  REPORT: Prior to the invocation, Chairman Diaz announced that a tense situation was occurring in Broward County involving Federal Bureau of Investigation (FBI) agents.

Commissioner Gilbert, III presented the invocation followed by the Pledge of Allegiance.

  REPORT: Chairman Diaz opened the reasonable opportunity for the public to be heard, and the following individuals appeared before the Board:

Ms. Michelle Craven, 8305 SW 205 Terrace, Cutler Bay, Florida 33189, spoke in support of the SW 87 Avenue County bridge outlined in Agenda Item 11A12.

Ms. Lovette McGill, 4771 NW 6 Avenue, Miami, Florida, spoke in support of Agenda Item 3A3, which renamed a portion of NW 14 Ave in honor of her friend Ms. Betty Wright.

Mr. John Quick, 8520 SW 145 Street, Palmetto Bay, Florida, spoke in opposition to Agenda Item 11A12.

Cutler Bay Mayor Tim Meerbott, 19031 Sterling Drive, Cutler Bay, Florida, spoke in support of the SW 87 Avenue Bridge outlined in Agenda Item 11A12 and noted the bridge would alleviate traffic issues for residents.

Former Cutler Bay Mayor Peggy Bell, 9354 SW 212 Terrace, Cutler Bay, Florida, voiced her support for Agenda Item 11A12.

Ms. Truly Burton, Executive Vice President, Builders Association of South Florida, requested Items 11A1 and 11A2 be deferred for sixty (60) days.

Mr. Albert Milo, 444 Brickell Avenue, Suite 301, Miami, Florida, echoed Ms. Burton�s request for a deferral of Items 11A1 and 11A2. He noted a comprehensive approach would be developed to address some of the policy issues that were raised by Commissioner McGhee.

There being no one else wishing to speak, Chairman Diaz closed the public hearing.

Chairman Diaz announced the Board would recess the meeting at 12:00 noon if the agenda was not completed and would resume at 1:00 pm.
 
1H MOTION TO SET THE AGENDA AND "PULL LIST"  
  REPORT: Successor County Attorney Geri Bonzon-Keenan announced the following requests:

� Commissioner Regalado requested to be added to the �Pull List� for Items 2B1, 2B2, 8F2, 8F5 and 8F5 Supplement, 8F6, 8F7 and 8F7 Supplement, 8N1, 8N2, 11A10, and 11A11; however, the County Administration had requested deferral of Item 8F6 to the February 17, 2021, Board meeting; and the Board needed to decide how to proceed;
� Commissioners Heyman and Regalado requested to be added to the �Pull List� for Items 8F1, 8F1 Supplement, 8F5, and 8F5 Supplement;
� Commissioner Monestime requested to be added to the �Pull List� for Item 11A6 and 11A10;
� Commissioners Higgins and Garcia asked to be added to the �Pull List� for Item 11A12;

It was moved by Commissioner McGhee that Items 11A1 and 11A2 be deferred to the April 20, 2021, Board of County Commissioners� meeting. Commissioner Regalado seconded this motion.

Commissioner Higgins spoke against the deferral, noting the Board should discuss and make a decision on these items. She indicated she could be supportive of the deferral provided these items would never affect District 5�s Rental Assistance Demonstration (RAD) Program when these items were returned before the Board.

Upon being put to a vote, the motion passed by a vote of 11-2 (Commissioners Higgins and Martinez voted �no�).

Successor County Attorney Bonzon-Keenan advised the items to be considered at today�s (2/2) meeting would be those listed in the printed final agenda with the additions, deferrals, withdrawals, and the scrivener�s errors noted in the Board of County Commissioners� Chairman Jose �Pepe� Diaz�s memorandum entitled �Changes Sheet� and included the requests previously mentioned. The Board would vote on all these items by a single vote setting the agenda except ordinances for first reading, public hearings, and Items 8A1, 8A2 and 8A4; items subject to the 4-Day Rule under Section 14; and the following �Pull List� items: 2B1, 2B2, 2B3, 3A1, 3A1 Supplement, 8F1, 8F1 Supplement, 8F2, 8F3, 8F5, 8F5 Supplement, 8F6 would be deferred to the February 17, 2021, Board meeting, 8F7, 8F7 Supplement, 8N1, 8N2, 11A1 and 11A2 would be deferred to the April 20, 2021, Board meeting, 11A4, 11A6, 11A7, 11A8, 11A9, 11A10, 11A11, 11A12, 11A13, 14A1, 15C1, and 15C1 Supplement.

It was moved by Commissioner Sosa that today�s (2/2) agenda be approved, along with the changes listed in the Chairman�s memorandum entitled �Changes Sheet,� requests and motions made by commissioners, and the additional changes noted by Successor County Attorney Bonzon-Keenan. This motion was seconded by Commissioner Higgins, and upon being put to a vote, passed by a vote of 13-0.

  REPORT TO THE BOARD ON THE ACCESSIBILITY OF VIZCAYA MUSEUM AND GARDENS - DIRECTIVE 201340(Mayor) Accepted

  REPORT: Commissioner Martinez spoke in support of the foregoing report and congratulated the Mayor and staff on how the accessibility issue was addressed.

Commissioner Regalado spoke in support of improving accessibility to Vizcaya Museum and Gardens (Vizcaya) for individuals with disabilities; however, she expressed concern regarding Vizcaya�s financial viability and asked that information be provided to the Board regarding Vizcaya�s fiscal outlook and the plans for the Science Museum expansion.

Mr. Joel Hoffman, Director, Vizcaya Museum and Gardens, stated Vizcaya received a Second Draw Paycheck Protection Program (PPP) Loan, conducted a COVID-19 Recovery Fundraiser, which raised $825,000 in private donations, and received a National Endowment for the Humanities (NEH) grant. He advised Vizcaya�s visitation percentage rate of normal attendance was approximately fifty percent (50%), and its budget had been cut back due to major revenue losses. However, a plan was in place to remain afloat in the months ahead. Mr. Hoffman expressed his hope that the next fiscal year beginning on October 1, 2021, would result in seventy-five percent (75%) of normal attendance.

Mr. Hoffman stated for the past year staff had been working with Mr. Michael Spring, Senior Advisor to the Mayor/Director of Cultural Affairs Department, on completing Hurricane Irma repairs; and all projects were in process. He advised an architect had prepared construction documents for the beginning phases of the Vizcaya Village revitalization and removal of the Science Museum building, and he looked forward to discussing further plans with Commissioner Regalado.

  REPORT ON THE PUBLIC HOUSING NUTRITIONAL ASSISTANCE PROGRAM - DIRECTIVE 200926(Mayor) Accepted

  REPORT: In response to questions from Commissioner Martinez, Mr. Michael Liu, Director, Public Housing and Community Development Department (PHCD), explained the requirements and distribution of the Public Housing Nutritional Assistance Program (PHNAP). He noted the projects Commissioner Martinez mentioned were affordable programs managed by the County and were not public housing properties.

Commissioner Regalado asked Mr. Liu to provide the Board of County Commissioners (Board) with information regarding increases in the Supplemental Nutrition Assistance Program (SNAP).

County Mayor Daniella Levine Cava stated the libraries were instrumental during the pandemic in assisting individuals to apply for a range of benefits including the SNAP Program.

Discussion ensued among the Board members regarding the distribution of grocery gift cards to implement the PHNAP.

Following Assistant County Attorney Brenda Kuhns-Neuman�s response that the item approved by the Board did not specify how the Program would be implemented, Commissioner Sosa stated she was unable to support the item as the Board had not approved the use of gift cards.

Mayor Levine Cava advised cash food gift cards were commonly used, and the use of gift cards was also used to implement the SNAP Program.

Mr. Liu stated it was not the PHCD�s intent to assume the legislative function; however, it was the department�s responsibility to interpret implementation of the language approved by the Board regarding a nutritional program.

Commissioner Souto opined the PHNAP should include input from nutrition experts from Jackson Health System (JHS).

Commissioner Gilbert, III suggested the term �public housing� be clarified to reflect that it referred to individuals in publicly owned housing as well as individuals in Section 8 housing and subsidized elderly housing. He asked the County Administration to provide the Board with options to make the PHNAP available to a greater number of residents living in housing supported by the government and not just those living in public housing.

Commissioner Hardemon commented on the distinction between public housing and affordable housing and emphasized the need for resources to be placed in public housing.

Commissioner Regalado asked that, in the future, information regarding mixed-income housing and any particular type of programing that would exclude certain individuals be provided to the Board ahead of time.

Commissioner Monestime spoke in support of the gift cards and noted the cards served a better purpose to low-income individuals who desired to receive the food of their choice. He expressed appreciation for the meals provided to 7,882 families.

Chairman Diaz stated the PHNAP Program�s availability was important information to all commissioners since poor constituents were residing in every county commission district, and the Board should have approved the PHNAP Program.

Commissioner Higgins stated the gift cards were an efficient way to provide people with food choices in their grocery shopping, and she thanked the County Administration for their efforts. She noted she was aware the gift cards were available since the summer of 2020.

  REPORT: Commissioner Martinez spoke in opposition to the foregoing proposed resolution and recommended Commissioners discuss this issue with the County Attorney�s Office.

Chairman Diaz concurred with Commissioner Martinez�s suggestion.

In response to Commissioner Garcia�s inquiry regarding distribution of proceeds from the settlement agreement, County Mayor Levine Cava stated that, due to the downturn in tourism tax dollars and the gap that was created in many essential programs, it was recommended the majority of the proceeds be used to prevent a gap in essential County programs.

Mr. Edward Marquez, Chief Financial Officer, expounded on the payment disbursement. He noted the County Administration�s recommendation was that, out of the $3.6 million the County would receive, the majority of the funds should be allocated to the Convention Development Tax (CDT) Reserve Fund. Mr. Marquez further noted $250,000 would be spent on a needs assessment for the County-owned Marlins Stadium and $21,000 would be reimbursed to the General Fund for a forensic audit that was done for litigation support.

Commissioner Heyman explained her rationale for voting �no� on the original contract for a professional baseball team in Miami. She referred to the language in section 6 of the original contract and observed that issues were adhered to and monitored thereafter by the subsequent administrations. Commissioner Heyman noted she would vote against the settlement and opined the County attorneys should pursue obtaining essential documents. She pointed out that a sale at $1.2 billion should generate more than $4.2 million for the County.

Commissioner Regalado expressed concerns about Item 8F1 Supplement regarding the funding allocation made after the fact, which forced the Board to make a decision on that funding allocation. She indicated her support for the settlement agreement but requested the funding allocation be bifurcated in order to discuss the item with the County Administration.

Successor County Attorney Geri Bonzon-Keenan advised the Supplement was the Mayor�s recommendation and did not amend the underlying item.

Commissioner Hardemon recalled Mr. Marquez�s comments regarding the distribution of proceeds from the settlement agreement; and he referred to Resolution R-469-18, which recommended that any legally available revenues received from the sale of the Miami Marlins Stadium or the lawsuit against the Marlins be used for the development and construction of the Strategic Miami Area Rapid Transit Plan.

Mayor Levine Cava explained that she sponsored the resolution when she was a commissioner, and it was a recommendation, not a final determination. She stated staff would report on the use of the funds.

Commissioner Martinez stated he would vote �no� on the proposed resolution.

Commissioner Heyman stated the County Administration recommended this item, not the County attorneys. She noted the County attorneys were ready to negotiate and proceed in arbitration.

Commissioner Gilbert, III inquired whether the County attorneys had evaluated this item; and Chairman Diaz asked who was recommending this item.

Assistant County Attorney Monica Rizo stated the Administration was recommending the item; however, the County attorneys had been working on the litigation. She commented on the contractual language approved as part of the Non-Relocation Agreement and opined that, based on the material and the limited discovery received by the County to date, the settlement was within the bounds of reason.

In response to Commissioner Gilbert�s III inquiry regarding the feasibility of considering this item in an executive session, Successor County Attorney Bonzon-Keenan advised mandatory arbitration was not allowed to be considered in an executive session. However, the County attorneys would be able to brief the county commissioners on this item since this issue could be considered by the County Commission at a later time.

There being no further discussion, the Board proceeded to defer the foregoing proposed resolution to its February 17, 2021, Board meeting.

Mayor Levine Cava announced that two (2) Federal Bureau of Investigation agents who were involved in this morning�s (2/2) shooting in Broward County had perished in the line of duty, and requested a moment of silence be observed. She asked that all law enforcement officers be recognized for their service, including the County�s Sergeants-at-Arms; Chief Public Safety Officer J. D. Patterson; Miami-Dade Police Department Director Alfredo �Freddy� Ramirez; Miami-Dade Corrections and Rehabilitation Department Director Daniel Junior; and Commissioner Martinez.

Ms. Lourdes Gomez, Director, Regulatory and Economic Resources (RER) Department, stated she did not have any additional information regarding the consultant related to a specific case in which the subject firm was involved in litigation.

Responding to Commissioner Garcia�s question regarding the redistricting process, Chief Operations Officer Morales suggested deferral of this item to the next Board meeting and that Archbridge Consulting and Training, Inc., be asked to attend the meeting to respond to questions.

  REPORT: Discussion ensued among Ms. Namita Uppal, Chief Procurement Officer, Internal Services Department (ISD), Mr. David Cardenas, Deputy Director, Parks, Recreation and Open Spaces (PROS) Department, and Commissioner Sosa regarding transportation services for children.

Commissioner Sosa asked Mr. Cardenas to find out the date the Board of County Commissioners (Board) enacted the legislation relating to the transportation of children to and from park programs and to present this legislation to the Board members.

Responding to Chairman Diaz�s inquiry, County Mayor Levine Cava stated the vehicles were needed and prioritized because of their mileage and length of service.

Commissioner Regalado asked that the vehicles requested by the Water and Sewer Department (WASD) be approved.

In response to Commissioner Martinez�s inquiry relating to whether a re-calibration of the vehicles was done before determining the number of vehicles needed, Mayor Levine Cava said the County Administration would review this issue in each department and report back to the Board. She suggested the Board defer this item to its February 17, 2021, Board meeting.

Regarding Commissioner Martinez�s question regarding vehicles that were 18 years and older, Mr. Cardenas stated he would provide a list of all the vehicles. He noted the PROS reviewed their entire fleet of vehicles to determine the need for each vehicle, and vehicles identified as not safe to be driven on the streets were set aside.

In connection to Chairman Diaz�s inquiry, Mayor Levine Cava confirmed the vehicles could last for another two weeks.

It was moved by Commissioner Martinez that the foregoing proposed resolution be deferred to the February 17, 2021, Board meeting. Commissioner Sosa seconded this motion.

Commissioner Heyman expressed concern regarding the delegation to the Mayor�s Office of publicly decided contracts and indicated she would vote �no.� She asked that this be part of the dialogue from the Mayor�s Office if the resolution came back before the Board.

Commissioner Gilbert, III stated he was comfortable voting on this item and suggested that his colleagues obtain answers to their questions if the item was deferred.

Chairman Diaz indicated he preferred the item moved forward.

Upon being put to a vote, the motion to defer resulted in one affirmative vote.

Commissioner Higgins spoke in support of the foregoing proposed resolution, noting it was more costly to maintain the vehicles than to purchase new ones.

  REPORT: Members of the Board directed questions to Ms. Alice Bravo, Director, Department of Transportation and Public Works (DTPW), regarding the rationale for not using County engineers for the traffic signal operations contract and the contract timeline.

Ms. Bravo stated the County�s engineers would be unable to work on the subject contract due to the need to have them working on departmental needs. She noted the project required additional manpower, and the contract had a limited duration scope requiring special expertise. However, the County�s engineers would work with the Transportation Planning Organization (TPO) to identify corridors with the greatest amount of congestion.

Commissioner Garcia opined the process needed to be more transparent.

Commissioner Higgins spoke in support of the foregoing proposed resolution.

Commissioner Martinez stated he would not support the resolution. He noted the Board had previously approved a contract for $160 million, and this contract should have been presented to the Board at the same time as the contract for $160 million.

Chairman Diaz stated items that were brought before the Board should be complete and include any other contracts or costs that could be added in the future.

County Mayor Levine Cava concurred with Chairman Diaz�s comments and noted the County Administration would work with staff to provide information as to whether or not an item should be done in-house.

Commissioner Gilbert, III recommended that future contracts include the underlying entity that was providing the service to be able to properly define the scope for the owner�s representative at that time.

Chairman Diaz asked Ms. Bravo to inform the Board members whether a portion of this contract needed to be advertised separately.

  REPORT: County Mayor Levine Cava commented on the County Administration�s rollout of a registration system for individuals 65 and over to sign up by telephone or online to receive the coronavirus disease 2019 (COVID-19) vaccine. She noted the vaccine would be administered to those who had registered once it was available. Mayor Levine Cava emphasized the County Administration had a plan for rolling out vaccines; however, they did not have the supply of vaccines yet.

Commissioner Regalado provided an overview of the foregoing proposed resolution. She opined it was important to clarify how the vaccine registration program would be implemented as other counties and the State were conducting registration programs. Commissioner Regalado inquired whether Mayor Levine Cava would be amenable to having separate registration lists to accommodate homebound individuals, those who were under age 65 and had other issues and those with disabilities. She expressed her support for Mayor Levine Cava�s initiative to implement the registration process; however, voiced concern about its operation. She noted the Board needed more guidance regarding the list. Commissioner Regalado mentioned that two counties created a lottery for the registration system and noted the County would be receiving additional information on zip codes and ages, which were very important.

Chairman Diaz concurred with Commissioner Regalado�s comments. He stated the County needed to do a better job of disseminating information about the vaccine, as there was confusion between the cities, the County, and the State administering the vaccines.

Discussion ensued among the Board members and Mayor Levine Cava regarding the vaccine registration process.

Mayor Levine Cava stated the County Administration was constantly updating the media regarding vaccine information, and the frequently asked questions and answers provided to each Commissioner�s office would be updated today (2/2) with the registration information. She advised there would be a date selection process for individuals to receive the vaccine and the ability to target by zip code. She noted the County Administration had stayed in contact with the League of Cities to keep them aware of the County�s coordination role and would continue to use that resource. Mayor Levine Cava explained the County Administration had also worked with the cities and community groups to identify where there had been pockets that had not been served and would continue to work with Jackson Health System (JHS) since that institution had a greater number of appointments.

Mr. J. D. Patterson, Chief Public Safety Officer, stated the County Administration also had a weekly meeting with some of the other groups utilizing virtual media communications like Zoom; and they could reach out to the County in that same manner as well.

Commissioner Garcia thanked Mayor Levine Cava for her efforts regarding the vaccination rollout and noted he just wished to ensure a process was in place for the vaccination rollout.

In response to Commissioner McGhee�s inquiry regarding whether a list of individuals age 65 and over to be vaccinated through agencies such as the Community Action Agency (CAA) was available, Mayor Levine Cava stated the County Administration contacted agencies that were serving homebound individuals age 65 and over; and the homebound program was also being implemented. She noted the County Administration was scheduling appointments for public housing residents.

Commissioner McGhee requested the list of individuals age 65 and over that would be vaccinated through agencies.

Mayor Levine Cava suggested the Health, Emergency Management and Intergovernmental Committee (HEMIC) request a legislative item be drafted to oversee the list and ensure that individuals who were already on the list were contacted through a mechanism that would accommodate them.

Commissioner McGhee asked whether it was possible to request from JHS the list of individuals suffering from COVID-19.

Successor County Attorney Geri Bonzon-Keenan advised some of the information regarding vaccines was under the protection of the Health Insurance Portability and Accountability Act (HIPPA) privacy laws and State Statutes. She noted that some general information or data not specific to identifying the individual or their medical treatments, such as zip codes was attainable. She stated she would work with Commissioner McGhee and his staff to advise him on the information available without violating those laws.

Commissioner McGhee inquired whether Mayor Levine Cava would be amenable to the idea of repurposing positions at the Community Action Agency (CAA) to provide education about the COVID-19 pandemic, establish additional vaccination sites, and provide outreach services for individuals listed in the lists in her possession.

Mayor Levine Cava stated she would discuss the redeployment of staff where the opportunities existed.

Commissioner McGhee asked Successor County Attorney Bonzon-Keenan to provide legislation related to the repurposing of employees under CAA�s jurisdiction to assist with the educational portion of this legislation.

Successor County Attorney Bonzon-Keenan stated Commissioner McGhee�s request had been noted as a legislative request and the attorneys would work with his staff to prepare an appropriate legislation and discuss it further. She noted there were some issues that also needed to be discussed as it pertained to the Mayor�s authority.

Mayor Levine Cava stated CAA employees were federally funded employees and there were some restrictions, but she was open to exploring the feasibility of using CAA�s staff for certain critical functions.

Chairman Diaz suggested Commissioner McGhee meet with Mayor Levine Cava to obtain additional information he requested as the HEMIC Chair.

Commissioner Monestime suggested the County Administration merge all of the County�s lists and bring them forth to facilitate the registration platform being developed by Commissioner Regalado. He noted this would be less costly, and it would enable Commissioner Regalado to complete the project faster.

Commissioner Regalado stated the proposed resolution requested a report be brought back to ensure comprehensiveness. She noted that, if a municipality had a list, it could be included in the County�s website.

  REPORT: In response to Commissioner Regalado�s inquiry regarding the drawdown of funds that occurred, Mr. Edward Marquez, Chief Financial Officer, stated the municipalities were documenting more of their expenses; and the County Administration had a list of undocumented expenses, which would be shared with the Board. He noted the proposed resolution did not affect the County Administration�s projections for spending money on the coronavirus disease 2019 (COVID-19)-related expenses past January 1, 2022, for ongoing County programs.

Discussion ensued between Commissioner Hardemon and Mr. Marquez regarding the $25 million allocation for municipal programmatic proposals subject to advanced approval by the Board and the approximately $9.8 million in unexpended funds from the $25 million.

County Mayor Levine Cava stated the Board approved the allocation. She noted that, if the funds remained unspent, it was time to use those funds. She further noted that, if a municipality was unable to spend the funds for a particular program, it would be up to the Board to decide how to reallocate the funds.

Commissioner Hardemon asked Mr. Marquez to provide a list outlining the amount of funds allocated to each city, including the amount each city had spent from those funds allocated.

Commissioner McGhee questioned what prevented the municipalities and the Unincorporated Municipal Service Area (UMSA) from sharing in the remaining available funds.

Mr. Marquez noted it was possible the cities had already spent part of the leftover funds, but no paperwork had been submitted on how the funds were spent. He further noted the cities might also have had other eligible projects, which were not yet presented to the County Administration for reimbursement.

Ms. Jennifer Moon, Chief, Office of Policy and Budgetary Affairs, concurred with Mr. Marquez�s comments. She stated that, if $9 million remained, it was not because the funds were not spent but due to not having been drawn-down yet. She advised that she was not confident that any of it would be available to be reallocated. Ms. Moon noted a formula was not developed for allocation of the dollars, and the County Administration would be making reimbursements until the cap was met. She further noted the cap had not been met as municipalities continued to submit their paperwork and requesting the drawdown of funds.

Commissioner Hardemon commented on the flexibility he had as a City Commissioner to create programs that were prudent for his residents; and now as a County Commissioner, he had no flexibility to create programs that would benefit UMSA residents. He suggested that, if UMSA funds were still available, the Board members should allow flexibility in determining the best direction for programs in their communities.

Ms. Moon stated the County Administration tried to separate funds in order to provide services specifically in UMSA; however, allocations were made from those funds for certain programs. She noted the majority of the funding was spent on direct County services that were being provided for the County as a whole rather than specific program for UMSA residents.

Commissioner Higgins spoke in support of the proposed resolution and thanked Commissioner Hardemon for sponsoring this item. She reminded the Board that UMSA and the municipalities were not excluded from the Coronavirus Aid, Relief, and Economic Security (CARES) Act programs created by the Board.

  REPORT: Commissioner Cohen Higgins introduced the foregoing proposed resolution and accepted Commissioner Garcia�s friendly amendment to include home health professionals.

Successor County Attorney Geri Bonzon-Keenan advised Commissioner Garcia proposed to amend the foregoing resolution as follows:

1. to add the phrase �as well as home health professionals� after the phrase �restaurant employees� in the title and to make conforming changes in the last recital clause on typewritten page 5 and in section 1 on typewritten page 6;
2. to add the following recital clauses, typewritten page 4, after the second recital clause: �Whereas, home health professionals provide caregiving and support services directly to individuals in their homes; and Whereas, many seniors and other adults in Florida depend on such assistance to help meet their basic needs and maintain an independent lifestyle; and
3. to add the following recital after the fifth recital clause, typewritten page 5: �Whereas, it is important that home health professionals continue to provide services without interruption to residents of Miami-Dade County, who may rely on such support and assistance; and . . .�

In response to Commissioner Martinez�s proposed amendment to include law enforcement officers in Phase 2 of the vaccine administration, Commissioner Cohen Higgins advised that law enforcement officers were included in the item at the last Board meeting urging the Governor and State Legislators to include law enforcement.

Commissioners Gilbert, III, Commissioners Monestime, Regalado and Souto requested to be added as co-sponsors.

There being no further discussion, the Board proceeded to vote on the foregoing proposed resolution as amended.

  REPORT: Commissioner Cohen Higgins provided an overview of the foregoing proposed resolution and noted today�s (2/2) vote was to place the item on the Transportation Planning Organization (TPO) agenda.

Assistant County Attorney Annery Alfonso confirmed that, if the proposed resolution was approved today, it would direct the Mayor to work with the TPO Director to prepare and place the item on the TPO agenda.

In response to Commissioner Martinez�s concern regarding whether the proposed resolution would establish a County policy that would affect every Commission District, Assistant County Attorney Alfonso advised the proposed resolution would establish a general County policy.

Commissioner Cohen Higgins offered to remove the language related to establishing County policy from the item to reflect that it would only be specific to County Commission District 8.

Commissioner Martinez requested to be added as a co-sponsor once the language was removed.

Commissioner Higgins recused herself from voting on the proposed resolution. She stated that she was unable to review this proposal due to the late distribution of the item and opined it should undergo Committee review to allow public input.

Chairman Diaz stated, as a courtesy, he placed several items on the agenda; however, in the future; an item would not be placed on the following agenda if it was not an emergency.

Commissioner Garcia expressed concern regarding the $3.1 million costs and the establishing of a countywide policy. He thanked Chairman Diaz for his comments.

Commissioner Gilbert indicated he would support the proposed resolution.

County Mayor Levine Cava asked Commissioner Cohen Higgins to consider deferring the resolution to Committee; and then, forwarding it to the Board to provide an opportunity for the community to provide feedback to the Board.

Chairman Diaz stated he did not have any objections as the item would be considered by the TPO.

There being no further discussion, the Board proceeded to vote on the foregoing proposed resolution as amended to remove within the title of the resolution the language �establishing County policy that the County arterial network extend without dead-ends, within traffic engineering standards, throughout the County and in furtherance of that policy. . .�

  REPORT: Commissioner Monestime congratulated Commissioner Heyman for sponsoring a Gun Buy Back Program event in Commission District 4. He noted he had a pending item regarding gun violence and looked forward to working with his colleagues in bringing this item back before the Board.

Commissioner McGhee commended Commissioner Heyman on the Gun Buy Back Program, and he requested to be added as a co-prime sponsor on Commissioner Monestime�s proposed legislation relating to gun violence.
