REPORT:
Commissioner Monestime recognized the Miami-Dade County Black Affairs Advisory Board (Advisory Board) for their efforts in continuing conversation about community development and achieving economic prosperity during the State of Black Miami Forum on November 7, 2019. He recalled their work as they addressed issues such as the coronavirus disease 2019, gun violence, and displacement through gentrification.
Commissioner Monestime presented a proclamation to the Advisory Board, as read by Vice Chairman Gilbert, declaring February 17, 2021 was officially Miami-Dade County Black Affairs Advisory Board Day.
Mayor Levine Cava, Chairman Diaz, and Commissioners McGhee, Cohen Higgins and Sosa congratulated the Advisory Board for the honor.
Mr. Stephen Hunter Johnson, Chairman of the Advisory Board, and several of his colleagues came forward and accepted the proclamation. Mr. Johnson acknowledged Ms. Retha Boone-Fye, Program Director of the Advisory Board, for her efforts and other members of the Advisory Board, as well.

REPORT:
Executive Assistant County Attorney Jess M. McCarty announced, in accordance with Rule 6.06 of the Board�s Rules of Procedure, members of the public would now have the reasonable opportunity to be heard regarding non-public hearing propositions before the Commission, which had not been subject to a previous opportunity to be heard. He noted that members of the public would be given an opportunity to speak on public hearing items under Section 5 of the Agenda when the item was called.
Chairman Diaz opened the reasonable opportunity for the public to be heard and the following individuals appeared before the Board to speak about Agenda Item 8K1:
Ms. Annie Lord, Executive Director of Miami Homes for All, 1951 NW 7th Avenue, Miami, FL 33136, supported the item.
Ms. Zelalem Adefris, Vice President of Policy and Advocacy at Catalyst Miami, 3000 Biscayne Blvd, Miami, FL 33137, supported the item and suggested a virtual or phone option be provided to members of the public during public hearings.
Ms. Alana Greer, Director of the Community Justice Project, 3000 Biscayne Blvd, Miami, FL 33137, also supported the item.
Ms. Tiana Gibbs (phonetic), 1951 NW 79th St., Miami, FL 33147, was a County resident who recounted her hardship with an eviction proceeding and her concerns with corporate landlords.
Ms. Zaina Alsous (phonetic), an organizer with the Miami Workers Center, no address given, appeared only as an observer and did not wish to speak.
There being no other person wishing to speak, Chairman Diaz closed the reasonable opportunity to speak.

MOTION TO SET THE AGENDA AND "PULL LIST"

REPORT:
Executive Assistant County Attorney Jess M. McCarty stated in addition to Chairman Diaz�s Memorandum entitled �Changes Sheet�, a second supplement to Agenda Item 8F2 was distributed and added to the Agenda; Commissioner Sosa released her pull of Agenda Item 8F1; Commissioner McGhee requested he be added to the pull list for Agenda Item 8F1; Commissioner Cohen Higgins requested she be added to the pull list for Agenda Item 8F2; Commissioner Gilbert released his pull on Agenda Item 8F3; Commissioners Regalado and Garcia requested they be added to the pull list for Agenda Item 8K1; and Commissioners Cohen Higgins and McGhee requested they be added to the pull list for Agenda Item 11A1.
Mr. McCarty announced the following commissioners who made requests for co-sponsorships of items on today�s agenda:
Commissioners Cohen Higgins and Monestime for Agenda Item 8K1; Commissioner McGhee for Agenda Item 11A3; Commissioner Gilbert for Agenda Items 11A4 and 11A6; Chairman Diaz and Commissioners Gilbert, Garcia and McGhee for Agenda Item 11A5; and Chairman Diaz and Commissioner Gilbert for Agenda Item 11A7.

Mr. McCarty noted the Board would approve all of those items by single vote: setting the agenda, except for Agenda Item 2B1, ordinances for first reading, public hearing items, discussion item 6B2, ordinances set for second reading, items subject to the four-day rule under section 14 of the agenda, and the following pull list items: 8F1, 8F1 Supplement 1, 8F1 Supplement 2, 8F2, 8F2 Supplement, 8F3, 8J1, 8K1, 11A1, 11A2, 11A3, 11A7, 11A8, 14A1, 14A2, 14A3, 14A4, and 14B1.
It was moved by Commissioner Higgins that the Board approve today�s agenda, with the changes listed in the Chairman�s Memorandum and the additional changes as mentioned above. This motion was seconded by Commissioner Sosa, and upon being put to a vote, passed by a vote of 13-0.

Commissioner Garcia questioned the $7.5 million allocation to affordable housing, as outlined in the foregoing proposed ordinance. He referred to previously adopted legislation that tied the hands of future County Commissioners as it related to excess funds and expressed concern that the Board would not be able to use excess funds should an emergency situations arise in the future. Commissioner Garcia indicated he would bring forth legislation that would ensure that this current board does not tie the hands of future boards regarding disbursement of budgetary allocations.
Commissioner Martinez recalled that a resolution had been passed by the Board which allowed the use any carryover funds for affordable housing, of which was a critical issue at that time. He stated he supported the previous legislation and would again.
Commissioner Higgins stated she was in support of affordable housing and of ensuring that the affordable housing trust fund continued to grow. She noted the Trust Fund allowed the County to rely less on federal and state aid for affordable housing.
In response to Commissioner Regalado�s inquiry regarding the allocation to the Department of Cultural Affairs and the projected deficit to Convention Development Tax Shortfall Fund, Miami-Dade County Mayor Daniella Levine Cava said that each member of the Board would be given a detailed briefing of the County�s budget prior to the March 2021 Budget Address.
Ms. Jennifer Moon, Chief of Policy and Budgetary Affairs, explained that the Affordable Housing Board made recommendations on how to allocate money from the Affordable Housing Trust Fund and that the Trust Fund received 50 percent of any excess carryover. She noted the allocations allowed the Housing Board to make significant changes to the availability of affordable housing in the County. Ms. Moon also pointed out the need to clarify available funds and allocation procedures in order to better expedite allocations.

Commissioner Higgins observed the foregoing proposed ordinance only allowed specific rooftop advertisement in the County for desired venues. She stated for the record that Department of Regulatory and Economic Resources (RER) must review every advertisement and deem them appropriate to the vicinity of nearby private residences.
Mr. Nathan Kogon, Assistant Director of Development Services, confirmed the ordinance had provisions, which required final review and approval from the Board, and were consistent with the County Code. He pointed out the rooftop advertisements were for point-of-sale signage of products and services sold within the building were the signs were located.
Assistant County Attorney Dennis Kerbel confirmed the goods and services must be sold within the building that had the rooftop signage, and the advertisement could not be used for third parties because the signage was not a billboard or mural. He added that the proposed ordinance was specific to buildings in industrial district or regional entertainment venues.
Commissioner Hardemon directed Mr. Kerbel to draft legislation to permit the County to collect revenue from the rooftop signage.
When asked by Commissioner Heyman if cities could opt in or out of the proposed ordinance, Mr. Kerbel answered that the cities must comply with the proposed ordinance if they chose to allow the rooftop signage.

REPORT:
With regards to the discussion item about the safety and cybersecurity of the County�s water system, Chairman Diaz announced that he would call for separate executive meeting to address concerns and questions.
Mr. Josenrique Cueto, Interim Director of the Miami-Dade Water and Sewer Department (WASD), reassured the Board that protocols, procedures and safeguards in place at the WASD facilities were designed to minimize cyber threats. He indicated the department had undergone a cybersecurity assessment with the Department of Homeland Security, which identified vulnerabilities that were addressed by WASD.
Mr. Cueto informed the Board that in 2020, WASD underwent a risk and resilience assessment, as required by the America�s Water Infrastructure Act of 2018. He stated the evaluation focused on the County�s water facilities and treatment plants with relations to natural and manmade hazards and based on the evaluation, the Department developed safeguards to prevent cyberattacks.
Commissioner Souto recalled that in October 26, 2001, he introduced an ordinance that addressed the County�s water system security. He said the item was deferred and was never brought up again, meanwhile the security issue remained unaddressed.

REPORT:
Chairman Diaz relinquished the Chair to Vice Chairman Gilbert in order for Assistant County Attorney Monica Rizo Perez to read his motion and for the Board to vote upon it.
Chairman Diaz requested authorization from the Board for him to participate in negotiations for a settlement agreement with the County, the City of Miami and the former owners of the Miami Marlins baseball team.
It was moved by Vice Chairman Gilbert that the Board approve a motion to allow Chairman Diaz to participate in the negotiations for a settlement agreement with the County, the City of Miami and the former owners of the Miami Marlins Baseball Team. This motion was seconded by Commissioner Cohen Higgins, and upon being put to a vote, the motion passed by a vote of 12-1; Commissioner Higgins voted no.
Chairman Diaz resumed the Chair and thanked the Board for passing his motion earlier in today�s (2/17) Board meeting which allowed him to negotiate via phone with Mr. David Samson, former co-owner of the Miami Marlins baseball team. He stated the Miami Marlins was sold in 2017 and the County and the City of Miami sued the former owners to get a fair percentage of the net sales proceeds. Chairman Diaz informed the Board that Ms. Rizo Perez monitored the phone conversation between him and Mr. Samson.
Ms. Rizo Perez elaborated the phone conversation was held so the County and Miami would negotiate more favorable terms from a $4.2 million settlement offer by the former owners of the Miami Marlins. She announced that the former owners agreed to pay a higher amount which totaled $5.5 million; the County would receive $4,763,000, while Miami would receive $737,000. Ms. Rizo Perez confirmed Miami-Dade County Mayor Daniella Levine Cava and the current owners of the team were informed of the negotiation and favored the new terms.
Mayor Levine Cava commended Chairman Diaz and members of the Administration for their efforts during the negotiation.
Mr. Samson appeared via video and expressed his hope that the money from the settlement would be helpful to County residents.
Commissioner Heyman expressed concerns that independent basic diligence was needed and the former owners were not completely transparent with their figures. She also stated the auditing services firm provided by the team was not independent and did not provide the County with complete documents. She opined County residents deserved a larger and fairer sum than what the former owners offered. Commissioner Heyman announced she would not support the item even though the settlement offer was larger.
Commissioner Gilbert agreed with Commissioner Heyman and added the former owners still benefitted from the settlement. However, he stated he would reluctantly support the item because the deal was already agreed upon. He said this served as a lesson learned by the County about doing its diligence.
Commissioner Martinez stated he would not support the item and reminded the Board that the deal was agreed upon by the previous Board. He spoke concerning the business actions in this matter, which he felt were detrimental to the County, and stated the County should continue to negotiate for a more favorable offer.
Commissioner Sosa recalled her efforts during the original negotiations, to amend the original deal to keep the team, but was unsuccessful. She said the Board should accept the new offer because it still benefitted County residents.
Commissioner Regalado stated the County�s debt towards the Marlins Stadium would continue to grow if the offer was not accepted. She added the Board was not entitled to every bit of information it requested from the team.
Commissioner Garcia expressed his reluctance to accept the new offer. He raised concerns that the County may not be able to get any money from the arbitration. He stated supported the item because the County should not risk the settlement offer and warned the County against entering a similar deal in the future.
Commissioner McGhee presented a motion for an amendment to Agenda Item 8F1 Amended that the County�s share of the equity payment from the settlement agreement from the former owners of the Miami Marlins baseball team would be divided equally among all County Commission Districts. This payment would be used for coronavirus disease 2019 (COVID-19) relief efforts as determined by the County Commissioners for their districts and approved by the Board.
Ms. Rizo Perez read the following amendment to the proposed foregoing item, as presented by Commissioner McGhee:
�To amend the resolution in item 8F1 to first set as Board policy that the County�s share of the equity payment be divided equally among all County Commission Districts to be used for COVID-19 relief efforts as determined by each of the County Commissioners for their respective districts and approved by subsequent Board action, and second to direct the County Mayor or Mayor�s designee when preparing the mid-year or end-of-the-year budget amendment to be consistent with this Board policy.�
Commissioner Sosa voiced her support for the amendment, but suggested if the County received additional federal COVID-19-related aid and there were leftover funds, that the money be used for other uses such as infrastructure or low-income housing.
Commissioner Souto said he would not support the item and opined the Board appeared weak if the offer was accepted. He recalled during the original negotiations of the possibility that the team would leave the County if an agreement was not reached.
Commissioner Higgins explained why she sponsored the proposed resolution even though the agreement displeased her. She said the only way to bring the item forward for discussion by the Board was by sponsoring it. She also agreed with Commissioner Garcia�s view that it was best to accept the new offer or risk not receiving any money if arbitration continued.
Commissioner Higgins noted the current owners of the Miami Marlins were helpful to the County by assisting with COVID-19 testing and vaccination at Marlins Park and other community efforts.
Mayor Levine Cava agreed that the current owners actively supported the County and were good partners.
Commissioner Higgins stated that while she accepted Commissioner Diaz�s amendment of the new settlement offer, she could not accept Commissioner McGhee�s proposed amendment and suggested it be brought back as a separate budget item.
Chairman Diaz admitted he was on the Board that accepted the original agreement which kept the team in the County. He also accepted responsibility for his past decision and explained his initial support was due to public pressure to keep the team from leaving the County. Chairman Diaz concurred with Commissioner Garcia that the County risked not being awarded any money if arbitration continued and the updated offer should be accepted by the Board.
Commissioner Sosa stated she supported Commissioner McGhee�s proposed amendment and pointed out that in the item�s supplement, a portion of the settlement would go towards the Marlins Park, while a memo from the County Mayor stated all the money would go to the General Fund. She asked for clarification because she stated she would not support the item if any of the settlement money went to the stadium. Commissioner Sosa also suggested that Commissioner McGhee�s amendment should be voted on.
Commissioner Monestime would not support the item because he said the item did not benefit residents enough to his satisfaction.
Executive Assistant County Attorney Jess M. McCarty informed Chairman Diaz it was the prerogative of the Chair about how to handle Commissioner Higgins' rejection of Commissioner McGhee�s amendment even though Commissioner Sosa wanted to vote on it.
Commissioner McGhee stated his amendment should not be mischaracterized as an addition to the Commission�s District Budget. He clarified the amendment would tag the money from the settlement which went to the General Fund. He stated he would not support the item without the amendment as he proposed, and further added that the money, in addition to COVID-19 relief, should also go for police and corrections operations.
Ms. Jennifer Moon, Chief of Policy and Budgetary Affairs, in response to Chairman Diaz�s inquiry on whether the money that went into the General Fund could be used for specific purposes, stated there were upcoming deficits in the County Budget, which could result in reduced services. She suggested the incoming money could be used to maintain designated services. Ms. Moon stated it would be up to the Administration on how to balance the budget.
Chairman Diaz stated the foregoing proposed resolution should be voted on with his amendment of a new settlement offer from the former owners of the Miami Marlins of $5.5 million payable to the County and the City of Miami.
Commissioner McGhee�s amendment on how the money would be used was to be voted on separately.
It was moved by Commissioner Higgins that the foregoing proposed resolution be adopted as amended. This motion was seconded by Chairman Diaz, and upon being put to a vote, passed by a vote of 9-4; Commissioners Heyman, Martinez, Souto and Monestime voted no.
The amended version of this Resolution has been assigned R-100-21.
After the vote, Commissioner McGhee added to his previous proposed amendment to include that the funds be used for police and corrections operations and for infrastructure.
Discussion ensured among the Board members regarding allocation of funds to commissioners to be used within their respective districts, wherein.
Mr. McCarty explained that Commissioner McGhee�s standalone motion was subjected to the 4-day rule.
Mayor Levine Cava, in response to Commissioner Monestime�s inquiry, announced the Administration would brief the Board on updated figures from the County Budget and attend to any issues faced by the districts. She added the Administration expected guidelines from the United States Department of the Treasury when the County received future aid from the federal government.
Mr. McCarty provided more details on what the Federal Emergency Management Agency allowed for reimbursement the Administration would provide a plan.
Mayor Levine Cava added the funds be sent directly to the County and set aside for its major cities while smaller cities would receive funding from the State of Florida. She also said the Administration would work with each County District to design specific programs.
Chairman Diaz asked for the money from the settlement to be frozen until the next Board meeting on March 2, 2021, to allow for further discussion and for legislation to be prepared.
It was moved by Commissioner McGhee that approved a motion regarding Agenda Item 8F1, as adopted as amended at today�s meeting to direct the County Mayor to freeze the allocations of funds from the equity payment from the settlement agreement of the former owners of the Miami Marlins baseball team until further direction from the Board or the next Board meeting. This motion was seconded by Commissioner Sosa, and upon being put to a vote, passed by a vote of 10-0; Commissioners Regalado, Heyman and Souto were absent.
Commissioner McGhee made a motion to reconsider his vote to approve Agenda Item 8F1 Amended and wanted to vote no instead. Chairman Diaz advised against this because the continuing discussion delayed the day�s agenda and endangered the agreement. Commissioner McGhee explained his concerns with the item in that it rewarded the Marlins more than the County residents. However, in deference to Chairman Diaz, he withdrew his motion to reconsider his vote.

REPORT:
Commissioner Heyman questioned why office furniture needed to be purchased as outlined in the foregoing proposed resolution. She noted the coronavirus disease 2019 pandemic resulted in lower revenue for the County with many County offices being closed or underutilized. She also sought confirmation that furniture costs were lowered in the item�s supplement.
Commissioner Garcia announced he would not support the item because of the amount of money allotted for the purchases and anticipated budget issues.
It was moved by Commissioner Heyman that the foregoing proposed resolution be adopted, as amended, to reflect the reduced amount provided in the supplement, which provided the additional justification to the Board regarding the furniture requirements for the contract allocation for various County departments (See 8F2 Supplement, Legislative File No. 210375). This motion was seconded by Commissioner Gilbert, and upon being put to a vote, passed by a vote of 11-2; Commissioners McGhee and Garcia voted no.

REPORT:
Commissioner Martinez asked for reassurance that the vendor meet with each member of the Board before devising a redistricting map and before presentation to the public.
Ms. Namita Uppal, Chief Procurement Office, Internal Services Department (ISD), in response to Commissioner Hardemon�s inquiry, stated that the request for proposal (RFP) for the services in the proposed resolution was properly advertised, and she explained that RFPs of this nature often only yielded two to three proposals from potential vendors.
Commissioner Hardemon expressed concern that ARCBridge was not a local vendor and had no employees with the company resided with Miami-Dade, given the varying differences between communities.
Ms. Lourdes Gomez, Director, Department of Regulatory and Economic Resources (RER), assured the Board that the RER staff, who managed the 2010 census process, and would manage this contract and work with ARCBridge to familiarize them with all County communities, and provide assistance in arranging the various meeting all the Commissioners and regional public meeting required. She noted the vendor must adhere to the federal redistricting process and consider historical communities of interest and specific minority voting in their analyses.
There being no further questions or comments, the Board proceeded to vote on the proposed resolution, as amended.

REPORT:
Commissioner Sosa spoke about an agreement between the County and MSC Cruises (MSC) for the design, construction, operation and maintenance of a terminal at PortMiami for a 62-year term. She stated the terminal would include two new berths for cruise ships and process over 90 million passengers. She noted the construction would generate 1,500 jobs and over 8,000 jobs once the terminal was operational.
Miami-Dade County Mayor Daniella Levine Cava announced the County had a signed joint statement with six (6) cruise lines (Carnival Corporation, Royal Caribbean Group, Norwegian Cruise Line Holdings, MSC Cruises, Disney Cruise Line and Virgin Voyages) and with Florida Power & Light (FPL) of an agreement to bring shore power to PortMiami. She stated this enabled PortMiami to be the first cruise ship terminal in the Southeast United States to provide shore power hookup. She commended former Miami Beach Mayor Philip Levine, Chief Operations Officer Jimmy Morales, and Mr. Juan Kuryla, Port Director and CEO of PortMiami, for their efforts. Mayor Levine Cava pointed out this agreement was beneficial for the County, the environment and the entire State of Florida.
Mr. Rick Sasso, Chairman of MSC, spoke about the merits of his cruise line before the Board. He stated that as a longtime resident of the County, he envisioned the expansion of MSC in PortMiami in order to help the County. Mr. Sasso concluded the project maintained PortMiami as the cruise ship capital of the world.
In response to Commissioner Higgins inquiry regarding shore power, Mr. Kuryla indicated the shore power project would run parallel to the construction of the terminal, pointing out the dock had to be wired for electricity, not the terminal itself. He stated there was a planned expansion of an existing substation, which would have enough power for two different berths, though not simultaneously.
There being no further comments, the Board proceeded to vote on the proposed resolution, as presented.

REPORT:
Commissioner Hardemon voiced his concerns that the distribution of the funds that were supposed to be distributed equally throughout all the districts. He noted, however, the eviction rates throughout the County were uneven, and he referred to the Miami-Dade County Eviction Report, dated February 11, 2021, from the Office of the Commission Auditor which showed certain areas in the County with high eviction rates. Commissioner Hardemon said if a district had low eviction rates it did not need an equal share of funds.
Discussion ensued among the Board about time-sensitive nature of the item; on how residents could apply for rental assistance, income requirements, and allocation of funding.
Commissioner Regalado questioned the high administrative cost and sought more details about the budget. Mr. Liu noted the program�s costs were very low compared to what was allowed. He explained that the case management approach used in the program required time and resources to better inform applicants and ensured successful applications.
In response to Commissioner Regalado questions, Mr. Michael Liu, Director, Public Housing and Community Development, indicated that based on federal guidelines of the program, issues such as tenants� incomes and the length of assistance, PHCD could provide additional benefits. He added the program helped tenants in arrears, which helped stabilize their housing situation, and that special attention would be given to tenants in the midst of eviction processes. He concluded that there was potentially more funding available from the federal government to address any future requirements or issues.
Commissioner Garcia asked whether other rental assistance programs existed in the County and what was being done to prevent rental fraud.
Commissioner Gilbert agreed with Commissioner Hardemon about the need to address the equity of the program�s funding distribution. He asked Mr. Liu if landlords who were in a city�s rental assistance program could apply for County rental assistance. Mr. Liu said they could not until funding from the city program was completely used.
Commissioner Martinez raised concerns about the large dollar amount of rent allowed by the federal government in the program, which was up to $3,000 monthly. He asked what duties would be performed by the vendor, listed in the item, Nan McKay and Associates.
Mr. Liu responded by Commissioner Martinez�s inquiry regarding the duties to be performed by the vendor, Nan McKay and Associates, and the $4.8 million the County would pay the vendor for their services.
Miami-Dade County Mayor Daniella Levine Cava reminded the Board of the eviction moratorium currently in place.
Assistant County Attorney Terrence A. Smith informed the Board that even though the Governor of Florida did not extend the eviction moratorium, federal moratoriums were extended for covered units that fell under the Coronavirus Aid, Relief and Economic Security (CARES) Act. Mr. Smith added that County courts have not process evictions if persons involved in the cases were included in the CARES Act, as long as a declaration or affidavit was signed by the case�s plaintiff(s).
Chairman Diaz asked Mr. Liu if financial aid was available for persons who made more money and did not qualify for rental assistance under the program, yet suffered because of COVID-19. Mr. Liu was not aware of any other programs.
Commissioner Hardemon proposed an amendment to the language in a memo from the County Mayor regarding this item. He referred to page 3 of the memo under the �Scope� subhead which read: �The $60,800,000.00 shall be allocated equally among the 13 Commission Districts to the extent feasible.� Commissioner Hardemon suggested that language be stricken and added �Priority shall be given to those undergoing eviction currently.� He explained this distributed the money where it was needed in the County.
Commissioner Regalado proposed an amendment that everyone in the current eviction process be prioritized, including persons protected under the order of the Centers of Disease Control.
Commissioner Gilbert expressed that Commissioner Regalado�s amendment may encourage more evictions. He also inquired if residents of Miami and Hialeah would be able to apply for County funds before the cities� funds were depleted.
Commissioner Higgins noted that based on the discussion and public comments it was desired that landlords be given documents which prevented evictions as they received rental aid from the program. She proposed the creation of documentation for landlords which required they could not conduct eviction proceedings for three to six months in lieu of rental aid. She agreed with Commissioner Gilbert�s view about issues with prioritizing persons undergoing evictions and rejected Commissioner Regalado�s amendment.
Commissioner Higgins clarified that the program was targeted for lower-income families and addressed Commissioner Hardemon�s point about equitable distribution of the funds in the districts and the funds would go towards those that needed the aid the most.
Commissioner Higgins directed Executive Assistant County Attorney Jess M. McCarty, in addition to adding Commissioner Hardemon�s proposed language about eviction and equitable fund distribution, to provide all the County Commissioners with complete information about the program three days before it launched. She stressed the importance of distributing the funds by the September 30, 2021 deadline. She also wanted an evaluation of the program presented at the June 15, 2021 and September 1, 2021 Board meetings and for the Miami Association of Realtors to receive a communications plan about the program. Commissioner Higgins also directed Mr. Liu to appear the Board in two months and report if any changes were needed to the program after it launched.
It was moved by Commissioner Higgins that the foregoing proposed resolution be amended. This motion was seconded by Commissioner Hardemon, and upon being put to a vote, the item passed by a vote of 12-0; Commissioner Heyman was absent.

After being informed that the Administration provided notice to proceed on the design of the South Florida Rapid Bus Transit (BRT) program, Commissioner Sosa expressed concerns about the proposed resolution because it directed the Miami-Dade County Mayor not to continue with the program for 60 days and to research alternative transit options. She commented the item jeopardized federal and state funding and that the BRT at least provided improved mass transit service for the south region of the County until funding could be obtained for mass transit rail service conversion.
Chief Operations Officer Jimmy Morales admitted the Administration received notice from the Federal Transit Administration (FTA) that the funding was at risk if the BRT was delayed. He also affirmed the project was designed for rail service conversion.
Commissioner Cohen Higgins alerted the Board of the language in the item was moot because it called for the Administration to not issue notice, but this already occurred on February 2, 2021.
Commissioner McGhee voiced concerns over the delays with mass transit improvements in the south. He opined the improved bus service provided by the BRT with the promise of gradual rail conversion was not satisfactory; residents desired rail service, which was long-promised but never delivered by the County. He proposed an amendment to strike the entire language in the item and to add new language which placed a time frame for full rail conversion in the south to begin in 2025. Commissioner McGhee also proposed the item commence a study through a request for proposal (RFP) for rail service in the south, which was to start today (2/17). He stated that if that RFP was not acceptable, then he suggested the service should be attached to the North Dade RFP for North Corridor rail service.
Commissioner Sosa questioned how the conversion would be funded and she would not support the amendment unless a detailed budget was provided.
Commissioner Martinez observed a cost analysis was already done for the project, but he supported the amendment.
Ms. Alice Bravo, Director, Miami-Dade Department of Transportation & Public Works, told Commissioner Monestime it would take two years for the project�s completion. She added that a conversion to rail service required a new grants process which would take five to seven years.
Commissioner Monestime confirmed with Ms. Bravo that the process could start immediately. He also stressed the need to identify funding sources for a conversion and suggested an amendment to request that the Administration begin the application for federal and state funding as soon as possible and to provide a report to the Board.
Commissioner Higgins explained that the FTA might not approve funding for mass transit rail in the south because of its small population. She added the BRT was already approved and brought immediate relief for residents before any rail studies concluded, which could be rejected by the FTA. REPORT:
Commissioner Regalado provided details about the foregoing proposed resolution which created, in collaboration with the Eleventh Judicial Circuit of Florida, an online portal called the Court Housing Eviction Landlord/Tenant Portal (Court HELP) for landlords and tenants. She indicated Court HELP allowed both parties to access court information and mediation services during eviction proceedings. She opined the portal would help to resolve litigations and evictions in the County.
The Honorable Miami-Dade County Administrative Judge Linda Singer Stein and the Honorable Miami-Dade County Judge Scott M. Janowitz, both of the Eleventh Judicial Circuit of Florida, appeared before the Board and detailed the need for the portal.
Commissioner Regalado expressed her support for the item and echoed the judges� observations about the efficiency of the portal and how it reduced court costs. She noted the judges came to the Board to request funding to launch Court HELP because they were unable to apply for grants.
Judge Janowitz, in response to Commissioner Martinez inquiry on whether Court HELP was based on the programs, replied that they researched other jurisdictions and used guidance from national state court administrations for creating the program. He added they also utilized what they learned from the Circuit�s traffic court portal.
Assistant County Attorney Oren Rosenthal informed the Board the item outlined funding for Court HELP would come from three potential funding sources and the Administration would return to the Board in 30 days with a contract that listed the actual funding sources.
Judge Janowitz stated that part of the program needed licensed software which would be integrated with the Circuit�s internal systems.
Judge Stein stated Court HELP was intended for residential evictions for non-payment and had the potential to be used for commercial evictions. She added the program, if it was successful, could also be used for other types of online mediations.
There being no further questions or comments, the Board proceeded to vote on the proposed resolution, as presented.

REPORT:
Miami-Dade County Mayor Daniella Levine Cava requested a Point of Personal Privilege to raise the issue of gun violence. She recalled six-year-old Chassidy Saunders who was killed January 16, 2021 after being caught in a crossfire of gun exchanges.
She noted that to date the murder was unsolved and pledged $5,000 from the County�s budget towards the reward fund to help find witnesses and bring justice for Ms. Saunders� family.
Mayor Levine Cava asked that the commissioners also contribute to the reward fund in a show of solidarity. She indicated contributions could be submitted to the organization Crime Stoppers of Miami-Dade and the Florida Keys.
