1A INVOCATION AS PROVIDED IN RULE 5.05(H)  
  REPORT: The Board of County Commissioners (hereafter referred to as the Board) observed a moment of silence.  
1B ROLL CALL  
  REPORT: In addition to the members of the Board, the following staff persons were present: Miami-Dade County Mayor Daniella Levine Cava, Deputy Mayors Jennifer Moon, Maurice Kemp, Edward Marquez and Jack Osterholt; County Attorney Abigail Price-Williams, Successor County Attorney Geri Bonzon-Keenan, Assistant County Attorneys Bruce Libhaber, Oren Rosenthal, Dennis Kerbel, Eddie Kirtley, and Abbie Schwaderer-Raurell; Clerk of the Board Director Melissa Adames; and Deputy Clerks Jose Soto and Nelson Diaz.

County Mayor Daniella Levine Cava welcomed back the returning commissioners and greeted the new commissioners who became members of the Board following the November 3, 2020 elections. She affirmed her commitment to work with the Board, help the commissioners achieve their objectives, and provide as much information as they needed.

Mayor Levine Cava announced a series of meetings to assist and orient the new commissioners. This included a virtual Sunshine meeting on November 24, 2020, and special meetings about the coronavirus disease 2019 (COVID-19) pandemic and how to deal with it. She added that she would schedule as many virtual meetings as permissible by law.

Mayor Levine Cava announced her intent to meet with each commissioner and discuss their individual visions and priorities. She expressed her confidence that the Board and her would work well together for the good of the County. Vice Chairwoman Sosa agreed that the Board and Mayor Levine Cava would be able to work together and handle any issues faced by the County such as COVID-19.

  REPORT: The Pledge of Allegiance was led by Vice Chairwoman Sosa.

1G REASONABLE OPPORTUNITY FOR THE PUBLIC TO BE HEARD AS PROVIDED IN RULE 6.06  
  REPORT: Vice Chairwoman Sosa opened the meeting for a reasonable opportunity to be heard and Commission Auditor Yinka Majekodunmi said there were 12 voicemail messages left by speakers into the record. However, there were technical issues which prevented the messages from being heard.

As those issues were worked on, Vice Chairwoman Sosa asked Successor County Attorney Geri Bonzon-Keenan on how to proceed in the meantime. Ms. Bonzon-Keenan answered that according to the State of Florida, the Reasonable Opportunity for the public to be heard must occur before the Setting of the Agenda.

After the technical issues were resolved a few minutes later, Mr. Majekodunmi read the names of the following speakers who left voicemails into the record in support of item 11A2 because it created safe pedestrian and bicycle pathways in the City of Miami (See Agenda Item 11A2, Legislative File No. 202049):

Ms. Katherine Moore, 4400 NE 34 Street, Miami, FL, was an administrator of an unnamed historic retirement home in Miami

Mr. Douglas Thompson 937 Sunset Road, Coral Gables, FL

Ms. Andrea Iglesias, 1800 SW 1st Ave., Miami, FL, a Chief Executive Officer of the Urban Health Partnerships

Mr. Eli Steers, 509 NE 57 St., Miami, FL, an attorney of Rails to Trails Conservancy

Mr. Colin Worth, 79 NW 92 St., Miami Shores, FL, Chairman of the Bicycle Pedestrian Advisory Committee of the Transportation Planning Organization

Mr. Kevin Amezaga, 12219 SW 111 Terrace, Miami, FL 30186, represented the Miami Riders Alliance

Ms. Maria Cristina Chicuen, 169 E. Flagler St., Miami, FL 33131, a Public Affairs Manager of the Miami Riders Alliance

Mr. Ryan Shed 1230 West Ave., Miami Beach, FL

Mr. Gary Ressler, no address given, represented the Tilia Companies (phonetic)

Mr. Hank Sanchez-Resnick, 3259 Gifford Lane, Coconut Grove, FL, a Co-Chair of the Friends of the Commodore Trails

Mr. Matthew Geltano, 125 Jefferson Ave., Miami Beach, FL could not be heard because of technical issues; once they were resolved Mr. Geltano�s message played in full where he voiced his support for item 11A2.

Mr. Daniel Lessig, a business owner at 120 NE 129 St, North Miami, FL, left a voicemail message to speak against item 11A3 and cited several issues with the item, especially that it increased taxes.

Mr. Majekodunmi stated there were no more live callers, voice messages or emails left to be read into the record.

Vice Chairwoman Sosa closed the reasonable opportunity to be heard, but after the Setting of the Agenda she was notified that there were public speakers waiting to be heard on item 11A3 and opined they should be allowed to speak.

Ms. Bonzon-Keenan informed Vice Chairwoman Sosa it was her discretion of when they could be heard; Vice Chairwoman Sosa allowed the public speakers to come forward and the following speakers spoke about the item 11A3:

Ms. Melissa Tapanes, 200 S. Biscayne Blvd., Miami, FL, a lawyer who represented several property owners based in a portion of Miami-Dade County�s Unincorporated Municipal Service Area, which was proposed to be annexed by Miami Gardens. She did not support Item 11A3 because it violated due process rights of the property owners, did not comply with Miami-Dade County Code, had errors in its financial calculations, and was not consistent with the County Charter.

Vice Chairwoman Sosa closed the reasonable opportunity for the public to be heard but after discussions about Agenda Item 6A2 concluded, she was again notified there were more persons waiting to speak about the item 11A3. Ms. Bonzon-Keenan advised Vice Chairwoman Sosa to let the persons speak at the time when item 11A3 was discussed by the Board since it was a pull list item.

SPECIAL NOTE: The persons were allowed to speak later in the meeting about item 11A3 when the Board discussed the item. (See Agenda Item 11A3, Legislative File No. 201996).
 
1H MOTION TO SET THE AGENDA AND "PULL LIST"  
  REPORT: Successor County Attorney Geri Bonzon-Keenan stated in addition to Vice Chairwoman Sosa�s Memorandum entitled �Changes Sheet�, Commissioner Diaz requested he be added to the pull list for Agenda Items 8A1, 8E2, 15B4, and 15B5; Commissioner Heyman requested she be added to the pull list for Agenda Items 11A3 and 14A1; Commissioner Gilbert requested he be added to the pull list for Agenda Item 11A9 and released his pull on Agenda items 8A2, 8D1, and 8F7.

Ms. Bonzon-Keenan announced Commissioner Regalado assumed sponsorship of Agenda Item 5D; Vice Chairwoman Sosa assumed sponsorship of Agenda Item 6A2; Commissioner McGhee assumed sponsorship of Agenda Items 7A, 8F1, 11A1; and Commissioner Gilbert assumed sponsorship of Agenda Item 7C, 11A3 and 11A14.

Ms. Bonzon-Keenan announced the following commissioners who made requests for co-sponsorships for the following items:

Commissioner McGhee for Agenda Items 4A, 7B, 8E1, 8E2, 8G1, 8I2, 11A2, 11A4, 11A5, 11A6 and 11A7; Commissioner Diaz for Agenda Items 11A5 and 11A7; Commissioner Souto for Agenda Item 11A2; and Commissioner Regalado for Agenda Item 11A2.

Ms. Bonzon-Keenan stated the items to be considered at today�s (11/19/2020) meeting would be those listed in the printed final Agenda, with additions, deferrals, withdrawals, and scrivener�s errors noted in Vice Chairwoman Sosa�s Changes Memorandum, and the aforementioned items. She added the Board would approve all of those items by single vote; setting the agenda, except for ordinances for first reading, public hearing items, discussion items 6A1 and 6A2, ordinances set for second reading, items subject to the four-day rule under section 14 of the agenda, and the following pull list items: 8A1, 8E2, 8F3, 11A2, 11A3, 11A9, 11A10, 14A1, 15B4, 15B5 and 15B6.

Vice Chairwoman Sosa noted the following items were on the pull list but had deferral requests: 4B, 5D, 8K3, 8N5, and 11A14. Commissioner McGhee made a motion to defer these items and was seconded by Commissioner Higgins; the deferrals were approved by a vote of 12-0 (District 8-Vacant).

It was moved by Commissioner Diaz to approve Vice Chairwoman Sosa�s Changes Memorandum for the November 19, 2020 for the Board meeting with additional changes noted by Ms. Bonzon-Keenan and those additional requests made by Board members. This motion was seconded by Commissioner Heyman and upon being put to a vote, passed by a vote of 12-0 (District 8-Vacant).

  REPORT: Vice Chairwoman Sosa presented the foregoing discussion item and opened the floor for discussion about Agenda Items 11A9 and 11A10 to decide whether the Board should appoint a commissioner to County Commission District 8, which was vacant after County Commissioner Daniella Levine Cava was elected County Mayor, or hold a special election in that district for a commissioner.

Successor County Attorney Geri Bonzon-Keenan read the title of the foregoing proposed resolutions into the record. She advised only Agenda Item 11A10 had to be approved as amended.

Commissioner Diaz commented it would take up to six months to hold a special election which left District 8 until then without representation. He also noted the cost of a special election was unknown considering it might lead to a runoff election. Deputy Mayor Jennifer Moon confirmed the cost would be $1.2 million. Commissioner Diaz suggested the Board appoint a person who originally ran for that seat and cited past precedence.

Vice Chairwoman Sosa agreed and added an appointment saved money for the County, which was needed to deal with the coronavirus disease 2019 (COVID-19) pandemic.

Commissioner Heyman reminded the Board, the seat did not belong to a specific person but to voters. She noted the people in District 8 wanted to vote for a replacement commissioner. She also said the cost was negligible compared to the County�s billion-dollar budget and cited past situations where special elections were held in the County and its cities. She also indicated election law mandated that a vacant seat must be filled by 90 days after the Regular Board meeting (11/19/2020). Commissioner Heyman observed that commission staff for District 8 continued to provide service to the district during the vacancy.

Commissioner Martinez agreed with Commissioner Heyman and opined an appointment was not representation. He stated he would support item 11A10 but not item 11A9.

Assistant County Attorney Oren Rosenthal clarified that according to the County Charter an election must be held by 90 days and if there was a runoff it must be held 30 days afterwards. He stated the Board was allowed to hold an election sooner based on the availability of the Supervisor of Elections.

Commissioner Gilbert stated he was appointed to the City Council of Miami Gardens. He opined that appointments were representation because they were done by commissioners who were chosen by voters to make decisions on their behalf, which included appointments. Commissioner Gilbert added that the appointment for the vacant seat was only temporary until a regulation election took place in 2022.

Mr. Rosenthal explained the County Charter�s rules about the vacancy. He informed the Board it had 30 days to decide whether to appoint a commissioner or call for a special election. Mr. Rosenthal added that persons running for office had the option to either resign their current post before running for another office or resign after the election.

Commissioner Garcia commented that Mayor Levine Cava�s decision not to vacate her commission seat prior to the election would cost the County money if a special election was held. He stated there was a public referendum for holding special elections and he favored it, as well.

Ms. Bonzon-Keenan noted public comments were not required for the Board�s decision but the public had a reasonable opportunity to be heard earlier in the meeting.

Vice Chairwoman Sosa suggested deferring both items and holding a dedicated meeting which allowed the public to voice their opinions.

Mr. Rosenthal referred to the proposed Charter amendment placed for elections in the November 3, 2020 election that mandated any person who ran for an office had to resign prospectively from his or her current office, effective after the primary or general election but occurring before the primary or general election. He stated this allowed the vacated office to be filled at the primary of general election to avoid a later special election.

Commissioner Diaz expressed concern about voting on the items because technical difficulties during the reasonable opportunity to be heard prevented the public from speaking. He made a motion to defer both items for a special meeting, which was seconded by Commissioner Higgins.

Discussion ensued among the Board members about the deferral of both items and whether the items were properly advertised, wherein Ms. Bonzon-Keenan answered that the items had been listed on the preliminary agenda and did not require notice.

Commissioner Souto voiced his support for the deferral.

Ms. Bonzon-Keenan pointed out a date and time needed to be decided if a special meeting was called.

Commissioner Monestime said he would not support the deferral because the public had not come forward to speak about the items, which were advertised. He also reminded the Board of current and past commissioners who were appointed.

Commissioner Hardemon agreed with Commissioner Monestime and pointed out other positions in the County were appointed.

Commissioner Garcia spoke against deferral of the items.

Deputy Mayor Jennifer Moon reported that the cost of a special election was one to one point two million dollars. She added this was not within the Election Department�s budget for fiscal year 2020. Ms. Moon also confirmed the cost of a special election would come from the County�s general fund.

After hearing the other Commissioner�s opinion regarding these matters, Commissioner Diaz withdrew his motion to defer both items.

Commissioner Heyman moved to vote on Agenda Item 11A10; Commissioner Martinez seconded the motion.

Ms. Christina White, Miami-Dade County Supervisor of Elections, recommended the special election be held on January 26, 2021 to maximize voter interest, although the Board had until February 16, 2021 to hold an election. Ms. White also mentioned that a runoff election could be held on February 23, 2021.

Commissioner Diaz opined that COVID-19 and the holiday schedule would impede a special election. He expressed that the Board should appoint someone to the position.

Vice Chairwoman Sosa stated she would not support a special election in order to save money and protect campaigners during the COVID-19 pandemic.

Ms. Bonzon-Keenan called a Point of Order and noted the special election in item 11A10 needed to be clarified if the item was adopted. She said early voting days and locations had to be determined.

Ms. White recommended the County should have nine early voting days and three early voting locations within County District 8; the early voting days would be from January 16 through February 24, 2021; and February 13 through the 21, 2021 in case a runoff election was needed.

Mayor Levine Cava supported for Ms. White�s recommendation; she also deferred to the Board regarding its decision.

Commissioner Garcia voiced his support for a special election and offered that residents desired one instead of an appointment. He said residents in County District 8 wanted special elections and stated that, in the past, residents of County District 13 voted for special elections during vacancies.

Mr. Rosenthal repeated his explanation of the process of vacancies, appointments, special elections and the proposed resolutions.

Commissioner Martinez concluded the residents of County District 8 expected a special election.

There being no further comments, the Board proceeded to vote on the proposed resolution, as amended, to include special election dates (January 26, 2021 and February 23, 2021 for a runoff election), nine early voting days and three early voting locations.

  REPORT: Commissioner Gilbert requested a Point of Personal Privilege to nominate Commissioner Diaz as Chairman of the Board of County Commissioners.

Commissioner Gilbert recalled how Commissioner Diaz helped him with critical information during a flood when he was the Mayor of Miami Gardens. He noted Commissioner Diaz would provide the guidance needed during the transition period for the new County Mayor and nearly half of the Board, which consisted of newly elected commissioners.

Vice Chairwoman Sosa followed the protocol of the agenda and called Agenda Item 6A2 out of order for an election of the Board seats of Chairperson and Vice Chairperson. She announced that the person elected for the Chairperson would serve on the Board as the Vice Chairperson until the new term started in January 1, 2021.

There being no other nominations, Vice Chairwoman Sosa announced that the Board unanimously supported the selection of Commissioner Diaz as Chairman.

Chairman-elect Diaz thanked the Board for their confidence and said it was an honor to be selected. In turn, he spoke favorably of Commissioner Gilbert�s tenure as Mayor of Miami Gardens and nominated him to be Vice Chairman of the Board of County Commissioners.

Commissioner Monestime seconded the nomination and Commissioner Gilbert was selected unanimously by the Board for the position of Vice Chairman. Vice Chairwoman Sosa noted this was the first time the Board unanimously agreed on the selection of both seats.

Successor County Attorney Geri Bonzon-Keenan confirmed the Clerk of the Board recorded the unanimous vote for the new Chairman and Vice Chairman. She introduced the motion to appoint Commissioner Diaz as the Temporary Presiding Officer; this motion was moved by Commissioner Regalado and seconded by Vice Chairwoman Sosa.

Ms. Bonzon-Keenan read: �The move is to appoint Commissioner Diaz as the Temporary Presiding Officer, who will preside through the end of the year during all or part of any commission meeting whenever Vice Chairwoman Sosa is absent.�

There being no further comments, the Board proceeded to vote on the appointment.

County Mayor Daniella Levine Cava congratulated Commissioners Diaz and Gilbert.

Commissioner Garcia sought more information about the proposed ordinance.

Assistant County Attorney Eddie Kirtley explained to Commissioner Garcia that the proposed ordinance permitted the use of anti-ram fixtures or bollards for parking areas surrounding businesses.

Commissioner Garcia asked if the bollards were mandated because he opined they negatively impacted restaurants. Mr. Kirtley re-affirmed that the bollards were optional.

Commissioners Hardemon and Regalado expressed concern with the item because its language included repeated use of the word �shall�. Commissioner Hardemon said the usage was confusing.

Mr. Kirtley replied that �shall� was existing Miami-Dade County Code language as it underwent reorganization and explained the overall usage of such language in items and provided details about the regulations related to bollards.

In response to Commissioner Regalado�s proposal that the language be amended, Mr. Kirtley repeated the proposed ordinance did not increase a mandate, was only optional for business owners and added the item did not increase expenditures for businesses.

Commissioner Gilbert commented the proposed ordinance only offered options and the concerns expressed by Commissioners Hardemon and Regalado were not applicable.

Commissioner Monestime asked for elaboration on how the item improved pedestrian safety and improved aesthetics around the businesses.

Ms. Lourdes Gomez, Deputy Director of the Department of Regulatory Resources, provided details about aspects of pedestrian safety in the item and noted it also offered cost efficiency for businesses.

Commissioner Diaz sought confirmation the item did not create hardships for businesses and only offered options; Mr. Kirtley confirmed this.

There being no further comments, the Board proceeded to vote on the proposed ordinance, as presented.

Successor County Attorney Geri Bonzon-Keenan read the title of the foregoing proposed ordinance into the record.

Vice Chairwoman Sosa offered a floor amendment to the proposed ordinance which was read by Assistant County Attorney Eddie Kirtley, as follows:

�Typewritten on pages 7 through 9 of the item, rule 2.01 would be amended to provide that the terms of the chairperson and vice chairperson shall commence on January 1 of the year following the chairperson and vice chairperson election, as is currently in the Code, except that when the outgoing chairperson and vice chairperson leave office due to term limits prior to the election of the next chairperson and vice chairperson, the terms of those new chairperson and vice chairperson shall begin that same day the election was held.�

Vice Chairwoman Sosa explained that in addition to having the new terms commence immediately after an election, the amendment enabled an incumbent chairperson or vice chairperson to remain in office and assist the incoming chairperson or vice chairperson during the transition period.

Commissioner Martinez did not accept the amendment because he opined continuity and consistency in the process needed to be maintained, and added it extended the term of an outgoing chairperson or vice chairperson.

Vice Chairwoman Sosa repeated the amendment aided an incoming chairperson during a transition and referred to the current situation where in this meeting she was the Acting Chairwoman until Commissioner Diaz, who was elected as Chairman, began his term in January 2021. Vice Chairwoman Sosa said she would only support the item if both the chairperson and vice chairperson left their positions at the same time.

Commissioner Martinez reminded Vice Chairwoman Sosa that according to the Board�s rules, if both seats were vacant, an interim chairperson would be selected.

Commissioner Hardemon supported Commissioner Martinez� argument.

Commissioner Regalado suggested the Board carefully select the positions in order to avoid a situation where both positions were term limited simultaneously.

Mr. Kirtley elaborated that whether or not both positions were term limited, the election for the seats would be moved to the first regular Board meeting after the new commissioners� terms with the terms of the new chairperson and vice chairperson beginning in that meeting instead of January 1 of the following year. He stated this was a uniform rule in the item and the interim positions where chosen in the final regular Board meeting of the outgoing chairperson and vice chairperson; the interim term ended after the incoming chairperson or vice chairperson began their terms. This ensured during the transition period that the agenda was executed and the duties of those positions were fulfilled. Mr. Kirtley concluded that Vice Chairwoman Sosa�s amendment would have kept January 1 as the start date of a new term except if both seats were vacant.

There being no further comments, the Board proceeded to vote on the proposed resolution, as presented.

  REPORT: Vice Chairwoman Sosa opined the annexation of 15 acres of Miami-Dade County�s Unincorporated Municipal Service Area (UMSA) to the City of Miami Gardens was ill-timed during the coronavirus disease 2019 (COVID-19) pandemic. She elaborated the annexation negatively affected the County�s budget and increased expenses for its residents and business owners. She added that since UMSA was primarily an industrial and commercial area, those owners should have input about the annexation, and reported she was contacted by business owners who threatened to leave UMSA if the annexation took place. Vice Chairwoman Sosa suggested a deferral until the COVID-19 pandemic passed.

Commissioner Diaz responded that, based on the past history of annexations in the County, there never was a good time to carry out an annexation. He proposed the annexation request by Miami Gardens proceed.

Commissioner Gilbert informed the Board that the business owners located in UMSA received public notification about the annexation and participated in public hearings held during committee meetings. He affirmed that the primary business owner in UMSA did not object to the annexation; , and noted the area was dilapidated, had high crime rates, and needed municipal services. Commissioner Gilbert concluded that due to the issues he cited, the annexation was a matter of public safety.

Commissioner Monestime called for a Point of Order to comment on the public speakers for the item. He indicated speakers were supposed to speak during the reasonable opportunity for the public to be heard (See Agenda Item 1G1), but technical issues and miscommunication prevented them from being heard.

The following public speakers came forward in support of the item:

Mayor Rodney Harris of Miami Gardens

Ms. Sonja Dickens, City Attorney of Miami Gardens, who noted the petition for annexation was legally prepared and in order.

Mr. Craig Clay, Assistant City Manager of Miami Gardens, who noted the UMSA needed County Code and police enforcement, as well as public works for improvements.

The following public speakers came forward in opposition to the item:

Mr. Nicholas Rodriguez, 200 S. Biscayne Blvd, Miami, FL, an attorney from the Bercow, Radell, Fernandez, Larkin & Tapanes law firm which represented the property owner; he noted the petition failed to comply with Miami-Dade County Code requirements.

Mr. Tom Robertson, 200 S. Biscayne Blvd, Miami, FL, appeared on behalf of UMSA business owners and said the application was defective.

Mr. Jeff Bercow, 200 S. Biscayne Blvd, Miami, FL, an attorney, stated the annexation was for 80 percent of commercial area, but did not include mixed-use areas near Miami Gardens, which should be included in the annexation.

Discussion ensued among the Board as Assistant County Attorney Eddie Kirtley confirmed to Commissioner Martinez that the County courts ruled that the annexation request was valid.

Commissioner Martinez opined the property owners in UMSA did not have any input about the annexation though they would be impacted by the increased taxes.

Commissioner Heyman agreed with Commissioner Martinez and wanted to know if County Code or State Code was used to determine that residents in UMSA did not have any input with the annexation. She expressed concern business owners at UMSA would experience increased taxes, yet were not allowed to vote on the annexation, opening the County to liability.

Assistant County Attorney Eddie Kirtley responded the County court ruled it lacked jurisdiction because the Board had not acted yet on the annexation. He added the annexation process was followed properly and legal challenges would not succeed.

Commissioner Regalado indicated she could not support deferring the item.

Assistant County Attorney Abbie Schwaderer-Raurell addressed the timeline of the foregoing application, and indicated two advertised public hearings had been held by the County in October 2020, and notices were sent to UMSA�s property owners; Miami Gardens also held a public hearing; the Office of Management and Budget (OMB) did a complete analysis of the application, which included financial impacts of the annexation; OMB and the County Attorney�s Office did not find any deficiencies with the application, which was completed before the public hearings. Ms. Schwaderer-Raurell stated, as outlined in the item, it was up to the Board to decide on how to proceed. Even if the Board adopted the proposed resolution there were additional steps needed before the annexation was approved.

Commissioner Hardemon noted his concern with the proposed resolution�s language and the procedure for annexation. Ms. Schwaderer-Raurell informed him the process was based on the County Code and Charter and explained the process.

Commissioner Garcia stated he could not support the item because he felt the annexation process was fragmented and needed a comprehensive study before an annexation could be properly considered.

Deputy Mayor Jennifer Moon responded to Commissioner Higgins concerns regarding the tiering of tax increases, stating that millage rates had to be applied consistently to all properties in the jurisdiction. She explained this in more detail to Commissioners Garcia and Hardemon. Additionally, Ms. Moon detailed the financial impact of the item to the County and concluded the annexation would save money for UMSA�s budget and ultimately the County. She also confirmed that during an annexation transition the County still provided public services to the UMSA.

Commissioner Gilbert concluded the UMSA needed public services, such as police and public works, which would be best provided by Miami Gardens because of its close location to UMSA. He noted out of 30 businesses in UMSA only three objected to the annexation and they were not residents who could vote. Commissioner Gilbert asked the Board for a positive consideration.

There being no further comments, the Board proceeded to vote on the proposed resolution as presented.

  REPORT: Successor County Attorney Geri Bonzon-Keenan read the following statement and motion on behalf of Commissioner Diaz:

�Recently, the City of Homestead entered into a settlement agreement with landowners who own property in a restriction zone adjacent to the Homestead Air Reserve Base. The settlement agreement purports to authorize those landowners to develop their property in a manner inconsistent with both the city�s and the County�s airport zoning regulations.

�Concerns have been expressed about the city not enforcing County airport zoning regulations, which are designed to preserve airport capacity and protect public safety. There is also a concern as to whether the city followed the proper process required to grant variances from such zoning regulations.

�The base is a regional asset of great importance to the County and base leadership has expressed concern that the settlement agreement can impair operations there.

�Therefore, Commissioner Diaz is moving to authorize the County Attorney to analyze the settlement agreement and the manner in which it was adopted; and then initiate or join in any litigation or related action that may be necessary to ensure the County�s interest in the enforcement of County zoning regulations is preserved and protected, and the ability of Homestead Air Reserve Base to fully function and maintain its value as a regional asset is not diminished by the settlement.�

Commissioner Diaz suggested Commissioner McGhee take the lead on the item because it involved the district he represented (Commission District 9).

Commissioner McGhee moved the motion, which was seconded by Commissioner Diaz.

Commissioner Diaz commented that the County had tried for three to four years to get the F35 squadron assigned to the base. He noted this action would create thousands of jobs and was vital to the community.

Hearing no further discussion the Board proceeded to vote on the motion which was approved with a vote of 11-0; Commissioner Martinez was absent and District 8 was vacant.

The foregoing motion would be memorialized in the form of a resolution and assigned Resolution No. R-1230-20.

  NON-AGENDA ITEM(S) OF NOV. 19, 2020 BCC MEETING Presented
  REPORT: Commissioner Monestime requested a Point of Personal Privilege and saluted Haitians and Haitian-Americans who celebrated the Haitian holiday Battle of Vertieres Day, which he noted was when the Haitian slave rebellion against France ended in Haiti. He provided more details about the 12-year rebellion which ended with the Haitian army victorious against French forces in the Battle of Vertieres on November 18, 1803.

Commissioner Monestime noted the importance of the Haitian Revolution and its contribution to American history, and called for all Haitian-Americans to honor the spirit of the freedom fighters.

Vice Chairwoman Sosa joined in the salute and said the holiday honored fairness, democracy, equality and freedom. She thanked Commissioner Monestime for bringing the holiday to the Board�s attention and suggested he draft a resolution to recognize it in the County.

  REPORT: Commissioner Diaz proposed the Board create an Office of Policy and Budget for use as a resource to the commissioners.

Vice Chairwoman Sosa enthusiastically agreed with Commissioner Diaz and offered a position in the proposed office of senior advisor to Deputy Mayor Jennifer Moon. She noted Deputy Moon had extensive budgeting experience working in the Administration and worked closely with the Board in the past. The other commissioners agreed with Vice Chairwoman Sosa.

Deputy Mayor Moon came before the Board and expressed her gratitude for the offer. She would seek counsel with her family first before she accepted the position. Vice Chairwoman Sosa asked her to formally inform the Board of her decision in writing within a day.

  NON-AGENDA ITEM(S) OF NOVEMBER 19, 2020 BCC REGULAR MEETING Presented
  REPORT: Commissioner Regalado requested a Point of Personal Privilege and opined that during a state of emergency the Board should have standing agenda items related to the coronavirus disease 2019 (COVID-19) pandemic included in the regular Board meetings instead of holding special meetings. She stated this would expedite the legislative process during the emergency.

Vice Chairwoman Sosa reminded Commissioner Regalado that the new incoming 2021 Chairperson would set the rules for the Board meeting agendas. Vice Chairwoman Sosa also said it was premature to set rules because of the transitionary status of the new commissioners and the new County Mayor.

Vice Chairwoman Sosa announced she would place on the agenda a discussion item about COVID-19 for the next Board meeting and would work with the Administration. Commissioner Regalado said she was working on legislation that during states of emergency there would be automatic standing items related to the emergencies in Board meetings.

Commissioner Martinez commented the special meetings were at least three to four hours long and the agenda should not be automatically set but done by the Chairperson. He opined the Board should set the special meetings and not the County Mayor.

Commissioner Monestime asked Successor County Attorney Geri Bonzon-Keenan if emergency items could be placed in the regular agenda. He also inquired if the requirement that the Board needed seven signatures from commissioners to hold emergency meetings could be eliminated.

Ms. Bonzon-Keenan replied that the Chairperson could call emergency meetings without signatures, although special meetings required seven signatures to achieve quorum and enact legislation.

Commissioner Monestime observed COVID-19-related items could make regular Board meetings very lengthy.

Vice Chairwoman Sosa pointed out that in the past Chairpersons allowed emergency items to be placed on the agenda of Board meetings.

Vice Chairwoman Sosa announced the next regularly scheduled Board meeting would include COVID-19-related items.
