the guidelines established were only for first responders.
